Article 40 excluded Schedule 1981-82, No. 21 An Act to prohibit the leasing of land on Rarotonga motus (6 April 1982 BE IT ENACTED by the Parliament of the Cook Islands in session assembled, in accordance with the provisions of sub-clause (1), article 41 of the Constitution of Cook Islands, and by the authority of the same, as follows: 1. Short Title and commencement - (1) This Act may be cited as the Rarotonga Motus Prohibition of Leases Act 1981-82. (2) This Act shall be deemed to have come into force on the 10th day of July 1981. 2. Prohibition of Leases - (1) Notwithstanding anything contained in the Cook Islands Act 1915 or in any other enactment or in any order of any court, no person shall be capable of leasing any land on any of the motus of Rarotonga set out in the Schedule to this Act. (2) Nothing in this section shall affect any interest acquired in any land prior to the commencement of this Act, provided that any dealing in respect of any lease, whether by transfer, assignment or otherwise, and whether occurring before or after the coming into force of this Act shall be prohibited. 3. Article 40 excluded - Article 40 of the Constitution shall have no application with regard to the provisions of this Act.
