The purpose of this Regulation is to establish a legal framework to ensure effective and efficient water supply services and provide an open, transparent and non-discriminatory process for the review and decision-making on modalities of licensing of Water Services in Rwanda. Le présent Règlement a pour objet d’établir un cadre juridique pour assurer des services effectifs et efficaces d’approvisionnement en eau et de fournir un processus ouvert, transparent et non discriminatoire pour l’examen et la prise de décision sur les modalités d’octroi des licences des services d’eau au Rwanda. Ingingo ya 2: Ibisobanuro by’amagambo Article 2: Definitions of terms Article 2: Définitions des termes Muri aya mabwiriza, amagambo akurikira afite ibisobanuro bikurikira: In this Regulation, the following terms shall be defined as follows: Dans le présent Règlement, les termes repris ci après ont les significations suivantes : 1o Amazi aranguzwa : amazi atunganyijwe kugira ngo agemurirwe uyacuruza cyangwa undi muntu uyatanga akoresheje kuyatwara, umwikorezi hamwe n’ibikorwaremezo bijyana na byo birimo inganda zo gukurura no gusunika amazi, ibigega byo kuyabika, amatiyo no kuyakwirakwiza mu bakiriya ; 1o Bulk water: water produced to be supplied for retail to another water utility or operator through the water carrier, hauler and associated infrastructures including pumping stations, reservoirs and pipelines and distribution; 1o Eau vendue en gros: eau produite pour être livrée à un autre fournisseur ou exploitant d’eau par le transporteur d’eau, le transporteur et les infrastructures connexes, y compris les stations de pompage, les réservoirs, les tuyaux et la distribution; Official Gazette n°20bis of 14/05/2018 73 2o Uburyo bukomatanyije bwo gukwirakiwiza amazi: umuyoboro wo gutunganya no gusaranganya amazi hakoreshejwe ikoranabuhanga rigezweho mu byerekeye uburyo bwimbitse bwo gushyiraho, gucuruza no gucunga ibikorwaremezo by’amazi umubare munini w’abakiriya bo mu gace amazi atangwamo; muri iki cyiciro harimo uburyo bwo gutunganya amazi y’imusozi (isoko, umugezi, ikiyaga, n’ibindi) cyangwa amazi y’ikuzimu akenshi aba ari ku ntera ndende (irengeje ibirometero 20) kugira ngo abashe gushyikirizwa abantu benshi no gushyira mu bikorwa uburyo bwo gutunganya amazi (bwaba mu buryo ubusanzwe cyangwa ubudasanzwe) ku buryo nibura gutunganya amazi bikorwa avanwamo umwanda; 2o Complex water supply systems: water treatment and distribution network with more advanced technology in terms of complexity in set up, operation and management of water infrastructures; coverage area, considerable number of customers.Such category comprises of water systems treating surface (spring, river, lake, etc) or groundwater generally long (more than 20 Kilometers) to be able to serve many people and perform water treatment processes (conventional or not) where the minimum treatment consists of disinfection; 2oSystèmes complexes d’approvisionnement en eau : réseau de traitement et de distribution d’eau au moyen d’une technologie plus avancée en termes de complexité dans la mise en place, exploitation et gestion des infrastructures hydrauliques ; le nombre considérable de clients, de la zone servie. Cette catégorie comprend les systèmes de traitement de l’eau de surface (source, rivière, lac, etc.) ou les eaux souterraines généralement longues (plus de 20 kilomètres) pour pouvoir servir de nombreuses personnes et réaliser des procédés (conventionnels ou non) dont le traitement des eaux consiste à la désinfection; 3oAbakiriya: umuntu uwo ariwe wese cyangwa Ikigo gifitanye amasezerano n’ukora umurimo wo gukwirakwiza amazi; 3o Customers: any person or institution having contract with water service provider for water supply service provision; 3oClients: toute personne ou institution ayant un contrat avec un préstataire de services d’eau pour l’approvisionnement en eau; 4o Amazi anyobwa: amazi asukuye bihagije ku buryo ashobora kunyobwa n’abantu cyangwa gukoreshwa afite ingaruka nke mu kwangiza umuntu ako kanya cyangwa mu gihe kirekire; 4o Drinking water: water safe enough to be consumed by humans or used with low risk of immediate or long term harm; 4o Eau à boire : eau suffisamment sûre pour être consommée par l’homme ou utilisée avec un faible risque de dommages immédiats ou à long terme ; 5o Usaba uruhushya: umuntu wese utanga dosiye isaba guhabwa uruhushya hakurikijwe aya mabwiriza; 5o License applicant: any operator who files an application for issuance of a license in accordance with this regulation; 5o Demandeur de licence: tout exploitant qui remplit un formulaire de demande d’une licence conformément au présent règlement; 6o Amafaranga atangwa ku ruhushya: umubare w’amafaranga wagenwe usaba uruhushya yishyura Urwego Ngenzuramikorere 6o License Fee: specified amount of money paid by the License applicant to the Regulatory Authority upon the issuance of the license under this regulation; 6o Frais de licence: montant spécifique payé par le demandeur de Licence à l’Autorité de Régulation Official Gazette n°20bis of 14/05/2018 74 nyuma yo guhabwa uruhushya hakurikijwe aya mabwiriza; après l’octroi de la licence en vertu du présent règlement; 7o Uruhushya : Inyandiko yemewe n’amategeko itangwa n’Urwego Ngenzuramikorere iha uburenganzira uyifite bwo gukora imirimo mu buryo buteganijwe n’iyo nyandiko. 7o License: any legal document issued by the Regulatory Authority which authorizes the licensee to carry out the activity specified under terms and conditions prescribed in that document; This regulation shall apply to any operator providing or willing to provide services of production, transportation, distribution and sale of water for the purpose of human consumption. The licensee shall ensure that water supplied to customers is always of good quality and fits human consumption requirements aesthetically, chemically and bacteriologically. Perform permanent monitoring of water quality by collecting samples at both the treatment plant and within the distribution network to ensure that water meets national standards; ii. Ensure that all samples collected meet bacteriological standards and at least 95% meet other standards; iii. Set an appropriate sampling program that complies with the sampling regime set by National Standards Board; iv. Determine parameters to be monitored based on national standards and ensure adequacy of sample collection and preservation; i. The Licensee shall establish a frequency of sampling based on the source and the response of raw water, the quantity of water produced and population served as according to applicable standards. Article 12: Water Pressure The Licensee shall maintain a pressure in the pipes that shall ensure that customers receive adequate water supply. The pressure of water supplied to customers shall be in the range between 0.6 to 1.5 