Box ደንብ ቁጥር 91/2004 ዓ.ም በአማራ ብሔራዊ ክልላዊ መንግስት የመንግስት ግዥና ንብረት ማስወገድ አገልግሎትን ለማቋቋም የወጣ ክልል መስተዳድር ምክር ቤት ደንብ Regulation No. 91/2012 A COUNCIL OF REGIONAL GOVERNMENT REGULATION ISSUED FOR THE ESTABLISHMENT OF PUBLIC PROCUREMENT AND PROPERTY DISPOSAL SERVICE IN THE AMHARA NATIONAL REGIONAL STATE ባህር ዳር ጥር 18 ቀን 2004 ዓ.ም Bahir Dar 27 th Jan, 2012 17ኛ አመት ቁጥር 4 17 th Year No. 4 14 th Year No 16 www.abyssinialaw.com ገፅ-2- ዝክረ-ሕግ ጋዜጣ ቁጥር 4 ጥር 18 ቀን 2004 ዓ.ም Zikre-Hig Gazette No.4 27th Day of January 2012 Page -2 የመንግስት ግዥ በተለያዩ መስሪያ ቤቶች በተበታተነ መንገድ በመፈፀሙ ምክንያት የሚባክነዉን ጊዜና ወጪ መቆጠብ እና የግዥ አገልግሎት ስራን በጥቂት የሰዉ ኃይል በመሥራት ዉጤታማ የሰዉ ኃይል አጠቃቀም እንዲኖር ማስቻል በመታመኑ፤ WHEREAS, it is believed that enabling the existence of effective utilization of man power through saving the wastage of time and expense and performing the activity of procurement service with a small amount of man power due to public procurement which has so far been exercised by various offices in a dispersed manner; አገልግሎቱ የግዥ ህጉንና ሂደቱን ጠንቅቀዉ በሚያዉቁ ባለሙያዎች ግዥ እንዲፈፀም ዕድል ስለሚሰጥ፣ ግዥ በዕቅድ እንዲመራ ስለሚረዳና ግልጽ ጨረታን በማበረታታት የተሻለ ብቃትና አቅም ያላቸዉን አቅራቢዎች ስለሚጋብዝ፤ እንዲሁም የግዥ አፈፃፀም መረጃን በአንድ ቦታ በቀላሉ ማግኘት የሚያስችል በመሆኑ እና በወል የሚፈለጉ ዕቃና አገልግሎቶች ስታንዳርድ እንዲኖር በማድረግ ለመስሪያ ቤቶች የሚገዙ ዕቃዎችና አገልግሎቶች አንድ ወጥና ተመሳሳይ እንዲሆኑ ስለሚያስችል፤ WHEREAS, the service enables to render the opportunity for the procurement to be executed by professionals who are adequately knowledgeable with the law and the process of purchasing, helps the procurement to be managed by plan, invites suppliers with better efficiency and capacity through encouraging open tender, facilities the easy availability of information as to the execution of procurement in one place and causes the goods and services to be purchased for offices to be similar and consistent by realizing the existence of standard for commonly demanded goods and services; የመንግስት መስሪያ ቤቶች ንብረቶች ሊወገዱ የሚገባበትን መንገድ ስርአት ባለዉ መልኩ በመምራት ይባክን የነበረዉን ሀብት በማዳን የመንግስትን ጥቅም ማስጠበቅ አስፈላጊ በመሆኑ፤ WHEREAS, it is necessary to protect the interest of the Government by taking care of the public bodies property that would otherwise have been in loss through managing the process of its disposal in a systematic way; የአማራ ብሔራዊ ክልላዊ መንግሥት መስተዳድር ምክር ቤት በተሻሻለዉ የክልሉ ህገ መንግስት አንቀጽ 58 ንዑሰ አንቀጽ(7) እና በመንግስት ግዥና ንብረት አስተዳደር አዋጅ ቁጥር 179/2003 ዓ.