[...] Inconsistencies in regulations Incompatibilité — règlements (3) In the event of an inconsistency between a consolidated regulation published by the Minister under this Act and the original regulation or a subsequent amendment as registered by the Clerk of the Privy Council under the Statutory Instru ments Act, the original regulation or amendment prevails to the extent of the inconsistency. Interpretation Interprétation 2 In this Order, Act means the Natural Products Marketing Act of Nova Scotia; (Loi) Board means the Nova Scotia Marketing Board, estab lished pursuant to the Act; (Régie) Commodity Board means the Nova Scotia Turkey Mar keting Board, established pursuant to the Act; (Office de commercialisation) turkey means a turkey of any variety, grade or class that is raised or kept for slaughter within the Province of No va Scotia and sold for slaughter. (dindon) 2 Dans le présent décret, dindon désigne un dindon de tout genre, catégorie ou classe, élevé ou gardé en Nouvelle-Écosse pour l’abattage et vendu pour l’abattage; (turkey) Loi désigne la loi intitulée Natural Products Marketing Act de la Nouvelle-Écosse; (Act) Office de commercialisation désigne l’office dit Nova Scotia Turkey Marketing Board, constitué en vertu de la Loi; (Commodity Board) Régie désigne la régie dite Nova Scotia Marketing Board constituée en vertu de la Loi. (Board) Interprovincial and Export Trade Marché interprovincial et commerce d’exportation 3 The Board and the Commodity Board are each autho rized to regulate the marketing of turkeys in interprovin cial and export trade and for such purposes may, by or der, with respect to persons and property situated within the Province of Nova Scotia, exercise all or any powers like the powers exercisable by each of them in relation to the marketing of turkeys locally within that Province un der section 4B of the Act. 3 La Régie et l’Office de commercialisation sont respecti vement autorisés à régler la vente du dindon sur le mar ché interprovincial et dans le commerce d’exportation et, pour ces objets, à exercer, par ordonnance, à l’égard des personnes et des biens qui se trouvent dans les limites de la province de la Nouvelle-Écosse, tous pouvoirs sem blables à ceux que chacun peut exercer quant au place ment du dindon, localement, dans les limites de cette province en vertu de l’article 4B de la Loi. Nova Scotia Turkey Order Décret relatif au dindon de la Nouvelle-Écosse Levies Contributions Section 4 Article 4 Current to November 21, 2016 2 À jour au 21 novembre 2016 Levies Contributions 4 The Commodity Board is authorized, (a) [Repealed, SOR/80-90] (b) in relation to the powers granted to it by section 3 with respect to the marketing of turkeys in inter provincial and export trade, to make orders fixing, imposing and collecting levies or charges from persons situated within the Province of No va Scotia who are engaged in the production or market ing of turkeys and for such purpose classifying such per sons into groups and fixing the levies or charges payable by the members of the different groups in different amounts and the Commodity Board may use such levies or charges for its purposes, including the creation of re serves and the payment of expenses and losses resulting from the sale or disposal of turkeys and the equalization or adjustment among the producers of turkeys of moneys realized from the sale thereof during such period or peri ods of time as it may determine. SOR/80-90. 4 L’Office de commercialisation est autorisé, a) [Abrogé, DORS/80-90] b) à l’égard des pouvoirs qui lui sont conférés par l’ar ticle 3, en ce qui concerne le placement du dindon sur le marché interprovincial et dans le commerce d’ex portation, par ordonnance, à fixer, imposer et percevoir des contri butions ou droits de la part de personnes qui se trouvent dans la province de la Nouvelle-Écosse et adonnées à la production ou au placement du dindon et, à cette fin, à classer ces personnes en groupes et à fixer les contribu tions ou droits payables par les membres des différents groupes en divers montants, à employer ces contribu tions ou droits à ses fins, y compris la création de ré serves, et le paiement de frais et pertes résultant de la vente ou de l’aliénation du dindon, et l’égalisation ou le rajustement entre ceux qui ont produit du dindon, des sommes d’argent qu’en rapporte la vente durant la ou les périodes que l’Office de commercialisation peut détermi ner.
