A PROCLAMATION TO PROVIDE FOR APICULTURE RESOURCES DEVELOPMENT AND PROTECTION WHEREAS, it is necessary to promote household and commercial beekeeping development in areas of high apiculture resource potential to realize appropriate contribution of the sub sector in the process of rapid economic development; WHEREAS, it has become necessary to ensure sustainable contribution of honey products in enhancing production and food security and poverty reduction efforts; WHEREAS, proper development of apiculture resources require the conservation of the biodiversity of honey bee races and honey source plants; NOW, THEREFORE, in accordance with Article 55 sub article (1) of the Constitution of the Federal Democratic Republic of Ethiopia it is hereby proclaimed as follows: 1. Short Title This Proclamation may be cited as “Apiculture Resources Development and Protection Proclam ation No. 660/2009.” አሥራስድስተኛ ዓመት qÜ R 6 አዲስ አበባ ታህሣሥ 05 qN 2ሺ2 16th Year No. 6 ADDIS ABABA 24th December, 2009 gA ØÁ‰L ነU¶T Uz¤È qÜ R 6 ታሀማሥ 05 qqqN 2ሺ2 ›.M Federal Negarit Gazeta No. 6 24th December, 2009 …. page 5118 2. ትርጓሜ የቃሉ አገባብ ሌላ ትርጉም የሚያሰጠው ካልሆነ በስተቀር በዚህ አዋጅ ውስጥ፣ 1/ “ንብ” ማለት ማርና ሌሎች የንብ ውጤቶችን የሚያዘጋጅ በኅብረት መኖር የሚችል አፅቄ ነፍሳት ሲሆን የጣዝማ ንቦችንና ሌሎች የንብ ዝርያዎችን አያካትትም፤ 2/ “ኅብረንብ” ማለት በአንድ ቀፎ ወይም በኅብረት በተፈጥሮ የመኖሪያ ቦታ ውስጥ የሚኖሩ ሠራተኛ ንቦችን፣ ንግሥት ንብን፣ አውራ ንቦችንና የንብ እጮችን ያካተተ ነው፤ 3/ “የንብ ሀብት” ማለት በተፈጥሮና በቀፎ ውስጥ የሚገኙ ኅብረንቦችና የማር ዕፅዋት ክምችት ነው፤ 4/ “የንብ ውጤቶች” ማለት ንቦች የሚያዘጋ ጁዋቸው ማር፣ ሰም፣ ጽጌብናኝ፣ የንብ ወተት፣ የንብ ሙጫ፣ የንብ ዕጭና የንብ መርዝ ናቸው፤ 5/ “ቀፎ” ማለት ለኅብረንቦች መኖሪያ፣ መራቢያና ማር ማዘጋጃ ተብሎ የተሰራ ቤት ነው፤ 6/ “ማናብ” ማለት ኅብረንቦችን በቀፎ ውስጥ በማኖር ወይም በማርባት ማር፣ ሰምና ሌሎች የንብ ውጤቶችን የማምረት ሥራ ነው፤ 7/ “አናቢ” ማለት ኅብረንቦችን በቀፎ ውስጥ የሚያረባ ሰው ነው፤ 8/ “ሰው” ማለት ማንኛውም የተፈጥሮ ሰው ወይም በሕግ የሰውነት መብት የተሰጠው አካል ነው፤ 9/ “የጓሮ ንብ ልማት” ማለት በመኖሪያ ቤት አካባቢ ወይም በጓሮ ኅብረንቦችን በማኖር ወይም በማርባት ምርት የመሰብሰብ ሥራ ነው፤ 0/ “የመስክ ንብ ልማት” ማለት በጫካ፣ በቁጥቋጦ ወይም በእርሻ ማሳ ውስጥ ወይም አካባቢ ለኅብረንቦች ለኑሮአቸውና ለሥራቸው ምቹ ሁኔታ በመፍጠር የሚካሄድ የማነብ ሥራ ነው፤ 2. Definitions In this Proclamation unless the context requires otherwise: 1./ “honeybee” means social insects that can produce honey and other honeybee products and it does not include non-stinging bees and other species of bees; 2/ “honeybee colony” means a group of honeybees nesting in a hive or in its natural habitat with stratified social structure including worker bees, queen bee, drones, eggs and bee broods; 3/ “apiculture resources” means colony of honeybees residing in forests and hives and honey source plant potentials available in nature; 4/ “honeybee products” means honey, bees wax, pollen, royal jelly, propolis, bee broods and bee venom that are naturally produced by honeybees; 5/ “hive” means shelter of colony