15. One-stop Shop Service ፩/ከኮሚሽኑ የኢንቨስትመንት ፈቃድ የወሰደ አልሚ፣ 1/An industrial park developer, operator or enterprise አስተዳዳሪ ወይም ድርጅት የሚከተሉትን የአንድ that has been issued investment permit by the ማዕከል አገልግሎቶች በኢንዱስትሪ ፓርክ ውስጥ Commission shall have access to the following one- ያገኛል፡- stop shop services at a park level: ሀ) የኢንቨስትመንት ፈቃድ ዕድሳት፣ ማሻሻያ፣ a) renewal, amendment, change or replacement of ወይም ለውጥ ወይም ምትክ፣ ወይም ነባር investment permit or issuance of investment የኢንቨስትመንት ሥራን ለማስፋፋት የሚሰጥ permit for expansion of investment project; የኢንቨስትመንት ፈቃድ፤ ለ) የንግድ ምዝገባ ለውጥ ወይም ማሻሻያ ወይም b) change or amendment of commercial registration ምትክ የንግድ የምስክር ወረቀት፤ or issuance of substitute certificate of commercial registration; ሐ) የንግድ ሥራ ፈቃድ፣ ዕድሳት ወይም ምትክ፤ c) issuance and renewal of business license, or issuance of substitute business license; መ) የንግድ ማሕበር ስም ማሻሻያ ወይም ለውጥ፤ d) amendment or change of the name of a business organisation; ሠ) የንግድ ስም ምዝገባ፣ ምትክ የንግድ ስም፣ e) registration of trade name, giving substitute trade የንግድ ስም የምስክር ወረቀት ማሻሻያ ወይም name, amendment of trade name certificate or its ስረዛ፤ cancellation; ረ) የኢንዱስትሪ ፓርክ ድርጅቶች ማሕበር f) registration and renewal of registration of the ምዝገባና እድሳት፤ association of industrial park enterprises; ሰ) የውጭ ቀጥተኛ ካፒታል ምዝገባ፤ g) registration of foreign direct capital; ሸ) ቪዛ የመስጠትና ዕድሳት፣ የመኖሪያ ፈቃድ h) issuance and renewal of visa, issuance and የመስጠትና ዕድሳት፣ renewal of residence permit; ቀ) የሥራ ፈቃድ መስጠት፣ ማደስ፣ መተካትና i) issuance of work permit, its renewal, replacement መሠረዝ፤ and cancellation; በ) የጉምሩክ ቀረጥ ነፃ ማበረታቻ እና ያለ ውጭ j) approval of exemption from customs duty and ምንዛሪ ፈቃድ ወደ አገር ውስጥ ዕቃ የማስገቢያ franco valuta importation of goods; ፈቃድ፤ ተ) የገቢ ግብር ነጻ ማበረታቻ ፈቃድ፤ k) approval of income tax holiday; ፱ሺ፱፻፳፯ https://chilot.me gA ፌደራል ነጋሪት ጋዜጣ ቁጥር    ቀን ፪ሺ፲ ዓ.ም Federal Negarit Gazette No.  15th September 2017…….page 9927 ቸ) በአንድ የኢንዱስትሪ ፓርክ ውስጥ ከአንድ l) receipt and entertainment of requests for transfer የቀረጥ ነፃ መብት ያለው ድርጅት ወደ ሌላ of construction materials, capital goods, spare የቀረጥ ነፃ መብት ያለው ድርጅት የግንባታ parts and motor vehicles from an industrial park ዕቃዎች፣ የካፒታል ዕቃዎች፣ የመለዋወጫ enterprise entitled to exemption from customs ዕቃዎች እና ተሽከርካሪዎች የማስተላለፍ duty to another enterprise with the same entitlement within a single industrial park; ፈቃድ፤ m) authentication of documents including ኀ) የመመስረቻ ጽሁፎች፣ የመተዳደሪያ ደንቦች memorandum of association, articles of ማሻሻያና ሌሎች ሰነዶች ማረጋጫ፤ association and amendments thereto; ነ) ለኢንዱስትሪ ፓርክ ሠራተኞች የግብር ከፋይ n) issuance of tax identification number to መለያ ቁጥር መስጠት፣ የውጭ አገር ዜግነት employees in the industrial park and ያላቸው ሠራተኞች የገቢ ግብር ነፃ ማበረታቻ communication of decisions regarding income ውሳኔ፤ tax holiday to expatriate employees; ኘ) ለኢንዱስትሪ ፓርክ ድርጅት የተጨማሪ እሴት o) registration of industrial park enterprises for ታክስ ምዝገባ፣ የተጨማሪ እሴት ታክስ value added tax, refund of value added tax, ማወራረድ፣ የቫውቸር እንዲሁም ሌሎች ከወጪ granting permits and rendering services such as ንግድ ማበረታቻ ጋር ተያያዥ ፈቃዶችና in relation to implementation of voucher and አገልግሎቶች ፤ other export incentives; p) provision of declaration of tax, payment of tax, አ) የግብር ማሳወቅ፣ የግብር ክፍያ፣ የግብር tax refund, tax audit and other services pertaining ተመላሽ ማወራረድ፣ የግብር ኦዲት እና ከግብር to tax; ጋር ተያያዥነት ያላቸው አገልግሎቶች፤ ከ) ከአሠሪና ሠራተኛ ግንኑኝነት ጋር የተያያዙ ምዝገባዎች፤ q) conduct of registrations pertaining to employers and workers; ኸ) የስምሪት አገር ምስክር ወረቀት እና የተለየ የገበያ ዕድል ተጠቃሚ ለመሆን የሚያስችል r) issuance of certificate of origin and other supporting certificates necessary to benefit from ደጋፊ የምስክር ወረቀቶች፤ special market opportunities; ወ) የአካባቢ ተጽዕኖ ግምገማ ጥናት ማጽደቅ እና s) approval of environmental impact assessment የምስክር ወረቀት፤ studies and issuance of certificate; ዐ) አስፈላጊ ሲሆን፣ የብቃት ማረጋገጫ እና ሌሎች t) issuance of a certificate of competence, and other በግብይት ሥርዓት የሚጠየቁ የምስክር certificates required in the marketing of products, ወረቀቶች፤ where necessary; ዘ) የባንክ፣ የመድህን፣ የመርከብ ማጓጓዣ፣ u) provision of banking, insurance, shipping, የሎጂስቲክስ እና ሌሎች ከፓርኩ ጋር logistical and other services of relevance to the አግባብነት ያላቸው አገልግሎቶች፤ park; ዠ) የኢንዱስትሪ ፓርክ የነዋሪነት የምስክር v) issuance of certificate of residence to industrial ወረቀት፤ park residents; የ) አሠሪና ሠራተኛ መዋጮዎችን ለግል ጡረታ w) collection of contributions from employers and ፈንድ የመሰብሰብ አገልግሎት፤ employees to the private organisations pension ደ) ከሥራው ጋር በተያያዘ የሠራተኛውን fund; ደኅንነትና ጤንነት የተመለከተ ክትትል እና x) follow up and give support regarding the safety ድጋፍ፤ and health of workers in relation to work; ጀ) ቅሬታዎችን ማስተናገድ እና ክርክሮችን y) Handling complaints and resolving disputes or መፍታት ወይም አግባብ ባለው አካል በተለይ creating conducive condition for resolution of አማራጭ የክርክር መፍቻ መንገዶች disputes by appropriate organs, especially using በመጠቀም እንዲፈቱ ሁኔታዎችን alternative dispute resolution methods. ማመቻቸት፡፡ https://chilot.me gA ፱ሺ፱፻፳፰ ፌደራል ነጋሪት ጋዜጣ ቁጥር    ቀን ፪ሺ፲ ዓ.