ም አንቀጽ 47 ንዑሰ አንቀጽ(1) በተሰጠዉ ስልጣን መሰረት ይህን ደንብ አዉጥቷል፡፡ NOW, THEREFORE, the Council of the Amhara National Regional Government, pursuant to the powers vested in it under the provisions of Art.58 Sub-Art./7/ of the Revised Regional Constitution and Art. 47 Sub-Art./1/ of the Public Procurement and Property Administration Proclamation No 179/2011, hereby issues this regulation as follows. www.abyssinialaw.com ገፅ-3- ዝክረ-ሕግ ጋዜጣ ቁጥር 4 ጥር 18 ቀን 2004 ዓ.ም Zikre-Hig Gazette No.4 27th Day of January 2012 Page -3 ክፍል አንድ PART ONE ጠቅላላ GENERAL 1. አጭር ርዕስ 1. Short Title ይህ ደንብ “በአማራ ብሔራዊ ክልላዊ መንግስት የመንግስት ግዥና ንብረት ማስወገድ አገልግሎት ማቋቋሚያ ክልል መስተዳድር ምክር ቤት ደንብ ቁጥር 91/2004” ተብሎ ሊጠቀስ ይችላል፡፡ This regulation may be cited as the “Amhara National Regional State Public Procurement and Property Disposal Service Establishment, Council of the Regional Government Regulation No. 91/2012”. 2. ትርጓሜ 2. Definitions 1. የቃሉ አገባብ ሌላ ትርጉም ካላሰጠዉ በስተቀር በዚህ ደንብ ዉስጥ፡ 1. Unless the context requires otherwise, in this regulation:  “አዋጅ” ማለት በአማራ ብሔራዊ ክልላዊ መንግስት የመንግስት ግዥና ንብረት አስተዳደር አዋጅ ቁጥር 179/2003 ዓ.ም ነዉ፡፡ a) “Proclamation ” shall mean the Amhara National Regional State Public Procurement and Property Administration Proclamation No. 179/2011; ለ. “ቢሮ” ማለት የአማራ ብሄራዊ ክልላዊ መንግስት ገንዘብና ኢኮኖሚ ልማት ቢሮ ነዉ፡፡ b) “Bureau” shall mean the Amhara National Regional State Finance and Economic Development Bureau; 2. በአዋጁ አንቀጽ ሁለት ስር የተሰጡ ትርጓሜዎች ተፈፃሚ ይሆናሉ፡፡ 2. The definitions provided for under Article 2 of the Proclamation shall be applicable; 3. መቋቋም 3. Establishment 1. የመንግስት ግዥና ንብረት ማስወገድ አገልግሎት (ከዚህ በኋላ “አገልግሎቱ” እየተባለ የሚጠራ) ራሱን የቻለና ህጋዊ ሰዉነት ያለዉ የክልሉ የመንግስት መሥሪያ ቤት ሆኖ በዚህ ደንብ ተቋቁሟል፡፡ 1. There is hereby established, the Public Procurement and Property Disposal Service, hereinafter referred to as the “Service” as the Regional government office, having its own autonomy and legal personality, as per this regulation; 2. የአገልግሎቱ ተጠሪነት ለቢሮው ይሆናል፡፡ 2. Objectives አገልግሎቱ የሚከተሉት ዓላማዎች ይኖሩታል፡- The service shall have the following objectives: 1. የመንግስት መስሪያ ቤቶች የሚጠቀሙባቸዉ ተመሳሳይ ዕቃዎችና አገልግሎቶች እንዲሁም አገራዊ ስትራቴጃዊ ጠቀሜታ ያላቸዉ ዕቃዎችና አገልግሎቶች ከከፍተኛ ግዥ የሚገኘዉን ኢኮኖሚያዊ ጠቀሜታ በሚያስገኝ ተመጣጣኝ ዋጋ፣ በተገቢዉ ጊዜና በተፈላጊዉ ጥራት እንዲቀርቡ ማስቻል፣ 1. To enable the timely provision of goods and services which are commonly used by public bodies as well