WATER RESOURCES USE PERMIT The Minister of Environment; Pursuant to the Constitution of the Republic of Rwanda; Pursuant to Law nº 49/2018 of 13/08/2018 determining the use and management of water resources in Rwanda, especially in Articles 21 and 22; Having reviewed Ministerial Order nº 002/16.01 of 24/05/2013 determining the procedure for declaration, authorisation and concession for the utilisation of water; After consideration and approval by the Cabinet, in its meeting of 20/10/2023; ORDERS: CHAPTER ONE: GENERAL PROVISIONS ARRÊTÉ MINISTÉRIEL No 001/MoE/24 DU 02/04/2024 RELATIF AU PERMIS D’UTILISATION DES RESSOURCES EN EAU Le Ministre de l’Environnement ; Vu la Constitution de la République du Rwanda ; Vu la Loi nº 49/2018 du 13/08/2018 portant utilisation et gestion des ressources en eau au Rwanda, spécialement en ses articles 21 et 22; Revu l’Arrêté Ministériel nº 002/16.01 du 24/05/2013 portant procédure de déclaration, autorisation et concession pour l’utilisation de l’eau ; Après examen et adoption par le Conseil des Ministres, en sa séance du 20/10/2023 ; ARRÊTE : CHAPITRE PREMIER: DISPOSITIONS GÉNÉRALES Official Gazette n° Special of 03/04/2024 7 Ingingo ya mbere: Icyo iri teka rigamije Iri teka rigena – (a) ibikorwa, imirimo n’inyubako bisabirwa uruhushya rwo gukoresha umutungo kamere w’amazi; (b) n’ibisabwa n’ibikurikizwa mu kubona, gukoresha, kongerera igihe no guhererekanya uruhushya rwo gukoresha umutungo kamere w’amazi. Ingingo ya 2: Isobanura Muri iri teka: (a) « Itegeko ry’amazi » bivuga Itegeko rigena imikoreshereze n’imicungire y’umutungo kamere w’amazi mu Rwanda; (b) « Ikigo » bivuga ikigo gifite imicungire y’umutungo kamere w’amazi mu nshingano; (c) « umuntu » akubiyemo umuntu ku giti cye, urwego rwa Leta, isosiyete y’ubucuruzi, koperative, fondasiyo cyangwa irindi shyirahamwe iryo ari ryo ryose. Article One: Purpose of this Order This Order determines – (a) activities, works and installations subject to water resources use permit; and (b) conditions and procedures for acquisition and use of water resources use permit, its extension and transfer. Article 2: Interpretation In this Order: (a) “Water Law” means the Law determining the use and management of water resources in Rwanda; (b) “Authority” means the authority in charge of water resources management; (c) “person” includes an individual, public organ, company, cooperative, foundation or any other association. Article premier: Objet du présent arrêté Le présent arrêté détermine – (a) les activités, les travaux et les installations soumis au permis d’utilisation des ressources en eau ; et (b) les conditions et les procédures d’obtention et d’utilisation du permis d’utilisation des ressources en eau, sa prolongation et son transfert. Article 2: Interprétation Dans le présent arrêté : (a) « la Loi sur l’eau » signifie la loi portant utilisation et gestion des ressources en eau au Rwanda ; (b) « Office » signifie l’office ayant la gestion des ressources en eau dans ses attributions ; (c) « personne » comprend une personne physique, un organe public, une société commerciale, une coopérative, fondation ou toute autre association. Official Gazette n° Special of 03/04/2024 8 Ingingo ya 3: Ibikorwa, imirimo n’inyubako bisabirwa uruhushya rwo gukoresha umutungo kamere w’amazi Ibikorwa, imirimo n’inyubako bikurikira bisabirwa uruhushya rwo gukoresha umutungo kamere w’amazi mbere yo gukorwa: (a) kuhira ubuso bw’ubutaka burenze hegitari imwe; (b) kubaka ibikorwa remezo, mu migezi cyangwa mu biyaga; (c) kubaka urugomero rusanzwe; (d) ubworozi bw’amafi bukorewe mu kiyaga; (e) ubworozi bw’amafi bukorewe mu cyuzi; (f) gukwirakwiza amazi mu ngo, mu nzuri no mu bigo bihuriramo abantu benshi; (g) inganda zironga kawa; (h) gukoresha amazi mu nganda; Article 3: Activities, works and installations subject to water resources use permit The following activities, works and installations are subject to obtaining a water resources use permit before they are carried out: (a) irrigation of a land surface of more than one hectare; (b) construction of infrastructure in rivers or lakes; (c) construction of a dam; (d) fish farming in lake; (e) fish farming in artificial pond; (f) domestic water supply, water supply for livestock and to community settlements; (g) coffee washing station; (h) industrial water use; Article 3: Activités, travaux et installations soumis au permis d’utilisation des ressources en eau Les activités, travaux et installations suivants sont soumis à