of honey -bees constructed for use in dwelling, reproducing and honey production purpose; 6/ “beekeeping” means the entrepreneurial practice of harvesting honey, beeswax and other honeybee products by keeping a colony of honeybees within hives; 7/ “beekeeper” means a person who is engaged in keeping of honeyhee colonies in hives; 8/ “person” means any natural or legal person; 9/ “backyard beekeeping development” means household activity of harvesting produces by keeping honeybee colonies in hives at household or backyard level; 10/ “field beekeeping development” means any beekeeping activities undertaken at or around forest, bush land or farmlands through providing suitable condition for the habitation and operation of colonies of honeybees; 5¹þ1)08 gA ØÁ‰L ነU¶T Uz¤È qÜ R 6 ታሀማሥ 05 qqqN 2ሺ2 ›.M Federal Negarit Gazeta No. 6 24th December, 2009 …. page 5119 01/ “የንግድ ንብ ልማት” ማለት መተዳደ ሪያው ግብርና ባልሆነ ሰው ኅብረንቦች ለልማቱ አመች በሆኑ ቦታዎች በቋሚነት ተቀምጠው ወይም የማዟዟር ማናብ ዘዴ በመጠቀም የሚካሄድ የንብ ውጤቶችን በብዛት የማምረት ሥራ ነው፤ 02/ “በማዟዟር ማናብ” ማለት የማር ዕፅዋትን የማበብ ወቅት በመከተል ዕፅዋቱ በብዛት ወደሚገኝበት አካባቢ ኅብረንቦችን በማጓጓዝና ለተወሰነ ጊዜ ብቻ በማስቀመጥ ምርት የሚሰበሰብበት የማናብ ዘዴ ነው፤ 03/ “ማር” ማለት ንቦች ከተለያዩ የማር ዕፅዋት ፈሳሽ የአበባ ወለላን ተፈጥሮአዊ በሆነ መንገድ ቀስመው ወደ ቀፎአቸው በመውሰድና ራሳቸው ከሚያመነጩት የተፈጥሮ ንጠረ ነገር ጋር በማዋሃድ የሚያዘጋጁት የተፈጥሮ ጣፋጭ ምግብ ሲሆን የጣዝማ ንቦች የሚያዘጋጁትንና በሰው ሰራሽ ዘዴ በፋብሪካ ውስጥ የሚዘጋጀውን ማር አያካትትም፤ 04/ “የማር አደን” ማለት በማር ወቅት ንቦች በተፈጥሮ የሚኖሩበትን ሥፍራ ፈልጎ በማግኘት ያዘጋጁትን ማር የመሰብሰብ ሥራ ነው፤ 05/ “ማር ማምረት” ማለት በማር ወቅት በቀፎ ውስጥ የሚኖሩ ኅብረንቦች ያዘጋጁት ማር መድረሱን በማረጋገጥ ከቀፎው የማውጣት ተግባር ነው፤ 06/ “ማናቢያ መሣሪያ” ማለት ማንኛውም ዓይነት ቀፎ፣ የአናቢ ትጥቅ ወይም ለማር፣ ለሰም ወይም ለሌላ የንብ ምርት ማምረቻ የሚያገለግል ማናቸውም ሌላ ዕቃ ነው፣ 07/ “ዕፅዋትን ማራከብ” ማለት ንቦች ፈሳሽ የአበባ ወለላና ጽጌብናኝ ለመሰብሰብ በማር ዕፅዋት አበቦች ላይ ሲዘዋወሩ የአንዱን ዕፅዋት ወንዴ ዘር ከሌላው ዕፅዋት ሴቴ ዘር ጋር የማገናኘት ወይም የማዳቀል ሂደት ነው፤ 11/ “commercial beekeeping development” means commercial scale development of honeybee products by non-agriculture business person through keeping of honeybee colonies in permanent apiaries or by making use of migratory beekeeping at various locations suitable for the operation of colonies of honeybees; 12/ “migratory beekeeping” means honey harvesting method that employs transportation of colonies of honeybees into high concentration honey source plant sites while keeping them there for a certain period of time following the course of blooming season of honey plants; 13/ “honey” means natural sweet food substance produced by honeybees from the nectar of blossoms which honeybees collect, transform and combine with specific of their own enzyme, store and leave in the honeycomb to ripen and mature, and it may not include honey produced by sting less or honey processed by artificial means; 14/ “honey hunting” means