as those goods and services of similar nature and having national strategic significance in the desired quality and at fair prices attributable to the economies of scale resulting from block purchase; 2. ቢሮዉ በሚያወጣዉ መመሪያ መሰረት ከሚወሰነዉ የእቃዎች የመነሻ ዋጋ ግምት በላይ የሆኑና በሽያጭ እንዲወገዱ ዉሣኔ የተሰጠባቸዉ የመንግስት መሥሪያ ቤቶች ንብረቶች በተቀናጀና በተቀላጠፈ አኳኋን በተመጣጣኝ ዋጋ እንዲወገዱ ማስቻል፣ 2. To enable the disposal of properties belonging to public bodies, whose price is more than the estimated initial price of the goods to be decided pursuant to the directive of the bureau and the disposal of which decided upon through sale, in an integrated and expeditious manner against reasonable price; 3. ለመንግስት የልማት ድርጅቶች በዕቃና አገልግሎት ግዥ እንዲሁም በንብረት ማስወገድ ረገድ እገዛ ማድረግ፤ 3. To assist public developmental enterprises with regard to the procurement of goods and services as well as the disposal of property. 5. ዋና መስሪያ ቤት 5. Head Office የአገልግሎቱ ዋና መሥሪያ ቤት በባህርዳር ከተማ ሲሆን እንደአስፈላጊነቱ በሌሎች ሥፍራዎች ቅርንጫፍ ጽ/ቤቶችን ሊያቋቁም ይችላል፡፡ The service shall have its head office in the city of Bahir Dar; provided, however, that it may establish branch offices in other places, as may be necessary. www.abyssinialaw.com ገፅ-5- ዝክረ-ሕግ ጋዜጣ ቁጥር 4 ጥር 18 ቀን 2004 ዓ.ም Zikre-Hig Gazette No.4 27th Day of January 2012 Page -5 ክፍል ሁለት PART TWO ስለአገልግሎቱ አቋም፣ ስልጣንና ተግባራት STATUS, POWERS AND DUTIES OF THE SERVICE 6. አቋም 6. Status አገልግሎቱ፡- The service shall have: 1. የስራ አመራር ቦርድ፤ 1. A Board of Management; 2. በክልሉ ርዕሰ መስተዳደር የሚሾም አንድ ሥራ አስኪያጅና አንድ ምክትል ስራ አስኪያጅ፤ 2. A director general and deputy director general to be appointed by the head of the regional government; 3. ሌሎች በየደረጃዉ ለስራዉ የሚያስፈልጉ ኃላፊዎችና ሠራተኞች ይኖሩታል፡፡ 3. Other heads and employees necessary for the tasks at various levels. 7. የአገልግሎቱ ሥልጣንና ተግባር 7. Powers and Duties of the Service 1. አገልግሎቱ የሚከተሉት ስልጣንና ተግባራት ይኖሩታል፡ 1. The service shall have the following powers and duties: ሀ) ዝርዝራቸዉ በቢሮዉ መመሪያ የሚወሰን የመንግስት መ/ቤቶች የሚጠቀሙባቸዉን ተመሳሳይ ዕቃዎችና አገልግሎቶች እንዲሁም አገራዊ ስትራቴጃዊ ጠቀሜታ ያላቸዉን ዕቃዎችና አገልግሎቶች ግዥ ያከናዉናል፤ a) Carryout the procurement of goods and services falling within the list of common user items for those public bodies as well as goods and services having national strategic significance, as may be determined by the directive of the Bureau; ለ) ግምታቸዉ በቢሮዉ መመሪያ ከሚወሰነዉ የገንዘብ መጠን በላይ የሆነና በመንግስት መሥሪያ ቤቶች ኃላፊነት ሥር ያሉ በሽያጭ እንዲወገዱ ዉሣኔ የተሰጠባቸዉን ንብረቶች ይሸጣል፤ b) Conduct the sale of public properties, the monetary values of which exceed the amount specified by directive of the bureau, due to be disposed pursuant to the decision of the public bodies in possession of such properties; ሐ) በዚህ ንዑስ አንቀጽ ፊደል ተራ ቁጥሮች (ሀ) ና (ለ) የተደነገገዉ እንደተጠበቀ ሆኖ፣ ለማንኛዉም የመንግስት መስሪያ ቤቶች፣ እንዲሁም ጥያቄ ሲቀርብለት ለመንግስት የልማት ድርጅቶች እና ለግሉ ዘርፍ፡ c) Without prejudice to the provision of letter numbers (a) and (b) of this Sub Article hereof, it shall render: www.abyssinialaw.com ገፅ-6- ዝክረ-ሕግ ጋዜጣ ቁጥር 4 ጥር 18 ቀን 2004 ዓ.ም Zikre-Hig Gazette No.4 27th Day of January 2012 Page -6 1) በወቅታዊ የገበያ መረጃ ላይ የተመሰረተ የአገር ዉስጥና የዓለም አቀፍ የግዥ አገልግሎቶችን ይሰጣል፣ 1) Domestic and international procurement service based on current market information; 2) የግዥ አፈፃፀምን የሚመለከት የምክርና ሥልጠና አገልግሎት ይሰጣል፡፡ 2) Consultancy and training services regarding the execution of procurement; to every public bodies as well as, up on request, to public developmental enterprises and the private sector. 2. አገልግሎቱ በዚህ አንቀጽ ንዑስ አንቀጽ /1/ ፊደል ተራ ቁጥሮች (ሀ) እና (ለ) የተመለከቱትን ሥልጣንና ተግባሮችን በሥራ ላይ ሲያዉል፡ 2. In carrying out the public procurement and disposal of public property pursuant to letter numbers /a/ and /b/ of Sub Art. /1/ of this article hereof, the service shall: ሀ) የመንግስት ግዥውና ንብረት የማስወገዱ ተግባር በአዋጁና አዋጁን ለማስፈፀም በወጡ ደንቦችና መመሪያዎች መሰረት መፈጸሙን ያረጋግጣል፤ a) Ensure that the duty of public procurement and property disposal is executed in accordance with the Proclamation, regulations and directives issued for the implementation of the Proclamation; ለ) የመንግስት መ/ቤቶች የሚጠቀሙባቸዉን ተመሳሳይ ዕቃዎችና አገልግሎቶች የአገር ዉስጥ ግዥ ሂደት አጠናቆ የማዕቀፍ ስምምነት በመፈራረም ይህንኑ የመንግስት መሥሪያ ቤቶች እንዲያዉቁት ያደርጋል፡፡ b) Complete the procurement procedures for domestic procurement of goods and services which are common user items to public bodies, enter into a frame work contract and notify same to the public bodies; ሐ) የመንግስት መ/ቤቶች የሚጠቀሙባቸዉን ተመሳሳይ ዕቃዎችና አገልግሎቶች ዓለም አቀፍ ግዥ እንዲሁም አገራዊ ስትራቴጃዊ ጠቀሜታ ያላቸዉን ዕቃዎችና አገልግሎቶች ግዥ ሂደት በማጠናቀቅ ዕቃዎቹና አገልግሎቶቹ ለተጠቃሚ አካላቱ እንዲደርሱ ያደርጋል፤ c) Carryout international procurement of goods and services which are common user items to public bodies and procurement of goods and services which have national strategic significance and effect delivery of such goods and services to the user entities; www.abyssinialaw.com ገፅ-7- ዝክረ-ሕግ ጋዜጣ ቁጥር 4 ጥር 18 ቀን 2004 ዓ.