l’obtention d’un permis d’utilisation des ressources en eau avant leur exécution : (a) l’irrigation d’une superficie des terres de plus d’un hectare ; (b) la construction des infrastructures dans les rivières ou lacs ; (c) la construction d’un barrage ; (d) la pisciculture en lac ; (e) la pisciculture en étang artificiel ; (f) l’approvisionnement en eau domestique, pour élevage, et aux établissements communautaires ; (g) la station de lavage du café ; (h) l’utilisation de l’eau dans l’industrie; Official Gazette n° Special of 03/04/2024 9 (i) kubaka ingomero z’amashanyarazi; (j) kuyungurura amabuye y’agaciro; (k) ibyambu byo mu mazi; (l) ibikorwa by’imyidagaduro bisaba ikoreshwa ry’amazi; (m) gucukura gazi mu mazi; (n) n’ikindi gikorwa cyagenwa na Minisitiri ufite imicungire y’umutungo kamere w’amazi mu nshingano. UMUTWE WA II: UBURYO BWO GUSABA NO GUTANGA URUHUSHYA RWO GUKORESHA UMUTUNGO KAMERE W’AMAZI Ingingo ya 4: Ibisabwa rusange mu gusaba uruhushya rwo gukoresha umutungo kamere w’amazi Ubusabe bw’uruhushya rwo gukoresha umutungo kamere w’amazi bugizwe n’ibi bikurikira: (a) ibaruwa isaba uruhushya yandikiwe Ikigo inyujijwe ku Muyobozi (i) construction of hydropower plants; (j) minerals washing; (k) ports; (l) recreation activities requiring the use of water; (m) gas extraction from water; (n) other activity as may be determined by the Minister in charge of management of water resources. CHAPTER II: PROCEDURES FOR APPLYING AND ISSUANCE OF WATER RESOURCES USE PERMIT Article 4: General requirements for water resources use permit application Application for a water resources use permit consists of the following: (a) an application letter addressed to the Authority through the Mayor of the (i) la construction des centrales hydro électriques ; (j) le lavage des minéraux ; (k) les ports ; (l) les activités récréatives nécessitant l’utilisation de l’eau ; (m) l’extraction de gaz à partir de l’eau ; (n) autre activité pouvant être déterminée par le Ministre ayant la gestion des ressources en eau dans ses attributions. CHAPITRE II: PROCÉDURES DE DEMANDE ET DE DÉLIVRANCE D’UN PERMIS D’UTILISATION DES RESSOURCES EN EAU Article 4: Exigences générales pour la demande de permis d’utilisation des ressources en eau La demande de permis d’utilisation des ressources en eau comprend ce qui suit : (a) une lettre de demande d’autorisation adressée à l’Office avec sous couvert Official Gazette n° Special of 03/04/2024 10 w’Akarere imirimo izakorerwamo; (b) ifishi yo gusaba yujujwe igenwa n’Ikigo; (c) inyemezabwishyu ya FRW 35.000 yo gusaba adasubizwa kandi yishyurwa mu Kigega cy’Igihugu cy’Ibidukikije (FONERWA); (d) fotokopi y’icyangombwa kiranga usaba cyangwa icyemezo cy’iyandikishwa cyatanzwe n’urwego rubifitiye ububasha, iyo usaba ari sosiyete y’ubucuruzi, koperative, ishyirahamwe cyangwa fondasiyo; (e) indi nyandiko yaba ngombwa. Ingingo ya 5: Ibyubahirizwa byihariye mu gusaba uruhushya rwo gukoresha umutungo kamere w’amazi ku bikorwa, imirimo cyangwa inyubako bisabirwa uruhushya Ubusabe bw’uruhushya rwo gukoresha umutungo kamere w’amazi ku bikorwa, imirimo cyangwa inyubako bikoresha amazi bikurikira bugomba kuba buherekejwe n’inyandiko zihariye zikurikira: District in which the activities will be carried out; (b) a filled application form prescribed by the Authority; (c) a proof of payment of the non refundable application fee of FRW 35,000 deposited in the National Fund for Environment (FONERWA); (d) copy of the applicant’s identification document or a certificate of registration, if the applicant is a company, cooperative, association or foundation; (e) any other relevant document. Article 5: Specific application requirements for activities, works or installations subject to water resources use permit The water resources use permit application for the following categories of activities, works or installations is accompanied by the following specific documents: du Maire du District où les activités seront menées ; (b) un formulaire de demande rempli qui est prescrit par l’Office ; (c) une preuve de paiement des frais de demande non remboursables de 35.000 FRW déposés au Fonds National de l’Environnement (FONERWA) ; (d) une copie du document d’identification ou un certificat d’enregistrement, lorsque le demandeur est une société commerciale, une coopérative, une association ou une fondation ; (e) tout autre document pertinent. Article 5: Conditions particulières de demande pour les activités, travaux ou installations soumis à