Pounds Regulations (Y.O.I.C. 1987/115)

POUNDS ACT Pursuant to section 23 of the Pounds Act , the Commissioner in Executive Council orders as follows: 1. The annexed Pounds Regulations arehereby made and established. 2. Commissioner’s Order 1976/161 is hereby repealed. Dated at Whitehorse, in the Yukon Territory, this 29th day of May, A.D., 1987. Administrateur du Yukon O.I.C. 1987/115 POUNDS ACT DÉCRET 1987/115 LOI SUR LES FOURRIÈRES 1YUKON REGULATIONS RÈGLEMENTS DU YUKON POUNDS REGULATIONS 1. In these regulations “director” means the director of agriculture 2. (1) When an animal is impounded, the pound keeper shall, subject to subsection (2), forthwith mark the animal in the manner set out in section 3. (2) Where an impounded animal has previously been marked by a pound keeper, the pound keeper shall not mark the animal. (3) A pound keeper shall not mark an animal in a manner that would conceal or alter a brand on the animal. 3. (1) A pound keeper shall mark impounded animals in the following manner: (a) a tattoo on the ear of neat cattle, swine and goats; (b) a tattoo on the upper lip of horses, mules and jacks; (c) a band on the leg of geese. (2) Where marking an animal pursuant to subsection (1) would conceal or alter a brand, the pound keeper shall affix a red tag to the animal's ear or leg. (3) A tattoo, band or red tag placed on an animal by a pound keeper shall set out the number and such other markings or codes as may be required by the director. 4 .(1) Every pound keeper shall keep records of all animals impounded by him or her, such records to include the following information; (a) the type of animal; (b) a brief description of the animal including any distinguishing markings; (c) the date the animal was impounded; (d) the date the animal was released; RÈGLEMENT SUR LES FOURRIÈRES 1. (3) Le gardien de la fourrière ne marque pas l’animal d’une façon qui pourrait cacher ou modifier une marque de bétail enregistrée. 3.(1) Le gardien de la fourrière marque l’animal de la manière suivante : a) tatouage sur l’oreille pour les bovins, les porcins et les caprins propres; b) tatouage sur la babine supérieure pour les chevaux, les mulets et les ânes; c) bague à la patte pour les oies. (2) Si la marque apposée en vertu du paragraphe (1) peut cacher ou modifier une marque de bétail enregistrée, le gardien de la fourrière fixe une étiquette rouge à l’oreille ou à la patte de l’animal. (3) Le tatouage, la bague ou l’étiquette rouge fixée à un animal par le gardien de la fourrière précise les autres marques ou codes exigés par le directeur et leur nombre. 4.(1) Le gardien de la fourrière tient note des animaux en fourrière en consignant les renseignements qui suivent : a) type d’animal; b) description sommaire de l’animal, y compris marques distinctives; c) date à laquelle l’animal a été mis à la fourrière; d) date à laquelle il a été relâché; O.I.C. 1987/115 POUNDS ACT DÉCRET 1987/115 LOI SUR LES FOURRIÈRES 2YUKON REGULATIONS RÈGLEMENTS DU YUKON (e) particulars of the pound keeper’s marking; (f) any other information required by the director. (2) Copies of the records under subsection (1) shall be delivered to the director upon request. 5. Where a person delivers an animal to a pound keeper the form of agreement the person shall sign is set out in Form A. 6. (1) For the purpose of notifying an owner that an animal has been impounded the pound keeper shall complete the notice in Form B and deliver it by hand or certified mail to the owner. (2) Where the owner of an impounded animal does not pay all the charges within three days of receipt of a notice under subsection (1), the pound keeper shall post a notice in form C in accordance with the Act. (Amended by O.I.C. 1989/18) 7. Where the owner of an animal cannot be found the pound keeper shall post a notice in Form D in accordance with the Act. 8. All returns forwarded to the Executive Council Member pursuant to the Act shall be in form E. 9. The areas set out in Schedule A are designated as pound districts. 10. The owner of an animal shall, when taking delivery of the animal from the pound keeper, pay to the pound keeper, the fee as set out in paragraphs 1 to 6 of Schedule B and complete and sign Form F. When an impounded animal is sold by a pound keeper at an auction the pound keeper may retain ten percent of the proceeds of the sale as the pound keeper’s fee in that regard. 12. (2) Si le propriétaire de l’animal gardé à la fourrière ne paie pas l’amende dans les trois jours suivant la réception de l’avis mentionné au paragraphe (1), le gardien affiche un second avis correspondant au formulaire C, conformément à la Loi. (Modifié par décret 1989/18) 7. S’il est impossible de retrouver le propriétaire de l’animal, le gardien de la fourrière affiche un avis correspondant au formulaire D, conformément à la Loi. 8. Les recettes remises au membre du Conseil exécutif en vertu de la Loi doivent être accompagnées du formulaire E. 9. Les endroits décrits à l’annexe A sont désignés «fourrières». 10. Lorsqu’il récupère son animal à la fourrière, le propriétaire paie les droits établis aux paragraphes 1 à 6 de l’annexe B, et il remplit et signe le formulaire F. (Modifié par décret 1989/18) 11. Le gardien de la fourrière qui vend un animal aux enchères garde 10 p. 100 du produit de la vente en remboursement de ses frais. 12.