ም Federal Negarit Gazette No.  15th September 2017…….page 9928 ፪/ ሁሉም አግባብነት ያላቸው የመንግሥት ተቋማት 2/ All relevant government organs that are required to ለኢንዱስትሪ ፓርክ ተጠቃሚዎች መስጠት give service to industrial park end-users shall have የሚገባቸውን አገልግሎቶች ወደ ኢንዱስትሪ ፓርክ duty to provide service either presence in the one- የአንድ ማዕከል አገልግሎት ቅርንጫፍ ገብተው stop shop service or designate the Commission or የመስጠት ወይም ኮሚሽኑን ወይም ሌሎች another appropriate institution to provide such service on their behalf within a park. አግባብነት ያላቸው ተቋማትን በመወከል አገልግሎት የመስጠት ግዴታ አለባቸው፡፡ ፫/ የኢንዱስትሪ ፓርክ አልሚ ወይም አስተዳዳሪ 3/ An industrial park developer or operator shall, as በፓርኩ የአንድ ማዕከል አገልግሎት ውስጥ part of one-stop-shop service within each park, በመታቀፍ የውሃ፣ የኤሌክትሪክ፣ የቴሌኮም (የድምጽ፣ provide water, electricity, telecom including voice, የዳታ፣ የቪዲዮና ተዛማጅ አገልግሎቶች)፣ የፈሳሽ እና video, data and other related services, remove liquid የደረቅ ቆሻሻ የማስወገድ እና ሌሎች አስፈላጊ and solid waste and other necessary services either directly or through the instrumentality of a third አገልግሎቶችን በቀጥታ ራሱ ወይም በሌላ አቅራቢ person. እንዲሰጡ ያደርጋል፡፡ ፬/ የአንድ ማዕከል አገልግሎት የመስጠት ኃላፊነት 4/ Governmental institutions that are responsible for ያለበት መንግሥታዊ ተቋም የኢንዱስትሪ ፓርክን rendering one-stop shop service in the park shall set ባሕሪይ ከግምት ውስጥ ያስገባ ልዩ መዋቅርና up structure and detailed operational procedures that ዝርዝር የአሰራር ሥርዓት መዘርጋት አለበት፡፡ take into account the nature of industrial parks. ፭/ የአንድ ማዕከል አገልግሎትን የተቀናጀና ውጤታማ 5/ Relevant government organs shall, under the ለማድረግ የመንግስት አስፈጻሚ አካላት በኮሚሽኑ coordination of the Commission, conclude agreement among themselves with the view አስተባባሪነት ስምምነት መፈራረም አለባቸው፡፡ integrating and making one-stop shop service effective. ፲፮.የቪዛ እና የመኖሪያ ፈቃድ አገልግሎት ስለመስጠት 16. Visa and Residence Permit ፩/ ኮሚሽኑ ከኢንቨስትመንት ጋር በተያያዘ ወደ አገር 1/ The Commission may facilitate the processing of ውስጥ ለሚገቡ የውጭ አገር ዜጎች እና በእነርሱ ሥር visa and residence permit applications of foreign ለሚተዳደሩ ቤተሰቦቻቸው ተገቢውን ቪዛ እና citizens who come to Ethiopia in relation to የመኖሪያ ፈቃድ እንዲያገኙ ሊጠይቅላቸው ይችላል፡፡ investment and that of their dependent family members. ፪/ ከኢንቨስትመንት ጋር በተያያዘ የውጭ አገር ዜጋ 2/ A foreign citizen who happens to be outside his country of residence may apply for Ethiopian visa ከሦስተኛ አገር ሆኖ የቪዛ ጥያቄ ያቀረበ እንደሆነ ወደ from the third country where the reason for travel to መኖሪያ አገሩ መመለስ ሳያስፈልገው ካለበት አገር Ethiopia pertains to investment. የቪዛ ጥያቄ ሊያቀርብና ሊሰጠው ይችላል፡፡ ፫/ ለኢንዱስትሪ ፓርክ አልሚ ወይም ድርጅት ባለቤት 3/ A multiple entry visa, that is valid for 5 (five) years ወይም ባለአክስዮን የ፭(አምስት) ዓመት የብዙ ጊዜ or residence permit may be issued, based on an መመላለሻ ቪዛ ወይም የመኖሪያ ፈቃድ በኮሚሽኑ assurance from the Commission, to an owner or በሚቀርብ ማረጋገጫ መነሻነት ሊሰጥ ይችላል፡፡ shareholder of an industrial park developer or enterprise. ፬/ በኢንዱስትሪ ፓርክ ውስጥ የሚሰራ የውጭ አገር 4/ A multiple entry visa, that is valid for 3 (three) years ዜግነት ያለው አስተዳዳሪ፣ የኢንዱስትሪ ፓርክ ምርት or residence permit may be issued, based on an ገዢ፣ ሠራተኛ፣ የሥራ ኃላፊ፣ የዋና መስሪያ ቤት assurance from the Commission, to a foreign ሥራ አስፈጻሚ፣ የቦርድ አባል ወይም ከፍተኛ operator that works in an industrial park, to an ባለሙያ በኮሚሽኑ በሚቀርብ ማረጋገጫ መነሻነት የ፫ industrial park product buyer, worker, manager, (ሦስት) ዓመት የብዙ ጊዜ መመላለሻ ቪዛ ወይም executive officer from head quarters, board member or high level professional staff. የመኖሪያ ፈቃድ ሊሰጥ ይችላል፡፡ https://chilot.me ፱ሺ፱፻፳፱ gA ፌደራል ነጋሪት ጋዜጣ ቁጥር    ቀን ፪ሺ፲ ዓ.ም Federal Negarit Gazette No.  15th September 2017…….page 9929 ፲፯.የሥራ ፈቃድ ስለመስጠት 17. Issuance of Work Permit ፩/ ኮሚሽኑ ከኢንዱስትሪ ፓርክ ጋር በተያያዘ 1/ A work permit shall be issued by the Commission to የኢንቨስትመንት ፈቃድ ለሰጠው አልሚ፣ አስተዳዳሪ a foreign citizen to be employed by an industrial ወይም ድርጅት ለሚቀጥረው የውጭ አገር ዜጋ የሥራ park developer, operator or enterprises that has been ፈቃድ ይሰጣል፡፡ given investment permit in relation to an industrial park. ፪/ ከኢንዱስትሪ ፓርክ ጋር በተያያዘ በውጭ አገር 2/ A work permit may be issued to the spouse of a ሠራተኛነት ተቀጥሮ ወደ ኢትዮጵያ የገባ ሠራተኛ foreign industrial park worker who lives in Ethiopia. የትዳር አጋር በአገሪቱ ውስጥ አብሮ የሚኖር ከሆነ የሥራ ፈቃድ ሊሰጠው ይችላል፡፡ ፲፰. ስለዕውቀት፣ ክህሎትና ቴክኖሎጂ ሽግግር 18. Transfer of Knowledge, Skills and Technology ፩/ የኢንዱስትሪ ሚኒስቴር እና ሌሎች አግባብነት 1/ The Ministry of Industry and other relevant organs shall make sure that industrial parks recruit workers, ያላቸው አካላት ከኢንዱስትሪ ፓርኮች ጋር በተያያዘ foster skills development and transfer, and transfer የሠራተኞች ምልመላ፣ የክህሎት ልማትና ሽግግር፣ and upgrading of technology; they shall also ensure የቴክኖሎጂ ሽግግርና ማሳደግ እንዲሁም የግብዓት supply of input and creation