Ingingo ya 2: Abagize Komite z’Ibidukikije Abagize Komite z‟Ibidukikije bagomba kuba ari abantu b‟inyangamugayo, bazwiho ubudakemwa, ubushishozi n‟ubushobozi mu by‟ibidukikije, bakorera mu bwisanzure bakanaba n‟abakorerabushake. After consideration and approval of the Cabinet in its session of 14/11/2007; HEREBY ORDERS: CHAPTER ONE: GENERAL PROVISIONS Article One: Purpose of this Order This Order determines the responsibilities, organization and functioning of Committees Responsible for conservation and protection of the Environment at Provincial, Kigali City, District, Sector and Cell levels, hereafter referred as “Environment Committees”. Article 2: Members of Environment Committees Members of Environment Committees shall be people of integrity, competent in environmental issues, impartial and able to work on a voluntary basis. Après examen et adoption par le Conseil des Ministres, en sa séance du 14/11/2007 ; ARRETE : CHAPITRE PREMIER : DISPOSITIONS GENERALES Article premier : Objet du présent arrêté Le présent arrêté porte attributions, composition et fonctionnement des Comités responsables de la conservation et de la protection de l‟environnement au niveau de la Province, de la Ville de Kigali, du District, du Secteur et de la Cellule, désignés par « Comités de l‟Environnement » dans les articles suivants : Article 2: Membres des Comités de l’Environnement Les membres des Comités de l‟Environnement doivent être des personnes intègres et compétentes travaillant bénévolement et sans aucune injonction. Official Gazette n° 45 of 08/11/2010 46 UMUTWE WA II: INSHINGANO ZA KOMITE Z’IBIDUKIKIJE Ingingo ya 3: Inshingano rusange za Komite z’Ibidukikije Muri rusange, Komite z‟ibidukikije zifite inshingano zikurikira: 1° kugenzura ishyirwa mu bikorwa ry‟ amategeko, politiki, ingamba, imigambi na gahunda byerekeranye no kurengera, kubungabunga no guteza imbere ibidukikije mu Rwanda; 2° gukurikirana ibijyanye no gukangurira abaturage kwita ku bidukikije no gukoresha neza ubutaka; 3° kugenzura ko abangije ibidukikije bakurikiranwa n‟inzego zibifitiye ububasha. Ingingo ya 4: Inshingano za Komite y’Ibidukikije ku rwego rw’Intara n’urw’Umujyi wa Kigali Ku rwego rw‟Intara n‟urw‟Umujyi wa Kigali, Komite y‟Ibidukikije ihuza ibikorwa bigamije kurengera no kubungabunga ibidukikije mu Ntara CHAPTER II: RESPONSIBILITIES OF ENVIRONMENT COMMITTEES Article 3: General responsibilities of Environment Committees In general, Environment Committees shall have the following responsibilities: 1° ensuring the implementation of the laws, policies, programmes and plans relating to the protection, conservation and promotion of the environment in Rwanda; 2° monitoring issues relating to awareness raising of the population on environment protection, and proper land use; 3° ensuring that persons who destroy the environment are pursued by the competent institutions. Every Environment Committee is in charge of overseeing the functioning of the committee below it in hierarchy. Article 4: Responsibilities of Environment Committee at the Provincial and Kigali City levels In Province and Kigali City, the Environment Committee is responsible for coordinating activities aimed at conserving and protecting the CHAPITRE II: ATTRIBUTIONS DES COMITES DE L’ENVIRONNEMENT Article 3: Objectifs des Comités de l’Environnement Les Comités de l‟Environnement ont généralement les objectifs suivants: 1° veiller à la mise en application des lois, politiques, stratégies, programmes et plans d‟actions relatifs à la protection, à la sauvegarde et à la promotion de l‟environnement au Rwanda; 2° assurer le suivi de la sensibilisation de la population sur la protection de l‟environnement et de l‟utilisation rationnelle des terres; 3° s‟assurer que ceux qui dégradent l‟environnement sont poursuivis par les autorités compétentes. Chaque Comité de l‟Environnement doit faire le suivi du fonctionnement du comité hiérarchiquement inférieur. Article 4: Attributions du Comité de l’Environnement au niveau de la Province et de la Ville de Kigali Au niveau