This Act shall: a) Be called the TOBACCO CONTROL (AMENDMENT) ACT OF BHUTAN 2014; b) Come into force on the 11th Day of the 5th Month of the Wood Male Horse Year of the Bhutanese Calendar corresponding to the 8th Day of July 2014;and c) Extend to the whole of Bhutan. 2. In the Tobacco Control Act 2010, hereinafter referred to as the Act, after section 2, a new section is inserted namely : Section 2A The Tobacco Control (Amendment) Act of Bhutan 2012 is hereby repealed. 3. In the Act, Section 4 is amended as: The person-in-charge may designate a smoking area and shall display notices indicating smoking is prohibited in all other areas. 5. In the Act, Section 11 (a) is amended as: Cultivate, harvest or manufacture tobacco or tobacco products. 6. In the Act, Section 11 (b) is amended as: Sell or distribute tobacco or tobacco products. 7. In the Act, Section 11 (c) is amended as: Buy tobacco or tobacco products. 8. In the Act, New Section is inserted namely: Section 11 (d) Possess tobacco or tobacco products without proof of tax and duty payments or beyond the permissible quantity and type determined by Parliament. 9. In the Act. New section is inserted namely: Section 11 (e) Knowingly transport tobacco or tobacco products without proof of tax and duty payments or beyond the permissible quantity and type determined by Parliament. Tobacco Control (Amendment) Act of Bhutan 2014 2 ༤. བཅའ་ཁྲིམས་དེའི་དོན་ཚན་ ༤ པ་དེ་ གཤམ་འཁོད་ལྟར་འཕྲི་སྣོན་མཛད་གྲུབ། འགན་འཛིན་མི་ངོམ་གྱིས་ ཏམ་ཁུ་འཐུང་སའི་ས་ཁོངས་ཅིག་ངོས་འཛིན་འབད་དགོཔ་ དང་ ས་ཁོངས་གཞན་ཚུ་ནང་ ཏམ་ཁུ་འཐུང་མི་ཆོག་ཟེར་བའི་བརྡ་བྱང་ཚུ་སྦྱར་ཏེ་བཞག་ དགོ། ༥. བཅའ་ཁྲིམས་དེའི་དོན་ཚན་ ༡༡ (ཀ) པ་དེ་ གཤམ་འཁོད་ལྟར་འཕྲི་སྣོན་མཛད་གྲུབ། ཏམ་ཁུ་ ཡང་ན་ ཏམ་ཁུའི་ཐོན་སྐྱེད་ འཛུགས་སྐྱོང་ བསྡུ་སྒྱོམ་ ཡང་ན་ བཟོ་བསྐྲུན་ སོགས་འབད་མི་ཆོག། ༦. བཅའ་ཁྲིམས་དེའི་དོན་ཚན་ ༡༡ (ཁ) པ་དེ་ གཤམ་འཁོད་ལྟར་འཕྲི་སྣོན་མཛད་གྲུབ། ཏམ་ཁུ་ ཡང་ན་ ཏམ་ཁུའི་ཐོན་སྐྱེད་ཚུ་ བཙོང་བ་ ཡང་ན་ བགོ་བཀྲམ་འབད་མི་ཆོག། ༧. བཅའ་ཁྲིམས་དེའི་དོན་ཚན་ ༡༡ (ག) པ་དེ་ གཤམ་འཁོད་ལྟར་འཕྲི་སྣོན་མཛད་གྲུབ། ཏམ་ཁུ་ ཡང་ན་ ཏམ་ཁུའི་ ཐོན་སྐྱེད་ཚུ་ ཉོ་མི་ཆོག། ༨. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་གསརཔ་ གཤམ་འཁོད་ལྟར་བཙུགས་ཡོད། དོན་ཚན་ ༡༡ (ང) ཏམ་ཁུ་ ཡང་ན་ ཏམ་ཁུའི་ཐོན་སྐྱེད་ཚུ་ ཅ་ཁྲལ་དང་ ནང་འདྲེན་ཚོང་ཁྲལ་སྤྲོད་པའི་སྒྲུབ་ བྱེད་མེད་པ་ ཡང་ན་ སྤྱི་ཚོགས་ཀྱིས་ཐག་བཅད་གྲུབ་པའི་ཚད་གཞི་ལས་ལྷག་སྟེ་ འཆང་ སྤྱོད་འབད་མི་ཆོག། ༩. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་གསརཔ་ གཤམ་འཁོད་ལྟར་བཙུགས་ཡོད། དོན་ཚན་ ༡༡ (ཅ) ཏམ་ཁུ་ ཡང་ན་ ཏམ་ཁུའི་ཐོན་སྐྱེད་ཚུ་ ཤེས་བཞིན་དུ་ ཅ་ཁྲལ་དང་ནང་འདྲེན་ཚོང་ཁྲལ་ སྤྲོད་པའི་སྒྲུབ་བྱེད་མེད་པ་ ཡང་ན་ སྤྱི་ཚོགས་ཀྱིས་ཐག་བཅད་གྲུབ་པའི་ཚད་གཞི་ལས་ ལྷག་སྟེ་ སྐྱེལ་འདྲེན་འབད་མི་ཆོག། འབྲུག་གི་ཏམ་ཁུ་དམ་འཛིན་(འཕྲི་སྣོན་)བཅའ་ཁྲིམས་ ༢༠༡༤ ཅན་མ། ༢ 10. In the Act, Section 12 is amended as: A person may import tobacco or tobacco products for personal consumption as per the quantity and type determined by Parliament in Annexure 1. 11. In the Act, Section 13 is amended as: A person importing tobacco or tobacco products for personal consumption shall pay duties and taxes as prescribed by Parliament. 12. In the Act, Section 15 is amended as: All tobacco products imported for personal consumption shall show the country of origin and appropriate health warnings. 13. In the Act, Section 16 is repealed. 14. In the Act, Section 26 (b) is amended as: Board may designate smoking rooms/areas in public places under section (3) from time to time. 15. In the Act, Title of Section 37 is amended as: Functions of Dzongkhag Tshogdu, Gewog Tshogde and Thromde Tshogde 16. In the Act, Section 37 is amended as: The Dzongkhag Tshogdu, Gewog Tshogde and Thromde Tshogde shall provide support and cooperation for co-ordination and conduct awareness programs on tobacco control. Tobacco Control (Amendment) Act of Bhutan 2014 3 ༡༠. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༡༢ པ་དེ་ གཤམ་འཁོད་ལྟར་འཕྲི་སྣོན་མཛད་གྲུབ། མི་ངོམ་གཅིག་གིས་ སྒེར་སྤྱོད་དོན་ལུ་ ཏམ་ཁུ་ ཡང་ན་ ཏམ་ཁུའི་ཐོན་སྐྱེད་ཚུ་ སྤྱི་ ཚོགས་ཀྱིས་ཐག་བཅད་གྲུབ་པའི་ཟུར་སྦྲགས་ ༡ པའི་ནང་འཁོད་མི་ ཚད་གཞི་དང་ འཁྲིལ་ཏེ་ནང་འདྲེན་འབད་ཆོག། ༡༡. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༡༣ པ་དེ་ གཤམ་འཁོད་ལྟར་འཕྲི་སྣོན་མཛད་གྲུབ། རང་སོའི་སྒེར་སྤྱོད་ཀྱི་དོན་ལུ་ ཏམ་ཁུ་དང་ ཏམ་ཁུའི་ཐོན་སྐྱེད་ཚུ་ ནང་འདྲེན་འབད་མི་ མི་ངོམ་དེ་གིས་ ཅ་ཁྲལ་དང་ཚོང་ཁྲལ་ཚུ་ སྤྱི་ཚོགས་ཀྱི་ཆེད་དུ་བཀོད་མི་དང་འཁྲིལ་ཏེ་ སྤྲོད་དགོ། ༡༢. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༡༥ པ་དེ་ གཤམ་འཁོད་ལྟར་འཕྲི་སྣོན་མཛད་གྲུབ། རང་སོའི་སྒེར་སྤྱོད་ཀྱི་དོན་ལུ་ ནང་འདྲེན་འབད་དེ་ཡོད་མི་ཏམ་ཁུའི་རིགས་ཚུ་ འབྱུང་སའི་ རྒྱལ་ཁབ་དང་ འདི་གིས་གཟུགས་ཁམས་འཕྲོད་བསྟེན་ལུ་གནོད་ཉེན་ཡོད་པའི་སྐོར་ལས་ ཉེན་བརྡ་འཁོད་དགོ། ༡༣. བཅའ་ཁྲིམས་འདི་གིས་ དོན་ཚན་ ༡༦ པ་ཆ་མེད་མཛད་གྲུབ། ༡༤. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༢༦ (ཁ) པ་དེ་ ཨིང་སྐད་ནང་འཕྲི་སྣོན་མཛད་ཡོད། ༡༥. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༣༧ པའི་མགོ་རྒྱན་ གཤམ་འཁོད་ལྟར་འཕྲི་སྣོན་ མཛད་གྲུབ། རྫོང་ཁག་ཚོགས་འདུ་དང་ རྒེད་འོག་ཚོགས་སྡེ་ ཁྲོམ་སྡེ་ཚོགས་སྡེ་ཚུ་གི་ལས་འགན། ༡༦. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༣༧ པ་དེ་ གཤམ་འཁོད་ལྟར་འཕྲི་སྣོན་མཛད་གྲུབ། རྫོང་ཁག་ཚོགས་འདུ་དང་ རྒེད་འོག་ཚོགས་སྡེ་ ཁྲོམ་སྡེ་ཚོགས་སྡེ་ཚུ་གིས་ ཏམ་ཁུ་དམ་ འཛིན་ཐོག་ལུ་ འགོ་འདྲེན་འཐབ་ནི་དང་ གོ་བ་བརྡ་སྤྲོད་ཀྱི་ལས་རིམ་ཚུ་ནང་ མཉམ་ འབྲེལ་དང་རྒྱབ་སྐྱོར་འབད་དགོ འབྲུག་གི་ཏམ་ཁུ་དམ་འཛིན་(འཕྲི་སྣོན་)བཅའ་ཁྲིམས་ ༢༠༡༤ ཅན་མ། ༣ 17. In the Act, Section 39 is repealed. 18. In the Act, Section 40 is amended as: The Road Safety and Transport Authority shall coordinate and conduct awareness programs on tobacco control within the public and private transport system. 19. In the Act, Section 41 is amended as: Any Civil Society organization may conduct awareness programs on the ill effects of tobacco consumption. 20. In the Act, Section 46 is amended as: An Authorized Officer shall dispose seized tobacco or tobacco products in accordance with the Rules framed by the Tobacco Control Board. 21. In the Act, Section 50 is amended as: Any person who contravenes section 11 (a) and (b) shall be punished with misdemeanor as per the Penal Code of Bhutan and pay fine equivalent to a minimum of 12 months and maximum of 35 months of minimum wage. 22. In the Act, after section 50, a new Section is inserted namely Section 50A Any person who contravenes section 11 (a) and (b) of this Act for the second time shall be punished with felony of fourth degree as per the Penal Code of Bhutan. Tobacco Control (Amendment) Act of Bhutan 2014 4 ༡༧. བཅའ་ཁྲིམས་འདི་གིས་ དོན་ཚན་ ༣༩ པ་ཆ་མེད་མཛད་གྲུབ། ༡༨. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༤༠ པ་དེ་ གཤམ་འཁོད་ལྟར་འཕྲི་སྣོན་མཛད་གྲུབ། ལམ་འགྲུལ་ཉེན་སྲུང་དང་སྐྱེལ་འདྲེན་དབང་འཛིན་གྱིས་ མི་མང་དང་སྒེར་སྡེའི་སྐྱེལ་འདྲེན་ ཚུ་ནང་ ཏམ་ཁུ་དམ་འཛིན་གྱི་གོ་བ་བརྡ་སྤྲོད་ཀྱི་ ལས་རིམ་མཉམ་འབྲེལ་དང་འགོ་འདྲེན་ འཐབ་དགོ། ༡༩. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༤༡ པ་དེ་ གཤམ་འཁོད་ལྟར་འཕྲི་སྣོན་མཛད་གྲུབ། མི་སྡེའི་ལས་ཚོགས་གང་རུང་གིས་ རང་སོའི་ས་གནས་ནང་ལུ་ ཏམ་ཁུ་ལག་ལེན་འཐབ་ པའི་གནོད་སྐྱོན་སྐོར་ལས་ གོ་བ་བརྡ་སྤྲོད་ཀྱི་ ལས་རིམ་འགོ་འདྲེན་འཐབ་ཆོག། ༢༠. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༤༦ པ་དེ་ གཤམ་འཁོད་ལྟར་འཕྲི་སྣོན་མཛད་གྲུབ། བཙན་ལེན་འབད་དེ་ཡོད་པའི་ཏམ་ཁུ་ ཡང་ན་ ཏམ་ཁུའི་རིགས་ཚུ་ ཏམ་ཁུ་དམ་འཛིན་ བཀོད་ཚོགས་ཀྱི་བཟོ་སྟེ་ཡོད་པའི་བཅའ་ཡིག་དང་འཁྲིལ་ཏེ་ དབང་ཆ་གྲུབ་པའི་འགོ་ དཔོན་ཅིག་གིས་ཕྱི་སེལ་འབད་ཆོག ༢༡. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༥༠ པ་དེ་ གཤམ་འཁོད་ལྟར་འཕྲི་སྣོན་མཛད་གྲུབ། དོན་ཚན་ ༡༡ (ཀ) དང་ (ཁ) པ་ལས་འགལ་བའི་ མི་ངོ་དེ་ལུ་ འབྲུག་གི་ ཉེས་ འགེལ་ཁྲིམས་དེབ་ལྟར་ ཉེས་ཕྲའི་ཉེས་ཁྲིམས་སྨིན་དགོཔ་དང་ ཉུང་ཤོ་ཟླ་ངོ་ ༡༢ དང་ མཐོ་ཤོ་ཟླ་ངོ་ ༣༥ དང་འདྲ་མཉམ་གྱི་ གླ་ཆ་ཉུང་ཤོས་ཀྱི་ ཉེས་ཆད་སྤྲོད་དགོ། ༢༢. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༥༠ པའི་རྗེས་སུ་ དོན་ཚན་གསརཔ་ གཤམ་འཁོད་ ལྟར་བཙུགས་ཡོད། དོན་ཚན་ ༥༠ཀ དོན་ཚན་ ༡༡(ཀ) པ་དང་ (ཁ) པའི་ ཉེས་ལས་བསྐྱར་ཟློས་ཅན་གྱི་ མི་ངོ་དེ་ལུ་ འབྲུག་གི་ ཉེས་འགེལ་ཁྲིམས་དེབ་ལྟར་ དབྱེ་རིམ་བཞི་པའི་ཉེས་ཁྲིམས་སྨིན་དགོ། འབྲུག་གི་ཏམ་ཁུ་དམ་འཛིན་(འཕྲི་སྣོན་)བཅའ་ཁྲིམས་ ༢༠༡༤ ཅན་མ། ༤ 23. In the Act, Section 51 is amended as: Any person who contravenes section 11 (c) of this Act shall be punished with petty misdemeanor as per the Penal Code of Bhutan. However, if tobacco or tobacco products bought is more than the permissible quantity, he or she shall be punished with misdemeanor as per the Penal Code of Bhutan and pay a fine three times the value of the tobacco or tobacco products. 24. In the Act, after section 51, a new Section is inserted namely: Section 51A a) Any person who contravenes section 11 (c) of this Act for the second time shall be punished with misdemeanor as per the Penal Code of Bhutan and pay a fine six times the value of the tobacco or tobacco products. b) Any person who contravenes section 11 (c ) of this Act for the third time shall be punished with felony of fourth degree as per the Penal Code of Bhutan. 