collection of honey after searching and finding the natural nesting sites of honey bee colonies; 15/ “honey harvesting” means removal of honey from bee hives during the honey harvesting season upon determining the honey produced by honeybees is ripe; 16/ “beekeeping equipment” means any type of hives, protective clothing of beekeepers or any beekeeping device for use in producing and processing honey, beeswax or other honeybee products; 17/ “pollination service” means the process of crossing or breeding of honey plant species by honeybees by transferring pollen from the male germplasm of the flower to the female germplasm of the same or different plant species, created while collecting nectar and pollen; 5¹þ1)09 gA ØÁ‰L ነU¶T Uz¤È qÜ R 6 ታሀማሥ 05 qqqN 2ሺ2 ›.M Federal Negarit Gazeta No. 6 24th December, 2009 …. page 5120 08/ “የንቦች ዕውደት” ማለት ኅብረንቦች የሚኖሩበትን ቀፎ፣ ዋሻ ወይም ሌላ ዓይነት የመኖሪያ ሥፍራ በከፊል ወይም በመሉ ለቀው አዲስ ኑር ለመመሥረት ወደሌላ ሥፍራ የሚሄዱበት ክንውን ነው፤ 09/ “የከተማ ማናብ ሥራ” ማለት በከተማ ውስጥ ወይም አካባቢ የሚካሄድ የማናብ ሥራ ነው፤ !/ “የመብረሪያ መንገድ” ማለት ንቦች ለሥራ ከቀፎ ሲወጡ ወይም ሲገቡ የሚበሩበት መንገድ ነው፤ !1/ “የንግሥት ንብ ርቢ” ማለት በተለያዩ የአሠራር ቴክኒኮች ወይም በሰው ሰራሽ ዘዴ ንግሥት ንብ የማራባት ሥራ ነው፤ !2/ “የንብ ምርምር” ማለት ለሳይንሳዊ ምርምርና ሙከራ ከማናብ ሥራ ጋር የተያያዘ በንቦች ዘር፣ በንቦች ሥነ ሕይወት፣ በሽታ፣ ማኔጅመንትና ሌሎች ሁኔታዎች ላይ የሚደረጉ ጥናታዊ ሥራዎችና ለቤተመዘክር የንብ ዘር የመሰብሰብ ተግባራትን ያካትታል፤ !3/ “ሚኒስቴር” ማለት የግብርናና የገጠር ልማት ሚኒስቴር ነው፤ !4/ “ክልል” ማለት በኢትዮጵያ ፌዴራላዊ ዲሞክራሲያዊ ሪፐብሊክ ሕገ መንግ ሥት አንቀጽ #7/1/ የተመለከተው ማንኛውም ክልል ሲሆን የአዲስ አበባና የድሬዳዋ ከተሞች አስተዳደሮችን ይጨምራል፤ !5/ በወንድ ፆታ የተገለጸው ማንኛውም አነጋገር ሴትንም ይጨምራል፡፡ 3. የንብ ሀብት ልማት 1/ ማንኛውም ሰው የራሱ ይዞታ በሆነ ጓሮ ወይም መስክ የንብ ልማት ማካሄድ ይችላል፡፡ 18/ “swarming honeybees” means a phenomenon in which colonies of honeybees set out or leaving their hives, cavity or other location of nesting in part or in all for new living place; 19/ “urban beekeeping” means beekeeping activity that takes place in or around an urban area; 20/ “flight path” means the route taken by worker bees in their outward or inward flight; 21/ “queen bee rearing” means the practice of queen bee raising through various working techniques or artificial methods; 22/ “bee research” means study research undertakings related to beekeeping on characterization of honeybee races, honeybee biology, honeybee pathology, honeybee management and other aspects of honeybees and includes collection of honeybee races for zoological museum purposes; 23/ “Ministry” means Ministry of Agriculture and Rural Development; 24/ “state” means any state referred to in Article 47(1) of the Constitution of the Federal Democratic Republic of Ethiopia and includes the Addis Ababa and Dire Dawa city administrations; 25/ any expression in the masculine gender includes the feminine. 