Ingingo ya 2: Ibisobanuro by’amagambo Muri iri tegeko, amagambo akurikira asobanura: 1° ibiribwa: ibintu byose bitari umuti, ibintu binoza kandi bisukura umubiri bitari n’itabi bikoreshwa nk’inyongera ku biribwa cyangwa binyobwa n’abantu kandi bibarirwamo n’ikindi cyose gikoreshwa mu ikorwa cyangwa ihindurwa ry’ ibiribwa; Pursuant to Organic Law n° 06/2009/OL of 21/12/2009 establishing general provisions governing public institutions as modified and complemented to date; ADOPTS: CHAPTER ONE: GENERAL PROVISIONS Article One: Purpose of this Law This Law establishes Rwanda Food and Medicines Authority, abbreviated as “RFMA”. It also determines its mission, organization and functioning. RFMA shall have legal personality, administrative and financial autonomy and be managed in accordance with general provisions governing public institutions. Article 2: Definitions of terms For the purposes of this Law, the following terms shall have the following meanings: 1° food products: any items other than pharmaceutical products, cosmetics and tobacco used as food supplements or drink for human beings and including any substance used in the manufacture or treatment of food; Vu la Loi Organique n° 06/2009/OL du 21/12/2009 portant dispositions générales applicables aux établissements publics telle que modifiée et complétée à ce jour ; ADOPTE : CHAPITRE PREMIER: DISPOSITIONS GENERALES Article premier: Objet de la présente loi La présente loi porte création de l’Office Rwandais des Produits Alimentaires et Pharmaceutiques dénommé «RFMA» en sigles anglais. Elle détermine également ses missions, son organisation et son fonctionnement. RFMA est doté de la personnalité juridique et de l’autonomie financière et administrative et est géré conformément aux dispositions générales applicables aux établissements publics. Article 2 : Définitions des termes Aux fins de la présente loi, les termes repris ci après ont les significations suivantes : 1° produits alimentaires : toute sorte d’articles à l’exclusion des produits pharmaceutiques, cosmétiques et du tabac qui servent de compléments alimentaires ou de boisson aux êtres humains et qui comprennent toute substance utilisée dans la fabrication Official Gazette n°43bis of 28/10/2013 22 2° ubwiza bw’ibiribwa: ubudakemwa n’ubuziranenge bw’ibiribwa; 3° kugenzura ibiribwa n’imiti: ukugenzura no gusuzuma ko imiti n’ibiribwa bitumizwa mu mahanga, bikorwa, bibikwa, byamamazwa, bitangwa cyangwa bigurishwa hakurikijwe ibiteganywa n’amategeko. Ingingo ya 3: Icyicaro cya RFMA Icyicaro cya RFMA kiri mu Mujyi wa Kigali, umurwa mukuru wa Repubulika y’u Rwanda. Gishobora kwimurirwa ahandi hose mu Rwanda igihe bibaye ngombwa. RFMA ishobora kugira amashami ahandi hose mu Gihugu bibaye ngombwa kugira ngo igere ku nshingano zayo byemejwe n’Iteka rya Minisitiri w’Intebe. UMUTWE WA II: INSHINGANO ZA RFMA Ingingo ya 4: Inshingano za RFMA Inshingano y’ingenzi ya RFMA ni ukugenzura ibijyanye n‘ibiribwa n’imiti. 2° quality of food products: efficacy and safety of food products; 3° regulation of food and pharmaceutical products: inspection and verification meant to check whether food and pharmaceutical products are imported, manufactured, stored, advertised, distributed or sold in accordance with law. Article 3: Head Office of RFMA The head office of RFMA shall be located in Kigali City, the capital of the Republic of Rwanda. It may be transferred elsewhere in the Republic of Rwanda if considered necessary. If deemed necessary and upon approval by a Prime Minister’s Order, RFMA may have branches elsewhere in the country in order to fulfil its mission. CHAPTER II: MISSION OF RFMA Article 4: Mission of RFMA The mission of RFMA shall be to inspect and verify food and pharmaceutical products. ou le traitement des aliments; 2° qualité des produits alimentaires : efficacité et innocuité des produits alimentaires ; 3° réglementation des produits alimentaires et pharmaceutiques : inspection et vérification réalisées en vue de s’assurer que les produits alimentaires et pharmaceutiques sont importés, fabriqués, stockés, font l’objet de publicité, distribués ou vendus conformément à la loi. Article 3: Siège de RFMA Le siège de RFMA est établi dans la Ville de Kigali, capitale de la République