bars or from 6 to 15 m static head at all the times. In case of circumstance affecting low pressure or no supply, customers must be informed in twenty-four hours (24) following such low pressure. Article 13: Quantity of water supplied The Licensee shall make all possible means to satisfy the demand of water and the minimum daily quantity of water to be supplied to a customer shall comply with national standards. Article 13: Quantité d’eau fournie Le titulaire de licence doit déployer tous les moyens possibles pour satisfaire à la demande d’eau et la quantité minimale quotidienne d’eau à fournir doit être conforme aux normes de qualité nationales. Article 14: Service coverage area The Licensee shall provide water services in the whole service area and shall increase the percentage of population accessing adequate drinking water services through individual house connections to the water network as well as public stand posts or Kiosks. Article 15: Connection service to water supply The Licensee shall connect all customers to water supply that have requested for connection and the average time to be connected shall not exceed five (5) working days. The water service provider shall be responsible for connections and no fees will be charged to the customer for pipes and other accessories used during connection. The Water Services provider shall own and maintain all water service connection infrastructure up to the water meter whether located on customer private property or in the public right of way and will have a right of access for such infrastructure. Le prestataire de services d’approvisionnement en eau doit posséder et entretenir toutes les infrastructures de raccordement au service d’eau jusqu’au compteur d’eau, qu’il soit situé sur une propriété privée du client ou dans l’emprise publique et aura un droit d’accès à ces infrastructures. Article 16: Connection service fees All customers shall pay a connection fee approved by the Regulatory Authority with respect to the installation and connection to the water supply network. The Licensee shall inform the Regualtory Authority on the existence of any other circumstance affecting water supply services and specify when this situation shall be redressed. Article 22: Tampering with water service connections All water service connections are vested to the Water service provider. The water service providers or their authorized agents shall have the right to connect or disconnect the service or to turn the service on or off at the water meter. Any unauthorized tampering with the water service connection is prohibited. The rationing program shall indicate the time as well as the area of supply and shall guarantee water supply at least three (3) times a week to every household. Where the meter is not functional, the water service provider may estimate the bill based on historical consumption before replacing the meter. Article 36: Customer service centre Water service provider shall maintain a customer service centre for the purpose of addressing and resolving customers’ requests and complaints and shall operate during normal business hours to receive oral and written requests and complaints from customers. Article 37: Registry of complaints The Water service provider shall maintain a registry of complaints received and resolved. The registry will record details of complaints received including the date, location and details of the problem, the names and contacts of the customer that reported or complained, the names of staff that received and dealt with the complaint and the time taken to resolve the case. The registry of complaints must be available any time for audits and inspections by the Regulatory Authority. Article 39: Appointment schedule The Licensee has the responsibility to respect the appointment schedule provided to customers in regard to any service requested. The Licensee or its representative shall notify the customer prior to the appointed time if any emergency situation prevents him/her to keep such appointment. Article 42: Water supply infrastructure management license The license for water supply infrastructure management is granted to operators that are under or willing to conclude for management contract with the owners of infrastructures. It authorizes the licensee to operate, manage and use appointed water supply infrastructures for the purpose of supplying water in the service area to customers. Article 43: Bulk water supply license A license of bulk water supply permits the holder to sell in bulk water to an appointed water utility company, water and sewerage utility or any other operator for the purpose of resale or retail it to customers at eligible premises. Article 44: Technical requirements for each type of a license The applicants of above license types shall fulfill technical requirements for water supply as indicated in Annex two (2) and the license shall be granted upon satisfaction of the Regulatory Authority with information provided by the applicants. The license application form, with all attachments, must be signed by the applicant or his/her authorized representative. The signatory party must sign a verification statement that all information provided to the Regulatory Authority in the application form is true and correct. Detailed list of current physical facilities to be covered by the license, with tables of the technical standards schemes and parameters of the facilities; e. Description of technical standards that will apply to any future construction or maintenance of physical facilities to be covered by the application; f. A business plan covering the duration of the license applied for, bearing in mind that an updated business plan shall be submitted every five (5) years to the Regulatory Authority for urban water supply and every three years (3) for rural water supply; g. List of fixed assets by depreciation groups and the last annual statement of depreciation; h. A proposed quality of service improvement plan to address any service deficits; i. Description of any rights of way requested by applicant; j. Affirmation that the applicant has not been convicted of any civil or criminal violations of economic or environmental laws, as well as a disclosure of any pending charges d. Copies of applicant’s financial statements audited by an independent auditor for the previous three years for the existing companies and the initial balance sheet for newly formed companies; p. Reports of any governmental inspections and reports of any other type of third party certifications, conducted on the physical facilities covered by the application; q. An inventory of all insurance held by applicant on the facilities covered by the license application; r. List of all other Rwandan or foreign licenses held by the applicant pertaining to Water supply activities; s. Any other information deemed necessary by the Regulatory Authority for decision making at any phase of the proceeding. o. Tout autre Information jugée nécessaire par l’Autorité de Régulation pour la prise de décision à n’importe quelle phase de la procédure. Any license application determined by the Regulatory Authority to be incomplete shall be considered as a defective filing; 2. Any license application from an applicant who has not made full payment of all regulatory fees due to the Regulatory Authority under a prior license shall be considered to be a defective filing until full payment of the outstanding balance is made; 3. The Regulatory Authority may require the applicant to cure defective filing before any further proceedings take place. 