3. Apiculture Resources Development 1/ Any person may undertake backyard or field beekeeping development on his own premises or fields under his possession. 5¹þ1)! gA ØÁ‰L ነU¶T Uz¤È qÜ R 6 ታሀማሥ 05 qqqN 2ሺ2 ›.M Federal Negarit Gazeta No. 6 24th December, 2009 …. page 5121 2/ እንዲያገግሙ በተከለሉ ቦታዎች፣ በማኅበራት ደን፣ በመንግሥት ደን ወይም በዱር እንስሳት ፓርክና ጥበቃ ቦታ ውስጥ የንብ ልማት ለማካሄድ የሚፈልግ ማንኛውም ሰው ይህንኑ ቦታ ለማስተዳደር ሥልጣን ከተሰጠው አካል የተሰጠ የጽሑፍ ፈቃድ መያዝ አለበት፡፡ 3/ የንግድ ንብ ልማት ወይም የንግድ የንግሥት ንብ ርቢ ለማካሄድ የሚፈልግ ማንኛውም ሰው አግባብ ባለው ሕግ መሠረት የተሰጠ የንግድ ፈቃድ መያዝ አለበት፡፡ 4/ የንብ ምርምር ለማካሄድ የሚፈልግ ማንኛውም የውጭ አገር ሰው በሚኒስቴሩ የተሰጠ የጽሑፍ ፈቃድ መያዝ አለበት፡፡ 5/ የከተማ ማናብ ሥራ የሚያካሂድ ማንኛውም ሰው፡ ሀ/ መሠረታዊ የማናብ ሥልጠና የምስ ክር ወረቀት ያለው ወይም የሥልጠና የምስክር ወረቀት ያላቸውን ግለሰቦች ቀጥሮ የሚያሰራ መሆን፣ ለ/ ኅብረንቦቹን እንስሳትና ሕፃናት በማይደርሱበት ቦታ ማስቀመጥ፣ እና ሐ/ የመብረሪያ መንገዳቸውን ከሦ ስት ሜትር ያላነሰ ከፍታ ባለው የግንብ፣ የዕፅዋት ወይም የጠቅጣቃ ሽቦ አጥር ማጠር፣ አለበት፡፡ 6/ በማዟዟር የማናብ ሥራ የሚያካሂድ ማንኛውም ሰው፡ ሀ/ ኅብረንቦችን ማስቀመጥ የሚያስች ለውን መሬት ለመጠቀም በመሬቱ ባለይዞታ የተሰጠ የጽሑፍ ፈቃድ መያዝ፣ 2/ Any person who wishes to undertake beekeeping development activities in natural resource rehabilitation area enclosure, community forest, state forest or wildlife park and protection area shall obtain written permit from the body that is authorized for the administration of such land. 3/ Any person who wishes to undertake commercial beekeeping development or commercial queen bee rearing shall obtain a business license issued pursuant to the relevant laws. 4/ Any foreigner who wishes to engage in bee research shall obtain a written permit issued by the Ministry. 5/ Any person who engages in urban beekeeping activities shall: a) possess basic beekeeping training certificate or employ persons having such training certificates; b) place the colonies of honeybees at locations away from the reach of animals and children; and c) build flight path fencing wall or live fencing or tight mesh wire fencing with the height of at least three meters above ground. 6/ Any person who undertakes migratory beekeeping shall: a) obtain a written authorization issued by the possessor of the land to be used for placing the colony of honeybees; 5¹þ1)!1 gA ØÁ‰L ነU¶T Uz¤È qÜ R 6 ታሀማሥ 05 qqqN 2ሺ2 ›.M Federal Negarit Gazeta No. 6 24th December, 2009 …. page 5122 ለ/ ኅብረንቦቹን በሚያጓጉዝበት ጊዜ ንቦቹ እንዳይወጡና በአካባቢው በመዘዋወር ላይ የሚገኝ ሰው ወይም እንስሳ ላይ አደጋ እንዳያስከትሉ በጠቅጣቃ ሽቦ ወይም አየር ሊያስገባ በሚችል ጨርቅ መሸፈን እንዲሁም በመንገድ ላይ ከማሳረፍ ወይም ሰውና እንስሳት ከሚዘዋወሩበት አካባቢ ከማቆም መቆጠብ፣ እና ሐ/ በሚጠቀምበት ቀፎ ላይ የራሱ የሆነ ምልክት ማድረግ፣ አለበት፡፡ 7/ ማንኛውም ሰው በዕውደት ላይ የሚገኙ ኅብረንቦችን አጥምዶ መያዝና መጠ ቀም ይችላል፣ ሆኖም ኅብረንቦቹ ከቀ ፎው የለቀቁበት አናቢ ወዲያው ተከታ ትሎ ያረፉበት ቦታ ከደረሰ አጥማጁ የባለቤትነት መብት አይኖረውም፡፡ 8/ ማንኛውም አናቢ ለዕፅዋት ተራክቦ አገልግሎት ኅብረንቦችን በማከራየት ሲጠቀም ኅብረንቦቹ የተፈለገው ዓላማ በሚቀመጡበት አካባቢ በሚኖሩ ሰዎ ችና በሚዘዋወሩ እንስሳት ላይ ጉዳት