Decree No. 193 of 2004 prohibiting the importation and circulation of some pesticides harmful to health and to the environment

Ministerial Decree Ministry of Agriculture & Fisheries 1 Ministerial Decree Number (193) of the year 2004 Concerning Ban on Importing and Circulation of some Harmful Pesticides for health and Environment The Minister of Agriculture and Fisheries, In accordance with the federal law number (1) of the year 1972 regarding the functions of the ministries and the powers of the ministers and the laws issued in amendment thereof, And the federal law number (41) of the year 1992 regarding pesticides, And the decision of the Cabinet number (12) of the year 1989 regarding the organizational structure of the ministry of agriculture and fisheries, And the ministerial decree number (97) of the year 1993, amended by the ministerial decree number (257) of the year 2003 regarding the executive by-law of the federal law number (41) of the year 1992 regarding pesticides, And in accordance with the reports and the technical studies received by the international organizations concerned by pesticides, the producers of pesticides from the big countries, as well as the agencies and the research centers concerned with preserving the environment against the dangers of pesticides and their effect on man and the environment, And upon the necessities of the public health, Be in acted the following law: Ministerial Decree Ministry of Agriculture & Fisheries 2 Article (1) All companies, individuals, establishments, governmental directorates and the private sector are prohibited from importing, circulation, and using any kind of the pesticides stated in the attached Appendix of this law. Article (2) The supplying companies of the pesticides included in the attached Appendix of this law shall have six months period to adapt their statuses with effect from the date of its issuance. Article (3) All the concerned parties shall carry out and implement the provisions of this law as from the date of its issuance. All the previous decisions that contravene and contradict it are considered cancelled, and it shall be published in the official Gazette.