25. In the Act, after section 51A, a new Section is inserted namely: Section 51B Any person who contravenes section 11(d) of this Act shall be: a) Fined double the value of tobacco or tobacco products, if he or she possesses tobacco or tobacco products within the permissible quantity without proof of tax and duty payments. b) Punished with petty misdemeanor as per the Penal Code of Bhutan, if he or she possesses tobacco or tobacco products Tobacco Control (Amendment) Act of Bhutan 2014 5 ༢༣. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༥༡ པ་དེ་ གཤམ་འཁོད་ལྟར་འཕྲི་སྣོན་མཛད་གྲུབ། དོན་ཚན་ ༡༡(ག) པ་ལས་འགལ་་བའི་ མི་ངོ་དེ་ལུ་ འབྲུག་གི་ ཉེས་འགེལ་ཁྲིམས་དེབ་ ལྟར་ ཉེས་པ་ཡང་ཕྲའི་ཉེས་ཁྲིམས་སྨིན་དགོ། གལ་སྲིད་ ཏམ་ཁུ་ ཡང་ན་ ཏམ་ཁུའི་ ཐོན་སྐྱེད་ཚུ་ ནང་འདྲེན་འབད་ཆོག་པའི་ཚད་གཞི་ལས་ལྷག་སྟེ་འབག་འོང་པ་ཅིན་ མི་ ངོམ་འདི་ལུ་ འབྲུག་གི་ཉེས་འགེལ་ཁྲིམས་དེབ་ལྟར་ ཉེས་ཕྲ་སྨིན་དགོཔ་དང་ ཏམ་ཁུ་ ཡང་ན་ ཏམ་ཁུའི་ཐོན་སྐྱེད་ཀྱི་ རིན་ཐང་གསུམ་ལྟབ་ཀྱི་ཉེས་ཆད་སྤྲོད་དགོ། ༢༤. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༥༡ པའི་རྗེས་སུ་ དོན་ཚན་གསརཔ་ གཤམ་འཁོད་ ལྟར་བཙུགས་ཡོད། དོན་ཚན་ ༥༡ཀ ཀ༽ དོན་ཚན་ ༡༡ (ག) པའི་ ཉེས་ལས་བསྐྱར་ཟློས་ཅན་གྱི་ མི་ངོ་དེ་ལུ་ འབྲུག་ གི་ ཉེས་འགེལ་ཁྲིམས་དེབ་ལྟར་ ཉེས་ཕྲའི་ཉེས་ཁྲིམས་སྨིན་དགོཔ་དང་ ཏམ་ ཁུ་དང་ ཏམ་ཁུའི་ཐོན་སྐྱེད་ཀྱི་ རིན་ཐང་དྲུག་ལྟབ་དང་འདྲ་མཉམ་གྱི་ཉེས་ཆད་ སྤྲོད་དགོ། ཁ༽ ཉེས་ལས་བསྐྱར་ཟློས་ཐེངས་གསུམ་པའི་ མི་ངོམ་ཨིན་པ་ཅིན་ འབྲུག་གི་ཉེས་ འགེལ་ཁྲིམས་དེབ་ལྟར་ དབྱེ་རིམ་བཞི་པའི་ཉེས་ཁྲིམས་སྨིན་དགོ། ༢༥. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༥༡ཀ་པའི་རྗེས་སུ་ དོན་ཚན་གསརཔ་ གཤམ་འཁོད་ ལྟར་བཙུགས་ཡོད། དོན་ཚན་ ༥༡ཁ། དོན་ཚན་ ༡༡ (ང) པ་ལས་འགལ་བའི་ མི་ངོམ་གང་རུང་ཅིག་ལུ། ཀ༽ གལ་སྲིད་ མི་ངོམ་ཅིག་གིས་ ཏམ་ཁུ་ཡང་ན་ ཏམ་ཁུའི་ཐོན་སྐྱེད་ཚུ་ ཚོང་ ཁྲལ་སྤྲོད་ཡོད་པའི་སྒྲུབ་བྱེད་མེད་པར་ གནང་བ་གྲུབ་པའི་ ཚད་གཞི་ནང་འཁོད་ འཆང་སྤྱོད་འབད་བ་ཅིན་ ཁོ/མོ་ལུ་ ཏམ་ཁུ་ ཡང་ན་ ཏམ་ཁུའི་ཐོན་སྐྱེད་ཀྱི་ རིན་ཐང་གཉིས་ལྟབ་ཀྱི་ཉེས་ཆད་སྤྲོད་དགོ། ཁ༽ གལ་སྲིད་ ཁོ/མོ་གིས་ ཏམ་ཁུ་ ཡང་ན་ ཏམ་ཁུའི་ཐོན་སྐྱེད་ཚུ་ གནང་བ་གྲུབ་ པའི་ ཚད་གཞི་ལས་ལྷག་སྟེ་ འཆང་སྤྱོད་འབད་བ་ཅིན་ འབྲུག་གི་ཉེས་འགེལ་ འབྲུག་གི་ཏམ་ཁུ་དམ་འཛིན་(འཕྲི་སྣོན་)བཅའ་ཁྲིམས་ ༢༠༡༤ ཅན་མ། ༥ beyond the permissible quantity and pay a fine equivalent to five times the value of the tobacco or tobacco products. c) Punished with misdemeanor and pay a fine equivalent to ten times the value of the tobacco or tobacco products, if the person contravenes section 11(d) for the second time. 26. In the Act, after section 51B, a new Section is inserted namely: Section 51C Any person who contravenes section 11 (e) of the Act shall be: a) Fined double the value of tobacco or tobacco products, if he or she transports tobacco or tobacco products within the permissible quantity without proof of tax and duty payments. b) Punished with petty misdemeanor as per the Penal Code of Bhutan, if he or she transports tobacco or tobacco products beyond the permissible quantity and pay a fine equivalent to five times the value of the tobacco or tobacco products. c) Punished with misdemeanor and pay a fine equivalent to ten times the value of the tobacco or tobacco products, if the person contravenes section 11 (e) for the second time. 27. In the Act, Section 52 is repealed 28. In the Act, after section 54, a new Section is inserted namely: Section 54A A person who violates any provision of this Act shall have his or her tobacco or tobacco products confiscated. 30. In the Act, after section 54A, a new Section is inserted namely: Section 54B A person who is in possession of tobacco or tobacco products at authorized port of entry shall not be liable to be punished under this Act, if he or she has not crossed the authorized port of entry. 31. In the Act, Section 60 (c) is amended as: “Cultivate” means to farm or to grow tobacco plant for use as tobacco or tobacco products. 32. In the Act, Section 60 (d) is amended as: “Harvest” means to gather leaves or any part of a tobacco plant for use as tobacco or tobacco products. 33. In the Act, after section 60 ( k ), a new Section is inserted namely: Section 60 (l) “Manufacture” means any process of converting tobacco to a consumable tobacco product. Tobacco Control (Amendment) Act of Bhutan 2014 7 ༢༩. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༥༤ པའི་རྗེས་སུ་ དོན་ཚན་གསརཔ་ གཤམ་འཁོད་ ལྟར་བཙུགས་ཡོད། དོན་ཚན་ ༥༤ཀ མི་ངོམ་གཅིག་གིས་ བཅའ་ཁྲིམས་འདིའི་དགོངས་དོན་ གང་རུང་ལས་འགལ་བའི་ ཏམ་ ཁུ་ ཡང་ན་ ཏམ་ཁུའི་ཐོན་སྐྱེད་ཚུ་ གཞུང་བཞེས་མཛད་དགོ། ༣༠. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༥༤ཀ་ པའི་རྗེས་སུ་ དོན་ཚན་གསརཔ་ གཤམ་ འཁོད་ལྟར་བཙུགས་ཡོད། དོན་ཚན་ ༥༤ཁ། ཆ་གནས་ཅན་གྱི་འཛུལ་སྒོའི་ས་ཁོངས་ཚུ་ནང་ ཏམ་ཁུ་ ཡང་ན་ ཏམ་ཁུའི་ཐོན་སྐྱེད་ཚུ་ འཆང་སྤྱོད་འབད་མི་ མི་ངོམ་དེ་གལ་སྲིད་ ཆ་གནས་ཅན་གྱི་འཛུལ་སྒོའི་ས་ཁོངས་མ་ བརྒལ་ཚེ་ བཅའ་ཁྲིམས་འདིའི་ནང་གསལ་ལྟར་གྱི་ ཉེས་ཁྲིམས་མི་ཕོག། ༣༡. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༦༠ ག་ པ་དེ་ གཤམ་འཁོད་ལྟར་འཕྲི་སྣོན་མཛད་ གྲུབ། འཛུགས་སྐྱོང་ཟེར་མི་འདི་ ཏམ་ཁུ་ ཡང་ན་ ཏམ་ཁུའི་འཐོན་སྐྱེད་སྦེ་སྤྱོད་ནིའི་དོན་ལུ་ ཏམ་ཁུའི་སྔོ་ཤིང་གི་ཞིང་ལཱ་འབད་ནི་ ཡང་ན་ ལོ་ཐོག་སྦེ་བཏབ་ནི་ལུ་གོ། ༣༢. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༦༠ང་ པ་དེ་ གཤམ་འཁོད་ལྟར་འཕྲི་སྣོན་མཛད་གྲུབ། ལོ་ཐོག་བསྡུ་ནི་ཟེར་མི་འདི་ ཏམ་ཁུ་ ཡང་ན་ ཏམ་ཁུའི་འཐོན་སྐྱེད་སྦེ་སྤྱོད་ནིའི་དོན་ལུ་ ཏམ་ཁུའི་སྔོ་ཤིང་གི་ཤོམ་འདབ་ ཡང་ན་ ཏམ་ཁུའི་སྔོ་ཤིང་གི་ཆ་ཤས་ཚུ་ བསྡུ་བསྒྱོམ་ འབད་་ནི་ལུ་གོ། ༣༣. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༦༠ (ད )པའི་རྗེས་སུ་ དོན་ཚན་གསརཔ་ གཤམ་ འཁོད་ལྟར་བཙུགས་ཡོད། དོན་ཚན་ ༦༠ ན། “བཟོ་སྐྲུན་” ཟེར་མི་འདི་ ཏམ་ཁུ་འདི་ སྤྱོད་རུང་བའི་ཏམ་ཁུའི་འཐོན་སྐྱེད་ཅིག་ལུ་བསྒྱུར་ བའི་འགྱུར་རིམ་གང་རུང་ཅིག་ལུ་གོ། འབྲུག་གི་ཏམ་ཁུ་དམ་འཛིན་(འཕྲི་སྣོན་)བཅའ་ཁྲིམས་ ༢༠༡༤ ཅན་མ། ༧ 34. In the Act, after section 60 (l), a new Section is inserted namely: Section 60 (m) “Distribute” means to make available or to provide tobacco or tobacco products for commercial purposes. 35. In the Act, after section 60 (m) , a new Section is inserted namely: Section 60 (n) “Transport” means to convey tobacco or tobacco products using any mode of transportation. 36. In the Act, after section 60 (n), a new Section is inserted namely: Section 60 (o) “Value” means the cost of the tobacco or tobacco products and the applicable tax for the tobacco or tobacco products. 