ም Zikre-Hig Gazette No.4 27th Day of January 2012 Page -7 መ) ልዩ ሙያዊ እዉቀት በሚያስፈልጋቸዉ ጉዳዮች ረገድ ይህንኑ አግባብ ካላቸዉ መንግስታዊ ተቋማት ሊጠይቅ ይችላል፡፡ d) Request for professional support from appropriate governmental institutions on matters that require special expertise. 8. ስለቦርዱ አባላት 8. Membership of the Board 1. ቦርዱ ሰብሳቢዉን ጨምሮ ከ5-7 የሚደርሱ አባላት ይኖሩታል፤ 1. The board shall, including the chairperson, have members ranging from 5 through 7. 2. የአገልግሎቱ ሥራ አስኪያጅ የቦርዱ አስረጅ በመሆን ይሰራል፤ 2. The manager of the Service shall act in the capacity of an expert for the board. 3. ቦርዱ የራሱን ፀሐፊ ይሰይማል፤ 3. The board shall designate its own secretary. 4. የቦርዱ ሰብሳቢና አባላት በቢሮዉ አቅራቢነት በክልሉ ርዕሰ መስተዳድር የሚሰየሙ ይሆናሉ፡፡ 4. The chairperson and members of the board shall be designated by the head of the regional government upon their nomination by the Bureau. 5. የቦርዱ ሰብሳቢና አባላት ተጠሪነታቸዉ ለቢሮዉ ይሆናል፡፡ 5. The accountability of the chairperson and members of the board shall be to the Bureau. 6. የቦርድ አባላት የስራ ዘመን ሶስት አመት ሆኖ እንደ አስፈላጊነቱ ለተጨማሪ ሶስት ዓመት ሊራዘም ይችላል፡፡ 6. The tenure of the board members shall be three years; provided, however, that it may be extended for an additional term of three years, as deemed necessary. 9. የቦርዱ ስልጣንና ተግባር 9. Powers and Duties of the Board ቦርዱ የሚከተሉት ሥልጣንና ተግባራት ይኖሩታል፡ The board shall have the following powers and duties: 1. አገልግሎቱን በበላይነት ይመራል፣ ይቆጣጠራል 1. Direct over and supervise the Service; 2. የአገልግሎቱን ረቂቅ ስትራቴጅዎችና የአፈፃፀም መመሪያዎች መርምሮ ያፀድቃል፣ በሥራ ላይ መዋላቸዉን ይከታተላል፤ 2. Examine and approve the draft strategies and operational directives of the Service; and follow-up the implementation of same; 3. በዚህ ደንብ አንቀጽ 6 ንዑስ አንቀጽ/1/(ሀ) መሰረት የሚፈጸሙ ከፍተኛ ግዥዎችን መርምሮ ያጸድቃል፤ 3. Review and approve the higher procurements performed pursuant to Art. 6 Sub-Art./1/ (a) of this Regulation; 4. የአገልግሎቱን ዓመታዊ የስራ ፕሮግራምና በጀት መርምሮ ለቢሮዉ ያቀርባል፤ ሲፀድቅም በስራ ላይ መዋሉን ያረጋግጣል፤ 4. Review and submit the annual work program and budget of the Service to the bureau as well as ensure the implementation of same upon approval thereof; www.abyssinialaw.com ገፅ-8- ዝክረ-ሕግ ጋዜጣ ቁጥር 4 ጥር 18 ቀን 2004 ዓ.