du Rwanda. Il peut, en cas de nécessité, être transféré en tout autre lieu du territoire de la République du Rwanda. Le RFMA peut, en cas de nécessité et sur approbation par arrêté du Premier Ministre, établir des branches en tout autre lieu du territoire national en vue de mieux s’acquitter de ses missions. CHAPITRE II: MISSIONS DU RFMA Article 4: Missions de RFMA La mission de RFMA consiste en l’inspection et la vérification des produits alimentaires et Official Gazette n°43bis of 28/10/2013 23 By’umwihariko RFMA ifite inshingano zikurikira: 1° kugenzura iyubahirizwa ry’amategeko n‘amabwiriza ajyanye n’ubuziranenge bw’ibiribwa n’imiti, ibikoresho byo mu buvuzi, ibintu bihumanya, ibintu binoza kandi bisukura umubiri, imiti ikomoka ku bimera n’ibindi byose bikoreshwa mu buvuzi; 2° kugena amabwiriza ajyanye no gutumiza mu mahanga, gukora, kugaragaza, kwerekana ikirango, kubika, kwamamaza, gutanga no kugurisha ibiribwa, imiti, imiti ikomoka ku bimera, ibyisigwa, ibihumanya n’ibindi bikoresho byo mu buvuzi cyangwa ibikoreshwa mu gukora ibivugwa muri iri tegeko; 3° kugenzura ko ibiribwa byongewemo intungamubiri n’inyongera ku biribwa bigurishwa ku isoko byubahiriza amabwiriza yemewe y’Igihugu cyangwa mpuzamahanga no gukurikiza amabwiriza ajyanye n’isuku cyangwa ubuziranenge bw’ibiribwa ahantu hafatirwa amafunguro rusange; 4° gukurikirana, kumenya, gusesengura no gutangaza amakuru ku ngaruka ziterwa In particular, RFMA shall have the following mission: 1° to monitor compliance with laws and regulations relating to the safety of food and pharmaceutical products, medical devices, poisons, cosmetics, herbal medicines and other health commodities; 2° to put in place regulations relating to the importation, manufacture, labelling, marking, storage, promotion, distribution and sale of food and pharmaceutical products, herbal medicines, cosmetics, poisons and other medical devices or substances used in the manufacture of products provided under this Law; 3° to ensure that fortified foods and food supplements that are placed on the market meet national or international standards as well as enforcing regulations relating to food hygiene or safety in public food service establishments; 4° to follow up, identify, analyze and publish information on adverse effects of the use of pharmaceutiques. En particulier, le RFMA a les missions suivantes: 1° surveiller le respect des lois et des règlements relatifs à la sécurité des produits alimentaires et pharmaceutiques, des dispositifs médicaux, des poisons, des produits cosmétiques, des substances phytothérapeutiques et d’autres produits de santé ; 2° arrêter des règlements relatifs à l’importation, à la fabrication, à l’étiquetage, au marquage, au stockage, à la promotion, à la distribution et à la vente des produits alimentaires et pharmaceutiques, des substances phytothérapeutiques, des produits cosmétiques, des poisons et d’autres dispositifs médicaux ou substances utilisées dans la fabrication de produits prévus par la présente loi ; 3° s’assurer que les aliments fortifiés et les compléments alimentaires mis sur le marché répondent aux normes nationales ou internationales et veiller à l’application des règlements relatifs à l’hygiène ou à la sécurité des aliments dans les lieux publics de restauration ; 4° faire le suivi, identifier, analyser et publier les informations sur les effets Official Gazette n°43bis of 28/10/2013 24 n’ikoreshwa ry’imiti n’ibiribwa no gufata ingamba zo kuzikumira; 5° gukurikirana, kumenya , gusesengura amakuru ku ikoreshwa ry’imiti isanzwe ikurikiranirwa hafi ku rwego rw’isi no gutanga raporo; 6° gukurikirana ko igeragezwa ry’imiti, ibikoresho byo kwa muganga n’imiti ikomoka ku bimera rikorwa hakurikijwe amabwiriza ariho; 7° kwemeza no kwandika ibiribwa n’imiti, byaba bikorewe mu Rwanda cyangwa byatumijwe mu mahanga; 8° gutanga, guhagarika no kwambura impushya cyangwa ibyangombwa hakurikijwe ibiteganywa n’amategeko; 9° kwemeza ko imfashanyo z‘ibiribwa n‘imiti zitangwa cyangwa zakirwa zubahirije amabwiriza y’ubuziranenge; 10° gushyiraho amabwiriza, guhugura no gukurikirana imikoreshereze y’imiti, ibikoresho byo kwa muganga, ibyisigwa, ibihumanya, imiti ikomoka ku bimera no gutanga amakuru yuzuye kandi nyayo ku bintu