Philemon Yang, Prime Minister, Arrete fixant les modalites de realisation des inspections et des controles des services techniques a bord des navires Par arrete n ° 143-CAB-PM en date du 30 aout 2010 : Chapitre I Des dispositions generales Article premier.-I.e present arret.e :fixe les moda lit.es de realisation des inspections et des controles conjoints de services techniques a bord des navires. Art. 2.- (1) Les inspections et controles vises a l'article 1 ci-dessus s'effectuent essentielle ment a quai. (2) Ils peuvent se derouler au large, en tant que de besoin. Art. 3.- (3) Places sous la coordination du ministere charge de la marine marchande et en collaboration avec les services competents du port, les controles a bard des navires s'ef fectuent en groupe suivant un calendrier arrete a l'avance et connu de taus les interve nants. (2) II n'est prevu aucune derogation a !'appli cation de l'alinea (1) ci-dessus. Chapitre II De l' exercice des controles a bord Art. 4.- (1) Les impections et controles a bard des navires sont operes par les administra tions ci-apres : le ministere charge de la marine marchande ; le ministere charge-de l'Environnement ; Head of Government. Order to lay down conditions for the conduct of inspection and control of technical services on board vessels By Order No. 143-PM of 30 August 2010: ' Chapter I General Provisions I.This order lays down conditions for the conduct of inspections and controls of techni cal services on board vessels. 2. (1) The inspection and control referred to under Article 1 above shall be conducted mainly on the quay. (2) They may, as and when necessary, be conducted in the open sea. 3. (1) Under the coordination of the Ministry in charge of merchant shipping and in conjunction with the relevant port services, controls on board vessels shall be conducted in teams in accordance with a timetable drawn up beforehand and known by all the stakeholders. (2) No waiver shall be allowed for the imple mentation of the preceding paragraph. Chapter II Conduct of control on board vessels 4. (2) D'autres administrations peuvent egale ment etre admises ,taperer des inspections. et controles a bard des navires, conformement a la reglementation en vigueur. Art. 5.- (1) Le service competent du ministere en charge de la marine marchande assure la coordination des interventions de taus les ser vices techniques operant des inspections et controles a bard des naivres. (2) Les services competents du port sont ten us de fournir a l'organe de coordination susvise, en temps utile, les informations et les docu ments necessaires aux inspections et contro les a bard des navires. (3) Le service competent du ministere en charge de la marine marchande determine avant tout acces a bard des navires, en collaboration avec les services techniques competents charges des inspections et des controles, la composition des equipes d'inspection et de controle, l'ordre de passage, le lieu et le moment de controle. (4) Il communique toute information utile aux di:fferents inspecteurs et controleurs, au com mandant du port et au commandant du navire. Art. 6.- (1) Les administrations effectuant les controles a bard des navires y accedent au meme moment. (2) Les personnes chargees de ces controles siont designees par leurs administrations res pectives. Art. 7.- (1) Dans le cadre de raccomplissement de leurs missions, chacune des administrations effec tue les inspections et les controles relevant de son domaine de competence. (2) A l'issue de l'inspection et du controle, cha que administration notifie au commandant du navire le rapport de son intervention. government services: the Ministry in charge of merchant shipping; the Ministry in charge of the environment; the Ministry in charge of public health; the Ministry in charge of agriculture; the Ministry in charge of livestock, fisheries and animal industries; the Ministry in charge of forestry and wildlife. (2) Other services may equally be authorized to conduct inspections and controls on board vessels, in accordance with the regulations in force. 5. (1) The relevant services of the Ministry in charge of merchant shipping shall coordinate the activities of all the technical services conducting inspections and controls on board vessels. (2) The relevant port services shall be bound to provide the abovementioned body, in due time, the information and documents neces sary for the conduct of inspections and controls on board vessels. (3) The relevant service of the Ministry in charge of merchant shipping shall, before any access on board vessels, determine in conjunc tion with the relevant technical services in charge of inspection and control, the composi tion of the inspection and control teams, the order of passage, the place and time of control. (4) It shall provide all useful information to different inspectors and controllers, the port commander and vessel commander. 6. (1) The services conducting controls on board vessels shall have access thereto concurrently. (2) The persons in charge of such controls shall be designated by their respective servi ces. 7. (1) To discharge its duties, each service shall conduct inspections and controls within its area of competence. 996 JOURNAL OFFICIEL DE LA REPUBLIQUE DU CAMEROUN 15 septembre 2010 (3) Une notification ecrite des resultats de l'inspection et du controle est egalement faite au service comptetent du ministere en charge de la marine marchande. (4) En cas de constatation d'anomalie a l'issue de l'inspecttion et du controle, le service com petent du ministere en charge de la marine marchande organise une intervention specifi que du service technique concerne et en informe le commandant du navire. Art. 8. (1) Les acces a bord se font tous les jours de 8 heures a 18 heures, exception faite des navires dont le sejour au port est inferieur a 12 heures, pour lesquels les inspections et les controles ne pourraient se derouler en dehors de la plage horaire sus definie. (2) Les plages horaires des inspections et controles de navires dont le sejour au port est inferieur a 12 heures sont determinees par le ministere charge de la marine marchande. Chapitre III Des dispositions diverses et finales Art. 9.- Chaque administration supporte les frais inherents a l'execution de ses missions. Art. 10.- Le present arret6, sera enregistre, public suivant la procedure d'urgence, puis insere au Journal Officiel en frarn;ais et en (2) After the conduct of the inspection and control, each service shall forward to the vessel commander a report of its inspection-control. ( 4) Where an abnormality is recorded follo wing the inspection and control, the relevant service of the Ministry in charge of merchant shipping shall organize a special intervention of the technical service concerned and inform the vessel commander thereof. 8. (1) Access on board shall take place everyday from 8 a.m. to 6 p.m., with the exception of vessels whose duration in the port is less than twelve hours, in which case the inspection and control may not be cond uc ted within the abovementioned timeslot. (2) The timeslots for the inspection and control of vessels whose duration in the port is less than 12 hours shall be determined by the Ministry in charge of merchant shipping. Chapter III Miscellaneous and Final Provisions 9. Each service shall defray the costs relating to the execution of its duties. anglais. 10.
