Short Title ይህ ደንብ “የአማራ ምርጥ ዘር ኢንተርፕራይዝ ማቋቋሚያ ደንብ ቁጥር 66 /2001 ዓ.ም” ተብሎ ሊጠቀስ ይችላል። This regulation may be cited as “The Amhara Seed Enterprise Establishment, Council of Regional Government Regulation No. 66/2009.” 2. ትርጓሜ፣ 2. Definition የቃሉ አግባብ ሌላ ትርጉም የሚሰጠው ካልሆነ በስተቀር በዚህ ደንብ ውስጥ፣ Unless the context otherwise requires, in this regulation: 1. “መንግሥት” ማለት የአማራ ብሔራዊ ክልላዊ መንግሥት ነው፣ 1. “Government” means the Amhara National Regional Government. 2. “ዘር” ማለት እውነተኛ ዘር፣ሥር፣ ቁርጥራጭ፣ ችግኝ፣ የእህል ዘሮች፣ የእንስሳት መኖ፣ የአትክልት ወይም የተለያየ የችግኝ ዘሮች ለማባዛት የሚረዱ ማለት ነው። 2. “Seed” means seed that helps to multiply genuine seed, roots, cuttings, seedling, cereal seeds, animal forage, seeds of vegetables or various seedlings. 3. "እናት ዘር" ማለት አዲስ በምርምር የወጣ የእህል ዘር ዓይነትና በግብርና ምርምር ክትትል የሚባዛ ማለት ነው። 3. “Breeder Seed” means a kind of cereal seed which is new, obtained through research and multiplied by following-up of agricultural research. 4. “ ቅድመ መሥራች ዘር” ማለት እናት ዘርን በማባዛት ተመርቶ የተገኘ ዘርማለት ነው፡ 4. “Pre-basic Seed” means seed produced and obtained by multiplying breeder seed. 5. “መሥራች ዘር” ማለት ቅድመ መሥራች ዘር በማባዛት ተመርቶ የተገኘ ዘር ማለት ነው፣ 5. “Basic Seed” means seed produced and obtained by multiplying pre-basic seed. 6. “የፀደቀ ዘር” ማለት በአገር ውስጥ የተመረተ ወይም ከውጭ የገባ ዘር የአገራችንን የዘር ደረጃ መሥፈርት የሚያሟላ እና መንግሥት ይህንን ሥራ እንዲያስፈጽም በወከለው አካል የጸደቀና 6. “Certified Seed” means seed produced at home or imported form abroad, meets the criterion of the country’s seed standard and approved by an organ appointed to cause the execution of this task by the government and that can be used for the ገፅ-4- ዝክረ-ሕግ ጋዜጣ ቁጥር 8 ግንቦት 28 ቀን 2001 ዓ.ም Zikre-Hig Gazette No 8, 5th Day of June, 2009, page -4 ለዘር ሊውል የሚችል ማለት ነው፣ purpose of seed. 7. “የዘር ጥራት ደረጃ” ማለት በኢትዮጵያ የጥራትና ደረጃ ማረጋገጫ ባለሥልጣን የሚወጣ የተለያየ ደረጃ ማለት ነው፣ 7. “Seed Quality Standard” means a standard set by Ethiopian Quality Standard Certification Authority. 8. “ምልክት” ማለት ዘር የሚጨመርበት ዕቃ ላይ የሚለጠፍ ወይም የሚያያዝ ወይም ከዘሩ ጋር የሚሄድና ጥራትና ብዛት ለመግለጽ የሚረዳ የኢንተርፕራይዙ ምልክት ወይም ጽሑፍ ማለት ነው፣ 8. “Mark” means a mark or writing of the enterprise to be pasted or fastened together with a container of seed or go along with the seed and helps to disclose the quality and quantity of the seed. 9. “ማዘጋጀት” ማለት እንደአስፈላጊነቱ ዘር ማድረቅ፣የማይፈለገውን ማስወገድ በመጠን መለየት፣ በኬሚካል ማሸትና በደንበኞች ፍላጎት መሠረት አሽጎ ማቅረብ ማለት ነው፣ 9. “Prepare” means, as deemed necessary, to dry, avoid the one which is not required, separate in size, treat with chemical and pack the seed and thereby supply same to customers, on the bases of their interest 10. “ደረጃውን ያላሟላ ዘር“ ማለት የአገር ውስጥ የዘር ጥራት ደረጃ መስፈርት ያላሟላ የተለያዩ የዕጽዋት ዘር ማለት ነው፣ 10. “Standard Unfit Seeds” means various plant seeds that do not satisfy the criteria of national seed quality standard. 