de la province et de la Ville de Kigali, le Comité de l‟Environnement coordonne les activités destinées à la Official Gazette n° 45 of 08/11/2010 47 no mu Mujyi wa Kigali. Ingingo ya 5: Inshingano za Komite y’Ibidukikije ku rwego rw’Akarere Ku rwego rw‟Akarere, Komite y‟Ibidukikije ishinzwe ibi bikurikira: 1° gufata ingamba zo gushyiraho ubwiherero n‟imicungire y‟isuku ku nyubako n‟ahantu hahurira abantu benshi no ku mihanda minini; 2° gukurikirana ikoreshwa ry‟ingufu zisubiranya no kurwanya isesagurwa ry‟ingufu zituruka ku biti; 3° kugenzura ko ahantu hakomye, ahantu nyaburanga, inyamaswa n‟ibimera byo mu bwoko burinzwe bifashwe neza; 4° gukurikirana ifatwa neza ry‟amashyamba; 5° gusuzuma igenwa ry‟amahoro y‟isuku; 6° gukurikirana ifatwa neza ry‟ubutaka, ibishanga n‟ahantu h‟amanegeka; 7° gukurikirana no gusuzuma ishyirwa mu environment in the Province and Kigali city. Article 5: Responsibilities of Environment Committee at the District level At District level, the Environment Committee shall have the following responsibilities: 1° to set up strategies for the installation of latrines and ensure proper hygiene in public buildings and places and on main roads; 2° to ensure the use of reusable energy and discourage the mismanagement of energy from wood consumption; 3° to ensure that protected areas, tourist sites and protected species are properly cared for; 4° to ensure monitoring of proper management of forests; 5° to analyze the establishment of taxes on hygiene; 6° to ensure monitoring of proper land use and management of marshlands and critical ecosystems; 7° to ensure monitoring and evaluation of conservation et à la protection de l‟environnement dans la Province et dans la Ville de Kigali. Article 5: Attributions du Comité de l’Environnement au niveau du District Au niveau du District, le Comité de l‟Environnement est chargé de : 1° mettre en place des stratégies visant à installer des latrines et assurer une hygiène correcte dans les bâtiments et lieux publics ainsi que sur les routes principales; 2° faire le suivi de l‟utilisation d‟énergies renouvelables et décourager la mauvaise gestion de l‟énergie provenant de l‟utilisation du bois comme combustible ; 3° assurer la sauvegarde des aires protégées, des lieux touristiques et des espèces animales et végétales protégées ; 4° assurer le suivi de la bonne gestion des forêts ; 5° analyser la fixation des redevances liées à l‟hygiène ; 6° faire le suivi de la gestion et de l‟utilisation convenables des terres, des marais et des écosystèmes critiques; 7° faire le suivi et l‟évaluation de la mise en Official Gazette n° 45 of 08/11/2010 48 bikorwa rya politiki na porogaramu z‟ibidukikije; 8° gukurikirana ibindi byose bigamijekubungabunga no kurengera ibidukikije byasabwe n‟Inama Njyanama y‟Akarere. Ingingo ya 6: Inshingano za Komite y’Ibidukikije ku rwego rw’Umurenge Ku rwego rw‟Umurenge, Komite y‟Ibidukikije ishinzwe ibi bikurikira: 1° kugenzura no gukurikirana ishyirwaho ry‟ibimoteri rusange, n‟imicungire y‟isuku ku masoko, imihanda n‟ahandi hantu hahurira abantu benshi; 2° gukurikirana ifatwa neza ry‟imiyoboro n‟amavomero y‟amazi akoreshwa mu ngo; 3° kugenzura no gukurikirana imitunganyirize ya za pepiniyeri; 4° gukurikirana ko ingamba zo kurwanya isuri zikurikizwa; 5° gukurikirana no gusuzuma ishyirwa mu bikorwa rya politiki na porogaramu z‟ibidukikije; 6° gukurikirana ibindi byose bigamije kubungabunga no kurengera ibidukikije the environmental policies and programmes implementation; 8° to follow up any other activities aimed at conserving and protecting the environment as requested by the District Council. Article 6: Responsibilities of the Environment Committee at the Sector level At Sector level, the Environment Committee shall have the following responsibilities: 1° to ensure and follow up the installation of waste bins, hygiene management in markets, roads/streets and other public places; 2° to ensure monitoring of the proper use of spring and wells by households; 3° to ensure and monitor the management of tree nurseries; 