of market linkage; and አቅርቦትና የገበያ ትስስር ተግባራዊ እንዲሆን ድጋፍ render support in regard to the realization of these. ያደርጋሉ፡፡ ፪/ የኢንዱስትሪ ሚኒስቴር የክህሎትና እውቀት ሽግግር 2/ The Ministry of Industry shall design training ወደ ኢትዮጵያውያን ሠራተኞች እንዲደረግ programs that enable transfer of skills and የሚያስችል የስልጠና መርሀ-ግብር ያዘጋጃል፤ knowledge to Ethiopian workers; and support and follow up to see it that an industrial park developer, ስልጠናውም በኢንዱስትሪ ፓርክ አልሚ፣ operator and enterprise provide the training. አስተዳዳሪና ድርጅት እንዲሰጥ ድጋፍና ክትትል ያደርጋል፡፡ ፫/ የኢንዱስትሪ ሚኒስቴር አግባብነት ካላቸው አካላት 3/ The Ministry of Industry shall, in collaboration with ጋር በመተባበር የቴክኖሎጂ ሽግግሩ እንዲፋጠን relevant bodies, put in place mechanisms that የአሰራር ሥርዓት ይዘረጋል፣ ያስፈጽማል፤ በተለይ facilitate technology transfer; particularly, the በመንግሥትና በኢንዱስትሪ ፓርክ ድርጅቶች Ministry shall have the responsibility to foster partnership between government and industrial park አጋርነት የቴክኖሎጂ ሽግግር፣ ቴክኖሎጂ ማሳደግ፣ enterprises with the view to enhancing the transfer የኢንዱስትሪ ምርታማነትና የምርት ጥራት የማሳደግ and advancement of technology, increase እንዲሁም ጥናትና ምርምር እንዲካሄድ የማድረግ productivity and quality of industrial products and ኃላፊነት አለበት፡፡ cause the conduct of studies and research. ፬/ በአዋጁና በዚህ ደንብ መሠረት የኢንዱስትሪ 4/ The Ministry of Industry shall cause institutes ሚኒስቴር የተሰጠውን ኃላፊነት ለመወጣት accountable to open its branch offices, as may be ኢንስቲትዩቶች እንደአስፈላጊነቱ ቅርንጫፍ ጽሕፈት appropriate, within parks or assign experts in order ቤቶች በኢንዱስትሪ ፓርኮች ውስጥ እንዲከፍቱ to discharge its responsibilities under the ያደርጋል ወይም ባለሙያዎች ይመድባል፡፡ Proclamation and these Regulations. ክፍል ስድስት SECTION SIX የኢንዱስትሪ ፓርክን የተመለከተ የጉምሩክ ሥነ-ሥርዓት CUSTOMS PROCEDURE AS CONCERNS INDUSTRIAL PARK ፲፱. የጉምሩክ ቁጥጥር 19. Customs Control ፩/ ማንኛውም የጉምሩክ ሥነ-ሥርዓት በኢንዱስትሪ 1/ All customs procedures shall be completed in an ፓርክ ውስጥ ይከናወናል፡፡ industrial park. ፪/ የኢንዱስትሪ ፓርክ ሙሉ በሙሉ ወይም ከፊል 2/ An industrial park may either in its entirety or partly የኢንዱስትሪ ፓርክ የጉምሩክ ቁጥጥር ክልል be a customs controlled area. ይኖረዋል፡፡ https://chilot.me gA ፱ሺ፱፻፴ ፌደራል ነጋሪት ጋዜጣ ቁጥር    ቀን ፪ሺ፲ ዓ.ም Federal Negarit Gazette No.  15th September 2017…….page 9930 ፫/ ከኢንዱስትሪ ፓርክ ጋር በተያያዘ የጉምሩክ ቁጥጥር 3/ Customs control in connection with industrial parks የሚካሄደው በጉምሩክ ክልል መግቢያና መውጫ shall be carried out at the entry and exit gates of the በሮች እንዲሁም በኢንዱስትሪ ፓርኮች በሮች ላይ customs territory as well as at the gates of the ይሆናል፡፡ industrial parks. ፬/ የኢንዱስትሪ ፓርክ አልሚ ወይም አስተዳዳሪ ወይም 4/ Goods transported by an industrial park developer or operator or enterprise to or from customs controlled ድርጅት ወደ ኢንዱስትሪ ፓርክ የጉምሩክ ቁጥጥር area of an industrial park shall be cleared by ክልል የተለያዩ ዕቃዎች ሲያስገባና ሲያስወጣ simplified customs procedure. በተቃለለ የጉምሩክ ሥነ-ሥርዓት ይስተናገዳል፡፡ ፭/ ማንኛውም የኢንዱስትሪ ፓርክ ድርጅት ከጉምሩክ 5/ Cargo shipped by an industrial park enterprise from ክልል መግቢያ በር ወደ ኢንዱስትሪ ፓርክ port of entry into the customs territory to an የሚያስተላልፈው ጭነት እስከ ኢንዱስትሪ ፓርክ industrial park shall neither be stopped nor examined ድረስ በሚጓጓዝበት ወቅት አይቆምም፤ አይፈተሽም፤ en route. The goods shall, however, be sealed in a container and the shipping documents that clearly ነገር ግን ዕቃው በኮንቴነር የታሸገ እና የዕቃው indicate the industrial park to which the cargo is ማጓጓዣ ሰነድም መድረሻ ጣቢያ የሆነው destined. የኢንዱስትሪ ፓርክ ስም መገለጽ አለበት፡፡ ፮/ በኢንዱስትሪ ፓርክ የሚገኝ ምርቱን ሙሉ ለሙሉ 6/ An industrial park enterprise that has undertaken to ወደ ውጭ አገር የሚልክ የኢንዱስትሪ ፓርክ export its entire produce shall be exempted from any ድርጅት የምርት ግብዓቶችን ከውጭ አገር ወደ customs duty and tax on raw materials it may import; ኢንዱስትሪ ፓርክ ሲያስገባ የጉምሩክ ቀረጥና ታክስ provided, however, where an industrial park አይከፍልም፤ ሆኖም ድርጅቱ ምርቱን በከፊል አገር enterprise sells parts of its produce to the customs territory, it shall be subject to appropriate customs ውስጥ የሚሸጥ ከሆነ በልዩነቱ ተገቢውን ቀረጥና duty and tax on the difference. ታክስ ይከፍላል ፡፡ ፯/ ማንኛውም የኢንዱስትሪ ፓርክ ድርጅት ምርቱን 7/ An industrial park enterprise that sells its products as በኢንዱስትሪ ፓርኩ ወይም በሌላ ኢንዱስትሪ ፓርክ input to another industrial park enterprise that ውስጥ ለሚገኝና ምርቱን ወደ ውጪ ለሚልክ exports its produce shall not be subject to payment of ድርጅት በግብዓትነት ሲያቀርብ ያለቀረጥና ታክስ customs duty and tax. መሸጥ ይችላል፡፡ 8/ Any enterprise located within the customs territory ፰/ በጉምሩክ ክልል ውስጥ ያለ ድርጅት በአገር ውስጥ that supplies input produced anywhere within the የተመረተ ግብዓትን ምርቱን ወደ ውጭ አገር country to an industrial park enterprise engaged in ለሚልክ የኢንዱስትሪ ፓርክ ድርጅት ሲያቀርብ ያለ export shall not be subject to payment of any ቀረጥና ታክስ መሸጥ ይችላል፤ ይህ የኢንዱስትሪ customs duty or tax on such transaction; an industrial ፓርክ ድርጅትም ከጉምሩክ ክልል የገዛውን የምርት park enterprise that exports products that it produced ግብዓት ተጠቅሞ የሚያመርተው ምርት ወደ ውጭ using input that it purchased in the customs territory