Pursuant to the Constitution of the Republic of Rwanda of 2003 revised in 2015, especially in Articles 121, 122 and 176; Pursuant to Law n° 48/2018 of 13/08/2018 on environment, especially in Article 16; Having reviewed Ministerial Order nº 006/2008 of 15/08/2008 regulating the importation and exportation of ozone layer depleting substances products and equipment containing such substances; After consideration and approval by the Cabinet, in its meeting of 14/12/2020; Article 2: Scope of this Order This Order applies to controlled substances that deplete ozone layer or may cause climate change, products and equipment that contain or rely on controlled substances that are listed in Annex to this Order. Article 3: Definitions In this Order, the following terms have the following meanings: 1 º Authority: the authority in charge of conservation of environment; 2 º controlled substances: ozone depleting substances listed in Annex to this Order, in items A, B, C and E and hydrofluorocarbons (HFCs) substances listed in Annex to this Order, in item F, including their Article premier: Objet du présent arrêté Le présent arrêté régit l’utilisation des substances qui appauvrissent la couche d’ozone ou qui sont susceptibles de causer des changements climatiques. Article 2: Champ d’application du présent arrêté Le présent arrêté s’applique aux substances contrôlées qui appauvrissent la couche d’ozone ou peuvent causer les changements climatiques, aux produits et aux équipements qui contiennent ou qui dépendent des substances contrôlées énumérées en annexe du présent arrêté. Article 3: Définitions Dans le présent arrêté, les termes repris ci-après ont les significations suivantes: 1 º Office: l’office ayant la conservation de l’environnement dans ses attributions; 2 º substances contrôlées: les substances appauvrissant la couche d’ozone énumérées en annexe du présent arrêté, aux points A, B, C et E ainsi que les substances hydrofluorocarbures (HFCs), énumérées en annexe du Official Gazette nº Special of 16/02/2021 8 hydrofluorocarbons/hydrofluorocar bures (HFCs) iri ku mugereka w’iri teka, mu gace ka F harimo n’imyuka bifitanye isano, byaba biri byonyine cyangwa bivanze, byaba ari umwimerere, byaragaruwe, byaranaguwe cyangwa byaravuguruwe; 3 º ibintu byangiza akayunguruzo k’imirasire y’izuba: ikintu kigabanya ingano y’umwuka karemano ugize akayunguruzo k’imirasire y’izuba; 4 º kuvugurura: gusubiranya ikintu kigenzuwe cyagaruwe mu rwego rwo gutuma cyongera gukora nk’igishya, hitawe ku cyo kigenewe gukoreshwa; 5 º kugarura: gukusanya no kubika ibintu bigenzuwe byakuwe mu bikoresho bibikoresha cyangwa bibibika, mu gihe cyo kubisimbuza mbere y’uko bikurwaho mu buryo bwabugenewe; 6 º kunagura: gusukura ikintu kigenzuwe cyagaruwe kugira ngo cyongere gukoreshwa. isomers, whether alone or in a mixture, and whether they are virgin, recovered, recycled or reclaimed; 3 º ozone depleting substances: a substance that brings about a reduction in the ozone layer gas in atmosphere; 4 º reclamation: the reprocessing of a recovered controlled substance in order to meet the equivalent performance of a virgin substance, taking into account its intended use; 5 º recovery: the collection and the storage of controlled substances from products or equipment or containers during maintenance or servicing or before disposal; 6 º recycling: a cleaning process of a recovered controlled substance in order to be re-used. présent arrêté, au point F, y compris leurs isomères, seules ou en mélange, qu’elles soient vierges, récupérées, recyclées ou valorisées; 3 º substances appauvrissant la couche d’ozone: une substance qui entraîne une réduction des gaz de la couche d’ozone dans l’atmosphère; 4 º valoriser: traiter de nouveau une substance contrôlée récupérée, afin d’atteindre les performances équivalentes d’une substance vierge, compte tenu de l’usage auquel elle est destinée; 5 º récupérer: collecter et stocker des substances contrôlées provenant des produits et des équipements ou des conteneurs au cours de l’entretien ou de la maintenance ou avant leur élimination; 6 º recycler: nettoyer une substance contrôlée récupérée pour être réutilisée. Official Gazette nº Special of 16/02/2021 9 Ingingo ya 4: Ibintu n’ibikoresho bibujijwe Uretse igihe Ikigo kibitangiye uruhushya, birabujijwe gukora, gutumiza, kohereza mu mahanga, gukoresha cyangwa gucuruza ibintu bigenzuwe n’ibikoresho bishingiye imikorere yabyo ku bintu bigenzuwe biri ku