እንዳያደርሱ ጥንቃቄ ማድረግ አለበት፡፡ 4. የንብ ሀብት አጠባበቅ 1/ ማንኛውም አናቢ በሥራው ሂደት የንብ ሀብቱን የመንከባከብና የመጠበቅ ኃላፊነት አለበት፡፡ 2/ በደን ለበስ አካባቢ፣ በየቋጥኙ ወይም በየዋሻው የሚኖሩ ኅብረንቦች የሚያዘ ጋጁትን ማር በአደን የሚሰበስብ ማንኛ ውም ሰው በንቦቹና በተፈጥሮ ሀብቱ ላይ ጉዳት ሳያደርስ መሰብሰብ አለበት፡፡ 3/ የሀገር ውስጥ የንብ ዝርያዎችን ከተዛ ማች የንብ በሽታዎች ለመከላከል፡ ሀ/ ሕይወት ያላቸው የንብ ዝርያዎችን ወይም ያገለገሉ የማናቢያ ወይም የማቀነባበሪያ መሣሪያዎችን ወይም ቁሳቁሶችን ወደአገር ውስጥ ማስገ ባት የተከለከለ ነው፤ b) when transporting honeybee colonies, make sure that containers are covered with light mesh wire sheets or woven fabric seal that allows air into the containers and not take a pause on the way or come to a halt at locations of human and animal traffic areas so as to avoid accidental bee sting attack against persons or animals; and c) attach distinctive mark on his hives. 7/ Any person may bait and make use of swarming honeybees; provided however, that he may have no title right where the rightful beekeeper is the first to promptly trace and arrive at the location where the swarms which evacuated the hives are landing. 8/ Any beekeeper who leases colonies of honeybees for pollination services shall, when placing the colonies of bees for the anticipated purpose, ensure that care has been taken to prevent accidental bee sting attack against local community members of animals in transit. 4. Apiculture Resources Protection 1/ Any beekeeper shall, in the course of his operations, protect and conserve the apiculture resources. 2/ Any person who practices honey hunting from forest, rock or cave nested honeybee colonies shall keep the removal of honey without causing any damage on the honeybee colonies and natural resource ecology of the area. 3/ To protect indigenous honeybee species from communicable honeybee diseases: a) importation of live bee species or used beekeeping or processing equipment or materials shall be prohibited; 5¹þ1)!2 gA ØÁ‰L ነU¶T Uz¤È qÜ R 6 ታሀማሥ 05 qqqN 2ሺ2 ›.M Federal Negarit Gazeta No. 6 24th December, 2009 …. page 5123 ለ/ ጥሬ ማር፣ ሰም ወይም ማንኛውም የንብ ውጤት ወደ አገር ውስጥ በሚገ ባበት ጊዜ በላኪው አገር አግባብ ያለው አካል የተፈረመ የጤናማነት የምስክር ወረቀት ተያይዞ መቅረብ አለበት፤ ሐ/ ወደ አገር ውስጥ በትራንዚትነት የሚገባ ያገለገለ የማናቢያ መሣሪያ ታሽጎ የሚያልፍ መሆኑ የታወቀ ካልሆነ በስተቀር የጤናማነት ምር መራ የምስክር ወረቀት ሊጠየቅበት ወይም የጤናማነት ምርመራ ሊደረግበት ይችላል፡፡ 4/ ፈቃድ ያለው የንግሥት ንብ ርቢ የሚ ያካሂድ ሰው ካልሆነ በስተቀር ለልማ ትም ሆነ ለምርምር ሥራ ሕይወት ያላቸውን ንቦች ወደውጭ ለመላክ አይፈቀድም፡፡ 5/ ማንኛውም የሰብል ጥበቃ የሚያካሂድ ሰው በፀረ-ሰብል ተባይ መከላከያ ኬሚ ካሎች ያለአግባብ አጠቃቀም ምክንያት ንቦች እንዳይመረዙና እንዳያልቁ ተገ ቢውን ጥንቃቄ የማድረግ ኃላፊነት አለበት፡፡ 6/ ማንኛውም ሰው ሆነ ብሎም ሆነ በቸልተኝነት በኅብረንቦች ላይ እሳት ቃጠሎ እንዲነሳ ማድረግ የለበትም፡፡ 5. የማናቢያ መሣሪያዎች አያያዝ የማናቢያ መሣሪያዎችና ተዛማጅ ቁሳቁሶች ከኬሚካሎች ነፃ በሆነ መጋዘን የተከማቹ መሆን አለባቸው፡፡ 6. የመረጃ ልውውጥ 1/ ጉዳዩ የሚመለከታቸው የክልል አካላት የንብ ሀብት መረጃዎችን በመሰብሰብና በማጠናቀር ለሚኒስቴሩ ይልካሉ፡፡ 2/ ሚኒስቴሩ ከተለያዩ ምንጮች ስለንብ ሀብት