አገር የሚልክ ከሆነ በዚህ የምርት ግብዓት ላይ shall also not be subject to payment of customs duty ታክስና ቀረጥ አይጠየቅም፡፡ and tax on the input used. ፱/ ምርቱን ሙሉ በሙሉ ወደ ውጭ አገር ለመላክ 9/ An industrial park enterprise that has undertaken to የተስማማ የኢንዱስትሪ ፓርክ ድርጅት ከውጭ አገር export its entire produce may keep up to one year raw material that it imported without payment of ያለቀረጥና ታክስ ያስገባውን ጥሬ ዕቃ እስከ አንድ customs duty and tax. Where such enterprise ዓመት ማቆየት ይችላል፤ ሆኖም ድርጅቱ ጥሬ establishes good cause to retain such raw material for ዕቃውን ከአንድ ዓመት በላይ ለማቆየት አሳማኝ a period exceeding one year, the Commission may ምክንያት ካቀረበ ኮሚሽኑ ሊፈቅድ ይችላል፡፡ allow additional time.. ፲/ ሙሉ ምርቱን ወደ ውጭ አገር ለመላክ የተስማማ 10/ An industrial park enterprise that has undertaken to export its entire produce may not, under any የኢንዱስትሪ ፓርክ ድርጅት በማናቸውም ሁኔታ circumstance, sell its products within the customs በጉምሩክ ክልል ውስጥ መሸጥ አይፈቀድለትም፤ territory; provided, however, it may under special ሆኖም በልዩ ሁኔታ በቦርዱ የተፈቀደለት ከሆነ circumstances, if authorised by the Board, sell its ተገቢውን የጉምሩክ ቀረጥና ታክስ ከፍሎ በጉምሩክ products within the customs territory subject to ክልል መሸጥ ይችላል፡፡ https://chilot.me gA ፱ሺ፱፻፴፩ ፌደራል ነጋሪት ጋዜጣ ቁጥር    ቀን ፪ሺ፲ ዓ.ም Federal Negarit Gazette No.  15th September 2017…….page 9931 ፲፩/ ሙሉ ምርቱን ወደ ውጭ አገር እንዲልክ payment of appropriate customs duty and tax. የሚጠበቅበት የኢንዱስትሪ ፓርክ ድርጅት 11/ Where an industrial park enterprise that is required ያመረተው ምርት የኤክስፖርት ደረጃውን ያልጠበቀ to export its entire produce provides proof that its ወይም ምርቱ ወደ ውጭ ከተላከ በኋላ ጉድለት products could not meet export standards or its ኖሮት የተመለሰ ስለመሆኑ ማስረጃ ካቀረበ፡- produce has been sent back after being exported owing to defects: ሀ) በኮሚሽኑ ሲፈቀድ በኢንዱስትሪ ፓርክ ውስጥ በተዘጋጀ ልዩ ቦታ በዓመት ሁለት a) may, after securing permission from the ጊዜ ብቻ ከአንድ ሳምንት ለማይበልጥ Commission, sell such products at a special ተከታታይ ቀናት ልዩ የሽያጭ መርሀ-ግብር sales event to be organised only twice per year ላይ የተጨማሪ እሴት ታክስ ከፍሎበት each for a continuous period not exceeding one week within the park at a place designated ሊሸጠው ወይም፣ for such purpose, subject to payment of value ለ) በአገሪቱ ውስጥ በሕግ አግባብ ለተቋቋመ added tax or; የበጎ አድራጎት ድርጅት በስጦታ ሊሰጠው b) may donate such products to a charity lawfully ወይም፣ established within the country or; ሐ) በሌላ መንገድ ሊያስወግደው ይችላል፡፡ c) get rid of such products by other means. ፲፪/ የኢንዱስትሪ ፓርክ ድርጅት ተረፈ ምርቱን የተጨማሪ እሴት ታክስ ብቻ ከፍሎ በጉምሩክ ክልል 12/ An industrial park enterprise may sell by-products ውስጥ መሸጥ ይችላል፤ ድርጅቱ የተጨማሪ እሴት within the customs territory subject to the payment ታክሱን የሚከፍለው ግብይቱ በሚከናወንበት ጊዜ of only value added tax. The value added tax due በሚኖረው ዋጋ ላይ ይሆናል፡፡ from the enterprise shall be computed on the basis of the price at which the enterprise sells the by- ፲፫/ የኢንዱስትሪ ፓርክ አልሚ ወይም ድርጅት ከውጭ products. ያስመጣቸውን የተበላሹ ወይም እክል ያለባቸውን 13/ An industrial park developer or enterprise may, by የካፒታል ዕቃዎች፣ መለዋወጫዎች እና አክሰሰሪዎች furnishing a letter of guarantee to the Authority, send ለባለሥልጣኑ የዋስትና ደብዳቤ በማቅረብ ወደ ውጭ abroad defective, damaged or incomplete capital ልኮ መተካት ወይም ማስጠገን ይችላል፤ ይህንን goods, spare parts and accessories and have them በተመለከተ ከባለሥልጣኑ ምንም ክፍያ replaced or repaired; and the Authority may not አይጠየቅም፡፡ require any payment as regards this. ፲፬/ የኢንዱስትሪ ፓርክ አልሚ ወይም ድርጅት የውጭ ምንዛሪ ፈቃድ ሳይጠይቅ ወደ አገር ውስጥ 14/ Where customs duty or tax is not due on goods ያስገባውን ዕቃ ቀረጥና ታክስ የማይፈለግበት ከሆነ imported franco valuta by an industrial park ከአገር መልሶ የሚወጣ ዕቃ ላይ የተጣለ ክፍያ developer or enterprise such goods may be sent ሳይፈጽም ባለሥልጣኑን በማስፈቀድ ማስወጣት abroad by the industrial park developer or enterprise, ይችላል፡፡ by securing permission from the Authority, without making payments that are charged in relation to ፲፭/የኢንዱስትሪ ፓርክ ድርጅት የመጠቀሚያ ጊዜ goods sent back abroad. ያለፈበት ወይም ጉዳት የደረሰበት የምርት ግብዓት 15/ An industrial park enterprise may, by adducing ከሚመለከተው የመንግሥት ተቋም ማረጋገጫ evidence to the Authority from a relevant ለባለሥልጣኑ በማቅረብ እንዲወገድ ማድረግ governmental institution, cause the removal of input ይችላል፡፡ that has expired or is defective. ፳. በጉምሩክ አሰራር ላይ የሚፈጸም ጥሰት 20. Violation of Customs Procedures An industrial park end-user that violates the customs and የጉምሩክንና ሌሎች ሕግጋትን የጣሰ የኢንዱስትሪ ፓርክ other laws shall be held accountable under the relevant law. ተጠቃሚ አግባብ ባለው ሕግ መሠረት ተጠያቂ ይሆናል፡፡ ፱ሺ፱፻፴፪ https://chilot.me gA ፌደራል ነጋሪት ጋዜጣ ቁጥር    ቀን ፪ሺ፲ ዓ.