mugereka w’iri teka. Ingingo ya 5: Ibintu byahagaritswe gukoreshwa Birabujijwe gukora, gutumiza cyangwa kohereza mu mahanga, gukoresha cyangwa gucuruza ibintu byahagaritswe gukoreshwa byangiza akayunguruzo k’imirasire y’izuba cyangwa bishobora gutera imihindagurikire y’ibihe, hakubiyemo ibikoresho cyangwa ibyakozwe birimo cyangwa bikoresha ibintu bigenzuwe nk’uko biteganywa n’Amasezerano ya Montréal yerekeye ibintu byangiza akayunguruzo k’imirasire y’izuba nk’uko yavuguruwe kugeza ubu, yemejwe burundu n’Iteka rya Perezida n⁰ 143/01 ryo ku wa 03/04/2017. Ingingo ya 6: Kumena ibintu bigenzuwe mu bidukikije Birabujijwe kumena ibintu bigenzuwe mu bidukikije. Article 4: Prohibited substances and equipment Except when authorised by the Authority, it is prohibited to produce, import, export, use or sell controlled substances, and equipment or products that contain or rely on controlled substances listed in Annex to this Order. Article 5: Phased-out substances It is prohibited to produce, import, export, use or sell phased-out substances that deplete the ozone layer or that may cause climate change, including equipment or products that contain or depend on controlled substances as provided for by Montréal Protocol on substances that deplete the ozone layer as amended to date, ratified by Presidential Order n⁰ 143/01 of 03/04/2017. Article 6: Discharge of controlled substances into the environment It is prohibited to discharge controlled substances into the environment. Article 4: Substances et équipements interdits Sauf autorisation de l’Office, il est interdit de produire, d’importer, d’exporter, d’utiliser ou de vendre les substances contrôlées ainsi que les équipements ou produits contenant ou dépendant des substances contrôléesénumérées en annexe du présent arrêté. Article 5: Substances éliminées Il est interdit de produire, d’importer, d’exporter, d’utiliser ou de vendre les substances éliminées qui appauvrissent la couche d’ozone ou qui sont susceptibles de causer des changements climatiques, y compris des équipements ou des produits contenant ou dépendant des substances contrôlées telles que prévues par le Protocole de Montréal relatif à des substances qui appauvrissent la couche d’ozone, tel que modifié à ce jour, ratifié par l’Arrêté Présidentiel n⁰ 143/01 du 03/04/2017. Article 6: Déversement de substances contrôlées dans l’environnement Il est interdit de déverser des substances contrôlées dans l’environnement. Official Gazette nº Special of 16/02/2021 10 Ingingo ya 7: Ingamba z’iyubahirizwa Bitabangamiye ibihano biteganywa n’amategeko abigenga, umuntu utubahirije ibivugwa mu ngingo ya 4, iya 5 n’iya 6 z’iri teka agomba: 1° gusenya ibintu bigenzuwe cyangwa byahagaritswe n’ibikoresho kandi akiyishyurira ikiguzi cyabyo; cyangwa 2° kubisubiza mu mahanga aho bishoboka kandi akiyishyurira ikiguzi cyabyo. Ingingo ya 8: Ibisabwa mu gutumiza cyangwa kohereza mu mahanga, kugarura, gutunganya, gusana, kuvugurura cyangwa kunagura ibintu bigenzuwe Umuntu ushaka gutumiza cyangwa kohereza mu mahanga, kugarura, gutunganya, gusana, kuvugurura cyangwa kunagura ibintu bigenzuwe n’ibikoresho bijyanye na byo agomba kubisabira uruhushya mu Kigo. Ingingo ya 9: Gusaba uruhushya Umuntu usaba uruhushya rwo gutumiza cyangwa kohereza mu mahanga, kugarura, Article 7: Compliance measures Without prejudice to penalties provided in accordance with relevant laws, a person who contravenes provisions of Articles 4, 5 and 6 of this Order is required to: 1° destroy controlled or phased-out substances and equipment at his or her own costs; or 2° re-export them where applicable, at his or her own costs. Article 8: Requirements to import, export, recover, maintain, repair, reclaim or to recycle controlled substances A person who intends to import, export, recover, maintain, repair, reclaim or recycle the controlled substances and related equipment must seek authorisation from the Authority. Article 9: Application for authorisation A person who applies for an authorisation to import or export, recover, maintain, repair, Article 7: Mesures de conformité Sans préjudice des sanctions prévues conformément à la législation en la matière, une personne qui contrevient aux dispositions des articles 4, 5 et 6 du présent arrêté est tenue de: 1° détruire des substances contrôlées ou éliminées et équipements à ses propres frais; ou 2° les réexporter le cas échéant, à ses propres frais. Article 8: Conditions d’importer, d’exporter, de