(2) If there is a conflict between a provision of this Act and a provision of the Animal Protection Act, the provision of the Animal Protection Act prevails to the extent of the conflict. L.Y. 2002, ch. 173, art. 7 Animals seized on highways Animaux saisis sur la voie publique 8 If an animal has been seized and delivered to a pound keeper under section 30 of the Highways Act, the pound keeper shall impound the animal and the animal shall be dealt with as if seized and impounded under this Act. L.Y. 2002, ch. 173, art. 8 Duty of pound keeper towards impounded animal Obligation du gardien de fourrière envers les animaux 9 Subject to section 7, the pound keeper shall impound every animal delivered to the pound keeper for that purpose and shall be responsible for feeding it and its safe keeping as long as the pound keeper is legally bound to hold the animal. (2) If, within three days after notification under subsection (1), the owner does not pay all lawful damages and other charges or provide security instead, and take their animal, the pound keeper shall sell the animal by public auction after posting notices for at least 10 days of the time and place of the auction in three of the most public places in the pound district. L.Y. 2002, ch. 173, art. 17 Prohibitions Interdictions 18(1) No pound keeper shall neglect a duty under this Act. 18(1) Il est interdit au gardien de fourrière de négliger d'exercer les fonctions que lui confère la présente loi. (2) No person shall (a) rescue an animal from a person lawfully taking it to the pound; (b) make a breach of a pound; or (c) unlawfully set at large an animal impounded. L.Y. 2002, ch. 173, art. 18 Disputes Différends 19 If a dispute arises as to any matter under this Act, or a complaint is made that a fine should be imposed under this Act, a justice of the peace may, if it is brought before the justice of the peace, dispose of it in a summary manner. L.Y. 2002, ch. 173, art. 19 Right of action not impaired Protection du droit d'action 20 Nothing in this Act impairs the right of any person to an action for damages occasioned by a trespassing animal, whether the action exists at common law or because of a statute. UNOFFICIAL CONSOLIDATION OF THE STATUTES OF YUKON 6 CODIFICATION NON OFFICIELLE DES LOIS DU YUKON POUNDS ACT LOI SUR LES FOURRIÈRES (2) The return mentioned in subsection (1) shall set out (a) the animals impounded during the year; (b) the amount of damages and other charges made; (c) all sales made by the pound keeper; (d) the surplus, if any, made on each sale; and (e) the disposition of every surplus.
