[...] Inconsistencies in regulations Incompatibilité — règlements (3) In the event of an inconsistency between a consolidated regulation published by the Minister under this Act and the original regulation or a subsequent amendment as registered by the Clerk of the Privy Council under the Statutory Instru ments Act, the original regulation or amendment prevails to the extent of the inconsistency. Interpretation Interprétation 2 In this Order, Act means the Natural Products Marketing Act of Nova Scotia; (Loi) Commodity Board means the Pork Producers Market ing Board of Nova Scotia established pursuant to the Act; (Office de commercialisation) hog means any member of the species Sus Scrofa L. (do mestic pig) produced in the Province of Nova Scotia; (porc) Plan means any plan for the marketing of hogs estab lished and amended from time to time pursuant to the Act. (Plan) SOR/82-146, s. 1. 2 Dans le présent décret, Loi désigne la loi intitulée Natural Products Marketing Act de la Nouvelle-Écosse; (Act) Office de commercialisation désigne l’office dit Pork Producers Marketing Board of Nova Scotia constitué en vertu de la Loi; (Commodity Board) Plan désigne tout plan de commercialisation du porc adopté et, à l’occasion, modifié en vertu de la Loi; (Plan) porc désigne tout membre de l’espèce Sus Scrofa L. Interprovincial and Export Trade Marché interprovincial et commerce d’exportation 3 The Commodity Board is authorized to regulate the marketing of hogs in interprovincial and export trade and for such purposes may, with respect to persons and prop erty situated within the Province of Nova Scotia, exercise all or any powers like the powers exercisable by it in rela tion to the marketing of hogs locally within that Province under the Act and the Plan. 3 L’Office de commercialisation est autorisé à régler la vente du porc sur le marché interprovincial et dans le commerce d’exportation et, pour ces objets, à exercer, à l’égard des personnes et des biens qui se trouvent dans les limites de la province de la Nouvelle-Écosse, tous pouvoirs semblables à ceux qu’il peut exercer quant au placement du porc, localement, dans les limites de cette province en vertu de la Loi et du Plan. Nova Scotia Hog Order Décret relatif au porc de la Nouvelle-Écosse Levies Contributions Section 4 Article 4 Current to November 21, 2016 2 À jour au 21 novembre 2016 Levies Contributions 4 The Commodity Board is authorized, (a) [Repealed, SOR/80-90] (b) in relation to the powers granted to it by section 3 with respect to the marketing of hogs in interprovin cial and export trade, to make orders fixing levies or charges and imposing them upon and collecting them from persons described in section 3 who are engaged in the marketing of hogs, and for such purposes, classifying such persons into groups and fixing the levies or charges payable by the members of the different groups in different amounts; and the Commodity Board may use such levies or charges for its purposes, including the creation of reserves, the payment of expenses and losses resulting from the sale or disposal of hogs and the equalization or adjustment among producers of hogs of moneys realized from the sale thereof during such period or periods of time as it may determine. SOR/80-90. 4 L’Office de commercialisation est autorisé, a) [Abrogé, DORS/80-90] b) à l’égard des pouvoirs qui lui sont conférés par l’ar ticle 3 en ce qui concerne le placement du porc sur le marché interprovincial et dans le commerce d’expor tation, par ordonnance, à fixer, imposer et percevoir des contri butions ou droits, de la part de personnes visées à l’ar ticle 3 et adonnées à la production ou au placement du porc et, à cette fin, à classer ces personnes en groupes et à fixer les contributions ou droits payables par les membres des différents groupes en divers montants, à employer ces contributions ou droits à ses fins, y compris la création de réserves, et le paiement de frais et pertes résultant de la vente ou de l’aliénation du porc et l’égali sation ou le rajustement, entre ceux qui ont produit du porc, des sommes d’argent qu’en rapporte la vente du rant la ou les périodes que l’Office de commercialisation peut déterminer.
