A PROCLAMATION TO PROVIDE FOR THE ESTABLISHMENT OF THE ETHIOPIAN WILDLIFE DEVELOPMENT AND CONSERVATION AUTHORITY WHEREAS, Ethiopia possesses diverse, rare and endemic species of wildlife which are of great value to tourism, education and science; WHEREAS, it is necessary to undertake appropriate conservation and development of wildlife for its sustainable use; WHEREAS, by halting the ever growing wildlife threatening conditions and enable the country to obtain economic and social benefits from its wildlife resource, it has become necessary to strengthen the sub-sector in accordance with the current global development utilization and conservation standard; WHEREAS, to provide proper attention for the development, conservation and utilization of the country’s wildlife resource and maximize its benefit, it has become necessary to establish a government body at the federal level; NOW, THEREFORE, in accordance with Article 55(1) of the Constitution of the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows: አףםአـףኛ ዓُא qÜ R #1 አዲስ አበֹו ግንቦُ 04 qN 2ְֱך ዓ.ו 14th Year No 31. Short Title This Proclamation may be cited as the “Ethiopian Wildlife Development and Conservation Authority Establishment Proclamation No. 575/2008”. 2. Definitions In this Proclamation unless the context requires otherwise: 1/ “Wildlife Proclamation” means the Development, Conservation and Utilization of Wildlife Proclamation No.541/2007; 2/ “Wildlife”, “Wildlife Resource”, “Wildlife Conservation Area” and “Wildlife Product” shall have the meanings assigned to them under Article 2 of the Wildlife Proclamation; 3/ “Ministry” or “Minister” means the Ministry or Minister of Culture and Tourism, respectively. 3. Establishment 1/ The Ethiopian Wildlife Development and Conservation Authority (hereinafter referred to as the “Authority”) is hereby established as an autonomous public agency of the federal government. 2/ The Authority shall be accountable to the Ministry. 4. Head Office The Authority shall have its head office in Addis Ababa and may have wildlife conservation area offices elsewhere, as may be necessary. 5. Objectives The objectives of the Authority shall be to ensure the development, conservation, and sustainable utilization of the country’s wildlife resource. 4¹þ( gA ØÁ‰L ነU¶T Uz¤È qÜ R #1 ግንቦُ 04 qN 2ሺህ ›.M Federal Negarit Gazeta No. .31 22nd May, 2008…. page 4091 6. የָםֳֹוጣኑ ָםጣንና ـግץֹו ُףֹוግـ ጣንናָם ִُـከגጣኑ የָםֳֹו ይኖָٍס፣ 1/ የዱץ እንስሳُ ሀብُ ָُדን፣ ጥበቃንና አጠቃוׂשን በֳאـከـ የፖֵתና የሕግ ፣ָֹוץׂשያ סኒስَגֳ ቅ እያዘጋጀּׂשנ በאንግת ُםፈׂשዱו በـግץֹו ֶይ ፣ֶָـዋֶْውን ይከٍא 2/ በסם የُבּהׂשـን የዱץ እንስሳُ ጥበቃ ቦٍዎ٤ ያֳָד፣ ያስـዳድָף፣ ሕገ ወጥ ـግُףֹו እንዳይፈጸֹْובው ይከֶከֶָ፣ 3/ በውጭ ًעስِגֳ ٤ካְድ አደን ፈቃድ ይרጣָ፣ 4/ ֲָَ፣ ካוፕ፣ ֹጅና ַֹ٤ አገָ ግֹِ٤ በዱץ እንስሳُ ጥበቃ ቦٍዎ٤ ውስጥ እንዲבּהּה ፈቃድ ይרጣָ፣ ץየዱ וእንስሳُ ወይ ץየዱ וናْውንד /5 እንስሳُ ውጤِ٤ን ከአገדֳ ץስወጣُ ወይו ወደ አገץ ውስጥ ֳדስገֹُו የגያ ስ٤ָ ፈቃድና የጤና וስክץ ወׂُשנ ይרጣָ፣ 6/ የዱץ እንרሳُ ውጤُ በרـጠው ፈቃድ ውስጥ ֳֳאـከـው ዓֶא דዋִን ይּבጣጠָף፣ ውጤًንו ይֳካָ፣ 7/ የዱץ እንስሳُ ጥበቃ ቦٍዎ٤ በዓֳו የـፈጥצ ሀብُ ጥበቃ ֱብُנ እንዲאዘ ገדֳ ּשስ٢ָ ዓֳו አׂשፋዊ אስፈُץ ጋግጣָ፣ እነዚֱኑנውን ያֶٍْחד ውንْףዳደـא ውׂשጠብ ٤ِץስፈא ይከֶָٍـ፣ 8/ ֳዱץ እንስሳُ ָُדና ጥበቃ የَክኒክ ዕץዳٍና ֶַו ድጋፍ ֵרጡ ከ٤ִג ወገኖ٤ ጋץ ዓֳו አׂשፍ ግንኙነُ ይָٍץרא፣ 9/ የዱץ እንስሳُ ሀብُን አስָאክِ ኢُዮ ጵያ አָֹו የֲነֹْו٤ው ዓֳו አׂשፍ ስווነ ጋግጣָ፣נጋْውን ያנደא ዊףֹוግـ ٤ِ וُדּהـ ፍׂשዓ וከٍْው ዓֳֳאגֳ በየጊዜው עፖُץ እያዘጋጀ ያስֶָـፋָ፡፡ 6. Powers and Duties The Authority shall have the powers and duties to: 1/ prepare and submit to the Ministry draft policies and laws relating to the development, conservation and utilization of wildlife resources; and follow up the implementation of the same upon approval by the government; 2/ develop and administer wildlife conservation areas established under it and control illegal activities committed in the areas; 3/ issue hunting permits to foreign tourists; 4/ issue permits for the establishment of hotels, campsites, lodges and other services in wildlife conservation areas; 5/ issue permits and health certificates to export and import any wildlife or wildlife products; 6/ control the utilization of wildlife products to ensure its compliance with the objectives of the permit, and make impact assessments on the product; 7/ ensure that wildlife conservation areas are established in accordance with international standards with a view to facilitating their registration by the World Conservation Union, and follow up their administration accordingly; 8/ establish international relations with all bodies having the potential of providing technical and other assistance for wildlife conservation; 9/ ensure the implementation of treaties to which Ethiopia is a party; compile and submit periodical reports to the concerned international institutions; 4¹þ(1 gA ØÁ‰L ነU¶T Uz¤È qÜ R #1 ግንቦُ 04 qN 2ሺህ ›.M Federal Negarit Gazeta No. .31 22nd May, 2008…. page 4092 0/ የዱץ እንስሳُን በֳאـከـ በדናْውו ዓֳו አׂשፍ ስብֹור ወይו ጉֹוዔ אንግ ን ይወክֶָ፣ُם 01/ የዱץ እንስሳُ ጥበቃ፣ ָُדና አጠቃ ጠናָםከُ ጥናُና የֳאגን በוׂש ፕצግוף ያካሂዳָ፣ ወቅٍዊ נאጃዎ ٤ን ያֹורስָֹו፣ ያׂשነֹוብָף፣ ֳـጠቃ ጫָ፣ףרያ ዎ٤ג 02/ ֳክָֹ٤ በዱץ እንስሳُ ָُדና ጥበቃ ጣָ፣רገድ አስፈֶጊውን እገዛ ይנ አስፈֶጊ ֲኖ תገኝ ָםጣንና ـግסֹוን ֳַֹ٤ የፌዴָףና የክָָ אንግُם አካֶُ በውክֳና ይרጣָ፣ 03/ በዱץ እንስሳُ ጥበቃ ቦٍዎו٤ ֲነ ከጥበቃ ቦٍዎ٤ ውጪ በגገኙ የዱץ እንስሳُ ֶይ ֵደשץ የ٤ִג በֹּٍלዎ٤ን ይከֶከֶָ፣ ይּבጣጠָף፣ 04/ ከፌዴא ָףንግُם ጋץ በـገֹו የኮን ሴֹּלን ውָ ُנטא በግָ ֳֹוሀብِ٤ የـגዳደُסን የዱץ እንስሳُ ጥበቃ ቦٍዎ٤ ይּבጣጠָף፣ 05/ በאንግُם በጸደאـ ׂשን ُנטא ጠው አገָግֹُ ዋጋ ያስከፍֶָ፣רגֳ 06/ የንብֳֹו ُנቤُ ይֲናָ፣ ውָ ይዋዋֶָ፣ በስו ይከሳָ፣ ይከרሳָ፣ 07/ ዓֶדውን ከግብ ֳדድנስ የגያስፈָጉ ያከናውናָ፡፡ ُףֹוግـ ٤ַֹ 7. የָםֳֹוጣኑ አוּה ጣኑ፣ָםֳֹו 1/ በגኒስُס አቅּתףነُ በאንግُם የגሾו ዋና ዳይפክץـ፣ እና 2/ አስፈֶጊው ـףטኞ٤፣ ይኖָٍס፡፡ 8. የዋና ዳይפክָם סـጣንና ـግץֹו 1/ ዋና ዳይפክסـ የָםֳֹוጣኑ ዋና ףם አስፈጻג በֲאን ከגኒስَס በרגጠው አጠቃֶይ עאאያ ُנטא የָםֳֹוጣ ኑን ףםዎ٤ ይָףא፣ ያስـዳድָף፡፡ 10/ represent the government in any international meetings and conferences relating to wildlife; 11/ conduct research and training programs and collect, process and provide to users up-to-date information on the conservation, development and utilization of wildlife; 12/ provide support to regions with respect to the development and conservation of wildlife, and delegate its powers and duties to other federal and regional government organs where necessary; 13/ prevent and control incidents of wildlife diseases within or outside of conservation areas; 14/ supervise wildlife conservation areas administered by private investors in accordance with concession agreements entered into with the federal government ; 15/ charge fees for the services it renders in accordance with the rate approved by the government; 16/ own property, enter into contracts, sue and be sued in its own name; 17/ carry out such other activities as are necessary for the fulfillment of its objectives. 7. Organization of the Authority The Authority shall have: 1/ a Director General to be appointed by the Government upon the recommendation of the Minister; and 2/ the necessary staff. 8. Powers and Duties of the Director General 1/ The Director General shall be the chief executive officer of the Authority and shall, subject to the general directives of the Ministry, direct and administer the activities of the Authority. 4¹þ(2 gA ØÁ‰L ነU¶T Uz¤È qÜ R #1 ግንቦُ 04 qN 2ሺህ ›.M Federal Negarit Gazeta No. .31 22nd May, 2008…. page 4093 2/ የዚֱ አንׂשጽ ንዑስ አንׂשጽ /1/ አጠቃ ֶይ አነጋገץ እንደـጠበׂש ֲኖ ዋና ዳይפክסـ፡ ሀ/ በዚֱ አዋጅ አንׂשጽ 6 የֳאـ ከـውን የָםֳֹוጣኑን ָםጣንና ይ ያውֶָ፣ֶ ףםበ ٤צֹוግـ ֳ/ በፌዴת ָףቪָ ץרቪስ ሕግ ـףט ጣኑንָםֳֹוየ ُנטא ኞ٤ ይׂשጥָף፣ ያስـዳድָף፣ ּ/ የָםֳֹוጣኑን የףם ፕצግוףና በጀُ ያዘጋጃָ፣ תፈׂשድו በףם ֶይ ያውֶָ፣ ደֳُ በጀُናׂשፈـጣኑ በָםֳֹוֳ /א የףם ፕצግُנטא וף ገንዘብ ወጪ ያደץጋָ፣ ץጋ ኛ ወገኖ٤ـስמጣኑ ከָםֳֹו /ט በגያደץጋْው ግንኙነِ٤ ሁִ ጣኑን ይወክֶָ፣ָםֳֹו እንቅስቃሴ ףםጣኑ የָםֳֹוስֳ /נ ፡፡ָֹוץׂשያ ُץፖע סኒስَגֳ 3/ ዋና ዳይפክָםֳֹוֳ סـጣኑ የףם ቅָጥፍና በגያስፈָግ אጠን ከָםጣ ንና ـግסֹו በከፊָ ֳָםֳֹוጣኑ ַֹ٤ ٪ֶፊዎ٤ና ـףטኞ٤ በውክָና ֵያስـ ֶָፍ ይ٤ֶָ፡፡ 9. በ ጀ ُ የָםֳֹוጣኑ በጀُ በאንግُם ይאደָֹו፡፡ 0. የሂכብ אዛግብُ ና ُክክֳኛ የֲኑִחـጣኑ የָםֳֹו /1 የሂכብ אዛግብُን ይይዛָ፡፡ 2/ የָםֳֹוጣኑ የሂሳብ אዛግብُና ገንዘብ ነክ רነዶ٤ በዋናው ኦዲץـ ወይו እשץ በרגይْדው ኦዲ٤צـ በየዓًא ይא ፡፡ִףאנ 01. የִָךָךـና የסָךـ ֱጎ٤ 1/ የዱץ እንስሳُ አዋጅ አንׂשጽ 2 ንዑስ አንׂשጽ /07/ ץרـዞ በגከֳـው አዲስ ንዑስ አንׂשጽ /07/ ــክָّ፣ 2/ Without prejudice to Sub-Article (1) of this Article, the Director General shall: a/ exercise the powers and duties of the Authority specified in Article 6 of this Proclamation; b/ employ and administer employees of the Authority in accordance with the Federal Civil Service Laws; c/ prepare the annual work programme and budget of the Authority and implement the same upon approval; d/ effect expenditure in accordance with the approved budget and work programme of the Authority; e/ represent the Authority in all its dealings with third parties; f/ submit reports to the Ministry on the activities of the Authority. 