11. “ዘር ማምረት” ማለት የተለያየ የአጽዋት ዘርን ከሃገር ውስጥ ምርምር ማዕከላትና ከውጭ አገር በማስገባት ማባዛት ማለት ነው፣ 11. “Producing Seed” means to multiply various plant seed from local research centers as well as importing same from abroad. 12. “ሰው” ማለት የተፈጥሮ ሰው ወይም በህግ አካል ሰብአዊ መብት የተሰጠው ማለት ነው። 12. “Person” means any natural or judicial body. 3. የተፈጻሚነት ወሰን 3. Scope of Application ይህ ደንብ ከምርጥ ዘር ሥራ ጋር ግንኙነት ያላቸው አካላት እንደ አርሶ አደር፣ የግብርና This regulation shall apply on bodies having relation with improved seed activity like farmer, agricultural research centers and institutions, ገፅ-5- ዝክረ-ሕግ ጋዜጣ ቁጥር 8 ግንቦት 28 ቀን 2001 ዓ.ም Zikre-Hig Gazette No 8, 5th Day of June, 2009, page -5 ምርምር ማዕከላትና ኢንስቲትዩት፣ ዩኒቨርስቲዎች፣ ኮሌጆች፣በዘር ብዜት በተሰማሩ ባለሃብቶች ፣ የመንግሥት እርሻ፣የዘር ጥራት ቁጥጥር ላብራቶሪ እና የመሣሰሉት በአማራ ብሔራዊ ክልላዊ መንግሥት ውስጥ ባሉት ላይ ተፈጻሚነት ይኖረዋል። universities, colleges, investors engaged in multiplying seed, state farm, seed quality control laboratory and such like in the Amhara National Regional state. 4. የጾታ አገላለጽ 4. Gender Application በዚህ ደንብ ውስጥ በወንድ ጾታ የተገለፀው የሴት ጾታንም ያጠቃልላል። The provision of this regulation set out in the masculine gender shall also apply to the feminine gender ክፍል ሁለት PART TWO የአማራ ብሔራዊ ክልል የዘር ኢንተርፕራይዝ መቋቋም፣ ተጠሪነትና አደረጃጀት ESTABLISMENT, ACCONTABILITY AND ORGANIZATIO OF THE AMHARA NATIAON REGION SEED ENTERPRISE 5. የድርጅቱ መቋቋምና ተጠሪነት 5. Establishment and Accountability of the Enterprise 1. የአማራ ምርጥ ዘር ኢንተርፕራይዝ ከዚህ በኋላ " ኢንተርፕራይዝ" ተብሎ የሚጠራው ራሱን ችሎና የመንግሥት የልማት ድርጅት አካል ሆኖ በዚህ ደንብ ተቋቁሟል፣ 1. The Amhara Seed Enterprise /hereinafter referred to as “The Enterprise”/ is hereby established as an autonomous part of government enterprise under this regulation. 2. የኢንተርፕራይዙ ተጠሪነት ለአማራ ብሔራዊ ክልላዊ መስተዳድር ም/ቤት ይሆናል። 2. The enterprise shall be accountable to the Council of Amhara National Regional Government. ገፅ-6- ዝክረ-ሕግ ጋዜጣ ቁጥር 8 ግንቦት 28 ቀን 2001 ዓ.ም Zikre-Hig Gazette No 8, 5th Day of June, 2009, page -6 6. የድርጅቱ አደረጃጀት/መዋቅር 6. Organization /Structure of the Enterprise 1. የኢንተርፕራይዙ ዋና ጽ/ቤት አድራሻ በባህር ዳር ከተማ ይሆናል፤ 1. The Enterprise Head Office shall be in Bahir Dar. 2. ኢንተርፕራይዙ እንደአስፈላጊነቱ የአግሮኢኮሎጂን ሁኔታና ኢንተርፕራይዙ የሚያቋቁማቸውን እርሻዎች መሠረት በማድረግ የሚከፈቱ ቅርንጫፍ መሥሪያ ቤቶች ይኖሩታል። 2. The Enterprise shall, as deemed necessary, have branch offices to be established on the basis of condition of agro-ecology and farmlands to be established by the enterprise thereof. ክፍል ሦስት PART THREE የኢንተርፕራይዙ ዓላማ፣ ስልጣን፣ ሥራና አስተዳደር አካላት OBJECTIVE, POWERS, DUTIES AND ADMINISTRATIVE BODIES OF THE ENTERPRISE 7. ዓላማ 7. Objective ኢንተርፕራይዙ የሚከተሉት ዓላማዎች ይኖሩታል፣ The Enterprise shall have the following objectives: 1. የተለያዩ የሰብልና የእንስሳት መኖ ዘሮችን ከእናት ዘር /Breeder seed/ አንስቶ እስከ የተመሰከረለት /Certified/ ዘር በእራሱ እርሻ መሬት ላይ፣ በመንግሥታዊና የግል ድርጅቶች እንዲሁም በአርሶ አደር ማሣ ላይ ጥራቱን የጠበቀ ዘር ማባዛትና አዘጋጅቶ ለደንብኞች ማቅረብ፣ 1. To supply to customers various cereal and animal forage seeds from breeder seed unto certified seed through multiplying and preparing quality seed on its farmland, government and private organizations as well as on the plot of the farmer. 2. አስፈላጊ የሆኑና ለክልሉ የተለያየ ዓየር ቀጠና ተስማሚ የሆኑ የሰብልና መኖ ዘሮችን ከውጭ አገር በማስገባት ለአርሶ 2. To provide farmers with cereal and forage seeds which are necessary and favorable to various climate-zones by ገፅ-7- ዝክረ-ሕግ ጋዜጣ ቁጥር 8 ግንቦት 28 ቀን 2001 ዓ.ም Zikre-Hig Gazette No 8, 5th Day of June, 2009, page -7 አደሮች ማቅረብ፣ importing same form abroad. 3. የዘር ቴክኖሎጂን ማስፋፋት፣ 3. To promote seed technology thereof 8. የኢንተርፕራይዙ ሥልጣንና ተግባር 8. Powers and Duties of the Enterprise ኢንተርፕራይዙ የሚከተሉት ሥልጣን እና ተግባር ይኖሩታል፦ The Enterprise shall have the following powers and duties: 1. በመንግሥት እቅድና በአገር ውስጥ እና በውጭ አገር ገበያ ላይ በማተኮር እናት /Breeder seed/ ቅድመ መሥራች /Pre basic/ የእህልና የተለያየ የእንስሳት መኖ ዘሮችን ከአገር ውስጥ ግብርና ምርምር ማዕከላት እና ከውጭ አገር የሚያስገባውን ዘር በማባዛት እና በማዘጋጀት ለገበያ ማቅረብ፣ከክልሉ ፍላጐት በላይ የሆነውን ለሌሎች ክልሎች ወይም ለሌላ ሃገር መሸጥ፣ 1. Focusing on the government plan and local and foreign market, supply to the market breeder-seed, pre-basic, cereal and various animal forage seeds form domestic agricultural research centers and the seed which it may import form abroad by multiplying and preparing same thereof; sell the seed which is beyond the region’s demand to other regions and countries. 2. የተለያዩ ዘሮች ቅድመ መሥራች፣ መሥራችና የተመሠከረለት ዘር ጥራቱን ጠብቆ ማባዛት፣ማዘጋጀትና ለገበያ ማቅረብ፣ 2. Having maintained its quality, multiply, prepare and supply various seeds of pre basic, basic and certified seed to the market; 3. የተለያዩ ምርጥ ዘሮችን በብዛት የሚፈለጉትን እና በሀገር ውስጥ የማይገኙትን ዘሮች ከውጭ አገር ማስገባት፣ 3. Import various improved seeds required in large quantities and not available at home from abroad. 4. ምርጥ ዘር፣ ተረፈ ምርትና ለአፈር እንክብካቤ ሲባል የተመረተን እህል መሸጥ፣ 4. sell improved seed, by-products and cereals produced for soil conservation; 5. ጉዳዩ ከሚመለከታቸው ተቋማት ጋር በመሆን በአገር ውስጥ የማይገኝ ዘር ከውጭ አገር በማስገባት፣ማባዛትና ለገበያ ማቅረብ፣ 5. along with the institutions which the matter concerns thereof, multiply and thereby supply same to the market through importing seed that is not available at home from abroad. ገፅ-8- ዝክረ-ሕግ ጋዜጣ ቁጥር 8 ግንቦት 28 ቀን 2001 ዓ.