bigengwa n’iri food and pharmaceutical products and take measures to prevent such effects; 5° to follow up, identify and analyze information on the use of pharmaceutical products that are usually subject to global drug safety monitoring and submit a report thereon; 6° to ensure that clinical trials on pharmaceutical products, medical devices and herbal medicines are conducted in accordance with prescribed standards; 7° to approve and register food and pharmaceutical products manufactured within or imported into Rwanda; 8° to issue, suspend and revoke licenses or permits in accordance with legal provisions; 9° to ensure that food and pharmaceutical products given away as aid are in conformity with relevant standards; 10° to establish regulations, train and make follow-up on the use of pharmaceutical products, medical devices, cosmetics, poisons and herbal medicines and provide accurate and comprehensive information on products regulated under this Law; négatifs résultant de l’utilisation des produits alimentaires et pharmaceutiques et prendre des mesures pour la prévention de ces effets; 5° faire le suivi, identifier et analyser les informations sur l’utilisation des produits pharmaceutiques qui font généralement l’objet de la pharmacovigilance mondiale ; 6° s’assurer que les essais cliniques sur les produits pharmaceutiques, les dispositifs médicaux et les substances phytothérapeutiques sont menées conformément aux normes prescrites ; 7° approuver et enregistrer les produits alimentaires et pharmaceutiques fabriqués au Rwanda ou importés ; 8° délivrer, suspendre et révoquer les certificats ou les autorisations conformément aux dispositions légales; 9° s’assurer que les produits alimentaires et pharmaceutiques donnés comme aide sont conformes aux normes de qualité applicables; 10° arrêter des règlements, organiser des formations et faire le suivi en matière d’emploi des produits pharmaceutiques, des dispositifs médicaux, des produits cosmétiques, des poisons, des substances phytothérapeutiques et donner des Official Gazette n°43bis of 28/10/2013 25 tegeko ; 11° gutegura urutonde rw’imiti ikoreshwa mu gihugu, uko ikoreshwa n’indwara ivura; 12° kugira inama Leta ku bibazo byose birebana n’ibiribwa n’imiti; 13° gushyikirana no gukorana n’izindi nzego zihuje inshingano zo mu karere cyangwa mpuzamahanga. UMUTWE WA III: URWEGO RUREBERERA RFMA N’ICYICIRO IRIMO Ingingo ya 5: Urwego rureberera RFMA n’icyiciro irimo Iteka rya Minisitiri w’Intebe rigena urwego rureberera RFMA n’icyiciro irimo. Hagati y’urwego rureberera RFMA n’urwego rufata ibyemezo hakorwa amasezerano yerekeye gahunda y’ibikorwa agaragaza ububasha, uburenganzira n’inshingano bya buri ruhande mu kugeza RFMA ku nshingano zayo. Ayo masezerano amara igihe gihwanye na manda y’ abagize urwego rufata ibyemezo rwa RFMA. 11° to establish the list of pharmaceutical products used in Rwanda, their medication instructions and diseases they treat; 12° to advise the Government on all matters regarding food and pharmaceutical products; 13° to build relationships and collaborate with regional or international bodies with similar missions. CHAPTER III: SUPERVISING AUTHORITY OF RFMA AND ITS CATEGORY Article 5: Supervising authority of RFMA and its category A Prime Minister’s Order shall determine the supervising authority of RFMA and its category. There shall be concluded between the supervising authority of RFMA and its decision making organ a performance contract indicating powers, rights and obligations of each party in order for RFMA to fulfil its mission. CHAPITRE III: ORGANE DE TUTELLE DE RFMA ET SA CATEGORIE Article 5: Organe de tutelle de RFMA et sa catégorie Un arrêté du Premier Ministre détermine l’organe de tutelle de RFMA et sa catégorie. Il est établi entre l’organe de tutelle de RFMA et son organe de prise de décisions, un contrat de performance déterminant les compétences, les droits et les obligations de chaque partie en vue de la réalisation de la mission de RFMA. Ce contrat est valide pour une durée égale au mandat des membres de l’organe de prise de décisions de RFMA. CHAPTER IV: ORGANISATION AND FUNCTIONING OF RFMA Article 6: Management organs of RFMA RFMA shall be comprised of the following two (2) management organs: 