2020 EMERGENCY POWERS S.R.O. 14 (DISASTER) COMMONWEALTH OF DOMINICA STATUTORY RULES AND ORDERS NO. 14 OF 2020. PROCLAMATION declaring a State of Emergency in Dominica BY HIS EXCELLENCY CHARLES A. SAVARIN D.A.H. President of the Commonwealth Dominica LS CHARLES A. SAVARIN President (Gazetted 1st April ,2020 .) A PROCLAMATION WHEREAS it is provided by section 3(1) of the Emergency Powers (Disaster) Act, Chapter 15:03 that where Dominica or any part thereof is affected or is imminently likely to be affected by a disaster, the President may, by proclamation which shall be published in the Gazette, declare that a state of emergency exists in Dominica or any portion thereof; WHEREAS section 17(3) of the Constitution of Dominica, set out in Schedule 1 of the Commonwealth of Dominica Constitution Order 1978 (S.I. No. 1027, U.K.), provides that a proclamation declaring a state of public emergency in Dominica shall not be effective unless it contains a declaration that the President is satisfied - 2020 EMERGENCY POWERS S.R.O. 14 (DISASTER) (a) that a public emergency has arisen as a result of the imminence of a state of war between Dominica and a foreign state or as a result of the occurrence of any earthquake, hurricane, flood, fire, outbreak of pestilence, outbreak of infectious disease or other calamity whether similar to the foregoing or not; or (b) that action has been taken or is immediately threatened by any person of such a nature and on so extensive a scale as to be likely to endanger the public safety or to deprive the community, or any substantial portion of the community, of supplies or services essential to life; AND WHEREAS a public emergency has arisen in Dominica as a result of 2019-N CoV, an infectious disease commonly known as COVID 19; NOW THEREFORE, I, CHARLES ANGELO SAVARIN, President of the Commonwealth of Dominica, in accordance with the powers vested in me by the Constitution of the Commonwealth of Dominica and the Emergency Powers (Disaster) Act, Chapter 15:03, do hereby declare that I am satisfied that a state of public emergency has arisen as a result of 2019-N CoV, an infectious disease commonly known as COVID 19, and that a state of emergency exists.