ም Zikre-Hig Gazette No.4 27th Day of January 2012 Page -8 5. የአገልግሎቱን ዓመታዊ የሂሳብ ሪፖርት ያፀድቃል፤ የዉጭ ኦዲተሮችን ሪፖርት ይሰማል፤ በኦዲት ሪፖርቱ መሰረት አስፈላጊዉ የእርምት እርምጃ መወሰዱን ያረጋግጣል፤ 5. Approve the annual financial report of the Service, hear the report of external auditors and ensure that the appropriate corrective measure is taken on the basis of such reports; 6. አገልግሎቱ የሚያስከፍለዉን የአገልግሎት ክፍያ መጠን ለክልሉ መስተዳድር ምክር ቤት አቅርቦ ያስወስናል፤ ተግባራዊ መሆኑንም ያረጋግጣል፤ 6. Submit to and have the amount of service charge of the Service decided by the Council of the Regional Government as well as ensure its implementation thereof; 7. አስፈላጊ ሆኖ ሲያገኘዉ አማካሪ ኮሚቴዎችን ያቋቁማል፡፡ 7. Form advisory committees, as deemed necessary. 10. ስለቦርዱ ስብሰባና የዉሳኔ አሰጣጥ ስነ-ሥርዓት 10. Meeting and Decision Making Procedure of the Board 1. ቦርዱ በሦስት ወር አንድ ጊዜ ይሰበሰባል፤ ሆኖም አስፈላጊ ሆኖ ሲገኝ በሰብሳቢዉ ጥሪ በማናቸዉም ጊዜ ሊሰበሰብ ይችላል፡፡ 1. The Board shall convene its meeting once in there months. It may, however, hold a meeting at the call of the chairperson, as deemed necessary. 2. በቦርዱ ስብሰባ ላይ ከግማሽ በላይ አባላት ከተገኙ ምልዓተ ጉባኤ ይሆናል፡፡ 2. There shall be a quorum where more than half of its members are present at a meeting of the Board. 3. የቦርዱ ዉሣኔ የሚተላለፈዉ በስብሰባዉ ከተገኙ አባላት በአብዛኛዉ ድምፅ ሲደገፍ ይሆናል፤ ሆኖም ድምፁ እኩል ለኩል የተከፈለ እንደሆነ ሰብሳቢዉ ወሳኝ ድምፅ ይኖረዋል፡፡ 3. The decision of the Board shall pass where it is supported by the majority members present at the meeting. In case of a tie, however, the chairperson shall have a casting vote. 4. የዚህ አንቀጽ ድንጋጌዎች እንደተጠበቁ ሆኖ ቦርዱ የራሱን የስብሰባ ሥነ-ሥርዓት መመሪያ ሊያወጣ ይችላል፡፡ 4. Without prejudice to the provisions of this Article hereof, the Board may issue its own meeting procedural directive thereof. 11. የሥራ አስኪያጁ ሥልጣንና ተግባር 11. Powers and Duties of the Manager 1. የቦርዱ አጠቃላይ አመራር እንደተጠበቀ ሆኖ ስራ አስኪያጁ የአገልግሎቱ ዋና ሥራ አስፈፃሚ በመሆን የአገልግሎቱን ሥራዎች ይመራል፣ ያስተዳድራል፡፡ 1. Without prejudice to the generality stipulated under Sub Art./1/ of this Article hereof; the manager shall: ሀ) በዚህ ደንብ አንቀጽ /6/ ስር የተመለ ከቱትን የአገልግሎቱን ሥልጣንና ተግባራት በሥራ ላይ ያዉላል፤ a) Exercise the powers and duties of the Service provided for under Art. /6/ of this Regulation; ለ) የክልሉን ሲቪል ሰርቪስ ህጎች መሰረታዊ መርሆዎች ተከትሎ በመንግስት በሚጸድቅ መመሪያ መሰረት የአገልግሎቱን ሠራተኞች ይቀጥራል፣ ያስተዳድራል፤ b) Hire and administer the employees of the Service in accordance with a directive to be approved by the Government following the basic principles of the Regional Civil Service laws; ሐ)የአገልግሎቱን ረቂቅ ስትራቴጃዊ ዕቅድ፣ ዓመታዊ የስራ ፕሮግራምና በጀት አዘጋጅቶ ለቦርድ ያቀርባል፣ በመንግስት ሲፈቀድም በሥራ ላይ ያዉላል፤ c) Prepare and