récupérer, d’entretenir, de réparer, de valoriser ou de recycler des substances contrôlées Une personne qui désire importer, exporter, récupérer, entretenir, réparer, valoriser ou recycler des substances contrôlées et des équipements connexes doit demander l’autorisation de l’Office. Article 9: Demande d’une autorisation Une personne qui demande une autorisation d’importer ou d’exporter, de récupérer, Official Gazette nº Special of 16/02/2021 11 gutunganya, gusana, kuvugurura cyangwa kunagura ibintu bigenzuwe n’ibikoresho bijyanye na byo ashyikiriza Ikigo ubusabe bwe mu nyandiko. Ubusabe buvugwa mu gika cya mbere cy’iyi ngingo bukorwa hifashishijwe ikoranabuhanga rya interineti. Dosiye isaba uruhushya iba ikubiyemo: 1 º ifishi isaba yujujwe neza itangwa n’Ikigo, ikubiyemo umwirondoro w’usaba, inkomoko y’ibintu bigenzuwe n’iy’ibikoresho birimo ibyo bintu; 2 º ibinyabutabire biranga ibintu bigenzuwe; 3 º icyemezo cy’iyandikisha ry’isosiyete y’ubucuruzi; 4 º icyemezo cy’ubucuruzi. Ingingo ya 10: Kumenyeshwa icyemezo cyafashwe ku busabe Ikigo kimenyesha uwasabye icyemezo cyafashwe ku busabe bw’uruhushya rwo reclaim or of recycling controlled substances and related equipment submits his or her application in writing to the Authority. The application referred to under Paragraph One of this Article is done via internet. The application file for an authorisation includes: 1 º a filled application form provided by the Authority, containing identification of the applicant, the origin of controlled substances and equipment that contain those substances; 2 º chemical parameters of the controlled substances; 3 º a company registration certificate; 4 º a trade licence certificate. Article 10: Notification of a decision taken on the application The Authority notifies the applicant of a decision taken on the application for an d’entretenir, de réparer, de valoriser ou de recycler des substances contrôlées et des équipements connexes adresse sa demande écrite à l’Office. Le dossier de la demande de l’autorisation comprend: 1 º un formulaire de demande fourni par l’Office dûment rempli, contenant l’identification du demandeur, l’origine des substances contrôlées et des équipements contenant ces substances; 2 º les paramètres chimiques des substances contrôlées; 3 º un certificat d’enregistrement d’une société commerciale; 4 º un certificat de licence de commerce. Article 10: Notification de la décision prise sur la demande L’Office notifie le demandeur de la décision sur la demande d’autorisation d’importer, Official Gazette nº Special of 16/02/2021 12 gutumiza cyangwa kohereza mu mahanga, kugarura, gutunganya, gusana, kuvugurura cyangwa kunagura ibintu bigenzuwe n’ibikoresho bijyanye na byo mu gihe kitarenze iminsi mirongo itatu (30) uhereye ku munsi dosiye y’ubusabe yuzuye yakiriweho. Ikigo kimenyesha uwasabye icyemezo cyafashwe hifashishijwe ikoranabuhanga rya interineti. Ingingo ya 11: Igihe uruhushya rumara Uruhushya rwo gutumiza cyangwa kohereza mu mahanga, kugarura, gutunganya, gusana, kuvugurura cyangwa kunagura ibintu bigenzuwe n’ibikoresho bijyanye na byo rugira agaciro k’igihe kitarenze imyaka itatu (3), uhereye igihe rwatangiwe. Ingingo ya 12: Inshingano z’uwahawe uruhushya Uwahawe uruhushya afite inshingano zikurikira: 1° kubahiriza igipimo cy’umwaka cy’ibitumizwa mu mahanga yahawe; authorisation of importation, exportation, recovery, maintenance, repair, reclamation or recycling of controlled substances and related equipment within thirty (30) days from the date a complete application file was received. The Authority notifies the applicant of a decision taken via internet. Article 11: Validity of authorisation The authorisation of importation, exportation, recovery, maintenance, repair, reclamation or recycling of controlled substances and related equipment is valid for a period not exceeding three (3) years, from the date of issuance. Article 12: Obligations of a holder of an authorisation The authorisation holder has the following obligations: 1° to comply with the annual import quotas allocation; d’exporter, de récupérer, d’entretenir, de réparer, de valoriser ou de recycler des substances contrôlées et des équipements connexes endéans trente (30) jours à compter de la date de réception du dossier complet de la demande. Article 11: Validité de l’autorisation L’autorisation d’importer, d’exporter, de récupérer, d’entretenir, de réparer, de valoriser ou de recycler des substances contrôlées