In this Act, "Aboriginal Government" means a governing or other body representing an Aboriginal people of the Northwest Territories; (gouvernement autochtone) "Aboriginal Party" means the Gwich’in Tribal Council, Inuvialuit Regional Corporation, Northwest Territory Métis Nation, Sahtu Secretariat Inc., Tåîchô Government and any other Aboriginal Government that becomes a party to the Intergovernmental Agreement; (partie autochtone) "Council" means the Intergovernmental Council on Land and Resource Management established by article 4.1 of the Intergovernmental Agreement; (conseil) "Intergovernmental Agreement" means the Northwest Territories Intergovernmental Agreement on Lands and Resources Management between the Government of the Northwest Territories and the Aboriginal Parties that was made on February 27, 2014; (entente intergouvernementale) "member" means a member of the Council, namely (a) the Minister, and (b) the leader or representative of each Aboriginal Party; (membre) 1. (Minister) Définitions 1 "Minister" means the Minister or Ministers designated by the Executive Council for the purposes of membership on the Council under the Intergovernmental Agreement. (Aboriginal Party) Actions under this Act 2. (1) An action or thing authorized by this Act must be carried out in accordance with the Intergovernmental Agreement. 2. (1) Toute action ou toute chose qu’autorise la présente loi doit être exécutée conformément à l’entente intergouvernementale. Acte autorisé Inconsistency with Agreement (2) In the event of an inconsistency or conflict between this Act and the Intergovernmental Agreement, the Agreement prevails to the extent of the inconsistency or conflict. (1) Unless the members agree otherwise, the Minister shall, at least once each year, participate with the other members in a meeting of the Council. 3. Séances du conseil First meeting (2) The Minister shall convene the first meeting of the Council within six months after the Intergovernmental Agreement comes into effect. (1) Practices and procedures respecting meetings of the Council shall be governed by rules made by the Council in accordance with the Intergovernmental Agreement. 5. Pratiques et procédures Not statutory instruments (2) For greater certainty, rules made by the Council are not statutory instruments within the meaning of the Statutory Instruments Act. Ne constituent pas des textes réglementaires Duties of Council 6. The Council shall carry out the duties set out in article 5 of the Intergovernmental Agreement. 6. Decisions of the Council are not binding on the members, and are subject to authorization or ratification by the members where required. 7. Les décisions du conseil ne lient pas les membres. The Minister may designate one or more employees of the public service to contribute to the functions of the secretariat of the Council referred to in article 4.7 of the Intergovernmental Agreement, or to perform other functions for the purposes of that Agreement. 8. Money required to be expended for the purpose of carrying out obligations of the Government of the Northwest Territories under this Act and the Intergovernmental Agreement shall be paid out of the Consolidated Revenue Fund, as defined in the Financial Administration Act, from money authorized 9. Unless they agree otherwise, the members shall review the Intergovernmental Agreement seven years after this Act comes into force, and then every seven years thereafter. 10.