37. In the Act, after section 60 (o), a new Section is inserted namely: Section 60 (p) “Public Place” means an area, permanent or temporary, that is accessible to the general public or for collective use by the general public regardless of ownership or right of access. Tobacco Control (Amendment) Act of Bhutan 2014 8 ༣༤. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༦༠(ན) པའི་རྗེས་སུ་ དོན་ཚན་གསརཔ་ གཤམ་ འཁོད་ལྟར་བཙུགས་ཡོད། དོན་ཚན་ ༦༠་པ། “བགོ་བཀྲམ” ཟེར་མི་འདི་གི་ ཚོང་སྒྱུར་གྱི་དོན་ལུ་ ཏམ་ཁུ་ ཡང་ན་ ཏམ་ ཁུའི་ཐོན་སྐྱེད་ཐོབ་ཚུགསཔ་བཟོ་ནི་ ཡང་ན་ བྱིན་ནི་ལུ་གོ། ༣༥. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༦༠(པ) པའི་རྗེས་སུ་ དོན་ཚན་གསརཔ་ གཤམ་ འཁོད་ལྟར་བཙུགས་ཡོད། དོན་ཚན་ ༦༠ཕ། “སྐྱེལ་འདྲེན་” ཟེར་མི་འདི་གི་ ཐབས་ལམ་གང་རུང་གི་ཐོག་ལས་ ཏམ་ཁུ་ ཡང་ན་ ཏམ་ཁུའི་ཐོན་སྐྱེད་ འབག་སྟེ་སྐྱེལ་འདྲེན་འབད་ནི་ལུ་གོ། ༣༦. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༦༠(ཕ) པའི་རྗེས་སུ་ དོན་ཚན་གསརཔ་ གཤམ་ འཁོད་ལྟར་བཙུགས་ཡོད། དོན་ཚན་ ༦༠བ། “རིན་ཐང” ཟེར་མི་འདི་ ཏམ་ཁུ་ ཡང་ན་ ཏམ་ཁུའི་ཐོན་སྐྱེད་ཀྱི་ གོང་ཚད་དང་ ཏམ་ ཁུ་ ཡང་ན་ ཏམ་ཁུའི་ཐོན་སྐྱེད་ལུ་ སྦྱོར་འཇུག་འབད་བའི་ཁྲལ་ལུ་གོ། ༣༧. བཅའ་ཁྲིམས་འདི་ནང་ དོན་ཚན་ ༦༠(བ) པའི་རྗེས་སུ་ དོན་ཚན་གསརཔ་ གཤམ་ འཁོད་ལྟར་བཙུགས་ཡོད། དོན་ཚན་ ༦༠མ། “མི་མང་ས་སྒོ་” ཟེར་མི་འདི་ སྤྱིར་བཏང་མི་མང་ ཡང་ན་ སྤྱིར་བཏང་མི་མང་གི་ བདག་དབང་དང་ དབང་ཆ་ལུ་མ་ལྟོས་པར་ མཉམ་རུབ་ཀྱི་ཐོག་ལས་ ལག་ལེན་འཐབ་ ཆོག་པའི་ གཏན་འཇགས ་ ཡང་ན་ གནས་སྐབས་ཀྱི་ས་ཁོངས་ཅིག་ལུ་གོ། འབྲུག་གི་ཏམ་ཁུ་དམ་འཛིན་(འཕྲི་སྣོན་)བཅའ་ཁྲིམས་ ༢༠༡༤ ཅན་མ། ༨ 38. In the Act, after section 60 (p), a new Section is inserted namely: Section 60 (q) “Tobacco Advertising and Promotion” means any form of commercial communication, recommendation, or action with the aim, effect or likely effect of promoting a tobacco product or tobacco use either directly or indirectly. 39. In the Act, after section 60 (q), a new Section is inserted namely: Section 60 (r) “Tobacco Sponsorship” means any form of contribution to any event, activity or individual with the aim, effect or likely effect of promoting a tobacco product or tobacco use directly or indirectly. 40. In the Act, Annexure is inserted as: Permissible quantity for import of tobacco or tobacco products per month: 1. 800 sticks of cigarettes; OR 2. 1200 sticks of bidis; OR 3. 150 pieces of cigars; OR 4. 750 grams of other tobacco or tobacco products.