1. Urwego Ngenzuramikorere rushobora, nyuma yo gusuzuma ubusabe, kumenyesha no gusaba uwasabye, mu gihe cy’iminsi cumi n’itanu (15) nyuma yo kurushyikiriza ubusabe, amakuru y’inyongera, ibisobanuro birambuye cyangwa Upon receipt of a license application, Director General of Regulatory Authority shall cause a docket to be opened to assess the application. The docket shall reflect all procedural and substantive decisions on the license application. The Regulatory Authority may upon scrutiny of the application, within fifteen (15) days after the receipt of the application, notify and require the applicant to furnish such additional information or particulars or documents as considered necessary for the purpose of dealing with the application. Where the application is rejected the Regulatory Authority shall: 1. Inform the applicant in writing its reasons for rejection within five (5) working days; 2. If necessary, ask for amendments to the application or provision of additional information within fifteen (15) days for the application to be reconsidered. The Regulatory Authority shall strive to complete consideration of a license application within twenty (20) days of receipt of the application. The twenty (20) days’ period does not include time for applicant to respond or to request for additional information. This time limit is an internal administrative goal, and not an enforceable deadline. The Regulatory Authority may set up additional substantive rules on license proceedings for the issuance of license. The Regulatory Authority shall make all information in the license register available to the public, except those documents that are considered confidential information under the Regulatory Authority rules. The Regulatory Authority shall maintain a docket of all pending license applications or license related proceedings, with information on the date the proceeding was opened, the reason for pending and the estimated period needed for decision upon the license. Article 51: Final Decision of the Regulatory Authority The Regulatory Authority shall make a final decision on the license application relying upon applicable rules and regulations. The Regulatory Authority shall decide to either issue the license, with or without conditions, or to deny the license application. The Regulatory Authority shall issue its decision as promptly as possible, but in no event later than twenty (20) days following receipt of a complete application, except where unusual circumstances require a longer period of review in order to render a fair and reasonable decision. In the case where the Regulatory Authority requires additional time for decision in order to obtain information from third parties, to resolve technical or legal issues, or similar reasons, the Regulatory Authority shall provide written notice to the applicant, with an explanation of the cause for the delay. The applicant and key members of management have not been found liable for any significant civil or criminal violation of economic or environmental law or any other law related to fraud in Rwanda as well as in another country; e. The applicant has not had a license revoked or found liable for significant license violations in Rwanda or another country within the past ten (10) years; f. The applicant fulfills all established criteria for protection of environment; g. The applicant has the right, title and interest to conduct the proposed activities on the site selected, or can obtain such right, title and interest through expropriation proceedings; h. The applicant has demonstrated that he/she will comply with all applicable laws and other regulations, including but not limited to, the Regulatory Authority regulations and decisions; d. Usaba yananiwe kugaragaza ubushobozi bwe mu bya tekiniki cyangwa mu by’imari mu gushyira mu bikorwa serivisi yemerewe ; 4. Usaba yigeze kugaragaraho ibyaha, kunyuranya n’amabwiriza mbonezamubano cyangwa kwica bikomeye amabwiriza agenga 1. The application was incomplete and the requested information was not submitted within the deadline set by the Regulatory Authority; 2. The applicant failed to demonstrate that he/she could meet the criteria for license issuance; 3. The applicant failed to demonstrate the technical or financial capacity to carry out the licensed services; 4. The applicant has a history of significant criminal, civil, or license violations for economic, environmental, or fraudulent acts within Rwanda or other countries; 1. La demande était incomplète et que les informations demandées n’ont pas été présentées dans le délai fixé par l’Autorité de Régulation ; 2. Le demandeur n’a pas démontré qu’il pouvait satisfaire aux critères d’octroi de licence ; 3. Le demandeur n’a pas démontré la capacité technique ou financière pour mener les services autorisés ; 4. Usaba adafite uburenganzira, ubushobozi n’inyungu bihagije kugira ngo ashyire mu bikorwa serivisi yemerewe gutanga ; 7. Usaba yananiwe kubahiriza amategeko yahawe n’Urwego Ngenzuramikorere, amakuru yasabwe cyangwa ibindi byemezo mu gihe uruhushya asanganywe rwamaze ; 8. Usaba yananiwe kwishyura amafaranga atangwa kuri dosiye isaba cyangwa amafaranga y’igenzuramikorere yishyurwa Urwego Ngenzuramikorere hakurikijwe uruhushya usaba yari asanganywe ; 9. Usaba yahombye cyangwa ari hafi yo kugwa mu gihombo cyangwa sosiyete ye iri mu iseswa, 10. Usaba atatanze andi makuru Urwego Ngenzuramikorere rusanga akenewe mu rwego rwo kubungabunga ubuzima 5. Members of the applicant’s management have a history of significant criminal, civil, or license violations for economic, environmental, or fraudulent acts within Rwanda or other countries; 6. The applicant does not have sufficient right, title and interest to conduct the licensed services; 7. The applicant failed to comply with the Regulatory Authority orders, information requests, or other decisions during a prior license term; 8. The applicant failed to pay an application fee or regulatory fee due the Regulatory Authority under the previous license; 9. The applicant is in, or about to enter into insolvency, bankruptcy or liquidation; 10. The applicant failed to provide any other information the Regulatory Authority determines necessary to protect the public health, safety and welfare. 