የሚሰበስባቸውን መረጃዎችና የምርምር ውጤቶች በመገምገመና በማዘጋጀት ለክልሎችና ለሌሎች ተጠቃሚዎች እንዲደርሱ ያደርጋል፡፡ b) importation of raw honey, beeswax or other bee product shall be accompanied by hygiene inspection certificate signed by the appropriate authority of the country of origin; c) hygiene certification may be requested or inspection may be required on any used beekeeping equipment in transit to the country unless the packaging requirement is recognized. 4/ Unless licensed for queen bee rearing activity, no person shall be allowed to export live honeybees for development or research purposes. 5/ Any person engaged in crop protection undertakings shall have the responsibility to take proper precaution to avoid poisoning fatalities that may occur on honeybees due to improper use of pesticide chemicals. 6/ No person shall set fire against colonies of honeybees either intentionally or due to negligence. 5. Handling of Beekeeping Equipment Beekeeping equipment and accessory material inventories shall be kept in warehouses free from chemical exposures. 6. Information Exchange 1/ Concerned state bodies shall collect, compile and send apiculture data and information to the Ministry. 2/ The Ministry shall make apiculture data and information and research findings compiled from various sources and their assessment outcomes available to states and other users. 5¹þ1)!3 gA ØÁ‰L ነU¶T Uz¤È qÜ R 6 ታሀማሥ 05 qqqN 2ሺ2 ›.M Federal Negarit Gazeta No. 6 24th December, 2009 …. page 5124 7. የንብ ሀብት ልማት ተቆጣጣሪ 1/ በሚኒስቴሩ ወይም አግባብ ባለው የክልል አካል የተመደበ የንብ ሀብት ልማት ተቆጣጣሪ፡ ሀ/ የዚህ አዋጅ ድንጋጌዎችና በአዋጁ መሠረት የወጡ ደንቦችንና መመ ሪያዎችን መከበራቸውን ለማረጋ ገጥ ወደ ማንኛውም አናቢ የሥራ ቦታ በሥራ ሰዓት በመግባት የማና ቢያ መሣሪያዎችንና የአስተናነብ ሁኔታን የማየትና የመገምገም፣ ለ/ ማንኛውም አናቢ ከሥራው ጋር የተያያዙ መረጃዎችን እንዲሰጠው የመጠየቅ፣ እና ሐ/ የቁጥጥር ተግባሩን ሲያከናውን ያገኛቸውን ይህን አዋጅ በሚተ ላለፉ ሰዎች ላይ ክስ ለመመስረት የሚያስችሉ መረጃዎችን ለሚመለ ከተው አካል የማስተላለፍ፣ ሥልጣን እና ተግባር ይኖረዋል፡፡ 2// ማንኛውም አናቢ ለንብ ሀብት ልማት ተቆጣጣሪ መረጃ በመስጠትና ለቁጥጥር ሥራው ክንውን ሁኔታዎችን በማመቻቸት የመተባበር ግዴታ አለበት፡፡ 8. ቅ ጣ ት በወንጀል ሕጉ የበለጠ የሚያስቀጣ ካልሆነ በስተቀር፡ 1/ ማንም ሰው ሥልጣን ከተሰጠው አካል የጽሑፍ ፈቃድ ሳይዝ አንዲያገግሙ በተከለሉ ቦታዎች፣ በማኅበራት ደን፣ በመንግሥት ደን ወይም በዱር እንስሳት ፓርክና ጥብቅ ቦታ በንግድ ልማት ላይ የተሰማራ ወይም የንግድ ፈቃድ ሳይዝ የንግድ ልማት ወይም የንግድ ንግሥት ንብ ርቢ ያካሄደ ከብር 2ሺ እስከ 5ሺ ብር በሚደርስ የገንዘብ መቀጮ ወይም አንድ ዓመት በሚሆን እሥራት ወይም በሁለቱም ይቀጣል፡፡ 7. Apiculture Resources Development Inspectors 1/ Any apiculture resources development inspector assigned by the Ministry or the appropriate state organ shall have the powers and duties to: a) enter, during working hours, the premises of a beekeeper and undertake inspection and assessment of beekeeping equipment and beekeeping practices to ensure compliance with the provisions of this Proclamation and regulations and directives issued