l’autorisation d'utilisation des ressources en eau La demande de permis d’utilisation des ressources en eau pour les activités, travaux ou installation suivants est accompagnée des documents spécifiques suivants: Official Gazette n° Special of 03/04/2024 11 (a) ku bikorwa byo kuhira ku butaka burenze hegitari icumi, kubaka ibikorwa remezo mu migezi cyangwa mu biyaga, kubaka urugomero rusanzwe, ingomero z’amashanyarazi no gucukura gazi cyangwa ibyambu byo mu mazi, ubusabe buherekezwa n’– (i) icyemezo cy’isuzumangaruka ku bidukikije cyatanzwe n’urwego rubifitiye ububasha; (ii) n’inyigo y’ikoreka ry’umushinga; (b) ku bworozi bw’amafi bukorewe mu kiyaga, ubusabe buherekezwa n’ – (i) inyandiko ishyigikira ubusabe y’urwego rw’Igihugu rufite ubworozi bw’amafi mu nshingano; (ii) n’ikarita igaragaza agace kazororerwamo ; (c) ku bworozi bw’amafi bukorewe mu cyuzi, ubusabe buherekezwa n’ – (i) inyandiko ishyigikira ubusabe y’urwego rw’Igihugu rufite ubworozi bw’amafi mu nshingano; (a) for irrigation at land surface exceeding ten hectares, construction of infrastructures in rivers or lakes, construction of a dam, hydropower plant and gas extraction or ports, the application is accompanied by – (i) an environmental impact assessment certificate provided by the competent organ; and (ii) the project feasibility study; (b) for fish farming in lakes, the application is accompanied by – (i) a recommendation from the organ in charge of fish farming; and (ii) a polygonal map of the fish farming area; (c) for fish farming in ponds, the application is accompanied by – (i) a recommendation from the organ in charge of fish farming; and (a) pour l’irrigation de terres d’une superficie supérieure à dix hectares, la construction d’infrastructures dans des rivières ou des lacs, la construction d’un barrage, d’une centrale hydro électrique et l’extraction du gaz ou des ports, la demande est accompagnée d’– (i) un certificat d’étude d’impact environnemental délivré par l’organe compétent ; et (ii) d’une étude de faisabilité du projet; (b) pour la pisciculture en lacs, la demande est accompagnée d’– (i) une recommandation de l’organe ayant la pisciculture dans ses attributions; et (ii) d’une carte polygonale de la zone des travaux piscicoles; (c) pour la pisciculture en étang, la demande est accompagnée d’– (i) une recommandation de l’organe ayant la pisciculture dans ses attributions ; et d’ Official Gazette n° Special of 03/04/2024 12 (ii) na raporo ku mitembere y’umugezi ; (d) ku gukwirakwiza amazi mu ngo, mu nzuri, no mu bigo bihuriramo abantu benshi, ubusabe buherekezwa n’inyigo y’ikoreka ry’umushinga; (e) ku nganda zironga kawa, ubusabe buherekezwa na raporo ku mitembere y’umugezi; (f) ku nganda n’ubucukuzi bw’amabuye y’agaciro, ubusabe buherekezwa n’– (i) icyemezo cy’isuzumangaruka ku bidukikije cyatanzwe n’urwego rubifitiye ububasha; (ii) na raporo ku mitembere y’umugezi; (g) ku bikorwa by’imyidagaduro, ubusabe buherekezwa n’ – (i) icyemezo cy’isuzumangaruka ku bidukikije cyatanzwe n’urwego rubifitiye ububasha; (ii) n’ikarita y’agace k’ahabera imyidagaduro. (ii) a hydrological report; (d) for domestic water supply, water supply in farms and to community settlements, the application is accompanied by the project feasibility study; (e) for coffee washing stations, the application is accompanied by a hydrological report; (f) for industries and mining, the application is accompanied by – (i) an environmental impact assessment certificate provided by a competent organ; and (ii) a hydrological report; (g) for recreational activities, the application is accompanied by – (i) an environmental impact assessment certificate provided by a competent organ; and (ii) a polygonal map of the recreational activity area. Ingingo ya 7 : Kumenyesha uwasabye uruhushya icyemezo cyafashwe ku busabe (1) Ikigo kimenyesha uwasabye uruhushya icyemezo cyafashwe ku busabe bw’uruhushya rwo gukoresha amazi mu gihe kitarenze iminsi 90 ibarwa uhereye ku munsi ubusabe bwakiriweho. Article 7: Notification to the applicant of the decision taken on the application (1) The authority notifies the applicant about the decision on his or her application for water resources use permit in a period not exceeding 90 days from the date of receipt of application. (2) If the Authority does not issue the water resources use permit it notifies the applicant of the reasons for such a refusal or requests the applicant to complete the application by providing missing information. Article 8: Validity of an incomplete application for water resources use permit An incomplete application for a water resources use permit is valid for a period of (g) les dispositions du plan de gestion du bassin versant ; (h) les dispositions des plans des villes, des districts et de l’utilisation des terres ; (i) la priorité pour l’allocation de l’eau telle que prévue par la Loi sur l’eau. Article 9: Online application of water resources use permit A person may apply for a water ressources use permit through online system designed for that purpose. Article 10: Contents of the water resources use permit A water resources use permit indicates at least contains the following: (a) permit number ; (b) names and address of the holder; (c) the quantity of water resources requested and its location within the catchment; (d) the purpose of water resources use or planned activity; (e) the place of water resources use or activity; période de six mois, après quoi elle n’est plus examinée. Article 11: Duration of the water resources use permit A water resources use permit is valid for an initial period not exceeding 15 years or the estimated lifetime of proposed activity, if it is less longer. The water resources use permit may be extended. Article 12: Obligations of a water resources use permit holder (1) A water resources use permit holder must at least – (f) la durée du permis d’utilisation des ressources en eau ; (g) la date de délivrance du permis d’utilisation des ressources en eau ; (h) le volume des ressources en eau à capter ou la superficie de la masse des ressources en eau sur lesquelles les activités seront menées. Ce permis d’utilisation des ressources en eau peut être prolongé. (2) Igitabo cyandikwamo impushya zo gukoresha umutungo kamere w’amazi kigaragaza ibi bikurikira: domestic water supply, hydropower plants or irrigation on a surface more than ten hectares; and (g) to submit to the Authority an annual water resources use report. (2) The Authority may impose specific obligations to a water resources use permit holder, depending on the type, purpose of water resources, its use or proposed activity. Article 13: Register of water resources use permits (1) The Authority establishes and updates the register of water resources use permits. (3) The register of water resources use permits may be established and kept in an electronic format. CHAPTER III: EXTENSION, TRANSFER, SUSPENSION, MODIFICATION OR CANCELLATION OF A WATER RESOURCES USE PERMIT Article 14: Extension of the duration of a water resources use permit (1) The holder of a water resources use permit may apply to the Authority for the extension of the duration of the water resources use permit before the expiry of the initial duration and indicates the duration of the extension applied for. (5) Uruhushya rwo gukoresha umutungo kamere w’amazi rwongerewe igihe of a water resources use permit is accompanied by the following: (a) an application letter; (b) an overall report of activities done during the elapsed period; (c) a proof of payment of the non refundable extension application fee of FRW 35,000 deposited in the National Fund for Environment (FONERWA); (d) any other relevant document, as may be decided by the Authority. (3) The Authority may grant or reject an extension after assessing whether the applicant complied with the terms of the initial water resources use permit contract. (4) If the Authority rejects the application for extension, it notifies the applicant indicating the reasons for such a decision. (6) The extension of a water resources use permit does not imply modification of the initial contract. Article 15: Transfer of a water resources use permit (1) A water resources use permit holder may apply to the Authority for the transfer of a water resources use permit, stating the reasons for the transfer and the names of the new holder. The application for permit transfer is accompanied by a proof of payment of the non-refundable transfer application fee of FRW 35,000 deposited in the National Fund for Environment (FONERWA). (2) If approved, the transfer is recorded in the register of water resources use permits. (3) The new water resources use permit holder has the same rights and obligations of the previous water resources use permit holder and conditions que le permis initial. Article 15: Transfert d’un permis d’utilisation des ressources en eau (1) Le titulaire d’un permis d’utilisation des ressources en eau peut demander à l’Office le transfert de ce