5. Les membres de la Direction de l’entreprise du demandeur ont des antécédents de violations criminelles, civiles ou de licence graves pour des actes économiques, environnementaux ou frauduleux au Rwanda ou dans d’autres pays ; 6. Le demandeur ne jouit pas du droit, du titre et de l’intérêt suffisants pour mener les services autorisés ; 7. Le demandeur ne se conforme pas aux ordres de l’Autorité de Régulation, aux demandes d’information aux autres décisions au cours de periode de la licence antérieure ; 8. Le demandeur n’a pas payé des frais de demandes ou les frais de régulation dus à l’Autorité de Régulation en vertu de la licence antérieure ; 9. Le demandeur est en faillite, ou est au bord de la faillite ou est en liquidation ; 10. Le demandeur n’a fourni aucune autre information que l’Autorité de Régulation juge nécessaire pour protéger la santé publique, la sécurité et le bien-être. Ingingo ya 54: Kongera agaciro k’uruhushya Uwahawe uruhushya agomba gusaba kongeresha agaciro k’uruhushya nibura iminsi mirongo cyenda (90) mbere y’uko agaciro karwo karangira Uburyo bwo kongeresha agaciro k’uruhushya bukurikiza ubusanzwe nk’ubwo gusaba uruhushya rushya. Uwahawe uruhushya agomba gutanga raporo y’ishyirwa mu bikorwa rya gahunda y’ibikorwa hamwe na gihamya y’uko yishyuye umusanzu ku byacurujwe buri mwaka mu myaka yashize. Article 54: License Renewal The licensee shall apply for the license renewal at least ninety (90) days before the expiration of the valid license. The license renewal proceeding shall be subject to the same procedures as new license application. The licensee shall provide an execution report of the business plan and the proof of payment of the annual turnover for the previous years. Article 54 : Renouvellement de la Licence La titulaire de la licence doit demander le renouvellement de la licence au moins quatre vingt-dix (90) jours avant l’expiration de la licence valide. La procédure de renouvellement de licence est soumise aux mêmes procédures que la nouvelle demande de licence. Le titulaire de la licence doit fournir un rapport d’exécution du plan d’action et la preuve du paiement du montant des calculée sur chiffre d’affaires annuel des années précédentes. The Regulatory Authority shall attempt to make its decision not later than thirty (30) days prior to the expiration of the valid license. The license renewal application shall not be considered if the applicant is not complying with this regulation. L’Autorité de Régulation s’efforce de rendre sa décision au plus tard trente (30) jours avant l’expiration de la licence valide. La demande de renouvellement de licence ne sera pas considérée si le demandeur ne se conforme pas au présent règlement. Ingingo ya 55 : Guhererekanya uruhushya Guherekanya impushya harimo kuzigurisha mu buryo buziguye cyangwa butaziguye, kuzitiza, kuzitanga, kuzikodesha cyangwa guhererekanya imirimo cyangwa ibikorwa bizishamikiyeho bigombera uruhushya ngo bihabwe undi muntu cyangwa ikindi kigo, bikorwa ari uko byabanje gutangirwa Article 55: License transfer Transfers of licenses, including the direct or indirect sale, assignment, conveyance, lease or other transfer of assets or activities subject to a license to a different individual or institution shall be subject to a prior written approval of the Regulatory Authority. Article 55: Transfert de licence Les transferts de licences à une personne ou à une institution différente, y compris la vente directe ou indirecte, la cession, le bail ou tout autre transfert d'actifs ou d'activités assujettis à une license, sont soumis à l'approbation préalable écrite de l'Autorité de régulation. Such approval shall be granted after consideration of the matter and if the proposed transfer meets all the conditions for granting the relevant license. Failure to comply with such conditions shall lead to license sanctions provided for in the annex 3of this regulation. Cette approbation est accordée après examen de l’affaire et si le cessionnaire proposé remplit toutes les conditions d'octroi de la licence concernée. Le non-respect de ces conditions entraîneront des sanctions de licence prévues à l’annexe 3 du présent règlement. Ingingo ya 56 : Uburyo bukurikizwa mu guhererekanya uruhushya Uburyo bukurikizwa mu guhererekanya uruhushya butangizwa n’uwahawe uruhushya. Igihe cyose Urwego Ngenzuramikorere rutari rwemeza ihererekanya, nta wahawe uruhushya wemerewe kurwegurira undi muntu. Uburyo bwose bukurikizwa mu ihererekanya ry’uruhushya bugomba gukorwa mu buryo bumwe n’ubwo isuzuma ry’ubusabe bw’uruhushya rikorwamo. Uweguriwe uruhushya afatwa nk’uwahawe uruhushya. Article 56: Procedures for license transfer A license transfer proceeding is initiated by the licensee. Until the Regulatory Authority has issued an approval of the transfer, no licensee may attempt to transfer its license to another person. A license transfer proceeding shall be conducted in the same manner as review of a license application. The transferee shall be considered as the licensee. Article 56 : Procédures de transfert de licence Une procédure de transfert de licence est engagée par son titulaire. Tant que l’Autorité de Régulation n’a pas approuvé le transfert, aucun titulaire ne peut tenter de la transférer à une autre personne. Toute procédure de transfert de licence doit être effectuée de la même manière que l’examen d’une demande de licence. Le cessionnaire est considéré comme le titulaire de licence. Igihe uruhushya rumara n’amabwiriza agenga uruhushya bikomeza kudahinduka, keretse iyo uweguriwe uruhushya asabye ko hagira ibihinduka mu ruhushya mu rwego rwo kubahiriza ibikurikizwa mu ihererekanywa ry’uruhushya. The duration of the license and the license terms and conditions shall remain the same, unless the license transferee requests a license modification as part of the transfer proceedings. La durée de la licence et les termes et les conditions de la licence demeurent inchangés, sauf si le cessionnaire de la licence demande une modification de la licence dans le cadre de la procédure de transfert. Ingingo ya 57 : Guhindura uruhushya Guhindura uruhushya bishobora gutangizwa n’Urwego Ngenzuramikorere cyangwa ku busabe bw’uwahawe urwo ruhushya. Article 57: License Modification A license modification may be initiated by the Regulatory Authority or by the request of the licensee. Article 57 : Modification de la licence Une modification de la licence peut être engagée par l’Autorité de Régulation ou à la demande du titulaire de la licence. Official Gazette n°20bis of 14/05/2018 113 Urwego Ngenzuramikorere rushobora guhindura uruhushya mbere y’uko igihe rwari kuzamara kirangira iyo