4° to ensure that strategies for fighting soil erosion are being executed; 5° ensure monitoring and evaluation of the execution of the environment policies and programmes; 6° to follow up any other activities aimed at protecting and conserving the œuvre des politiques et programmes en matière d‟environnement ; 8° faire le suivi de toute autre activité destinée à conserver et protéger l‟environnement sur demande du Conseil de District. Article 6: Attributions du Comité de l’Environnement au niveau du Secteur Au niveau du Secteur, le Comité de l‟Environnement est chargé de : 1° assurer le contrôle et le suivi de la mise en place des poubelles publiques, de la gestion de l‟hygiène dans les marchés, sur les routes et autres lieux publics ; 2° faire le suivi de l‟usage approprié des adductions d‟eau et des points d‟eau à usage domestique ; 3° assurer le contrôle et le suivi de la gestion des pépinières ; 4° assurer le suivi de la mise en application des stratégies de lutte contre l‟érosion ; 5° faire le suivi et l‟évaluation de la mise en œuvre des politiques et programmes en matière d‟environnement ; 6° faire le suivi de toute autre activité destinée à conserver et protéger l‟environnement sur Official Gazette n° 45 of 08/11/2010 49 byasabwe n‟Inama Njyanama y‟Umurenge. Ingingo ya 7: Inshingano za Komite y’Ibidukikije ku rwego rw’Akagari Ku rwego rw‟Akagari, Komite y‟Ibidukikije yifashishije abafite mu nshingano zabo ibidukikije n‟isuku mu midugudu, ishinzwe: 1° gukurikirana itegwa n‟ibikwa ry‟amazi y‟imvura kuri buri rugo; 2° kugenzura isuku n‟imitunganyirize y‟imyanda yo mu ngo; 3° gukurikirana ikoreshwa neza ry‟ingufu zituruka ku biti hakoreshwa amashyiga ya rondereza; 4° kugenzura imitunganyirize n‟imikoreshereze y‟imihanda iri mu Tugari; 5° kugenzura imiterere y‟imirwanyasuri n‟itera ry‟ibiti; 6° kugenzura ko ingo zifite ubwiherero kandi bukoreshwa neza; 7° gutanga amabwiriza agamije kurengera environment as requested by the Sector Council. Article 7: Responsibilities of the Environment Committee at the Cell level At Cell level, the Environment Committee in collaboration with the persons in charge of environment and hygiene at the Villages shall have the following responsibilities: 1° to ensure monitoring of rain water harvesting and storage at every household; 2° to ensure proper hygiene and waste management in at household level; 3° to ensure proper use of energy generated from wood consumption by using energy saving cooking stoves called “rondereza”; 4° to ensure proper use and management of roads in the Cell; 5° to ensure fight against erosion measures and tree planting in the Cell; 6° to ensure that all households have properly used latrines; 7° to provide directives for conservation demande du Conseil de Secteur. Article 7: Attributions du Comité de l’Environnement au niveau de la Cellule Au niveau de la Cellule, le Comité de l‟Environnement, en collaboration avec les chargés de l‟environnement et de l‟hygiène dans des villages, est chargé de : 1° assurer le suivi de la collecte et de la conservation de l‟eau de pluie dans chaque ménage ; 2° assurer le contrôle de l‟hygiène et de la gestion des déchets ménagers ; 3° assurer le suivi de l‟utilisation rationnelle de l‟énergie provenant du bois comme combustible par la promotion de fours améliorés ; 4° assurer le contrôle de l‟entretien et de l‟utilisation des routes se trouvant dans la Cellule ; 5° contrôler l‟état des dispositifs anti érosifs et la plantation d‟arbres dans la Cellule ; 6° s‟assurer que tous les ménages disposent d‟une latrine bien entretenue; 7° donner des instructions en vue de Official Gazette n° 45 of 08/11/2010 50 ibidukikije ku rwego rw‟Umudugudu; 8° gukurikirana no gusuzuma ishyirwa mu bikorwa rya politiki na porogaramu z‟ibidukikije; 9° gukurikirana ibindi byose bigamije kubungabunga no kurengera ibidukikije byasabwe n‟Inama Njyanama y‟Akagari. UMUTWE WA III: IMITERERE YA KOMITE Z‘IBIDUKIKIJE Ingingo ya 8: Abagize komite y’ibidukikije ku Rwego rw‘Intara Komite y‟Ibidukikije ku rwego rw‟Intara igizwe