ም Zikre-Hig Gazette No 8, 5th Day of June, 2009, page -8 6. እንደ አስፈላጊነቱ ከመንግሥት እርሻ ከግል ድርጅቶች ከአርሶ አደሮችና ከማህበራት ወይም ዩኒየኖች ጋር ስምምነት በማድረግ በማሳቸው ላይ የተለያዩ የሰብል ዘሮችን እንዲያባዙ በማድረግ አዘጋጅቶ ለገበያ ማቅረብ፣ 6. Prepare and supply to the market seeds, causing the multiplication of various cereal seeds on the government farm, on the plot of private organizations, farmers and co operatives or unions, on the basis of agreement made therewith. 7. የዘር ማባዣ እርሻ ይኖረዋል እንዲሁም አስፈላጊ በሆነበት ቦታ ንብረቱን ማስያዝ፣ መሸጥ ወይም አሳልፎ መስጠት ይችላል፣ 7. Shall acquire seed multiplying farm, as well as, on conditions where necessary, may mortgage, sell or give away its property. 8. በአገር ውስጥና በውጭ አገር ገበያ በብዛት በሚፈለጉ የሰብል ዘር ላይ ትኩረት በማድረግ የተለያዩ የሰብል ዘሮችን አምርቶ ለገበያ ያቀርባል፡ 8. Produce and supply various cereal seeds for markets by focusing on cereal seeds required in a large quantity in domestic and foreign market. 9. ከአገር ውስጥና ከውጭ አገር ግብርና ምርምር ተቋማት የሚለቀቁትን የእህል፣ ሰብልና የእንስሳት መኖ ዝርያዎችን የማላመድ ሥራ ያካሂዳል፣ 9. Carry out adapting activities of species of cereal, crop and animal forage to be released form domestic and foreign agricultural research institutions. 10. ቅርንጫፍ ጽ/ቤቶች በሚገኙበት ቦታ ሁሉ የዘር ጥራት መመርመሪያ ላብራቶሪ በማቋቋም የዘር ጥራት ምርመራ አገልግሎት በከፍያ ይሰጣል፣ 10. Render seed quality testing service, on charge, by establishing seed quality testing laboratory at any place where branch offices are found. 11. በአገር አቀፍና በአለም አቀፍ ደረጃ በምርጥ ዘር ማምረት ላይ በተደራጁ ማህበራት አባል ሊሆን ይችላል። 11. May be a member of co-operatives organized for the task of producing improved seeds at national and international level. 12. ለመንግሥታዊ፣ መንግሥታዊ ላልሆኑ እንዲሁም ለግል ድርጅቶች በክፍያ የዘር ማበጠር አገልግሎት ይሰጣል፣ 12. Render seed-cleaning service, on charge, to government, non-government as well as private organizations thereto. ገፅ-9- ዝክረ-ሕግ ጋዜጣ ቁጥር 8 ግንቦት 28 ቀን 2001 ዓ.ም Zikre-Hig Gazette No 8, 5th Day of June, 2009, page -9 13. ምርጥ ዘር ለማባዛት ያፈራቸውን ንብረቶች በኪራይ ለተለያዩ እርሻ ሥራ፣ አጨዳና የማበጠር ሥራ እንዲውሉ ያደርጋል፣ 13. Cause the use of properties it generates to multiply improved seed for various farming activity, reaping and seed-cleaning activities on rent. 14. ከዘር ጋር ተያያዥነት ያለውን የኢንቨስትመንት እስትራቴጂክ ዕቅድ ያዘጋጃል፣ሲፈቀድለት ሥራ ላይ ያውላል። 14. Prepare investment strategic plan having relation with seed; put in place upon its approval. 15. ንብረት ያፈራል፣በስሙ ይዋዋላል፣ይከሳል፣ ይከሰሳል። 15. Generate asset, enter into contract as well as sue and be sued in its name. 9. የኢንተርፕራይዙ አደረጃጀት 9. Organization of the Enterprise ኢንተርፕራይዙ ከዚህ ቀጥሎ ያሉት አደረጃጀቶች ይኖሩታል፦ The Enterprise shall have the following organization: 1. የሥራ አመራር ቦርድ፣ 1. A managing board; 2. ዋና ሥራ አስኪያጅ፣ 2. A chief Manager; 3. አስፈላጊ የሆኑ ሠራተኞች እና ሥራ የሚካሄድበት መዋቅር 3. Necessary staff and a structure for its work operation. 