ም Federal Negarit Gazette No.  15th September 2017…….page 9932 ክፍል ሰባት SECTION SEVEN ቅሬታ እና ክርክር ስለሚፈታበት ሥርዓት COMPLAINT HANDLING AND DISPUTE RESOLUTION ፳፩. መርሆዎች 21. Principles ፩/ በኢንዱስትሪ ፓርክ ውስጥ የሚነሳ የአስተዳደር 1/ Administrative complaints, civil and commercial ቅሬታ፣ የፍትሐብሔር እና የንግድ ክርክር ቀልጣፋ፣ disputes that arise in an industrial park shall be ሚዛናዊና ውጤታማ በሆነ መንገድ ይፈታል፡፡ settled in efficient, effective and balanced manner. ፪/ በኢንዱስትሪ ፓርክ ውስጥ በአሠሪና ሠራተኛ 2/ Complaints and collective or individual labour መካከል የሚፈጠር ቅሬታና የወል ወይም የተናጠል disputes that arise between a worker and his የሥራ ክርክር ለአማራጭ የክርክር መፍቻ ዘዴዎች employer in an industrial park shall be resolved ቅድሚያ በመስጠት በሠራተኛና አሠሪ ሕግ መሠረት pursuant to the Labour Law by giving priority to alternative dispute mechanism. ይፈታል፡፡ ፳፪.አስተዳደራዊ እርምጃ 22.Administrative Measure ፩/ ፈቃዱን ለማግኘት የተቀመጡትን ቅድመ-ሁኔታዎች፣ 1/ Where an industrial park developer or operator ይህን ደንብ፣ መመሪያዎችን ወይም ሌሎች አግባብነት violates the conditions for the issuance of its permit, ያላቸውን ሕግጋት የጣሰው የኢንዱስትሪ ፓርክ አልሚ these Regulations, directives or other relevant laws, ወይም አስተዳዳሪ ከሆነ ቦርዱ፣ የኢንዱስትሪ ፓርክ the Board shall issue it a warning requiring that ድርጅት ከሆነ ደግሞ ኮሚሽኑ ከስልሳ ቀናት ባልበለጠ corrective measures be taken in less than sixty days; ጊዜ ውስጥ አስፈላጊውን የማስተካከያ እርምጃ a similar warning shall be issued by the Commission where the foregoing violation is committed by an እንዲወስድ ማስጠንቀቂያ ይሰጠዋል፡፡ industrial park enterprise. ፪/ ማስጠንቀቂያ የተሰጠው አልሚ፣ አስተዳዳሪ ወይም 2/ Where an industrial park developer, operator or ድርጀት በዚህ አንቀጽ ንዑስ አንቀጽ (፩) በተሰጠው enterprise fails to take corrective measures within the ጊዜ ውስጥ አስፈላጊውን የማስተካከያ እርምጃ time limit provided for under sub-article (1) of this ካልወሰደ እንደአግባብነቱ በቦርዱ ወይም በኮሚሽኑ Article, the Board, or as may be appropriate the ከስልሳ ቀናት ላልበለጠ ጊዜ ፈቃዱ ሊታገድ Commission, may suspend its permit for not more ይችላል፡፡ than sixty days. ፫/ ፈቃዱ የታገደበት የኢንዱስትሪ ፓርክ አልሚ ወይም 3/ Where an industrial park developer or operator or አስተዳዳሪ ወይም ድርጅት በዚህ አንቀጽ ንዑስ enterprise whose permit has been suspended fails to አንቀጽ (፪) በተሰጠው ጊዜ ውስጥ አስፈላጊውን take corrective measures and fails to resume work ማስተካከያ አድርጎ ወደ ሥራ ካልተመለሰ ቦርዱ within the time limit fixed pursuant to sub-article (2) የሦስተኛ ወገኖችን መብት ለማስጠበቅ ሲል አግባብ of this Article, the Board may decide that the matter ባለው አካል ጊዜያዊ ባለአደራ እንዲሰየምና ቀጣይ be referred to an appropriate body for a provisional trustee that takes appropriate measures to preserve እርምጃ እንዲወሰድ ሊወስን ይችላል፡፡ the rights of third parties be appointed. ፳፫.በኮሚሽኑ ውሳኔ ላይ ቅሬታ ስለማቅረብ 23. Lodging Complaint against Decision of the Commission ፩/ ማንኛውም የኢንዱስትሪ ፓርክ ተጠቃሚ በኮሚሸኑ 1/ Any industrial park end-user may lodge complaint በሚወሰድ አስተዳደራዊ እርምጃ ላይ ለቦርዱ ቅሬታ to the Board against administrative measures taken by the Commission. ሊያቀርብ ይችላል፡፡ 2/ The complaint against the decision or ፪/ በኮሚሽኑ በተሰጠ ውሳኔ ወይም በተወሰደ አስተዳደራዊ administrative measure taken by the Commission እርምጃ ላይ ቅር በመሰኘት ለቦርዱ የሚቀርብ shall be made in writing; a copy of the decision or ማንኛውም ቅሬታ በኮሚሽኑ ከተሰጠው ውሳኔ ወይም measure taken by the Commission shall be ከተወሰደው አስተዳደራዊ እርምጃ ግልባጭ ጋር በጽሁፍ submitted together with the pleading. መቅረብ አለበት፡፡ 3/ Where a party with vested interest requests that the ፫/ ኮሚሽኑ የሰጠው ውሳኔ እና የወሰደው አስተዳደራዊ decision or administrative measure taken by the እርምጃ የሚመለከተው ወገን በጽሑፍ እንዲሰጠው Commission be given to it in writing, the ከጠየቀ በሰባት የሥራ ቀናት ውስጥ ሊሰጠው Commission shall give that within seven official ይገባል፡፡ working days of the request. https://chilot.me gA ፱ሺ፱፻፴፫ ፌደራል ነጋሪት ጋዜጣ ቁጥር    ቀን ፪ሺ፲ ዓ.ም Federal Negarit Gazette No.  15th September 2017…….page 9933 ፳፬.በቦርዱ ውሳኔ ላይ ስለሚቀርብ ይግባኝ 24. Appeal Against Decision of the Board ፩/ በቦርዱ ውሳኔ ቅር የተሰኘ ወገን ጉዳዩን አግባብ ላለው 1/ A party aggrieved by a decision of the Board may ፍርድ ቤት በይግባኝ መውሰድ ይችላል፡፡ lodge appeal to an appropriate court. ፪/ ቅሬታ አቅራቢው የቦርዱ ውሳኔ ግልባጭ በጽሑፍ 2/ Where a complainant requests the copy of decision እንዲሰጠው ከጠየቀ በሰባት የሥራ ቀናት ውስጥ of the Board be given to him in writing, the Secretariat of the Board shall give it within seven በቦርዱ ጽሕፈት ቤት ሊሰጠው ይገባል፡፡ official working days of the request. ፳፭.በሌሎች መንግሥታዊ አካላት ላይ ስለሚቀርብ ቅሬታ 25. Complaints Lodged Against Other Government Institutions ፩/ የኢንዱስትሪ ፓርክ ተጠቃሚ በሌሎች ማናቸውም 1/ An industrial park end-user may submit complaint መንግሥታዊ አካላት ከኢንዱስትሪ ፓርክ ጋር to the Commission against decisions made and በተያያዘ በሚሰጥ ውሳኔ ወይም በሚወሰድ administrative measures taken by any other አስተዳደራዊ እርምጃ ላይ ቅሬታውን ለኮሚሽኑ government institution in relation to an industrial ሊያቀርብ ይችላል፡፡ park. ፪/ ኮሚሽኑ በዚህ አንቀጽ ንዑስ አንቀጽ (፪) መሠረት 2/ The Commission may cause resolution of complaint የቀረበን ቅሬታ በየኢንዱስትሪ ፓርኩ የአንድ ማዕከል submitted pursuant to sub-article (1) of this Article አገልግሎት ውስጥ መፍትሔ እንዲያገኝ ማድረግ at each industrial park’s one-stop shop service. ይችላል፡፡ ፫/ በዚህ አንቀጽ ንዑስ አንቀጽ (፪) የተጠቀሰው ቅሬታ 3/ Where a complaint is submitted to the one-stop ለኮሚሽኑ የኢንዱስትሪ ፓርክ የአንድ ማዕከል shop service for resolution pursuant to sub-article (1) of this Article, the