1° the Board of Directors; 2° the Directorate General. A Prime Minister’s Order may determine other relevant organs in order for RFMA to fulfil its mission. Section One: Board of Directors Article 7: Board of Directors of RFMA The Board of Directors of RFMA shall be the governing and decision-making organ. Its competences, responsibilities and functioning of the Board of Directors as well as the responsibilities and the term of office of its members shall be determined by a Prime Minister’s Order. A Presidential Order shall appoint members of the Board of Directors including the Chairperson and the Deputy Chairperson. Members of the Board of Directors shall be selected on the basis of their competence and expertise. CHAPITRE IV: ORGANISATION ET FONCTIONNEMENT DE RFMA Article 6: Organes de direction de RFMA RFMA est doté de deux (2) organes de direction suivants : 1° le Conseil d’Administration ; 2° la Direction Générale. Un arrêté du Premier Ministre peut déterminer d’autres organes nécessaires en vue de la réalisation de la mission de RFMA. Section première : Conseil d’Administration Article 7: Conseil d’Administration de RFMA Le Conseil d’Administration de RFMA est l’organe de direction et de prise de décisions. Les compétences, les attributions et le fonctionnement du Conseil d’Administration, ainsi que les attributions et la durée du mandat de ses membres sont déterminés par arrêté du Premier Ministre. Un arrêté présidentiel nomme les membres du Conseil d’Administration dont le Président et le Vice-Président. Les membres du Conseil d’Administration sont choisis sur base de leur compétence et de leur expertise. Article 8: Sitting allowances for members of the Board of Directors Members of the Board of Directors present in the meetings of the Board of Directors shall be entitled to allowances determined by a Presidential Order. Article 9: Incompatibilities with membership in the Board of Directors Members of the Board of Directors shall not be allowed to perform any remunerated activity within RFMA. They shall not also be allowed, whether individually or companies in which they hold shares, to bid for tenders of RFMA. Section 2: Directorate General Article 10: Composition of the Directorate General of RFMA Members of the Directorate General of RFMA shall be determined by a Presidential Order. Section 2: Direction Générale Article 10: Composition de la Direction Générale de RFMA Les membres de la Direction Générale de RFMA sont déterminés par arrêté présidentiel. Ingingo ya 12: Imiterere, imikorere n’inshingano by’inzego z’imirimo za RFMA Imiterere, imikorere n’inshingano by’inzego z’imirimo za RFMA bigenwa n’iteka rya Minisitiri w’Intebe. UMUTWE WA V: UMUTUNGO N’IMARI Ingingo ya 13: Umutungo wa RFMA n’inkomoko yawo Umutungo wa RFMA ugizwe n’ibintu byimukanwa n’ibitimukanwa. Umutungo wa RFMA ukomoka kuri ibi bikurikira: 1° ingengo y’imari igenerwa na Leta; modalities for performance of their duties shall be determined by a Prime Minister’s Order. Article 11: Statute governing the staff of RFMA and benefits of members of the Directorate General and staff of RFMA The staff of RFMA shall be governed by the General Statute for Rwanda Public Service. Benefits allocated to the members of the Directorate General and staff of RFMA shall be determined in accordance with legal provisions governing benefits to employees of public institutions. Article 12: Organization, functioning and responsibilities of organs of RFMA The organization, functioning and responsibilities of organs of RFMA shall be determined by a Prime Minister’s Order. CHAPTER V: PROPERTY AND FINANCE Article 13: Property of RFMA and its sources The property of RFMA shall comprise movables and immovables. The property shall come from the following sources: 1° State budget allocations; membres de la Direction Générale de RFMA sont déterminées par arrêté du Premier Ministre. Article 11: Statut régissant le personnel de RFMA et les appointements accordés aux membres de la Direction Générale et au personnel de RFMA Le personnel de RFMA est régi par le Statut général de la fonction publique rwandaise. Les appointements accordés aux membres de la Direction Générale et au personnel de RFMA sont déterminés conformément aux