"association" means Manitoba Flax Growers Association Inc. "flax" means all flax seed and flax straw produced in Manitoba. "solin" means all solin seed and solin straw produced in Manitoba. Designation 3 Manitoba Flax Growers Association Inc. is designated as the representative organization of all producers of flax and solin in Manitoba. Désignation 3 La Manitoba Flax Growers Association Inc. est désignée à titre d'organisme représentatif de tous les producteurs de lin et de solin au Manitoba. Fees 4 Every producer who produces and markets flax or solin must pay a fee to the association of: (a) 0.5% of the price of the flax seed and solin seed marketed; (b) 1% of the price of flax straw and solin straw marketed. Deduction of fees 5(1) Every purchaser who buys flax or solin from a producer must deduct from the money payable to the producer, the fees payable by the producer to the association. Déduction des cotisations 5(1) L'acheteur de lin ou de solin déduit des sommes qu'il doit au producteur les cotisations que celui-ci est tenu de verser à l'Association. 5(2) Within one month after the end of each of the following periods, every purchaser must forward to the association the fees deducted during the period: (a) the period beginning on January 1 and ending on March 31; (b) the period beginning on April 1 and ending on June 30; (c) the period beginning on July 1 and ending on September 30; (d) the period beginning on October 1 and ending on December 31. 5(2) Les acheteurs sont tenus de faire parvenir à l'Association, au plus tard un mois après la fin de chaque période indiquée ci-après, les cotisations qu'ils ont déduites pendant cette période : a) la période commençant le 1er janvier et se terminant le 31 mars; b) la période commençant le 1er avril et se terminant le 30 juin; c) la période commençant le 1er juillet et se terminant le 30 septembre; d) la période commençant le 1er octobre et se terminant le 31 décembre. 2 Accessed: 2016-03-30 Date de consultation : 2016-03-30 Current from 2011-08-01 to 2016-03-27 À jour du 2011-08-01 au 2016-03-27 FINANCEMENT D'ORGANISMES DE PRODUCTEURS AGRICOLES A18 — R.M. 119/2008 5(3) When fees are forwarded to the association under subsection (2), the purchaser must also provide the association with the following information: (a) the name and address of each producer from whom the fees were withheld; (b) the amount of the fees being forwarded on each producer's behalf; (c) the quantity of flax or solin purchased from each producer. 5(3) Les acheteurs joignent aux cotisations qu'ils font parvenir à l'Association conformément au paragraphe (2) les renseignements suivants : a) le nom et l'adresse de chaque producteur à l'égard duquel des cotisations ont été retenues; b) le montant des cotisations envoyées au nom de chaque producteur; c) la quantité de lin ou de solin achetée à chaque producteur. Use of fees 6 The association is authorized to use the fees for the purpose of defraying the expenses of the organization in carrying out its purpose. Refunds 7(1) A producer may apply to the association for a refund of fees.