10. የቦርዱ መቋቋም 10. Establishment of the Board የሥራ አመራር ቦርድ ከዚህ በኋላ “ቦርዱ” ተብሎ የሚጠራ የኢንተርፕራይዙ የበላይ አመራር በዚህ ደንብ ተቋቁሟል። A managing board /hereinafter referred to “The Board”/ is hereby established by this regulation as being senior managing organ of the enterprise. 11. የቦርዱ አካላት 11. Members of the Board የቦርዱ አባላት አምስት (5) ይሆናሉ። Members of the board shall be five in number. 1. የቦርዱ አባላት የሚከተሉት ይሆናሉ፦ 1. Members of the board shall be the following persons: ሀ) የክልሉ ርዕሰ መስተዳድር የሚሰይሙት የቦርዱ ስብሳቢ ይሆናል A. A person to be designated by the Head of Regional Government ……..Chair-person ገፅ-10- ዝክረ-ሕግ ጋዜጣ ቁጥር 8 ግንቦት 28 ቀን 2001 ዓ.ም Zikre-Hig Gazette No 8, 5th Day of June, 2009, page -10 ለ) የግብርናና ገጠር ልማት ቢሮ ኃላፊ አባል B. Member መ) የገንዘብ ኢኮኖሚና ልማት ቢሮ ኃላፊ አባል D. Head of Finance and Economy Development Bureau ….. Member ሠ) የአማራ ምርጥ ዘር ኢንተርፕራይዝ ዋ/ሥራ አስኪያጅ ፀሐፊና አባል E. Chief Manager of the Amhara Seed Enterprise … Secretary and member 12. የቦርዱ ሥልጣንና ተግባር 12. Powers and Duties of the Board ቦርዱ የሚከተሉት ሥልጣንና ተግባር ይኖሩታል፦ The board shall have the following powers and duties: 1. የኢንተርፕራይዙን የሥራ እንቅስቃሴ በበላይነት ይመራል፣ ይቆጣጠራል፣ 1. Manage and supervise overall activities of the enterprise; 2. የኢንተርፕራይዙን የሥራ አመራር አባላት ደመወዝና አበላቸውን ይወስናል፣ 2. Fix the amount of salary and allowance of managing members of the enterprise; 3. በፋይናንስ ህግ ላይ ተመርኩዞ ሊመለስ የማይችል ተብሎ የታመነበትን ወይም የተረጋገጠ ገንዘብ ከኢንተርፕራይዙ ሂሣብ እንዲፋቅ/እንዲሰረዝ/ መመሪያ ያወጣል፣አፈጻጸሙንም ይከታተላል፣ 3. Issue a directive so that the finance believed or affirmed not to be repaid, pursuant to the finance law, to be remitted /cancelled/ from the account of the enterprise and follow-up its implementation; 4. የውጪ ኦዲተር ምደባን ያፀድቃል፣ 4. Approve the assignment of external auditor; 5. ለኢንተርፕራይዙ ሥራ አፈጻጸም የሚያስፈልጉ መመሪያዎችን ያወጣል፣ 5. Issue guidelines necessary for the performance of the enterprise; 6. የዋና ሥራ አስኪያጁን እና የም/ዋ/ ስራ አስኪያጅ ሹመትና ከሥራ መሰናበት ለርዕሰ መስተዳድር አቅርቦ ያጸድቃል፣ 6. Submit to the Head of Regional Government and cause the approval of appointment and dismissal of the chief manager and vice chief manager. 7. የቦርዱን ውስጠ ደንብና ሥነ ሥርዓት 7. Formulate and put in place internal by ገፅ-11- ዝክረ-ሕግ ጋዜጣ ቁጥር 8 ግንቦት 28 ቀን 2001 ዓ.ም Zikre-Hig Gazette No 8, 5th Day of June, 2009, page -11 ቀርጾ ተግባራዊ ያደርጋል። law and procedure of the board; 13. ዋና ሥራ አስኪያጅ 13. Chief manager of the Enterprise የኢንተርፕራይዙ ዋና ሥራ አስኪያጅ በክልሉ መንግሥት ርዕሰ መስተዳድር የሚሾም ይሆናል። Chief manager of the enterprise shall be appointed by the Head of Regional Government. 