1998 TITLEBY REGISTRATION (AMENDMENT) ACT 8 69 COMMONWEALTH OF DOMINICA ACT NO.8 OF 1998 I assent VERNON SHAW President 29th December. 1998. AN ACT TO AMEND THE TITLE BY REGISTRATION ACT. CHAPTER 56:50. (Gazetted 31st December. 1998.) BE IT ENACTED by the Parliament of the Commonwealth of Dominica as follows: 1. This Act may be cited as the TITLE BY REGISTRATION (AMENDMENT) ACT 1998. Shorr title. 2. In this Act the Title by Registration Act is referred to as "the lnterpreration. ~~'. o.~~ 70 1998 TITLE BY REGISTRATION (AMENDMENT) ACT 8 Amendmemof section l040flheAct Amendment of section 164oflheAct. Amendmentof section 182 of the Act. Amendment of the Fourth Schedule of the Act. 3. Section 104 of the Act is amended by deleting the word "larceny" therein and replacing it with the word "theft". 4. Section 164 of the Act is amended by deleting the words "any fees" and replacing them with the words "higher fees". S. Section 182 of the Act is repealed and replaced with the following "182. Wheneverany request, application or otherdocu ment (hereinafter called document) offered for registration purports to have been prepared by any person, other than a barrister, solicitoror other person authorised to prepare legal documents. the Registrar shall before admitting such docu ment to registration. require an affidavit from that person proving that he did not draw or prepare the said document either directly or indirectly, for or in expectation ofany fee, gain or reward, and a further affidavit from the party bearing the cost of the registration ofthe said document, that no such fee, gain or reward was offered. paid, or was to be paid by him to the person for drawing or preparing the said docu ment. Further, the Registrar is hereby authorised to retain custody of such document so offered for the purpose of being registered pending the production of the aforesaid affidavits." 6. The Fourth Schedule of the Act is amended by (a) adding the following as paragraph two of the Schedule "On every Memorandum of Transfer ofland between spouses a judicial fee of I% of the value ofthe land" and (b) deleting the following paragraphs 1998 TITLE BY REGISTRATION ACT8 71 (AMENDMENT) "On every claim, under section 170 of the Act, for the decision or direction of the Full Court $4.50 On every certificate of closing of registration $10.50 On every certified copy of any document if it does not exceed five folios $1.80 if it exceeds five folios, then for the first five folios $1.80 and for every folio exceeding the first five .25" and replacing them with On every claim, under section 175 of the Act, for the decision or direction of the Full Court $30.00 On every certificate of closing of registration $50.00 and On every certified copy of any document if it does not exceed five folios $10.00 if it exceeds five folios, then for the first five folios $10.00 and for every folio exceeding the first five $1.50" 7.
