("canola") ../a018e.php ../a018f.php AGRICULTURAL PRODUCERS’ ORGANIZATION FUNDING A18 — M.R. 57/96 2 07/08 Purpose 2 The purpose of this regulation is to stimulate, increase and improve the production and marketing of canola and canola products in Manitoba. Designation 3 Manitoba Canola Growers Association is designated as the representative organization of all producers of canola. Fees 4 Every producer who produces and markets canola shall pay a fee to the association of $1 per tonne on all sales of canola in Manitoba. R.M. 116/2008 Deduction of fees 5(1) Every purchaser who buys canola from a producer shall deduct from the monies payable to the producer, the fees payable by the producer to the association. Déductions 5(1) La personne qui achète du canola à un producteur retient sur le prix à payer le droit que ce dernier est tenu de payer à l'Association. 5(2) Within one month after the end of each of the following periods, every purchaser shall forward to the association the fees deducted during the period: (a) the period beginning on August 1 and ending on October 31; (b) the period beginning on November 1 and ending on January 31; (c) the period beginning on February 1 and ending on April 30; and (d) the period beginning on May 1 and ending on July 31. 5(2) L'acheteur fait parvenir à l'Association, dans le mois qui suit la fin des périodes indiquées ci-après, les droits qu'il a déduits : a) la période du 1er août au 31 octobre; b) la période du 1er novembre au 31 janvier; c) la période du 1er février au 30 avril; d) la période du 1er mai au 31 juillet. 5(3) When fees are forwarded to the association under subsection (2), the purchaser shall also provide the association with the following information: (a) the name and address of each producer from whom the fees were withheld; (b) the amount of the fees being forwarded on that producer's behalf; (c) the quantity of canola purchased from that producer. 5(3) L'acheteur qui fait parvenir les droits conformément au paragraphe (2) fournit également les renseignements suivants : a) le nom et l'adresse des producteurs pour lesquels les droits ont été déduits; b) le montant des droits envoyés au nom de chaque producteur; c) la quantité de canola acheté à chaque producteur. FINANCEMENT D'ORGANISMES DE PRODUCTEURS AGRICOLES A18 — R.M. 57/96 07/08 3 Use of fees 6 The association is authorized to use the fees for the purpose of defraying the expenses of the organization in carrying out its purpose. Refunds 7(1) A producer may apply to the association for a refund of fees. Remboursements 7(1) Les producteurs peuvent demander à l'Association de leur rembourser leurs droits. 7(2) An application for a refund must be made in writing on a form provided by the association and must contain the information that the association requests. 7(2) Les demandes de remboursement se font par écrit à l'aide de la formule que fournit l'Association et comprennent les renseignements qu'exige cette dernière. 7(3) An application for a refund must be received by the association (a) before September 1, for fees deducted in the 6-month period beginning on the previous February 1 and ending on July 31; and (b) before March 1, for fees deducted in the 6-month period beginning on the previous August 1 and ending on January 31. 7(3) Les demandes de remboursement doivent parvenir à l'Association : a) avant le 1er septembre lorsqu'elle visent les droits déduits entre le 1er février précédant et le 31 juillet; b) avant le 1er mars lorsqu'elle visent les droits déduits entre le 1er août précédant et le 31 janvier. 7(4) If the application for a refund complies with this section, the association shall make a refund, (a) not later than April 30, for fees deducted in the 6-month period beginning on the previous August 1 and ending on January 31; and (b) not later than October 31, for fees deducted in the 6-month period beginning on the previous February 1 and ending on July 31. 7(4) L'Association donne suite aux demandes de remboursement qui remplissent les exigences du présent article : a) au plus tard le 30 avril lorsque ces demandes visent les droits déduits entre le 1er août précédant et le 31 janvier; b) au plus tard le 31 octobre lorsque ces demandes visent les droits déduits entre le 1er février précédant et le 31 juillet. Books and records 8 Every purchaser of canola grown or harvested in Manitoba shall keep and maintain complete and accurate books and records respecting the purchase of canola and provide copies of them when requested to do so by the agency. Information 9 The association shall furnish to the agency such information and financial statements as the agency determines necessary to ensure that the fees paid to the association are properly used for the purpose of the association. AGRICULTURAL PRODUCERS’ ORGANIZATION FUNDING A18 — M.R. 57/96 4 07/08 Transitional 10 For 1996, clause 5(2)(c) does not apply and a purchaser shall instead forward to the association, on or before August 31, 1996 the fees deducted in the period beginning on the day this regulation comes into force and ending on July 31.