14. የዋና ሥራ አስኪያጅ ሥልጣንና ተግባር 14. Powers and Duties of the Chief Manager የኢንተርፕራይዙ ዋና ሥራ አስኪያጅ የሚከተሉት ሥልጣንና ተግባራት ይኖሩታል፦ The chief manager of the enterprise shall have the following powers and duties: 1. በዚህ ደንብ አንቀጽ 13 ሥር የተደነገገው እንደተጠበቀ ሆኖ ዋና ሥራ አስኪያጁ የኢንተርፕራይዙን የሥራ እንቅስቃሴ በበላይነት ይመራል፣ ያስተዳድራል፣ 1. Without prejudice to the provision of art 13 of this regulation hereof, the chief manager shall manage and administer overall activities of the enterprise; 2. የቦርዱ ፀሐፊ በመሆን በቦርድ ስብሰባ ላይ ይሳተፋል፣ 2. Take part in meeting of the board being as secretary of the board; 3. የኢንተርፕራይዙን ሥራ ይመራል፣ ያደራጃል፣ ያስተዳድራል፣ ይቆጣጠራል፣ 3. Manage, organize, administer and oversee activities of the enterprise; 4. የኢንተርፕራይዙን ዕቅድና በጀት አዘጋጅቶ ለቦርድ ያቀርባል፣ሲፈቀድ ሥራ ላይ ያውላል ይቆጣጠራል፣ 4. Prepare plan and budget proposal of the enterprise, submit it to the board and thereby implement same up on approval thereof. 5. በሥራ ዕቅድና በጀት መሠረት ክፍያዎች እንዲፈጸሙ ያዝዛል፣ 5. Order payments to be disbursed pursuant to the work-plan and budget thereof. 6. የአሰሪና ሠራተኛ ህግን መሠረት በማድረግ የኢንተርፕራይዙን ሠራተኞች ይቀጥራል፣ያስተዳድራል፣ያሳድጋል፣ ያዛውራል፣ይቆጣጠራል፣ይገመግማል፣ 6. Pursuant to the labor law, recruit, administer, promote, transfer, supervise, evaluate, fine, having submitted to the board, cause the determination of amount of their salary and allowance of ገፅ-12- ዝክረ-ሕግ ጋዜጣ ቁጥር 8 ግንቦት 28 ቀን 2001 ዓ.ም Zikre-Hig Gazette No 8, 5th Day of June, 2009, page -12 ይቀጣል፣ ደመወዝና አበላቸውን ለቦርዱ አቅርቦ ያስወስናል እንዲሁም ከሥራ ያሰናብታል፣ employees of the enterprise, submitted to the board as well as dismiss them form work. 7. ኢንተርፕራይዙን በመወከል ከሶስተኛ አካል ጋር ስምምነት ይፈጽማል፣ 7. Representing the enterprise, makes agreement with third party; 8. የሥራና ሂሣብ ሪፖርት አዘጋጅቶ ለቦርዱና ለክልሉ መስተዳደር ምክር ቤት ያቀርባል። 8. Prepare and submit report of working activity and account to the board and the council of Regional Government; 9. የኢንተርፕራይዙን ሥራ ለማቀላጠፍ ሲባል እንደአስፈላጊነቱ ሥልጣኑን በውክልና ለኢንተርፕራይዙ ሥራ ክፍሎች ኃላፊዎችና ሠራተኞች መስጠት ይችላል። 9. As may be necessary, be able to delegate his powers to the heads of work divisions and employees of the enterprise for the purpose of effectiveness of activity of the enterprise; 10. የድርጅቱን ሂሣብ ለማንቀሳቀስ የባንክ ሂሣብ ይከፍታል፤ 10. Open bank account so as to operate account of the enterprise; 11. በቦርዱ የሚሰጡትን ሌሎች ተግባራትን ያከናውናል። 11. Perform such other duties given to him by the board ክፍል አራት PART FOUR ልዩ ልዩ ድንጋጌዎች MISCELLANEOUS PROVISIONS 15. የኢንተርፕራይዙ ካፒታል 15. Capital of the Enterprise ኢንተርፕራይዙ መነሻ ካፒታል የሚሆን ገንዘብና መሬት ከመንግሥት ያገኛል። The enterprise shall obtain finance to be initial capital and land form the government. 16. የኢንተርፕራይዙ የበጀት ምንጭና የበጀትዓመት 16. Source of Budget and Budget Year of the Enterprise 1. የኢንተርፕራይዙ የገቢ ምንጭ ከዚህ በታች በተዘርዘሩት ይሆናል፦ 1. Source of income of the enterprise shall be form the followings specified herein below: ገፅ-13- ዝክረ-ሕግ ጋዜጣ ቁጥር 8 ግንቦት 28 ቀን 2001 ዓ.