3/ The Director General may delegate part of his powers and duties to other officials and employees of the Authority to the extent necessary for the efficient performance of the activities of the Authority. 9. Budget The budget of the Authority shall be allocated by the Government. 10. Books of Accounts 1/ The Authority shall keep complete and accurate books of accounts. 2/ The books of accounts and financial documents of the Authority shall be audited annually by the Auditor General or by Auditors designated by the Authority. 11. Amendments and Repeal 1/ Sub-Article (17) of Article 2 of the Wildlife Proclamation is repealed and amended by the following new Sub-Article (17): 4¹þ(3 gA ØÁ‰L ነU¶T Uz¤È qÜ R #1 ግንቦُ 04 qN 2ሺህ ›.M Federal Negarit Gazeta No. .31 22nd May, 2008…. page 4094 የኢُዮጵያ ֳُד ’ጣንָםֳֹו‘ /07» የዱץ እንስሳُ ָُדና ጥበቃ «ጣን ነው፣ָםֳֹו 2/ በዱץ እንስሳُ አዋጅ አንׂשጽ 4 ንዑስ አንׂשጽ /2/ እና አንׂשጽ 07 ንዑስ አንׂשጽ /2/ ውስጥ “גኒስَס” የֳגው ቃָ ”ץኒስَג וዝעً ናֱָֹוዞ “የץרـ በֳגው ــክָّ፡፡ 3/ በዚֱ አንׂשጽ ንዑስ አንׂשጽ /1/ እና /2/ ከـጠُשׂשን በስץׂשـ በዱץ እንስሳُ አዋጅ ውስጥ በדናْውם וፍף ዞץרـ ው ቃֳָגየ ”סኒስَג“ ክָّ፡፡ــ ውֳגጣኑ” በָםֳֹו“ 4/ የዱץ እንስሳُ አዋጅ አንׂשጽ 03 ץרـዞ አንׂשጽ 04፣ 05፣ 06፣ 07፣ 08፣ 09፣ እና ! እንደቅደـ וከֶْـው አንׂשጽ 03 ጽ 04፣ 05፣ 06፣ 07፣ 08፣ׂשዞ አንץרـ እና 09፣ ֲነዋָ፡፡ 02. የאብُና ግዴٍ ֳֶـאፍ የዱץ እንስሳُ የףם ዘץፍን የֳאגከً የግብץናና የገጠג ُדָ ץኒስَא ץብُና ግዴٍዎ٤ በዚֱ አዋጅ ֳָםֳֹוጣኑ ፈዋָ፡፡ֶָـ 03. አዋጁ የגፀናበُ ጊዜ ይይֱֱ አአዋዋጅጅ በበፌፌዴዴָָףף ነነጋጋُُעע ጋጋዜዜጣጣ ٍٍُُזז ከከወወጣጣበበُُ ׂשׂשንን ጀጀצצוו የየፀፀናና ይይֲֲናናָָ፡፡፡፡ አአዲዲስስ አአበበֹוֹו ግግንንቦቦُُ 0044 ׂשׂשንን 22ְֱֱךְך ዓዓ..וו GR¥ wLdgþ×RgþS yxþT×eà ØÁ‰§êE ÄþäK‰sþÃêE ¶pBlþK PÊzþÄNT “17/ ‘Authority’ means the Ethiopian Wildlife Conservation Authority;” 2/ The term “Ministry” under Sub-Article (2) of Article 4 and Sub-Article (2) of Article 17 of the Wildlife Proclamation is repealed and amended herein by the “Ministry of Culture and Tourism”. 3/ Any reference to “Ministry” in the Wildlife Proclamation, other than those referred to in Sub-Articles (1) and (2) of this Article, are repealed and amended herein by the “Authority”. 4/ Article 13 of the Wildlife Proclamation is repealed and Articles 14, 15, 16, 17, 18, 19 and 20 are re-numbered as Articles 13, 14, 15, 16, 17, 18 and 19, respectively. 12. Transfer of Rights and Obligations The rights and obligations of the Ministry of Agriculture and Rural Development with respect to its activities relating to wildlife are hereby transferred to the Authority. 13. Effective Date This Proclamation shall enter into force up on the date of publication in the Federal Negarit Gazeta.