n‟aba bakurikira: 1° ufite ibidukikije mu nshingano ze mu Ntara; 2° uhagarariye abikorera mu Ntara; 3° ufite imicungire n‟imikoreshereze y‟ubutaka mu nshingano ze mu Ntara; 4° inararibonye mu bijyanye n‟ibidukikije; 5° Abantu babiri (2) bahagarariye imiryango itegamiye kuri Leta yita ku bidukikije batorwa na bagenzi bbabo; and protection of the environment at the Village level; 8° to ensure monitoring and evaluation of the environmental policies and programmes implementation; 9° to follow up any other activities aimed at conserving and protecting the environment as requested by the Cell Council. CHAPTER III: ORGANIZATION OF THE ENVIRONMENT COMMITTEES Article 8: Composition of Environmental Committee at the Provincial level The Environment Committee at the Provincial level shall comprised of the following: 1° a person in charge of environment in the Province. 2° a representative of the private sector in the Province; 3° a person in charge of land use management in the province; 4° one expert in environment matters; 5° two (2) representatives of non governmental organizations dealing with environment matters who shall be conserver et protéger l‟environnement au niveau du Village ; 8° assurer le suivi et l‟évaluation de la mise en œuvre des politiques et programmes en matière d‟environnement ; 9° suivre toute autre activité destinée à conserver et protéger l‟environnement sur demande du Conseil de Cellule. Article 12: Composition of the Environment Committee at the Cell level Environment Committee at Cell level shall be comprised of the following: 1° a representative of National Women Council at Cell level; 2° a representative of National Youth Council at Cell level; 3° a representative of the private sector at Cell level; 4° two (2) experts in environment matters approved by the Council of the Cell; 5° a representative of non government organizations dealing with environment matters who is elected by his/her peers; 6° persons in charge of environment in the Executive Committees of the Villages; 7° the persons in charge of social affairs in the Executive Committees of the Villages. Ingingo ya 14: Manda ya Komite z’Ibidukikije Komite zishinzwe ibidukikije zifite manda y‟imyaka itatu (3) ishobora kongerwa inshuro imwe. Ingingo ya 15: Igihe za Komite z’Ibidukikije ziterana n’uburyo zitumizwa Ku rwego rw‟Intara, urw‟ Umujyi wa Kigali, urw‟Akarere n‟urw‟Umurenge, Komite z‟Ibidukikije ziterana rimwe mu gihembwe. Ku rwego rw‟Akagari, Komite y‟Ibidukikije iterana rimwe mu kwezi. CHAPTER IV: FUNCTIONING OF THE ENVIRONMENT COMMITTEES Article 13: Leaders of Environment Committees At each administrative level provided by this Order, the Environment Committee members shall elect among them a President and Vice President. At each administrative level provided by this Order, the person in charge of environment shall be the Secretary of the Environment Committee. Article 14: Terms of Environment Committees Environment Committees shall have a term of three (3) years which may be renewable once. Article 15: Time and procedure for calling a meeting of the Environment Committees At the level of Provincial, Kigali city, District and Sector levels, the Environment Committees shall meet once every quarter. At the Cell level the Environment Committee shall meet once every month. CHAPITRE IV : FONCTIONNEMENT DES COMITES DE L’ENVIRONNEMENT Article 13: Responsables des Comités de l’Environnement Les membres du Comité de l‟Environnement à chaque niveau administratif prévu par le présent arrêté, élisent parmi eux un Président et un Vice-Président. A chaque niveau administratif prévu par le présent arrêté, la personne ayant l‟environnement dans ses attributions assure le secrétariat du Comité de l‟Environnement. Article 14: Mandat des Comités de l’Environnement Le mandat des Comités de l‟Environnement est de trois (3) ans renouvelable une fois. Article 15: Périodicité et modalités de convocation des réunions des Comités de l’Environnement Aux niveaux de la province, de la Ville de Kigali, du District, et du