ም Zikre-Hig Gazette No 8, 5th Day of June, 2009, page -13 ሀ) ከዘር፣ ተረፈ ምርት እና እህል ሽያጭ የሚያገኘው ትርፍ A. A profit made on the sale of seed, by products, and cereals; ለ) ከሚሰጠው አገልግሎት የሚሰበሰብ ክፍያ፣ B. Fee charges collected form the service it renders thereof; ሐ) ከተለያዩ አካላት የሚገኝ እርዳታና ድጋፍ፣ C. Support and aid obtained form various bodies; መ) ከባንክና ከሌሎች ድርጅቶች ከሚገኘው ብድር እና ስጦታ፣ D. Loan and donation obtained form bank and other organizations; ሠ) ከመንግሥት ከሚያገኘው መቋቋሚያና ብድር፤ E. Initial budget and loan obtained from the government. 2. የኢንተርፕራይዙ የበጀት ዓመት ከመንግሥት የበጀት ዓመት ጋር አንድ ይሆናል። 2. The budget year of the Regional State shall be the budget year of the enterprise 17. የድርጅቱ ሠራተኞች ቅጥርና አስተዳደር 17. Recruitment and Administration of Employees of the Enterprise 1. የኢንተራፕራይዙ ሠራተኛ ቅጥርና አስተዳደር በአሠሪና ሠራተኛ ህግ መሠረት የሚፈጸም ይሆናል። 1. Recruitment and administration of the employees of the enterprise shall be implemented in accordance with labor law. 2. በዚህ አንቀጽ ንዑስ አንቀጽ 1 የተደነገገው እንደተጠበቀ ሆኖ ድርጅቱ እንደ አስፈላጊነቱ የራሱን የሠራተኛ መተዳደሪያ ደንብ ያዘጋጃል፣ ሲፈቀድም በሥራ ላይ ያውላል። 2. Without prejudice to the provision of sub.art.1 of this art. hereof, the enterprise shall, as deemed necessary, prepare its administrative guideline of the employees; and put it in place upon approval. 18. የሂሣብ መዝገብ 18. Books of Account 1. ኢንተርፕራይዙ የተሟላና ህጋዊ የሆነ የገንዘብ ሰነዶችና የሂሣብ መዝገብ ይኖረዋል፣ 1. The enterprise shall have complete and legal financial documents and books of account; 2. የሂሣብ መዝገቡና የገንዘብ ሰነዶቹ በአማራ ክልል ዋና ኦዲተር መሥሪያ ቤት 2. Books of account and financial documents shall be audited every year by the Office of Amhara Region Audit General or an ገፅ-14- ዝክረ-ሕግ ጋዜጣ ቁጥር 8 ግንቦት 28 ቀን 2001 ዓ.ም Zikre-Hig Gazette No 8, 5th Day of June, 2009, page -14 ወይም እሱ በሚወክለው ኦዲተር በየዓመቱ ይመረመራል፣ auditor to be designated by it. 19. መመሪያ የማውጣት ሥልጣን፣ 19. Power to issue Directive ቦርዱ ይህንን ደንብ ሥራ ላይ ለማዋል መመሪያዎችን ሊያወጣ ይችላል፣ The board shall issue directives for the implementation of this regulation 20. ተፈጻሚነት የሌላቸው ህጎች 20. Inapplicable Laws ከዚህ ደንብ ጋር የሚቃረኑ ደንቦች፣ መመሪያዎች ወይም የአሰራር ልማዶች ተፈጻሚነት አይኖራቸውም፣ Regulations, directives or customary practice contrary to his regulation shall be inapplicable 21. ተጠያቂነት 21. Responsibility ኢንተርፕራይዙ ካለው ሀብት በላይ ተጠያቂ አይሆንም። The Enterprise shall not be responsible for beyond the resource it has thereof; 22. የመተባበር ግዴታ 22. Obligation to Co-Operate የመንግሥት አካላት በሙሉ ለኢንተርፕራይዙ ድጋፍ መስጠት አለባቸው። All government bodies shall have an obligation to render support to the enterprise. 23. ደንቡ የሚጸናበት ጊዜ 23.