Commission shall consult the አገልግሎት ቀርቦ ከታየ በኋላ ኮሚሽኑ relevant parties and come up with a written ከሚመለከታቸው ባለጉዳዮች ጋር በመነጋገር በሰላሳ recommendation to solve the grievance, within ቀናት ውስጥ የመፍትሄ ሀሳብ በጽሁፍ ማቅረብ thirty days of the submission. አለበት፡፡ ፳፮. ቅሬታን በእርቅ ስለመፍታት 26. Conciliation ፩/ በኢንዱስትሪ ፓርክ ተጠቃሚዎች መካከል የሚነሱ 1/ The Commission shall cause resolution of disputes ቅሬታዎችን ኮሚሽኑ በአንድ ማዕከል አገልግሎት arising between industrial park end-users through በእርቅ መፍትሔ እንዲያገኙ ያደርጋል፡፡ negotiation at the one-stop shop service. ፪/ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) የተመለከተው 2/ The service specified under sub-article (1) of this አገልግሎት የሚሰጠው ቅሬታ ውስጥ የገቡት ወገኖች Article shall be provided only if the parties to the የአስታራቂነት ጥያቄያቸውን ተስማምተው በጽሑፍ dispute agree to seek that and submit their request ለአንድ ማዕከል አገልግሎት ሲያቀርቡ ብቻ ነው፡፡ in writing. / የአስታራቂነት ጥያቄ ለኮሚሽኑ በቀረበ ጊዜ የአንድ 3/ Where a request for conciliation service is ማዕከል አገልግሎት የቅሬታ አፈታት ባለሙያ submitted to the Commission, the conciliator at the እንደአስፈላጊነቱ ከባለጉዳዮቹ ጋር በመነጋገር እጅግ one-stop shop service shall consult the relevant ቢዘገይ ቅሬታው በቀረበ ሰላሳ ቀናት ውስጥ የመጨረሻ parties, if need be, and come up with a written final የመፍትሔ ሐሳብ በጽሁፍ ያቀርባል፡፡ recommendation to solve the dispute, within thirty days of submission of the complaint. ፬/ በኮሚሽኑ የቀረበውን የመፍትሔ ሀሳብ እንደሚቀበሉት 4/ The parties shall be bound by the terms of the ቅሬታ ውስጥ የገቡት ወገኖች በጽሁፍ ያረጋገጡ recommendation drawn up by the Commission only እንደሆነ የቀረበው ሀሳብ አስገዳጅነት ይኖረዋል፡፡ if they in writing confirm their acceptance. ፭/ የእርቅ ሀሳቡ ይፋ ከተደረገበት ቀን ጀምሮ በአስራ 5/ The recommendations shall be deemed rejected, if አምስት ቀናት ውስጥ ሁሉም ወገኖች የእርቅ ሀሳቡን all the parties to the dispute fail to in writing እንደተቀበሉ በጽሑፍ ካላረጋገጡ እንዳልተቀበሉት confirm their acceptance of the terms of ይቆጠራል፡፡ recommendation within fifteen days from the time such recommendations were made known to them. https://chilot.me ፱ሺ፱፻፴፬ 9934 gA ፌደራል ነጋሪት ጋዜጣ ቁጥር    ቀን ፪ሺ፲ ዓ.ም Federal Negarit Gazette No.  15th September 2017…….page ፮/ በእርቅ ሂደት የሚኖር ወጪ ተገልጋዮቹ ይሸፍናሉ፤ 6/ The parties shall settle expenses incurred in ይህንንም አስቀድመው ሊስማሙ ይገባል፡፡ connection with the conciliation; and they shall undertake to do that beforehand. ፳፯.በግልግል ዳኛ ስለመጨረስ 27. Resolution by Arbitration ፩/የኢንዱስትሪ ፓርክ ተጠቃሚዎች ቅሬታቸውን 1/ Industrial park end-users may agree to resolve በግልግል ዳኛ ለመጨረስ መስማማት ይችላሉ፡፡ disputes between themselves by arbitration. ፪ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) የተመለከተው 2/ The agreement referred to under sub-article (1) of ስምምነት በጽሑፍ መደረግ አለበት፤ ዝርዝሩ this Article shall be concluded in writing; the በፍትሐብሔር ሕግ ቁጥር ሺ፫፻፳፭ እና ተከታዮቹ details shall be governed by Article 3325 and the ድንጋጌዎች መሠረት ይወሰናል፡፡ subsequent provisions of the Civil Code of Ethiopia. ፳፰.የግልግል ዳኛ መሆን የሚችሉ ባለሙያዎች ዝርዝር 28. Roster of Professionals that may Serve as Arbitrators ፩/ ኮሚሽኑ ከኢንዱስትሪ ፓርክ ተጠቃሚዎች 1/ The Commission shall, based on the recommendation of industrial park end-users, የሚቀርበውን ጥቆማ መሠረት በማድረግ በግልግል compile a roster of credible professionals that can ዳኝነት ለመስራት ተአማኒነትና የሙያ ብቃት serve as arbitrators. ያላቸው ሰዎች ስም ዝርዝር ያዘጋጃል፡፡ ፪/ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) የተመለከተውን 2/ The Commission shall update the roster specified ዝርዝር ኮሚሽኑ በየሁለት ዓመቱ ወቅታዊ under sub-article (1) of this Article biennially. ያደርጋል፡፡ ፳፱. የግልግል ዳኛ አመራረጥ 29. Appointment of Arbitrator ፩/ክርክራቸውን በግልግል ዳኛ ለመጨረስ የተሰማ ሙ 1/ Parties that have agreed to resolve their ወገኖች በዚህ ደንብ አንቀጽ ፳፰ ከተመለከተው differences by arbitration may appoint as an ዝርዝር ውስጥ ወይም ሌላ ማንኛውም ሰው በግልግል arbitrator a person that appears on the roster specified under Article 28 of these Regulation or ዳኝነት መምረጥ ይችላሉ፡፡ any other person. ፪/ የግልግል ዳኞች ስንት እንደሚሆኑ ወይም እንዴት 2/ Where the arbitration agreement fails to specify እንደሚመረጡ ስምምነቱ ያላመላከተ እንደሆነ the number of arbitrators or the manner in which እያንዳንዱ ወገን አንድ የግልግለ ዳኛ ይመርጣል፡፡ they shall be appointed, each party shall appoint one arbitrator. ፫/ ተቃራኒ የውል ቃል ከሌለ በቀር የግልግል ዳኞች 3/ Unless otherwise agreed, where there is an even ብዛት በጥንድ የሚ ቆጠሩ እንደሆነ ዳኞቹ ወደ ሥራው number of arbitrators, they shall, before assuming ከመግባታቸው በፊት አንድ ሌላ የግልግል ዳኛ their functions, appoint another arbitrator who ይመርጣሉ፡፡ ይኸውም የተመረጠው የግልግል ዳኛ shall as of right preside over the arbitration ለግልግል ዳኝነቱ ሰብሳቢ ይሆናል፡፡ በግልግል ዳኞቹ tribunal. Where the arbitrators fail to reach መካከል ስምምነት የሌለ እንደሆነ ከተዋዋይ ወገኖች agreement, the Arbitration Institute of Addis Ababa Chamber of Commerce and Sectoral አንዱ በሚያቀርበው ጥያቄ የአዲስ አበባ የንግድና Association shall, upon the request of one of the ዘርፍ ማህበር የግልግል ኢንስቲትዩት በዚህ ደንብ parties to the dispute, appoint an arbitrator from አንቀጽ ፳፰ ከተመለከተው ዝርዝር ውስጥ ይመርጣል፡፡ the roster specified under Article 28 of these Regulations. ፬/ ብዛታቸው በጥንድ የማይቆጠሩ እንደሆነ የግልግል 4/ Where their number is odd, the arbitrators shall ዳኞቹ ከመካከላቸው ሰብሳቢ የሚሆነውን ይመርጣሉ፡፡ appoint the presiding arbitrator from among በግልግል ዳኞቹ መካከል ስምምነት የሌለ እንደሆነ themselves. Where the arbitrators fail to reach ከተዋዋይ ወገኖች አንዱ በሚያቀርበው ጥያቄ የአዲስ agreement, the Arbitration Institute of Addis Ababa Chamber of Commerce and Sectoral አበባ የንግድና ዘርፍ ማህበር የግልግል ኢንስቲትዩት Association shall, upon the request of one of the ከግልግል ዳኞቹ መካከል ለግልግል ዳኝነቱ ሰብሳቢ parties to the dispute, appoint the presiding ይሾማል፡፡ arbitrator from among the arbitrators. ፱ሺ፱፻፴፭ https://chilot.me gA ፌደራል ነጋሪት ጋዜጣ ቁጥር    ቀን ፪ሺ፲ ዓ.ም Federal Negarit Gazette No.  15th September 2017…….page 9935 ፴. ተፈጻሚነት የሚኖረው ሕግ 30.Applicable Law ቅሬታቸውን በግልግል ዳኝነት ለመጨረስ የተስማሙ Industrial park end-users that have agreed to resolve their የኢንዱስትሪ ፓርክ ተጠቃሚዎች ጉዳያቸው differences by arbitration are at liberty to choose the የሚፈታበትን መሠረታዊና የሥነ-ሥርዓት ሕግ መምረጥ substantive and procedural law to be applied by the tribunal. ይችላሉ፡፡

31.Arbitrator Fee ፴፩. የግልግል ዳኛ የአገልግሎት አበል The Commission shall, in consultation with appropriate ኮሚሽኑ አግባብ ካለው አካል ጋር በመመካከር bodies, prepare arbitration rate of fee schedule to be በኢንዱስትሪ ፓርክ ተጠቃሚዎች መካከል በሚደረግ applied to determine fees due to arbitrators that resolve የግልግል ዳኝነት የግልግል ዳኛ ሆነው የሚያገለግሉ disputes among industrial park end-users. ሰዎች የሚከፈላቸውን አበል ለመወሰን የሚረዳ የክፍያ ተመን ሰንጠረዥ ያዘጋጃል፤ የተመን ሰንጠረዡም በየሁለት ዓመቱ ወቅታዊ ያደረጋል፡፡

32.Assignment of Federal Court Circuit Bench ፴፪.ተዘዋዋሪ ችሎት በኢንዱስትሪ ፓርክ ውስጥ ስለሚያስችልበት ሁኔታ The Commission shall, in consultation with the Federal Supreme Court, facilitate conditions for the assignment of ኮሚሽኑ ከፌዴራል ጠቅላይ ፍርድ ቤት ጋር በመመካከር a circuit bench of appropriate federal court in industrial አግባብነት ያለው የፌደራል ፍርድ ቤት ተዘዋዋሪ ችሎት parks. በኢንዱስትሪ ፓርኮች ውስጥ የሚያስችልበት ሁኔታ ያመቻቻል፡፡ ክፍል ስምንት SECTION EIGHT ልዩ ልዩ ድንጋጌዎች MISCELLANEOUS PROVISIONS

33.Personal Effects ፴፫.የግል መገልገያ ዕቃዎች ፩/ በኢንዱስትሪ ፓርክ የተሰማራ የውጭ ባለሀብት 1/ A foreign investor engaged in an industrial park or ወይም ከውጭ አገር የተመለሰ ኢትዮጵያዊ ወይም an Ethiopian that resides abroad or a person of የውጭ አገር ዜግነት ያለው ትውልደ ኢትዮጵያዊ Ethiopian origin may import duty-free and without paying other taxes personal effects such as those በኢንዱስትሪ ፓርክ ውስጥ በሚሰራበት ጊዜ የግል used in living room, bedroom, kitchen, bathroom, መገልገያ ዕቃዎች እንደ የሳሎን/የመኝታ ቤት፣ sports appliances, lap top and desk top computers, የወጥ ቤት፣ የባኞ ቤት እና የስፖርት ዕቃዎች፣ ላፕ musical instruments, camera, electronic gadgets, ቶፕ እና ዴስክ ቶፕ ኮምፒውተሮች፣ የሙዚቃ TV, CD player, for use if he lives or works in an መሳሪያ፣ ካሜራ፣ ኤሌክትሮኒክስ፣ ቲቪ፣ ሲዲ industrial park; the details of which shall be ማጫወቻ እና የመሳሰሉ ሌሎች ልዩ ልዩ ዕቃዎች prescribed by a directive. ያለቀረጥና ታክስ ከውጭ አገር ማስገባት ይችላል፤ ዝርዝሩ በመመሪያ ይወሰናል፡፡ ፪/ በኢንዱስትሪ ፓርክ የተሰማራ የውጭ ባለሀብት 2/ A foreign investor engaged in an industrial park or ወይም ከውጭ አገር የተመለሰ ኢትዮጵያዊ ወይም an Ethiopian that resides abroad or a person of የውጭ አገር ዜግነት ያለው ትውልደ ኢትዮጵያዊ Ethiopian origin that has imported personal effects በዚህ አንቀጽ ንዑስ አንቀጽ (፩) መሠረት ወደ pursuant to sub-article (1) of this Article may: አገር ውስጥ ያስገባቸው የግል መገልገያ ዕቃዎች፡- a) transfer such goods to another person ሀ) ተመሳሳይ መብት ላለው ሰው ያለቀረጥና with similar rights without payment of ታክስ ማስተላለፍ ይችላል፤ customs duty and tax; ለ) አስቀድሞ ተገቢውን ቀረጥና ታክስ በመክፈል b) Transfer such goods to another person ለራሱ ከፓርክ ውጪ ሊወስደው ወይም that does not have similar rights or take ተመሳሳይ መብት ለሌለው ሰው ማስተላለፍ them outside the park for his own use ይችላል፡፡ subject to the payment of appropriate customs duty and tax in advance. https://chilot.me gA ፱ሺ፱፻፴፮ ፌደራል ነጋሪት ጋዜጣ ቁጥር    ቀን ፪ሺ፲ ዓ.ም Federal Negarit Gazette No.  15th September 2017…….page 9936 / በዚህ አንቀጽ ንዑስ አንቀጽ () መሠረት መብቱን 3/ A person who wants to transfer his rights pursuant ማስተላለፍ የሚፈልግ ሰው ከማስተላለፉ በፊት to sub-article (2) of this Article shall secure ኮሚሽኑን ማስፈቀድ አለበት። approval of the Commission before effecting transfer. ፴፬.ከደመወዝ ገቢ ግብር ነፃ ስለመሆን 34. Exemption from Tax on Salary ምርቱን ወደ ውጭ አገር ለመላክ የተስማማ Foreign nationals employed by an industrial park enterprise የኢንዱስትሪ ፓርክ ድርጅት የንግድ ሥራ ፈቃድ that has undertaken to export its produce shall be exempted ካወጣበት ጊዜ ጀምሮ ባሉት የመጀመሪያ አምስት from paying income tax on their salary during five ተከታታይ ዓመታት ውስጥ የሚቀጥራቸው ባለሙያ consecutive years starting from the date on which the የውጭ አገር ዜጎች ከደመወዝ ገቢ ግብር ነፃ ይሆናሉ፡፡ enterprise obtained business license. ፴፭.