L.Y. 2002, ch. 94, art. 3 Oath of office Serment professionnel 4 A forest officer appointed under section 3 shall, before entering on the performance of duties, take and subscribe to the following oath: “I, , a forest officer appointed under the Forest Protection Act, do solemnly swear that to the best of my ability and judgment I will faithfully, honestly and impartially perform my duties as forest officer according to the true intent and meaning of the Forest Protection Act and the regulations made at any time thereunder. L.Y. 2002, ch. 94, art. 7 Leaving fires Extinction des feux 8 Except with the written permission of a forest officer, no person shall leave the vicinity of a fire that they have set out, started, or kindled, other than a fire kindled in a stove, furnace, or other device suitably designed and capable of confining it, until they have totally extinguished it. L.Y. 2002, ch. 94, art. 8 Fire season Période réglementée 9 There shall be a fire season in each year beginning on April 1 and ending on September 30, except that the fire season may be extended, shortened, or designated for one or more additional periods as the Commissioner in Executive Council may prescribe. L.Y. 2002, ch. 94, art. 10 Sites for open fires Emplacement des feux en période réglementée 11 During the fire season a person who sets out, starts, or kindles a fire pursuant to a permit shall select a site for the fire as free from inflammable material as possible and exercise every precaution to prevent the fire from spreading. L.Y. 2002, ch. 94, art. 12 Extinguishment of fires Obligation d'éteindre les feux 13(1) A person who, during the fire season, in or within one kilometre from a forest area, (a) uses any explosives; or (b) throws or drops a burning match, ashes of a pipe, lighted cigarette, or cigar or other burning substance, shall totally extinguish the fire of the explosive, match, ashes, cigarette, cigar, or other burning substance and any fire caused thereby before leaving the vicinity of the fire. 13(1) Quiconque, pendant la période réglementée, dans un secteur forestier ou dans un rayon d'un kilomètre de ce secteur, utilise des explosifs ou jette une substance allumée, notamment une allumette, les cendres d'une pipe, une cigarette ou un cigare allumés est tenu de veiller à ce qu'ils soient complètement éteints et d'éteindre complètement le feu qui peut en résulter avant de quitter les environs. (2) No person shall, during the fire season, in or within one kilometre from a forest area, (a) operate an engine unless it is equipped with a prescribed fire prevention device for arresting sparks and for preventing the escape of fire or live coals from ashpans and fire boxes; (b) operate a steamboat on any water in the Yukon unless it is equipped with a prescribed fire prevention device for arresting sparks; (c) burn any wood-waste in any burner or destructor unless it is equipped with a prescribed fire prevention device for arresting sparks; or (d) use or operate any engine, steamboat, burner or destructor or conduct any logging or other industrial operations unless they have available and in good operating condition any tools, pumps, hoses, and other fire-fighting equipment the forest supervisor may prescribe. L.Y. 2002, UNOFFICIAL CONSOLIDATION OF THE STATUTES OF YUKON 4 CODIFICATION NON OFFICIELLE DES LOIS DU YUKON FOREST PROTECTION ACT LOI SUR LA PROTECTION DES FORÊTS ch. 94, art. 13 Closed areas Secteurs interdits 14(1) When the forest supervisor considers that the safety of life or property in any area of the Yukon is endangered by the hazardous condition of the forest cover or by fire, the forest supervisor may, by order in writing signed by the forest supervisor, declare the area a closed area and prohibit anything therein considered likely to cause or spread fire. 14(1) Le directeur des forêts peut, par ordre écrit signé de sa main, désigner un secteur comme étant un secteur interdit et y interdire toute activité qu'il estime susceptible de causer un incendie ou d'en propager un, s'il est d'avis que la sécurité de la vie et des biens dans ce secteur du Yukon est mise en danger du fait de l'état dangereux de la végétation ou de l'existence d'un incendie. (2) A forest officer may take any emergency action in a closed area as considered necessary to control and extinguish fire and safeguard life and property. (3) Subject to subsection (4), no person shall (a) enter or remain in a closed area for the purpose of travelling, camping, fishing, or hunting or for any similar purpose; or (b) do anything prohibited by an order under subsection (1) in or within one kilometre from a forest area in a closed area, except pursuant to a permit therefore issued under section 15. (4) Subsection (3) does not apply to (a) miners or prospectors while actively engaged in mining or prospecting; (b) permanent residents living in a closed district; or (c) land owners or persons doing anything not prohibited in an order under subsection (1), and those persons are entitled to free access to and egress from their property or operation in a closed area without securing a permit therefore. (5) When, with respect to a closed area established under subsection (1), the forest supervisor considers the danger to have abated, the forest supervisor shall, by order in writing signed by the forest supervisor, cancel the order establishing the closed area. L.Y. 2002, ch. 94, art. 14 Permits Permis 15(1) The Minister, the forest supervisor or a person authorized in writing by the forest supervisor may issue permits authorizing, subject to orders and regulations, (a) the use of fire during the fire season for the purpose of clearing land, cooking or preparing food, or obtaining warmth; (b) the burning of inflammable material during the fire season; (c) the use of fire during the fire season for any industrial purpose; and (d) the entry of a closed area and the doing of anything prohibited by an order under subsection 14(1), for any periods of time and on any terms and conditions as the Minister or the forest supervisor may specify in the permit. 15(1) Le ministre, le directeur des forêts ou la personne que celui-ci désigne par écrit peuvent délivrer des permis autorisant le titulaire, sous réserve des ordres et des règlements, pour la période et sous réserve des modalités que le ministre ou le directeur des forêts précise dans le permis : a) à faire du feu durant la période réglementée pour déblayer un terrain, cuire des aliments ou se chauffer; b) à brûler des matières inflammables durant la période réglementée; c) à faire du feu à des fins industrielles durant la période réglementée; d) à pénétrer dans un secteur interdit et à y exercer une activité interdite par l'ordre donné en vertu du paragraphe 14(1). (2) Despite anything contained in this Act, the Commissioner in Executive Council, the forest supervisor or a forest officer may, for any cause considered sufficient, suspend or cancel any permit. (3) The owner of every camp, mine, sawmill, or engine that is situated within one kilometre from a forest area shall establish a fire guard, satisfactory to the forest supervisor, around the camp, mine, sawmill, or engine. (4) Every person clearing a right of way for any trail, telephone, telegraph, power or pipeline, road, highway, ditch, or flume shall, if directed to do so by the forest supervisor, pile, burn, or otherwise dispose of all inflammable material on the right of way to the satisfaction of the forest supervisor, as rapidly as the clearing progresses and the weather conditions permit, or at any other time that the forest supervisor orders. (5) No person clearing any land or carrying on any lumbering operation shall fell or permit to be felled any trees or brush in such a manner that the trees or brush fall and remain on land of which the person is not the owner. (6) Subject to sections 9 and 14, every person who causes an accumulation of inflammable material within 100 metres of the right of way of any railway shall immediately pile and burn the inflammable material.