Secteur, les Comités de l‟Environnement se réunissent une fois par trimestre. Au niveau de la Cellule, le Comité de l‟Environnement se réunit une fois par mois. Komite y‟Ibidukikije ku rwego rw‟Akarere igenera kopi ya raporo Ikigo cy‟Igihugu cyo However, Environment Committees may also meet any time if it is deemed necessary, for better fulfillment of their responsibilities. The Environment Committees shall convene upon attendance of at least two thirds (2/3) of its members. At each level, the Environment Committee meeting shall be convened by its President or Vice-President in case of President absence. The invitation must be received by the Environment Committee members eight (8) working days before the meeting. Article 16: Decision making Decisions of the Environment Committee shall be taken by consensus. In case of failure, the decisions shall be taken on the majority of two thirds (2/3) of the members present. Article 17: Submission of reports Each Environment Committee at each level shall submit a report to the Council through the Executive Committee of that particular administrative level and provide a copy to the immediate superior Environment Committee. Article 17 : Modalités de soumission des rapports Chaque Comité de l‟Environnement transmet son un rapport au Conseil par le biais du Comité Exécutif du niveau administratif concerné et réserve une copie au Comité de l‟Environnement de l‟échelon immédiatement supérieur. Environment Committee reports shall be analyzed and approved by the Council of the relevant administrative level so as to enable implementation of the recommendations in the report. At Sector and Cell levels, the Environment Committees reports shall be transmitted through the Executive Secretary. Article 18: Reasons for leaving the membership of the Environment Committee A member of the Environment Committee shall leave office in case of: 1° death; 2° resignation; 3° dismissal by the institution he/she is representing. In case of termination of his/her responsibilities, the Environment Committee member shall be replaced within ninety (90) days of his/her termination. In such, case, the President of the Environment Committee shall notify the Council of that administrative level in writing, about the replacement. l‟Office Rwandais de Protection de l‟Environnement (REMA). Les rapports des Comités de l‟Environnement sont examinés et approuvés par le Conseil du niveau administratif concerné afin de permettre la mise en œuvre des recommandations de ces rapports. Au niveau du Secteur et de la Cellule, les rapports des Comités de l‟Environnement sont présentés sous couvert du Secrétaire Exécutif. Article 18: Motif de cessation de la qualité de membre du Comite de l’Environnement Un membre du Comité d‟Environnement perd cette qualité dans les cas suivants: 1° décès ; 2° démission volontaire ; 3° révocation par l‟institution qu‟il représente. Le membre qui cesse ses attributions au sein Comité de l‟Environnement est remplacé dans un délai qui ne dépasse pas quatre-vingt dix (90) jours à partir du jour de la cessation de ses attributions. Dans ce cas, le Président Comité de l‟Environnement doit en informer le Conseil au niveau de l‟entité administrative correspondante. CHAPTER V: FINAL PROVISIONS Article 19: Authorities responsible for the implementation of this Order The Minister of Environment and Lands and the Minister of Local Government are entrusted with the implementation of this Order. Article 20: Repealing provision All prior provisions contrary to this Order are hereby repealed. Article 21: Commencement This Order shall come into force the date of its publication in the Official Gazette of the Republic of Rwanda. CHAPITRE V : DISPOSITIONS FINALES Article 19 : Autorités chargées de l’exécution du présent arrêté Le Ministre de l‟Environnement et des Terres et le Ministre de l‟Administration Locale sont chargés de l‟exécution du présent arrêté Article 20: Disposition abrogatoire Toutes les dispositions antérieures et contraires au présent arrêté sont abrogées.
