RFA ishobora kugira amashami ahandi hose mu Gihugu bibaye ngombwa, kugira ngo igere ku nshingano zayo, byemejwe na CHAPTER ONE: GENERAL PROVISIONS Article One: Purpose of this Order This Order determines mission, responsibilities, organisation and functioning of Rwanda Forestry Authority, hereinafter abbreviated as “RFA”. Article 2: Category RFA falls within the category of non commercial public institutions. Article 3: Supervising authority of RFA RFA is under supervision of the Ministry in charge of forests. Article 4: Head office The head office of RFA is located in Ngororero District, Western Province. It may be relocated elsewhere on the Rwandan territory if considered necessary, upon approval by the Cabinet meeting. RFA may have branches elsewhere in the country if considered necessary in order to fulfil its responsibilities, upon approval by CHAPITRE PREMIER: DISPOSITIONS GÉNÉRALES Article premier: Objet du présent arrêté Le présent arrêté détermine la mission, les attributions, l’organisation et le fonctionnement de l’Office Rwandais des Forêts, ci-après dénommé “RFA” en sigle anglais. Article 2: Catégorie RFA rentre dans la catégorie des établissements publics à caractère non commercial. Article 3: Autorité de tutelle de RFA RFA est placé sous la tutelle du Ministère ayant les forêts dans ses attributions. Article 4: Siège Le siège du RFA est établi dans le District de Ngororero, Province de l’Ouest. Il peut, en cas de besoin, être transféré en un autre lieu du territoire du Rwanda, sur approbation du Conseil des Ministres. Le RFA peut avoir des branches en tout autre lieu du territoire national, en cas de besoin, pour accomplir ses attributions, sur Official Gazette nº 19 Bis of 09/05/2022 166 Minisiteri ifite amashyamba mu nshingano. CHAPTER II: MISSION, RESPONSIBILITIES AND POWERS Article 5: Mission The mission of RFA is to ensure growth, management and preservation of forest resources for purposes of sustainable development. Article 6: Responsibilities RFA has the following responsibilities: 1º to implement Government policies on management and utilisation of forestry resources; 2º to advise the Government on policies, strategies and laws relating to management and utilisation of forestry resources; 3º to work with public and private institutions in charge of management of forests in order to increase their production and control of soil erosion; approbation du Ministère ayant les forêts dans ses attributions. Official Gazette nº 19 Bis of 09/05/2022 169 Ingingo ya 7: Ububasha RFA ifite ububasha bukurikira: 1° gusaba ikigo cyangwa urwego bireba raporo ku miterere y’amashyamba n’ishyirwa mu bikorwa ry’ingamba zo kuyarinda no kuyacunga; 2° guhuza no gutanga umurongo ngenderwaho ku mishinga yose ifitanye isano n’amashyamba; 3° gusura, nta nteguza, uwahawe uruhushya rwo gusarura amashyamba cyangwa urundi ruhushya mu rwego rwo gukora igenzura ku iyubahirizwa ry’ibisabwa; 4° guhagarika by’agateganyo cyangwa kwambura uruhushya rwo gusarura amashyamba cyangwa urundi ruhushya iyo uwaruhawe atubahiriza ibirukubiyemo cyangwa ibiteganywa n’amategeko; 5° guca ihazabu yo mu rwego rw’ubutegetsi iteganywa n’amategeko; Article 7: Powers RFA has the following powers: 1° to request a relevant institution or organ for a report on the status of forests and implementation of measures for protection and management of forests; 2° to coordinate and provide strategic guidance to all initiatives related to forests; 3° to visit, without any notice, a holder of forest harvesting permit or any other permit in the framework of conducting supervision on the compliance with the requirements; 4° to suspend or revoke a forest harvesting permit or any other permit if the holder does not respect its conditions or legal provisions; 5° to impose administrative fine provided for by laws; Article 7: Pouvoirs RFA dispose de pouvoirs suivants: 1° demander à une institution ou un organe concerné un rapport sur l’état des forêts et la mise en œuvre des mesures de protection et de gestion des forêts; 2° coordonner et fournir une orientation stratégique à toutes les initiatives relatives aux forêts; 3° visiter, sans prévenir, un titulaire de permis de récolte des forêts ou tout autre permis dans le cadre de mener des inspections sur la conformité aux exigences; 4° suspendre ou révoquer un permis de récolte des forêts ou tout autre permis dont le titulaire ne respecte pas ses conditions ou les dispositions légales; 5° imposer une amende administrative prévue par la loi; Official Gazette nº 19 Bis of 09/05/2022 170 6° kwemeza igenamigambi ry’imicungire y’amashyamba hashingiwe ku igenamigambi ry’Igihugu; 7° gutegura igenamigambi n’ibyangombwa bikenewe muri gahunda yo kwegurira abikorera imicungire n’imikoreshereze y’amashyamba ya Leta; 8° kugaruza amashyamba ya Leta. CHAPTER III: ORGANISATION AND FUNCTIONING Article 8: Management organs The management organs of RFA are the following: 1° the Board of Directors; 2° the Executive Organ. Article 10: Additional responsibilities of the Board of Directors Subject to the provisions of the Organic Law establishing general provisions governing public institutions, the Board of Directors of RFA has the following additional responsibilities: 1° to approve the draft budget proposal of RFA and make a follow-up on the budget execution; 2° to submit a quarterly and annual report to the Ministry in charge of forests; 3° to decide on any other matter falling within the responsibilities of RFA. Article 11: Powers of the Board of Directors The Board of Directors of RFA is the supreme management and decision making organ. Le patrimoine de RFA provient des sources suivantes: 1° les allocations budgétaires de l’État; 2° les subventions des partenaires; 3° les revenus provenant des services fournis; 4° les intérêts de son patrimoine; 5° les prêts accordés à RFA approuvés par le Ministre ayant les finances dans ses attributions; 6° les dons et legs. Article 26: Budget RFA prepares its annual budget to be adopted by the relevant authority. Article 27: Annual financial report Within three (3) months following the closure of the financial year, RFA submits the annual financial report to the Ministry in charge of forests after its approval by the Board of Directors in accordance with laws governing management of State finance and property. CHAPTER V: FINAL PROVISIONS Article 28: Authorities responsible for the implementation of this Order The Prime Minister, the Minister of Public Service and Labour, the Minister of Environment and the Minister of Finance and Economic Planning are entrusted with the implementation of this Order. Article 26: Budget RFA prépare son budget annuel qui est approuvé par l’autorité compétente. Article 27: Rapport annuel des états financiers Endéans trois (3) mois qui suivent la fin de l’exercice financier, RFA soumet au Ministère ayant les forêts dans ses attributions le rapport annuel des états financiers après son approbation par le Conseil d’Administration conformément aux lois régissant les finances et le patrimoine de l’État. CHAPITRE V: DISPOSITIONS FINALES Article 28: Autorités chargées de l’exécution du présent arrêté Le Premier Ministre, le Ministre de la Fonction Publique et du Travail, le Ministre de l’Environnement et le Ministre des Finances et de la Planification Économique sont chargés de l’exécution du présent arrêté.