Urwego Ngenzuramikorere rubona ko guhindura urwo ruhushya ari ngombwa mu rwego rwo : The Regulatory Authority may modify a license before the expiration of the license term when it determines that a modification of the license is needed in order to respond to: L’Autorité de Régulation peut modifier une licence avant l’expiration de la période de licence lorsqu’elle trouve qu’une modification de la licence est nécessaire pour: a. Gukemura ikibazo cy’ubushobozi buke bw’uwahawe uruhushya mu kubahiriza amategeko n’amabwiriza bikurikizwa ; b. Kwigobotora ibibazo uwahawe uruhushya adafitiye ububasha bwo gukemura ; c. Kugira ibihindurwa mu mutungo cyangwa mu miterere y’inzego by’uwahawe uruhushya cyangwa imiterere y’abashoye imigabane mu bikorwa bye. a. a. The inability of the licensee to comply with existing laws and regulations; b. To overcome events beyond licensee’s control; c. Changes in the ownership or organizational structrure of the licensee or shareholding. a. a. Réagir à l’incapacité du titulaire de licence à se conformer aux lois et règlements en vigueur ; b. Surmonter les événements indépendants de la volonté du titulaire de licence ; c. Opérer des changements dans la propriété ou la structure organisationnelle du titulaire de licence ou de l’actionnariat. Ingingo ya 58: Guhagarika uruhushya Urwego Ngenzuramikorere rutangiza uburyo bwo guhagarikisha uruhushya rwohereza integuza yanditse uwahawe uruhushya rumutegeka kugira icyo abikoraho cyangwa kubahiriza amategeko n’amabwiriza. Article 58: Suspension of licence The Regulatory Authority shall commence a license suspension proceeding by sending written notice to the licensee requiring him to provide a response or to comply with laws and regulations. Article 58: Suspension de la licence L’Autorité de Régulation amorce la suspension de licence en procédant par l’envoi d’une mise en demeure écrite au titulaire lui exigeant de fournir une explication ou de se conformer aux lois et règlements. Iyo uwahawe uruhushya atemera ibikubiye mu birego aregwa kandi ntabashe kubyumvisha Urwego Ngenzuramikorere, Urwego Ngenzuramikorere rushyiraho umwanya wo kumutega amatwi. Iyo, mu buryo bukurikizwa kugira ngo uruhushya ruhagarikwe, Urwego Ngenzuramikorere rutanyuzwe n’ibisobanuro ruhawe, rushobora guhagarika cyangwa kuvanaho uruhushya. If the licensee contests the content of the charges and fails to convince the Regulatory Authority the latter shall hold a hearing exercise on the charges. If during the course of the suspension proceedings, the Regulatory Authority is not satisfied with the explanations, it can suspend or revoke the license. Si le titulaire de la licence conteste le contenu des accusations et ne parvient pas à convaincre l’Autorité de Régulation, celle-ci doit tenir une audience sur les accusations. Si, au cours de la procédure de suspension, l’Autorité de Régulation n’est pas satisfaite des explications, elle peut suspendre ou révoquer la licence. Ubusabe bw’uruhushya cyangwa indi nyandiko iyo ariyo yose yashyikirijwe Urwego Ngenzuramikorere mu rwego rwo gusuzuma ubusabe bw’uruhushya yari irimo amakuru atari ay’ukuri ; 2. Uwahawe uruhushya yashyize amakuru atari ukuri mu nyandiko iyo ariyo yose igomba kubikwa hakurikijwe aya mabwiriza cyangwa ibikubiye mu yandi mabwiriza ; 3. Uwahawe uruhushya yasubiye gukora ikosa ryo kwica ya ingingo imwe iteganyijwe muri aya mabwiriza cyangwa mu ruhushya urwo arirwo rwose cyangwa amabwiriza yatanzwe hakurikijwe aya mabwiriza ; 1. 1. The application for the subject license or any other material submitted to the Regulatory Authority as part of the license application review included false information; 2. The licensee has falsified any record required to be maintained pursuant to this regulation or any license or order issued pursuant thereto; 3. The licensee committed a second violation of the same provision of this regulation or any license or order issued pursuant thereto; 1. 1. La demande de licence en question ou tout autre document soumis à l’Autorité de Régulation dans le cadre de l’examen de la demande de licence comprenant de fausses informations ; 2. Le titulaire de la licence a falsifié tout enregistrement requis pour être maintenu conformément au présent règlement ou toute licence ou ordonnance délivrée en vertu du présent règlement ; 3. Le titulaire de la licence a commis une deuxième violation de la même disposition du présent règlement ou de toute licence ou ordre en vertu du présent règlement ; Urwego Ngenzuramikorere ruhagarika uruhushya hakurikijwe ibiteganyijwe muri aya mabwiriza ku buryo bikurikira : Igihe gito gishoboka ihagarikwa ry’uruhushya rimara ni amezi atandatu (6); The Regulatory Authority shall suspend a license in accordance with the provisions of this regulation as follows: The minimum duration of the suspension shall be six (6) months; L’Autorité de Régulation suspend une licence conformément aux dispositions du présent règlement comme suit : La durée minimale de la suspension est de six (6) mois ; Iryo hagarikwa rirangira ari uko bigaragaye ko ibyangombwa bisabwa bikurikira byujujwe : A suspension shall terminate only upon a finding that the following requirements have been satisfied: La suspension ne prend fin qu’après avoir constaté que les conditions suivantes ont été remplies : i. Uwahawe uruhushya asabye mu nyandiko Urwego Ngenzuramikorere ko rwarangiza ihagarikwa ry’uruhushya yahawe. ii The licensee has addressed all violations upon which the suspension was based; iii The licensee has submitted a written request to the Regulatory Authority to terminate the suspension. ii. Le titulaire de la licence a demandé par écrit à l’Autorité de Régulation de mettre fin à la suspension. To contract out services including management, administration, repair and maintenance to independent contractors but a. a. To ensure that all necessary technical, commercial, financial and administrative functions are performed in a commercially manner and that the service is provided according to cost recovery principles set out in the tariff adjustment guideline issued and set by the Regulatory Authority; i. To obtain approval from the Regulatory Authority for charging tariffs and to apply them according to guidelines issued by the Regulatory Authority; e. RUHAMYA Perezida w’Inama Ngenzuramikorere Official Gazette n°20bis of 14/05/2018 133 ANNEX 2: TECHNICAL AND FINANCIAL INFORMATION TO BE PROVIDED BY APPLICANTS FOR LICENSES IN WATER SUPPLY The Authority requires that any applicant for a license in water supply must demonstrate that He/she has, or will have, adequate technical, managerial, and financial capability to be able to reliably operate a water system in compliance with drinking water requirements. The Authority has therefore set specific criteria that applicants must fulfil in order to be issued a license for water supply. The applicant must respond, where applicable, to all items as provided below. 