Act to amend the Watershed Conservation Districts Act (Chapter 65)

Subaec, (2) ot sec. , amended. C HAP T E R 65 An Act to amend The Watershed Conservation Districts Act. [Assented to A pril 15th, 1961 ] HE R 'iVIAJ ESTY, by an d with t he advice and consent of theLegi slative Assembly of Manitoba, enacts as follows: ~l~d(d~ld. ot sec. 1. Section 2 of The Watershed Conse rv ation Districts Act, being chapt er 70 of the Stat utes of Manitoba, 1959 (Second Session), is amend ed by adding t hereto, immediately after clause (Ie) thereof, t he fo llowing cla use: "f:~d~.bl. ( le1) " rateable land" means land liable to taxation by a municipali ty bu t does not include any improvements, buildings, erections, structures, or fixtures, built, erected, constructed, fixed or placed on the land. 2. Subsection (2) of section 6 of the Act is amended (a) by adding thereto, immediately after the word "comprise" in the first line thereof, the word "rateable"; (b) by striking out the word "equalized" in the sec ond line thereof; (c) by striking out the word "equalized" in the third line thereof; and (d, by adding thereto, immediately after the word "the" where it appears for the third time in the third line thereof, the word "rateable". Subsec. (2) ot sec. 17 amended. 3. Subsection (2) of section 17 of the Act is amended (a) by striking out the word "ten" in the second line of clause (b) thereof and substituting therefor the word "five": . , .:So (b) by striking out the word "equalized" in the sev enth line thereof; Subsec. ( . ) ot sec. 17 amended. and (c) by striking out the word "property" in the eighth line thereof and substituting therefor the word "land". 4. Subsection (4) of section 17 of the Act is amended 347 1961 WATERSHED CONSERVATION DISTRICTS CAP. 65 and (a) by striking out the word "equalized" in the third line thereof; Subsecs. (6), .(7), and (8) ot sec. 17 repealed and subatttuted. Levy ot taxes. Payment ot amount apportioned. Paymentot apportionment by local sovt. dlst, Special levy on part ot munici pality to cover deficit. 348 (b) by striking out the word "property" in the fourth line thereof and substituting therefor the word "land". 5. Subsections (6), (7), and (8) of section 17 of the Act are repealed and the following subsections are substituted therefor: (6) Subject to subsection (2) of section 21, the board shall, not later than the last day of February in each year, forward to each included municipality a statement of the amount apportioned to it in respect of that year; and the statement shall be in such form and contain such particu lars as may be prescribed in the regulations; and the municipality shall thereupon levy and collect as a special rate, a tax on the assessed value (a) of the rateable land; or (b) of the land as defined in clause (f) of section 983 of The Municipal Act; within the included area for the purpose of making pay ment to the board of the amount apportioned to it. (7) Except in the case of a local government district, each included municipality shall, after making a levy un der subsection (6) in any year, pay to the board (a) on or before the thirty-first day of August in that year an amount that is not less than twenty-five per centum of the amount apportioned to it; (b) on or before the thirty-first day of October in that year an amount that together with the amount paid under clause (a) amounts to not less than eighty-five per centum of the amount appor tioned to it; and (c) on or before the thirty-first day of December in that year the balance of the amount apportioned to it. (8) Each local government district within the includ ed area shall, after making a-Ievy under subsection (6) in any year, pay to the board on or before the tenth day of each month the amount of the levy collected in the next preceding month. (9) Where an included area does not comprise the whole of a municipality, if in any year the amount col CAP. 65 WATERSHED CONSERVAnON DISTRICTS 1961 lected under subsection (6) or under this subsection is not sufficient to pay the amount apportioned to the munici pality in respect of the included area, and those amounts have been paid by the municipality from its general funds, the municipality may, in any subsequent year, levy and collect as an additional special rate, a tax (a) on the rateable lands; or (b) on the lands as defined in clause (f) of sec tion 983 of The Municipal Act; within the included area for the purpose of reimbursing its general funds the amount of the deficiency paid there from as aforesaid. Subsec. (1) or 6. Subsection (1) of section 18 of the Act is amendedsec. 18 amended, (a) by striking out the word "equalized" in the eleventh line thereof; and (b) by striking out the word "property" in the twelfth line thereof and substituting therefor the word "land". Subsection (2) of section 18 of the Act is amended (a) by striking out the word "equalized where it ap pears in the fifth, eighth, and tenth lines thereof; (b) by striking out the word "property" in the sixth, ninth, and eleventh lines thereof and substituting there for, in each case, the word "land". 8. Subsection (3) of section 18 of the Act is amended (a) by striking out the word "equalized" in the sixth line thereof; (b) by striking out the word "property" in the sev enth line thereof and substituting therefor the word "land". 9.
