Offences 3 The offences in relation to which administrative pen alties may be payable are those set out in Schedule A. Degree of seriousness of alleged offence 4(1) Subject to subsections (2), (3) and (4), a Director who permits a person to pay an administrative penalty un der section 31 of the Act in relation to an alleged offence has the discretion to determine the degree of seriousness of the alleged offence. 4(2) In determining the degree of seriousness of an al leged offence, the Director shall determine, in the opinion of the Director, (a) whether the alleged offence constituted a minor, moderate or major deviation from the requirements of the statutory or regulatory provision allegedly breached, and (b) whether the potential for adverse impact to the en vironment posed by the alleged offence was none or was minor, moderate or major. 4(3) A Director who has made the determinations re quired under subsection (2) shall establish a range for the daily administrative penalty in accordance with Schedule B. 4(4) Having established a range for an administrative penalty, the Director shall determine the amount of the daily administrative penalty within the range, which shall reflect (a) the importance played by compliance in the ad ministration of the Act and the regulations, Définitions 2 Dans le présent règlement « contrevenant présumé » désigne une personne à qui il est permis ou peut être permis de payer une amende admi nistrative; « Loi » désigne la Loi sur l’assainissement de l’air; « lois sur l’environnement » désigne la Loi sur l’assai nissement de l’air, la Loi sur l’assainissement de l’envi ronnement, la Loi sur l’assainissement de l’eau, la Loi sur le contrôle des pesticides et les règlements établis sous leur régime. Infractions 3 Les infractions pour lesquelles des amendes adminis tratives sont payables sont indiquées à l’Annexe A. Gravité de l’infraction présumée 4(1) Sous réserve des paragraphes (2), (3) et (4), un di recteur qui permet à une personne de payer une amende administrative en vertu de l’article 31 de la Loi relative ment à une infraction présumée peut, à sa discrétion, dé terminer la gravité de cette dernière. 4(2) Lorsqu’il détermine la gravité d’une infraction pré sumée, le directeur doit déterminer si, à son avis, a) l’infraction présumée constitue une transgression mineure, modérée ou importante des exigences de la disposition législative ou réglementaire qui est présu mée avoir été enfreinte, et b) le risque d’atteinte néfaste à l’environnement créé par l’infraction présumée est nul ou mineur, modéré ou important. 4(3) Un directeur qui a tranché les questions tel que re quis en vertu du paragraphe (2), doit établir une échelle des amendes administratives quotidiennes conformément à l’Annexe B. 4(4) Un directeur qui a établi une échelle pour une amende administrative doit fixer le montant de l’amende administrative quotidienne selon l’échelle, et ce montant doit tenir compte de a) l’importance de se conformer à la Loi et aux règle ments, 3 C-5.2 Clean Air Act 98-41 (b) the degree of wilfulness or negligence involved in the alleged offence, (c) whether or not there was any mitigation in rela tion to the alleged offence, (d) whether or not steps have been taken to prevent a recurrence of the alleged offence, (e) whether or not the alleged offender has a history of non-compliance with environmental legislation, (f) whether or not the alleged offender or another per son benefited from the alleged offence, and (g) any other factors the Director considers relevant. Calculation of total amount of administrative penalty 5 Subject to subsection 31(5) of the Act, the total amount of an administrative penalty set out in a written notice delivered to an alleged offender under subsection 31(3) of the Act shall be the product of (a) the amount of the daily administrative penalty de termined by the Director under this Regulation, and (b) the number of days or parts of a day during which, in the opinion of the Director, the alleged offence con tinued. Calcul du montant total de l’amende administrative 5 Sous réserve du paragraphe 31(5) de la Loi, le montant total d’une amende administrative établi dans un avis écrit délivré à un contrevenant présumé en vertu du paragraphe 31(3) de la Loi équivaut au produit a) du montant de l’amende administrative quoti dienne fixé par le directeur en vertu du présent règle ment, et b) du nombre de jours ou parties de jours durant les quels, de l’avis du directeur, l’infraction présumée s’est poursuivie.