1. General Water System Information This section should present or describe basic information regarding the proposed water system and the report shall describe or provide the following information: • Description of the proposed water supply system. This should describe the name of the water supply system, the number of service connections for which the proposed facilities are being designed and provide information on the number of population to be served by the facility. It shall include the number of persons that will have access to or may use water from the water system. Also, the applicant shall provide estimates of number of residential (single house and apartments), commercial (, restaurant, motel, etc.), school, industrial, public taps and agricultural connections that are expected to be served by the system. It shall provide information about the date of construction and/or rehabilitation of the water supply system and shall indicate the Districts, sectors, Cells covered by the water supply system. • Map of facilities. The applicant must provide a map that clearly shows the locations of the proposed water source (s), the treatment facilities, storage facilities and primary transmission lines. These locations must be included in the map of the service area of the water system. 2. Source Water Information The information required consists of the following: • Description of the source. The applicant must describe in details the nature of the source of water (surface or ground water), its capacity and location, the raw water quality, etc. Also, to provide the full description of the intakes if the source is surface water and if groundwater, provide any information on the proposed wells (depth of water table, recharge, etc.). • Water rights. The applicant should be able to provide adequate information which demonstrates that He/she has legal rights to extract water in the area by providing a copy of an abstraction permit from Competent Authority authorising to draw indicated amount of water. • Water quantity: The applicant shall demonstrate that the proposed source is sufficient to reliably serve the anticipated water demands for at least 10 years considering all consumptions projections. The information must establish the water demand in the service area forecasted for a period of 10 years. • Water safety plan: The applicant shall conduct and provide a report of the assessment of vulnerability of the water system to contamination. The report must include the assessment to determine the vulnerability to contamination and any remedial actions proposed if the source is susceptible to contamination. • Water quality analysis. In order to assess the suitability of the proposed source and the appropriateness of any planned treatment, it is essential that the applicant determine the quality of the source. Samples of the raw water must be taken and analysed by a certified laboratory. Treated water must be sampled and Official Gazette n°20bis of 14/05/2018 134 analysed for all parameters listed in the drinking water standards and a report shall be provided to the Authority. 3. Treatment and Design Information Information required in this part consists of: • Description and layout. The applicant shall describe in details the type of water treatment and the treatment scheme to be used with compulsory disinfection as a minimum treatment for all water sources. If the water quality analyses indicate that any drinking water standard may be exceeded, the applicant should be able to demonstrate that appropriate treatment shall be applied. The applicant shall also provide a flow diagram showing the locations and relationships of individual treatment process units. • Design capacities. The applicant shall indicate design criteria or parameters to be used for the treatment units as well as the planned design capacities. For groundwater source, the anticipated yield should be estimated. • Treatment chemicals. The type of chemicals planned to be used as well as the dosages and method of feeding those chemicals must be described in this part and the applicant shall demonstrate that all chemicals used in water treatment comply with national standards. • Disinfection facilities. Disinfection being the most important treatment process for all water sources, the applicant must provide detailed information on any proposed disinfection facilities including equipment to be used, feed rates, residuals, contact times, CT values, etc. • Storage: The applicant shall be able to demonstrate the capacities of treated water storage tanks at the treatment plant and any other storage tanks if available. Also, the operator shall provide information regarding the material used for storage construction. 4. Distribution System Information In this part, the applicant shall indicate: • Location: In addition to the overall map required under general information, the applicant will prepare a map showing the locations of all pumping stations, storage tanks, mains, hydrants, isolation valves and flushing valves. • Water mains. The applicant shall provide the locations, sizes, lengths, depths, and type of materials used or to be used for all transmission and distribution mains. Special protections, such as where a water main crosses over a sewer line, roads, bridges, etc should be shown and described. • Pumping stations and storage tanks. Descriptions, specific designs and the capacities of all pumping stations must be provided. • Distribution pressure. The report should present sufficient design information to demonstrate that the system has been designed to sustain a minimum pressure of 0.6 bars throughout the distribution system at all times. Official Gazette n°20bis of 14/05/2018 135 5. Operational Plans In this part, the applicant shall provide the following information: • Water Quality Monitoring Plan. The water system must be monitored to assure that none of the drinking water quality parameters has exceeded the standards for water supplied to consumers. It is therefore, required that the operator develops and submits a water quality-monitoring plan that describes proposed methods to comply with standards and regulations. The plan must show the locations of sampling points, the frequency of sampling at each point and the types of analyses to be run on the samples. The plan should also indicate who will be collecting the samples (e.g. water system personnel, certified laboratory) and the training those persons have or will receive. Once your monitoring plan has been approved, it will be incorporated into the license and will be enforced. • Water System Operations Plan. A comprehensive plan for operation of the water system must be prepared and submitted. This shall include the leakage detection and repair and other routine maintenance plan. • Disaster/Emergency Response Plan. The operator will need to prepare a plan for responding to emergencies that includes notification to the Regulatory Authorities, notification to consumers, and actions to be taken in the event of an emergency (earthquake, water supply disruption, power outage, contamination incident, etc.). • Customer services: The operator shall provide information about the number of hours of supply, the strategies to handle the complaints raised by the customers and the response time to address them, 6. Commercial and financial information In this part, the applicant shall provide information on the revenues from water sales and other revenues generated during a month/quarter/year. Also the expenses including wages and salaries, Royalty fee, operation and maintenance cost, depreciation and other financial expenses must be reported the Regulatory Authority. 