et des équipements connexes est valable pour une période n’excédant pas trois (3) ans, à partir de la date de délivrance. Article 12: Obligations du titulaire d’une autorisation Le titulaire de l’autorisation a les obligations suivantes: 1° se conformer à l’obligation des quotas d’importation annuels; Official Gazette nº Special of 16/02/2021 13 2° gushyikiriza Ikigo raporo ngarukamwaka igaragaza ingano y’ibyo yinjije mu Gihugu cyangwa y’ibyo yohereje mu mahanga umwaka ubanza. Ingingo ya 13: Guhagarika by’agateganyo cyangwa kwamburwa uruhushya Mu gihe habayeho kutubahiriza ibiteganywa muri iri teka, Ikigo gishobora guhagarika by’agateganyo uruhushya rwo gutumiza cyangwa kohereza mu mahanga, kugarura, gutunganya, gusana, kuvugurura cyangwa kunagura ibintu bigenzuwe n’ibikoresho bijyanye na byo. Uwahawe uruhushya arwamburwa kubera impamvu zikurikira: 1 º kutubahiriza ibisabwa mu ruhushya yahawe; 2 º kwinjiza mu Gihugu ibintu bigenzuwe cyangwa ibikoresho birimo ibyo bintu mu buryo bunyuranyije n’amategeko; 3 º iyo uruhushya rwatanzwe hashingiwe ku mpapuro mpimbano cyangwa ku buriganya. 2° to submit to the Authority an annual report of the total quantities imported or exported for the previous year. Article 13: Temporary suspension or revocation of the authorisation In case of violation of provisions of this Order, the Authority may suspend the authorisation of importation, exportation, recovery, maintenance, repair, reclamation or recycling of controlled substances and related equipment. The authorisation is revoked from the holder due to the following reasons: 1 º failure to comply with the terms and conditions of the authorisation; 2 º illegal importation of controlled substances or equipment containing those substances; 3 º when an authorisation was issued based on false documents or fraud. 2° transmettre à l’Autorité un rapport annuel des quantités totales importées ou exportées pour l’année précédente. Article 13: Suspension temporaire ou révocation de l’autorisation En cas de violation des dispositions du présent arrêté, l’Office peut suspendre l’autorisation d’importer, d’exporter, de récupérer, d’entretenir, de réparer, de valoriser ou de recycler des substances contrôlées et des équipements connexes. L’autorisation est révoquée du titulaire pour des raisons suivantes: 1 º le défaut de se conformer aux termes et conditions de l’autorisation; 2 º l’importation illégale des substances contrôlées ou des équipements qui contiennent ces substances; 3 º lorsqu’une autorisation a été délivrée sur base de faux documents ou de fraude. Dosiye y’utumiza ibintu mu mahanga Article 14: Fixing annual import quotas The Authority fixes, every year, the national import quotas of controlled substances based on the quantity imported or exported during the previous year. The quotas of imported or exported controlled substances are fixed on decreasing scale across years. Article 15: Communication of annual import quotas of controlled substance The national import quota of controlled substances for the following year is communicated not later than October of each year. Article 16: Application for import quota The application for annual import quota of controlled substances for the following year is submitted not later than 30th November of each year. Article 17: Labelling Imported or exported controlled substances and equipment containing those substances must bear a label or any other indication showing their nature, percentage and a caution indicating consequences of using those substances. Article 18: Management of controlled substances A person who intends to recover, maintain, repair, reclaim or recycle controlled substances and related equipment must comply with relevant laws and regulations. Ingingo ya 20: Ibarura y’ibintu bigenzuwe Ikigo gikora, buri mwaka, ibarura rigaragaza ingano y’ibintu bigenzuwe, ibyakozwe Article 19: Reporting Not later than January every year, a person who imports or exports, recovers, maintains, recycles or reclaims controlled substances reports to the Authority the following: 1 º the quantities imported and exported for the previous year; 2 º the quantities recovered, recycled, reclaimed or destroyed for the previous year. The Authority determines the format of the report. A person who imports or exports, recovers, maintains, recycles, reclaims or destroys controlled substances keeps a copy of the annual report for five (5) years, after submission to the Authority.