hereunder; b) request any beekeeper to furnish any information related to his operations; and c) submit, to the appropriate body, evidences gathered in the course of carrying out inspections and are relevant for prosecuting violations of the provisions of this Proclamation 2/ Any beekeeper shall have the duty to cooperate with the apiculture resources development inspector in providing information and facilitating the conduct of inspection. 8. Penalty Unless it requires higher penalty under the criminal law: 1/ Any person who undertakes commercial beekeeping or queen rearing or who found in act of without written permit from supervising authority in rehabilitation area closure or community forest or state forest or wildlife parks and reserve areas is punishable with a fine from Birr 2,000 to Birr5,000 or imprisonment up to one year or both. 5¹þ1)!4 gA ØÁ‰L ነU¶T Uz¤È qÜ R 6 ታሀማሥ 05 qqqN 2ሺ2 ›.M Federal Negarit Gazeta No. 6 24th December, 2009 …. page 5125 2/ የንብ ሀብት ልማትና ጥበቃ መረጃዎችን በአግባቡ የያዘና ሲጠየቅም ለመስጠት ፈቃደኛ ያልሆነ ኅብረንቦችን በጠቅጣቃ ሽቦ ወይም በካኪ ጨርቅ ሳይሸፍን ያጓጓዘና የሰውና እንስሳት ዝውውር በሚበዛበት ቦታ ያቆመ ማንም ሰው ከብር 1ሺ5) እስከ ብር 3ሺ በሚደርስ የገንዘብ መቀጮ ወይም ከስድስት ወር እስከ አንድ ዓመት በሚሆን እሥራት ወይም በሁለቱም ይቀጣል፡፡ 3/ የንብ ሀብት ልማት ለማካሄድ ሲል በተፈጥሮ ሀብት ላይ ጉዳት የሚያደርስ፣ ወይም በንቦች ላይ የንብ በሽታ ለማስተላለፍ ምክንያት የሚሆን ወይም አላግባብ በሆነ የፀረ-ሰብል ተባይ መከላከያ ኬሚካል አጠቃቀም ምክንያት በንቦች እና በንብ ውጤቶች ላይ ጉዳት የሚያደርስ ወይም በማር አደን ወቅት በኅብረንቦች ላይ የእሳት ቃጠሎ የሚያደርስ ከብር 5ሺ እስከ ብር 0ሺ በሚደርስ የገንዘብ መቀጮ ወይም ከሦስት ዓመት እስከ ሰባት ዓመት በሚሆን እሥራት ወይም በሁለቱም ይቀጣል፡፡ 4/ የንብ ሀብት ልማት ተቆጣጣሪው ሥራውን እንዳይሰራ ከአሰናከለ ከአስፈራራ ወይም ጉዳት ከአደረሰ ከብር 2ሺ እስከ 5ሺ ብር በሚደርስ የገንዘብ መቀጮ ወይም ከሁለት እስከ አምስት ዓመት በሚሆን እሥራት ወይም በሁለቱም ይቀጣል፡፡ 5/ ማንም የተከለሰ ወይም የተበከለ ወይም የተመረዘ የንብ ውጤት ሲያቀነባብርና ሲያጓጉዝ ከተገኘ ወይም ለኅብረተሰቡ ከሸጠ ወይም ከሰጠ ከብር 0ሺ እስከ 05ሺ ብር በሚደርስ የገንዘብ መቀጮ ወይም ከአምስት አስከ አሥር ዓመት በሚሆን እሥራት ወይም በሁለቱም ይቀጣል፡፡ 6/ ማንም ሰው ያለፈቃድ ወይም ከተሰጠው ፈቃድ ተቃራኒ ከሆነ ሁኔታ ሕይወት ያለው የንብ ዝርያ፣ የንብ ዘር፣ ያገለገሉ የማናቢያ መሣሪያዎችና ቁሳቁሶች ከውጭ ከአስገባ፤ ከአገር ደግሞ የንብ ዘሮችን ወደ ውጭ አገር ከአስወጣ ወይም ለማስወጣት ከሞከረ ከብር 05ሺ እስከ !ሺ ብር በሚደርስ የገንዘብ መቀጮ ወይም ከአሥር እስከ አሥራአምስት ዓመት በሚሆን እሥራት ወይም በሁለቱም ይቀጣል፡፡ 2/ Any person who exercise improper handling of data and information on activities related to beekeeping and processing and discourages furnishing of data and information when requested or transport honeybee colonies without covering with mesh wire or kaki fabric and take a stop at locations of human and animal traffic areas is punishable with a fine from Birr 1,500 to Birr 3,000 or imprisonment from six months up to one year or both. 3/ Any person who commits hazard on natural habitat while operating beekeeping or cause to spread honeybee diseases to healthy colonies or induce harm on beekeeping and bee products due to improper