7. Environmental Impact Assessment Since all new water systems are projects requiring approval, new water systems must undergo an environmental Impact assessment study and must complies with the Environmental Regulations. RUHAMYA Chairperson of the Regulatory Board Official Gazette n°20bis of 14/05/2018 136 ANNEXE 2 : INFORMATIONS TECHNIQUES ET FINANCIERES DEVANT ETRE FOURNIES PAR LES DEMANDEURS DE LICENCES D’APPROVISIONNEMENT EN EAU L’Autorité exige que tout demandeur d’une licence d’approvisionnement en eau doit démontrer qu’il possède ou disposera d’une capacité technique, de gestion et financière suffisante pour pouvoir exploiter de façon fiable un système d’approvisionnement en eau conforme aux exigences en matière d’eau potable. L’Autorité a donc fixé des critères spécifiques que les demandeurs doivent remplir pour obtenir une licence d’approvisionnement en eau. Le demandeur doit répondre, le cas échéant, à tous les éléments indiqués ci dessous. 1. Informations générales sur le système d’approvisionnement en eau Cette partie doit présenter ou décrire les informations de base concernant le réseau d’approvisionnement en eau proposé et le rapport doit décrire ou fournir les informations suivantes : • Description du système proposé pour l’approvisionnement en eau. Ceci doit décrire le nom du réseau d’approvisionnement en eau, le nombre de raccordements au service pour lesquels les installations proposées sont conçues et fournir des informations sur le nombre de personnes qui seront desservies par l’installation. Il doit inclure le nombre de personnes qui auront accès à l’eau ou qui pourront l’utiliser. En plus, le demandeur doit fournir des estimations du nombre de robinets résidentiels (maisons unifamiliales et appartements), commerciaux (restaurants, motels, etc.), scolaires, industriels, publics et des raccordements agricoles qui devraient être desservis par le réseau. Il doit fournir des informations sur la date de construction et/ou de réhabilitation du système d’approvisionnement en eau et indiquer les Districts, les Secteurs et les Cellules couvertes par le système d’approvisionnement en eau. • Carte des installations. Le demandeur doit fournir une carte indiquant clairement les emplacements des sources d’eau proposées, des installations de traitement, des installations de stockage et des lignes de transport principales. Ces emplacements doivent être inclus sur la carte de la zone de service du réseau d’approvisionnement en eau. 2. Information sur l’Eau de Source Les informations requises sont les suivantes : • Description de la source. Le demandeur doit décrire en détail la nature de la source d’eau (eau de surface ou souterraine), sa capacité et son emplacement, la qualité de l’eau brute, etc. De même, il faut fournir la description complète des consommations si la source est de l’eau de surface et si elle de l’eau souterraine, il faut donner toute information sur les puits proposés (profondeur de la nappe phréatique, recharge, etc.). • Droits à l’eau. Le demandeur doit être en mesure de fournir des informations adéquates démontrant qu’il a le droit d’extraire de l’eau dans la zone en fournissant une copie d’un permis d’extraction à l’Autorité Compétente lui autorisant de puiser la quantité d’eau indiquée. • Quantité d’eau : Le demandeur doit démontrer que la source proposée est suffisante pour répondre de manière fiable aux demandes d’eau prévues pendant au moins 10 ans, compte tenu de toutes les projections de consommation. L’information doit établir la demande d’eau dans la zone de service prévue pour une période de 10 ans. • Plan de sûreté de l’eau : Le demandeur doit réaliser et présenter un rapport d’évaluation de la vulnérabilité à la contamination du système d’approvisionnement en eau. Le rapport doit inclure l’évaluation pour déterminer la vulnérabilité à la contamination et les mesures correctives proposées si la source est susceptible de contamination. Official Gazette n°20bis of 14/05/2018 137 • Analyse de la qualité de l’eau. Pour évaluer la pertinence de la source proposée et si le traitement planifié est approprié, il est essentiel que le demandeur détermine la qualité de la source. Des échantillons d’eau brute doivent être prélevés et analysés par un laboratoire agréé. L’eau traitée doit être échantillonnée et analysée pour tous les paramètres énumérés dans les normes sur l’eau potable et un rapport doit être fourni à l’Autorité. 3. Informations sur le traitement et la conception Les informations requises dans cette partie comprennent : • Description et dessin. Le demandeur doit décrire en détail le type de traitement de l’eau et le schéma de traitement à utiliser avec la désinfection obligatoire comme traitement minimal pour toutes les sources d’eau. Si les analyses de la qualité de l’eau indiquent que toute norme concernant l’eau potable pourrait être dépassée, le demandeur doit être en mesure de démontrer que le traitement approprié doit être appliqué. Le demandeur doit également fournir un organigramme montrant les emplacements et les relations des unités individuelles du processus de traitement. • Capacités de conception. Le demandeur doit indiquer les critères de conception ou les paramètres à utiliser pour les unités de traitement ainsi que les capacités de conception prévues. Pour les sources d’eau souterraine, le rendement prévu devrait être estimé. • Produits chimiques de traitement. Le type de produits chimiques prévus ainsi que les dosages et la méthode d’application de ces produits chimiques doivent être décrits dans cette partie et le demandeur doit démontrer que tous les produits chimiques utilisés dans le traitement de l’eau sont conformes aux normes nationales. • Installations de désinfection. Puisque la désinfection est le processus de traitement le plus important pour toutes les sources d’eau, le demandeur doit fournir des informations détaillées sur toutes les installations de désinfection proposées, y compris l’équipement à utiliser, les taux d’approvisionnement, les résidus, les temps de contact, les valeurs CT, etc. • Stockage : Le demandeur doit pouvoir démontrer les capacités des réservoirs de stockage d’eau traitée à l’usine de traitement et tout autre réservoir de stockage, si disponible. En plus, l’exploitant doit fournir des informations sur les matériaux utilisés pour la construction du stockage. 