የሦስትዮሽ አሰራር ኮሚቴ 35. Tripartite Committee 1/ A tripartite committee consisting of the Ministry of ፩/ የሠራተኛና ማህበራዊ ጉዳይ ሚኒስቴር፣ የኢንዱስትሪ Labour and Social Affairs, the Ministry of Industry, ሚኒስቴር፣ እንደሁኔታው የኢንዱስትሪ ፓርክ አልሚ፣ industrial park developer, operator or enterprise and አስተዳዳሪ ወይም ድርጅት አሰሪዎች እና የሠራተኛ employees’ representatives shall be established in a ተወካይ የሚገኙበት የሦስትዮሽ አሰራር ኮሚቴ park. ይቋቋማል። 2/ The tripartite committee shall be responsible for: ፪/ የሦስትዮሽ አሰራር ኮሚቴው፡- ሀ) ቀጣይነት ያለው ምክክር በማድረግ የሠራተኛ a) ensuring the rights and duties of መብትና ግዴታ መከበሩን ማረጋገጥ፣ ግጭት workers are respected and creating እንዳይከሰት አመቺ ሁኔታ የመፍጠር፤ conducive conditions to prevent conflict through continuous ለ) ከኢንዱስትሪ ሚኒስቴር ጋር በመመካከር consultation and engagement; የእውቀት፣ ክህሎትና ቴክኖሎጂ ሽግግር b) ascertaining, in consultation with the መደረጉን በማረጋገጥ ምርታማነት እንዲጨምር Ministry of Industry, that transfer of የማድረግ፤ knowledge, skill and technology takes place and productivity increases; ሐ) ሌሎች የኢንዱስትሪ ሰላም ለማስፈን የሚረዱ c) Carrying out other activities that help ተግባራትን የማከናወን ኃላፊነት አለበት፡፡ attain industrial peace. ፫/ ኮሚሽኑም ከኢንዱስትሪ ሚኒስቴር ጋር በመመካከር 3/ The Commission shall, in consultation with the ኮሚቴው በዚህ አንቀጽ ንዑስ አንቀጽ () መሠረት Ministry of Industry, follow up and provide ተግባሩን በአግባቡ ስለማከናወኑ ክትትልና ድጋፍ assistance that the Committee discharges the ያደርጋል፤ይቆጣጠራል፡፡ responsibilities entrusted to it under sub-article (2) of this Article; the Commission shall also regulate the activities of the Committee. ፴፮. ሕግ ስለማስከበርና የመረጃ ልውውጥ 36.Law Enforcement and Exchange of Information ፩/ ኮሚሽኑ በኢንዱስትሪ ፓርኮች ውስጥ አግባብነት 1/ The Commission shall cause cooperation and ያላቸው የፀጥታና የሕግ አስከባሪ አካላት coordination of appropriate security and law ከኢንዱስትሪ ፓርክ አልሚ፣ አስተዳዳሪ ወይም enforcement bodies operate within industrial ድርጅት ጋር በትብብርና በቅንጅት እንዲሰሩ parks with that of the industrial park developer, ያደርጋል፡፡ operator or enterprise. ፪/ የኢንዱስትሪ ፓርክ አልሚ፣ አስተዳዳሪ፣ ድርጅት 2/ Where a law enforcement organ or any another ወይም የሥራ ኃላፊ የፈቃድ መስፈርት መጣሱን relevant body comes to know of violation of the ያወቀ ወይም ሌላ ምርመራ የጀመረ አግባብ ያለው terms of permit by an industrial park developer, አካል ጥሰቱን ወይም የጀመረውን ምርመራ operator, enterprise or manager or any other በተመለከተ ኮሚሽኑን ወዲያውኑ ማሳወቅ organ that initiates any investigation into such ይኖርበታል፡፡ matters, shall forthwith inform the Commission about such violation or commencement of investigations. https://chilot.me ፱ሺ፱፻፴፯ 9937 gA ፌደራል ነጋሪት ጋዜጣ ቁጥር    ቀን ፪ሺ፲ ዓ.ም Federal Negarit Gazette No.  15th September 2017…….page ፴፯. የመሸጋገሪያ ድንጋጌዎች 37.Transitory Provisions ፩/ አግባብ ባላቸው ሌሎች ሕጎች የተደነገገው 1/ Without prejudice to the provisions of other እንደተጠበቀ ሆኖ ይህ ደንብ ከጸናበት ቀን በፊት appropriate laws, memorandums of understanding የተሰየመን የኢንዱስትሪ ፓርክ በተመለከተ concluded with industrial park developers, ከኢንዱስትሪ ፓርክ አልሚዎች፤ አስተዳዳሪዎች operators and enterprises and decisions taken as concerns industrial parks designated before the እና ድርጅቶች ጋር የተፈጸሙ የመግባቢያ coming into force of these Regulations shall ስምምነቶችና የተሰጡ ውሳኔዎች ተፈጻሚነታቸው continue to apply. ይቀጥላል፡፡ ፪/ በዚህ ደንብ ለኢንዱስትሪ ፓርክ ተጠቃሚ የተሻለ 2/ Provisions of this Regulation that confer better መብት የሚሰጡ ድንጋጌዎች ከዚህ ደንብ rights on industrial park end-users shall be መውጣት በፊት በተሰየመ የኢንዱስትሪ ፓርክ ላይ applicable to industrial parks designated before ተፈጻሚ ይሆናሉ፡፡ the coming into force of this Regulation.

38. Issuance of Directives ፴፰ .መመሪያ ስለማውጣት 1/ The Commission shall, in consultation with ፩/ ኮሚሽኑ የኢንዱስትሪ ፓርክ አሰያየም፣ ፈቃድ፣ stakeholders draft directives, concerning: ግንባታ፣ አስተዳደር፣ የአንድ ማዕከል አገልግሎት፣ designation of industrial park, permit, ቪዛና የመኖሪያ ፈቃድ፣ ጉምሩክ፣ የወጪ ንግድ፣ construction, operation, one-stop shop service, ቅሬታ አፈታት እና ሌሎች ከኢንዱስትሪ ፓርክ ጋር visa and residence permit, customs, export trade, ተያያዥነት ያላቸው ጉዳዮች ላይ ከቅርብ ባለድርሻ complaint handling and dispute resolution and አካላት ጋር በመመካከር ረቂቅ መመሪያዎችን other matters of relevance to industrial park አዘጋጅቶ በቦርዱ ያጸድቃል፡፡ cause them to be approved by the Board. ፪/ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) መሠረት ቦርዱ 2/ The Commission or other pertinent governmental የሚያወጣቸውን መመሪያዎች ለመተግበር institutions shall issue detailed implementation የሚያስችሉ ዝርዝር የአፈጻጸም መመሪያዎች ኮሚሽኑ directives enabling the enforcement of the ወይም የሚመለከተው መንግሥታዊ ተቋም ማውጣት directives issued by the Board pursuant to sub- አለበት፤ ኮሚሽኑ በሚመለከተው መንግሥታዊ ተቋም article (1) of this Article. The Commission shall follow-up and coordinates the issuance of such ዝርዝር የአፈጻጸም መመሪያ መውጣቱን directives by the appropriate governmental ይከታተላል፤ ያስተባብራል፡፡ institutions. ፴፱.ተፈጻሚነት ስለማይኖራቸው ሕጎች 39. Inapplicable Laws ከዚህ ደንብ ጋር የሚቃረኑ ደንቦች፣ መመርያዎች እና No regulation, directive and practice shall, in so far as it is አሰራሮች በዚህ ደንብ በተሸፈኑ ጉዳዮች ላይ inconsistent with this Regulation, have force or effect with ተፈጻሚነት አይኖራቸውም፡፡ respect to matters covered by this Regulation. ፵.ደንቡ የሚጸናበት ጊዜ 40.