dispositions légales régissant les avantages alloués au personnel des établissements publics. Article 12: Organisation, fonctionnement et attributions des organes de RFMA L’organisation, le fonctionnement et les attributions des organes de RFMA sont déterminés par arrêté du Premier Ministre. CHAPITRE V: PATRIMOINE ET FINANCES Article 13: Patrimoine de RFMA et ses sources Le patrimoine de RFMA comprend les biens meubles et immeubles. Il provient des sources suivantes: 1° les dotations budgétaires de l’Etat ; Official Gazette n°43bis of 28/10/2013 29 2° inkunga zaba iza Leta cyangwa iz’abafatanyabikorwa; 3° ibituruka ku mirimo ikora; 4° inyungu zikomoka ku mutungo wayo; 5° inguzanyo zihabwa RFMA zemewe na Minisitiri ufite imari mu nshingano ze; 6° impano n’indagano. Ingingo ya 14: Imikoreshereze, imicungire n’imigenzurire by’umutungo wa RFMA Imikoreshereze, imicungire n’imigenzurire by’umutungo wa RFMA bikorwa hakurikijwe amategeko abigenga. Ubugenzuzi bushinzwe igenzura rya buri munsi ry’imikoreshereze y’umutungo wa RFMA buha raporo Inama y’Ubuyobozi, bukagenera kopi Uyobora Ubuyobozi Bukuru bwa RFMA. Ingingo ya 15: Iyemeza n’imicungire by’ingengo y’imari ya RFMA Ingengo y’Imari ya RFMA yemezwa kandi igacungwa hakurikijwe amategeko abigenga. Ingingo ya 16: Raporo y’umwaka w’ibaruramari Mu mezi atatu (3) akurikira impera z’umwaka w’ibaruramari, uyobora Ubuyobozi Bukuru bwa 2° State or partners’ subsidies; 3° income from services rendered; 4° interest from its property; 5° loans granted to RFMA as approved by the Minister in charge of finance; 6° donations and bequests. Article 14: Use, management and audit of the property of RFMA The use, management and audit of the property of RFMA shall be carried out in accordance with relevant legal provisions. RFMA internal audit service shall submit a report to the Board of Directors, with a copy to the head of the Directorate General of RFMA. Article 15: Approval and management of the budget of RFMA The budget of RFMA shall be approved and managed in accordance with relevant legal provisions. Article 16: Annual financial report Within three (3) months following the closure of the financial year, the head of the Directorate 2° les subventions de l’Etat ou des partenaires; 3° les revenus des services prestés; 4° les intérêts de son patrimoine; 5° les prêts accordés au RFMA approuvés par le Ministère ayant les finances dans ses attributions; 6° les dons et legs. Article 14: Utilisation, gestion et audit du patrimoine de RFMA L’utilisation, la gestion et l’audit du patrimoine de RFMA sont effectués conformément aux dispositions légales en la matière. Le service d’audit interne de RFMA transmet son rapport au Conseil d’Administration avec copie au responsable de la Direction Générale de RFMA. Article 15: Adoption et gestion du budget de RFMA Le budget de RFMA est adopté et géré conformément aux dispositions légales en la matière. Ingingo ya 18: Ivanwaho ry’ingingo z’amategeko zinyuranyije n’iri tegeko Ingingo zose z’amategeko abanziriza iri kandi zinyuranyije na ryo zivanyweho. Ingingo ya 19: Igihe itegeko ritangira gukurikizwa Iri tegeko ritangira gukurikizwa ku munsi ritangarijweho mu Igazeti ya Leta ya Repubulika y’u Rwanda. Kigali, kuwa 11/09/2013 General of RFMA shall submit to the supervising authority of RFMA the annual financial report after its approval by the Board of Directors in accordance with laws governing the management of State finance and property. CHAPTER VI: FINAL PROVISIONS Article 17: Drafting, consideration and adoption of this law This Law was drafted in English, considered and adopted in Kinyarwanda. Article 18: Repealing provision All prior legal provisions contrary to this Law are hereby repealed. Article 19: Commencement This Law shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda. CHAPITRE VI: DISPOSITIONS FINALES Article 17 : Initiation, examen et adoption de la présente loi La présente loi a été initiée en Anglais, examinée et adoptée en Kinyarwanda. Article 18: Disposition abrogatoire Toutes les dispositions légales antérieures contraires à la présente loi sont abrogées. Article 19: Entrée en vigueur La présente loi entre en vigueur le jour de sa publication au Journal Officiel de la République du Rwanda.