4. Informations sur le système de distribution Dans la présente partie, le demandeur indique : • L’emplacement : En plus de la carte globale requise d’après les informations générales, le demandeur préparera une carte montrant l’emplacement de toutes les stations de pompage, des réservoirs de stockage, du réseau, des bouches d’incendie, des vannes d’isolement et des vannes de chasse. • Réseau d’eau. Le demandeur doit fournir les emplacements, les dimensions, les longueurs, les profondeurs et le type de matériaux utilisés ou à utiliser pour tous les réseaux de transport et de distribution. Des protections spéciales, notamment lorsque le réseau d’eau traverse une ligne d’égout, les routes, les ponts, etc., doivent être indiquées et décrites. • Stations de pompage et réservoirs de stockage. Les descriptions, les conceptions spécifiques et les capacités de toutes les stations de pompage doivent être fournies. • Pression de la distribution. Le rapport devrait présenter suffisamment d’informations sur la conception pour démontrer que le système a été conçu pour maintenir une pression minimale de 0,6 bars dans tout le réseau de distribution en tout temps. Official Gazette n°20bis of 14/05/2018 138 5. Plans opérationnels Dans cette partie, le demandeur doit fournir les informations suivantes : • Plan de Surveillance de la Qualité de l’Eau. Le système d’approvisionnement en eau doit être surveillé pour s’assurer qu’aucun des paramètres de qualité de l’eau potable n’a dépassé les normes en ce qui concerne l’eau fournie aux consommateurs. Il est donc exigé que l’exploitant élabore et présente un plan de surveillance de la qualité de l’eau qui décrit les méthodes proposées pour se conformer aux normes et aux règlements. Ce plan doit indiquer l’emplacement des points d’échantillonnage, la fréquence d’échantillonnage à chaque point et les types d’analyses à effectuer sur les échantillons. Le plan doit également indiquer celui qui recueillera les échantillons (par exemple, le personnel du réseau d’approvisionnement en eau, le laboratoire agréé) et la formation dont bénéficient ou bénéficieront ces personnes. Une fois votre plan de surveillance approuvé, il sera intégré à la licence et sera appliqué. • Plan d’Exploitation du Réseau d’Approvisionnement en Eau. Un plan complet pour le fonctionnement du système d’approvisionnement en eau doit être préparé et présenté. Il comprend la détection et la réparation des fuites et tout autre plan d’entretien courant. • Plan d’Intervention en cas de Catastrophe ou d’Urgence. L’exploitant devra préparer un plan de d’intervention dans les situations d’urgence comprenant la notification aux Autorités de Régulation, la notification aux consommateurs et les mesures à prendre en cas d’urgence (tremblement de terre, interruption de l’approvisionnement en eau, panne de courant, incident de contamination, etc.). • Services à la clientèle : L’exploitant doit fournir des informations sur le nombre d’heures de fourniture, les stratégies de traitement des plaintes soulevées par les clients et le temps d’intervention pour y remédier, 6. Informations commerciales et financières Dans la présente partie, le demandeur doit fournir des informations sur les revenus provenant des ventes d’eau et des autres revenus générés pendant un mois/un trimestre/une année. En plus, les dépenses y compris les salaires et traitements, frais de redevance, le coût d’exploitation et d’entretien, l’amortissement et autres frais financiers doivent être déclarés l’Autorité de Régulation. 7. Evaluation de l’Impact sur l’Environnement Etant donné que tous les nouveaux systèmes d’approvisionnement en eau sont des projets nécessitant une approbation, les nouveaux systèmes d’approvisionnement en eau doivent faire l’objet d’une étude d’impact environnemental et doivent être conformes au Règlement sur l’Environnement. Any operator who operate without a License shall be liable of an administrative fine of one million (1,000,000Frw) Rwandan francs II. A delay or non-submission of activities reports, shall be liable to a daily administrative fine of two hundred thousand (200,00OFrw) Rwandan francs; III. Any operator who does not respect the approved water tariffs; shall be liable to an administrative fine of two hundred thousand (200,00OFrw) Rwandan francs; IV. Any delay to pay the regulatory fee shall be liable to an administrative fine of two point five percent (2.5%) interest on arrears per month of amount of the contribution to be paid; V. The Regulator may impose to any natural person or legal entity which fails to provide information requested within the time limit specified, a daily administrative fine of two hundred thousand (200,000 Frw) to two million (2,000,000 Frw) Rwandan francs; VI. Any operator that alters or causes or permits to be altered any accessories with intent to avoid the accurate measurement or register of water or to obtain a greater supply of water than he is entitled to or who wilfully or negligently interferes or damages any meter commits a fault; shall be liable of an administrative fine of five hundred thousand (500,000Frw) Rwandan francs; VII. The non-respect of water rationing programs shall be liable to administrative fine of one hundred thousand (100,000 Frw) Rwandan francs. VIII. Le Régulateur peut imposer à toute personne physique ou morale qui ne fournit pas les informations demandées dans le délai fixé, une amende administrative quotidienne de deux cent mille (200.000 Frw) à deux millions (2.000.000 Frw) de francs rwandais ; VI. Tout exploitant qui modifie ou fait modifier ou permet de modifier des accessoires afin d’éviter la mesure précise ou le registre de l’eau ou d’obtenir un approvisionnement en eau plus important que celui auquel il a droit ou qui, délibérément ou par négligence, interfère ou endommage tout compteur commet une faute ; est passible d’une amende administrative de cinq cent mille (500.000Frw) de francs rwandais ; VII. Le non-respect des programmes de rationnement de l’eau est passible d’une amende administrative de cent mille (100.000 Frw) de francs rwandais. VIII. Tout exploitant qui, délibérément ou par négligence, endommage des ouvrages hydriques, toute usine de traitement d’eau ou un autre bien acquis pour une opération commet une faute et paie une amende administrative de deux millions (2.000.000 Frw) de francs rwandais.
