AGRICULTURAL PRODUCTS ACT Pursuant to subsection 24 of the Agricultural Products Act, the Commissioner in Executive Council orders as follows: 1. Commissaire du Yukon O.I.C. 1988/103 AGRICULTURAL PRODUCTS ACT DÉCRET 1988/103 LOI SUR LES PRODUITS AGRICOLES 1YUKON REGULATIONS RÈGLEMENTS DU YUKON AGRICULTURAL PRODUCT APPEAL BOARD REGULATIONS 1. These regulations may be cited as the Agricultural Product Appeal Board Regulations. Agricultural Products Appeal Board 2.(1) The Agricultural Products Appeal Board shall consist of at least three and not more than five members. (2) The Executive Council member shall appoint the members of the board and, after consulting with them, may designate the chair and vice-chair of the board. Board Members Term of Office 3.(1) The chair shall hold office during pleasure for a term of three years and the other members shall hold office during pleasure for a term of two years. (2) Members are eligible for reappointment at the end of their term. Appeals to the Board 4.(1) An appeal against a decision or order of the board must be by written notice of appeal delivered to an inspector or to the Deputy Head of the Department of Renewable Resources within 90 days of the day the decision or order is pronounced. (2) An application under subsection 15(3) of the Act to determine the market value of an agricultural product must be by notice in writing delivered (a) to an inspector or to the Deputy Head of the Department of Renewable Resources, where the applicant is the owner of the agricultural product, or (b) to the owner of the agricultural product and to the board, where the applicant is the Executive Council member. (3) The inspector or Deputy Head who receives a notice of appeal or notice of application under subsection 15(3) of the Act shall forthwith deliver the notice to the chair of the board. Board Meetings 5.(1) The board shall meet at the call of the chair. RÈGLEMENT SUR LA COMMISSION D’APPEL DES PRODUITS AGRICOLES 1. Titre : Règlement sur la Commission d’appel des produits agricoles. Commission d’appel des produits agricoles 2.(1) La Commission d’appel des produits agricoles se compose d’au moins trois membres et d’au maximum cinq. (2) Le membre représentant le Conseil exécutif choisit les autres membres et, après consultation de ces derniers, peut désigner le président et le vice-président de la Commission. Mandat des membres 3.(1) Le président garde son poste jusqu’à la conclusion d’un mandat de trois ans. Le mandat des autres membres est fixé à deux ans. (2) Les membres peuvent être nommés pour un deuxième mandat consécutif à la conclusion du premier. Appel 4.(1) Tout appel concernant une décision ou une ordonnance de la Commission se fait par avis écrit remis à un inspecteur ou au sous-ministre des Richesses renouvelables dans les 90 jours qui suivent la date de la décision ou de l’ordonnance. (2) La demande écrite présentée aux termes du paragraphe 15(3) de la Loi (valeur marchande d’un produit agricole) est remise : a) soit à un inspecteur ou au sous-ministre des Richesses renouvelables, si le demandeur est le propriétaire du produit; b) soit au propriétaire du produit agricole et à la Commission, si le demandeur est le membre représentant le Conseil exécutif. (3) L’avis d’appel remis à un inspecteur ou au sous ministre aux termes du paragraphe 15(3) de la Loi est transmis au président de la Commission. Réunion de la Commission 5.(1) La Commission se réunit à la demande du O.I.C. 1988/103 AGRICULTURAL PRODUCTS ACT DÉCRET 1988/103 LOI SUR LES PRODUITS AGRICOLES 2YUKON REGULATIONS RÈGLEMENTS DU YUKON (2) The chair shall call a board meeting forthwith after receiving a notice of appeal or a notice of application under subsection 15(3) of the Act. Written notice of the meeting must be given to the appellant, or applicant, and to the respondent concerned with the appeal or application that the board proposes to deal with at the meeting. (3) The board shall allow the parties to the appeal or application to give evidence and to present argument at the hearing. Decisions of the Board 6.(1) On hearing an appeal the board may dismiss the appeal or rescind the decision or order of the inspector and make the decision or order that the inspector ought to have made. (2) The board shall make its decision within 30 days of the conclusion of the hearing and shall forthwith in writing inform the party of its decision and the reasons for its decision. Reports of the Board 7.(1) The board shall report to the Executive Council Member on the proceedings of the board whenever the Executive Council Member requests that it do so. président. Décision de la Commission 6.(1) La Commission peut rejeter l’appel ou la décision ou l’ordonnance de l’inspecteur après examen des faits et prendre la décision qui s’impose ou délivrer l’ordonnance appropriée. (2) La Commission rend sa décision dans les 30 jours suivant l’audience et en informe les parties par écrit, avec explications. Rapport 7.(1) La Commission fait un rapport sur les audiences au membre représentant le Conseil exécutif chaque fois que celui-ci lui en fait la demande.