use of pesticides or cause damage on the honeybee colonies and ecology of the area due to fire hazard while honey hunting is punishable with a fine from Birr 5,000 to Birr 10,000 or imprisonment from three up to seven years or both. 4/ Any person who defy, threatens or put in danger the supervising authority is punishable with a fine from Birr 2,000 to Birr 5,000 or imprisonment from two up to five years or both. 5/ Any person who found in act of processing, transporting or market supplying to the market place or consumer market sale or transfer of adulterated, contaminated or poisoned bee products is punishable with a fine from Birr 10,000 to Birr 15,000 or imprisonment from five up to ten years or both 6/ Any person who imports or exports or attempts to import or export live bee species or honeybee races or used beekeeping equipment or goods without the operating permits or contrary to the conditions thereof, or any person who commits or attempts any honeybee races smuggling is punishable with a fine from Birr 15,000 to Birr 20,000 or imprisonment from ten up to fifteen years or both. 5¹þ1)!5 gA ØÁ‰L ነU¶T Uz¤È qÜ R 6 ታሀማሥ 05 qqqN 2ሺ2 ›.M Federal Negarit Gazeta No. 6 24th December, 2009 …. page 5126 7/ ማንም ሰው ይኸንን አዋጅና በዚህ አዋጅ መሠረት የሚወጡ ደንቦችንና መመሪያዎችን ከተላለፈ ወይም አፈጻጸ ማቸውን ያደናቀፈ እስከ አምስት ዓመት በሚሆን እሥራት ወይም በሁለቱም ይቀጣል፡፡ 9. ደንብና መመሪያ የማውጣት ሥልጣን 1/ የሚኒስትሮች ምክር ቤት ይህን አዋጅ ለማስፈጸም የሚያስፈልጉ ደንቦችን ሊያወጣ ይችላል፡፡ 2/ ይህን አዋጅና በዚህ አንቀጽ ንዑስ አንቀጽ /1/ መሠረት የወጡ ደንቦችን ለማስፈጸም የሚያስፈልጉ መመሪያዎችን ሚኒስቴሩ ሊያወጣ ይችላል፡፡ 0. ተፈጻሚነት ስለማይኖራቸው ሕጎች ይህን አዋጅ የሚቃረን ማንኛውም ሕግ፣ ደንብ፣ መመሪያ ወይም የተለመደ አሰራር በዚህ አዋጅ ውስጥ በተመለከቱት ጉዳዮች ላይ ተፈጻሚነት አይኖረውም፡፡ 01. አዋጁ የሚፀናበት ጊዜ ይህ አዋጅ በፌዴራል ነጋሪት ጋዜጣ ታትሞ ከወጣበት ቀን ጀምሮ የጸና ይሆናል፡፡ አዲስ አበባ ታህሣሥ 05 ቀን 2ሺ2 ዓ.ም GR¥ wLdgþ×RgþS yxþT×eà ØÁ‰§êE ÄþäK‰sþÃêE ¶pBlþK PÊzþÄNT 7/ Any person who violates the provisions of this Proclamation or any regulations and directives to be issued according to this Proclamation or causes any obstruction in the implementation process is punishable with imprisonment up to five years. 9. Power to issue Regulation and Directives 1/ The Council of Ministers may issue regulations necessary for the implementation of this Proclamation. 2/ The Ministry may issue directives necessary for the implementation of this Proclamation and regulations issued pursuant to sub-article (1) of this Article. 10. Inapplicable Laws No law, regulations, directives or customary practices shall, in so far as they are inconsistent with this Proclamation, be applicable with respect to matters provided for by this Proclamation. 11. Effective Date This Proclamation shall enter into force up on the date of publication in the Federal Negarit Gazeta.