submit the draft strategic plan, annual work program and budget of the Service to the Board and implement same upon its approval by the Government; መ)ከሦስተኛ ወገኖች ጋር በሚያደርጋቸዉ ግንኙነቶች ሁሉ አገልግሎቱን ይወክላል፤ d) Represent the Service in all its dealings to be carried out with third parties; ሠ) ስለ አገልግሎቱ የስራ እንቅስቃሴ ወቅታዊ ሪፖርቶችን ለቦርዱ ያቀርባል፡፡ e) Submit periodic reports to the Board on the activities of the Service; ረ) በቦርዱ የሚሰጡትን ሌሎች ተዛማጅ ተግባራት ያከናዉናል፡፡ f) Carryout such other related activities as are referred to him by the Board. 3. ስራ አስኪያጁ ለአገልግሎቱ የስራ ቅልጥፍና በሚያስፈልግ መጠን ከሥልጣንና ተግባሩ በከፊል ለአገልግሎቱ ምክትል ስራ አስኪያጅና ለሌሎች ሠራተኞች በዉክልና ሊያስተላልፍ ይችላል፡፡ 3. The Manager may delegate part of his powers and duties to the Deputy Manager and other employees of the Service to the extent necessary for the efficient performance of the activities of the Service. www.abyssinialaw.com ገፅ-10- ዝክረ-ሕግ ጋዜጣ ቁጥር 4 ጥር 18 ቀን 2004 ዓ.ም Zikre-Hig Gazette No.4 27th Day of January 2012 Page -10 ክፍል ሦስት PART THREE ልዩ ልዩ ድንጋጌዎች MISCELANEOUS PROVISIONS 12. የአገልግሎቱ የበጀት ምንጭ የአገልግሎቱ በጀት ከሚከተሉት የሚመነጭ ይሆናል፡ 12. Budgetary Source of the Service The budget of the Service shall be generated from the following: 1. በመንግስት የሚመደብ በጀት 1. Budget to be allocated by the government. 2. ከሌሎች ምንጮች 2. Other sources. 13. ስለሂሳብ መዛግብት አያያዝና ምርመራ 13. Maintenance of Books of Account and Auditing 1. አገልግሎቱ ትክክለኛ የሆኑ የሂሳብ መዛግብትንና የሂሳብ ሰነዶችን ይይዛል፡፡ 1. The Service shall maintain accurate books and documents of account. 2. የአገልግሎቱ የሂሳብ መዛግብትና ገንዘብ ነክ ሰነዶች በየዓመቱ በክልሉ ዋና ኦዲተር መስሪያ ቤት ወይም እርሱ በሚሰይማቸዉ ኦዲተሮች ይመረመራሉ፡፡. 2. The books of account and financial related documents of the Service shall be audited annually by the Office of the Auditor General of the Regional State or those auditors designated by same. 14. ተፈፃሚነት ስለማይኖራቸው ሕጎች 14. Inapplicable Laws ይህንን ደንብ የሚቃረን ማናቸዉም ሌላ ደንብ፣ መመሪያ ወይም የተለመደ አሰራር በዚህ ደንብ በተሸፈኑ ጉዳዮች ላይ ተፈፃሚነት አይኖረዉም፤ No other regulation, directive or customary practice inconsistent with this regulation shall be applicable with respect to matters covered for therein. 15. ደንቡ የሚፀናበት ጊዜ 15. Effective Date ይህ ደንብ በክልሉ ዝክረ ህግ ጋዜጣ ታትሞ ከወጣበት ቀን ጀምሮ የፀና ይሆናል፡፡ This Regulation shall come into force as of the date of its publication on the Zikre-Hig Gazette of the Regional State. ባህርዳር Done at Bahir Dar ጥር 18 ቀን 2004 ዓ.ም.