permis, en indiquant les raisons de ce transfert et les noms du nouveau titulaire. La demande de transfert du permis est accompagnée d’une preuve de paiement des frais de demande de transfert non remboursables de 35.000 FRW, déposés au Fonds National de l’Environnement (FONERWA). (2) Le transfert est enregistré dans le registre des permis d’utilisation des ressources en eau, s’il est approuvé. Ingingo ya 17: Gutesha agaciro uruhushya rwo gukoresha umutungo kamere w’amazi (1) Impamvu zo gutesha agaciro uruhushya rwo gukoresha umutungo kamere w’amazi ni – (a) ukudakoresha umutungo kamere w’amazi uvugwa mu ruhushya rwo gukoresha umutungo kamere w’amazi yahawe mu gihe cy’imyaka itatu ikurikirana; (b) ugukoresha umutungo kamere w’amazi ku ngano irenze ingano igaragazwa n’uruhushya rwo gukoresha umutungo kamere w’amazi yahawe; complies with the same terms and conditions as those to which the previous holder was subject. Article 16: Modification of a water resources use permit The Authority may, at the written request of the holder of a water resources use permit, modify the permit, after an assessment of the reasons for the request. Article 17: Cancellation of a water resources use permit (1) The reasons of cancellation of a water resources use permit are – (a) not using the water resources specified in the water resources use permit for three consecutive years; (b) use of water resources in a volume exceeding the quantity specified in the water resources use permit; d’utilisation des ressources en eau et respecte les mêmes conditions que celles auxquelles était soumis le titulaire précédent. (3) Iyo uruhushya rwo gukoresha umutungo kamere w’amazi ruteshejwe agaciro, nyirarwo afite uburenganzira bwo gutakambira Ikigo cyongere gusuzuma icyo cyemezo mu minsi 30 (c) use of water resources for purposes other than those specified in the water resources use permit; (d) deliberate provision of false information on the water use or activity that is the subject of the water resources use permit or failure to provide information; or (e) breach of the provisions of regulations related to environment, water resources or any of the terms and conditions of the water resources use permit contract. (2) The Authority informs in writing the water resources use permit holder of the decision to cancel the water resources use permit. (2) L’Office informe par écrit le titulaire du permis d’utilisation des ressources en eau de la décision de son annulation. (3) Si le permis d’utilisation des ressources en eau est annulé, le titulaire du permis a le droit de faire le recours gracieux auprès de l’Office contre cette décision dans un délai de 30 jours à compter de Official Gazette n° Special of 03/04/2024 25 ibarwa uhereye umunsi yaboneye inyandiko ibimumenyesha. Article 18 : Modification ou annulation d’un permis d’utilisation des ressources en eau sans faute du titulaire L’Office peut, après notification et audition du titulaire du permis d’utilisation des ressources en eau, modifier ou annuler ce permis lorsqu’un plan de gestion de bassin versant ou l’intérêt public l’exige. (3) Iyo igihe cy’ihagarikwa ry’agateganyo ry’uruhushya rwo gukoresha umutungo kamere w’amazi mu bihe Article 19: Suspension of water resources use permit in case of an emergency (1) The Authority may suspend a water resources use permit – (a) in period of extreme drought, floods or other cases of force majeure; (b) when there is a risk of significant degradation of water quality; or (c) when health authorities so recommend to prevent or control the spreading of diseases. (2) The notice of suspension of water resources use permit in case of an emergency must specify the reasons for and the duration of the suspension. (2) L’avis de suspension du permis d’utilisation des ressources en eau en cas de situations d’urgence doit préciser les motifs et la durée de cette suspension. CHAPTER IV: MISCELLANEOUS AND FINAL PROVISIONS Article 20: Validity of acts performed before the entry into force of this Order (1) The authorisations, concessions, licences and other instruments authorising the use of water issued before the entry into force of this Order remain valid, provided that they do not contradict this Order. (2) Where the provisions contained in the authorisations, concessions, licences and instruments provided for in Paragraph (1) of this Article as well as in the contracts relating thereto are in conflict with the provisions of this Order, the provisions of this Order prevail.
