Interpretation Interprétation 2 In these Regulations, Act means The Natural Products Marketing Act, 1972 of Saskatchewan; (Loi) assembly yard means premises to which producers may deliver their hogs; (parc de groupage) Commission means the Saskatchewan Hog Marketing Commission established pursuant to the Act and the Plan; (Commission) hog means any member of the species Sus Scrofa L. (do mestic pig) produced in Saskatchewan; (porc) order buyer means any person buying sows at a public auction in an assembly yard for the purpose of reselling to or on behalf of another person; (courtier en truies) Plan means the Saskatchewan Hog Marketing Plan es tablished and amended from time to time pursuant to the Act; (Plan) processor means any person engaged in the business of processing hogs or using hogs in manufacturing; (trans formateur) 2 Dans le présent règlement, Commission désigne l’organisme dit Saskatchewan Hog Marketing Commission créé en vertu de la Loi et du Plan; (Commission) courtier en truies désigne une personne achetant des truies aux enchères publiques dans un parc de groupage pour les revendre à une autre personne ou en son nom; (order buyer) Loi désigne la loi intitulée The Natural Products Marke ting Act, 1972 de la Saskatchewan; (Act) parc de groupage désigne l’endroit où les producteurs peuvent livrer leurs porcs; (assembly yard) petit transformateur désigne un transformateur qui, au cours de l’année civile précédente, a transformé moins de deux pour cent de tous les porcs abattus en Saskatche wan, selon les rapports publiés par le ministère de l’Agri culture du Canada; (small processor) Plan désigne le plan intitulé Saskatchewan Hog Marke ting Plan adopté et modifié en vertu de la Loi; (Plan) Saskatchewan Hog Marketing (Interprovincial and Export) Regulations Règlement sur la commercialisation du porc de la Saskatchewan (marché interprovin cial et commerce d’exportation) Interpretation Interprétation Sections 2-6 Articles 2-6 Current to November 21, 2016 2 À jour au 21 novembre 2016 producer means (a) any person engaged in producing or feeding hogs and making them available for slaughter and includes the employer of any such person, (b) any person who, under any lease or agreement, is entitled to a share of the hogs produced or fed by a person referred to in paragraph (a), and (c) any person who takes possession of any hogs from any person under any form of security for a debt; (pro ducteur) small processor means a processor who, in the previous calendar year, processed less than two per cent of all hogs slaughtered in Saskatchewan according to the re ports published by the Department of Agriculture of Canada. (processor) Application Application 3 These Regulations apply only to the marketing of hogs in interprovincial and export trade and to persons and property situated in the Province of Saskatchewan. 3 Le présent règlement ne vise qu’à réglementer la com mercialisation des porcs sur le marché interprovincial et dans le commerce d’exportation et ne s’applique qu’aux personnes et aux biens qui se trouvent dans la province de la Saskatchewan. Purchase and Sale Achat et vente 4 (1) Subject to sections 5 to 8, no producer shall sell or offer to sell hogs to any person other than the Commis sion. 4 (1) Sous réserve des articles 5 à 8, un producteur ne peut vendre ou offrir de vendre du porc qu’à la Commis sion. (2) Subject to sections 5 to 8, no person other than the Commission shall purchase hogs from a producer. (2) Un courtier peut acheter des truies d’un producteur. 7 The following classes of hogs shall be exempt from these Regulations: (a) breeding stock; (b) weanling pigs; (c) feeder pigs; and (d) boars. 7 Le présent règlement ne vise pas les catégories de porcs suivantes : a) les animaux de reproduction; b) les porcelets sevrés; c) les animaux d’engraissement; et d) les verrats. 8 (1) A producer may market hogs in the interprovincial trade, otherwise than through the Commission, if he (a) holds a dispensation certificate; and (b) does so through the hog marketing system, if any, in the province where the hogs are marketed. 8 (1) Un producteur peut commercialiser du porc sur le marché interprovincial autrement que par l’entremise de la Commission s’il a) est en possession d’une dispense; et b) agit ainsi en se conformant aux exigences du sys tème de commercialisation de la province où les porcs sont commercialisés. (2) A dispensation certificate may be issued by the Com mission to any producer who applies therefor (a) if the producer has obtained prior approval there for from the hog marketing authority, if any, in the province where the hogs are to be marketed; (b) for a period expiring on December 31st next fol lowing the day of issue; and (c) without charge.
