This Law also determines its mission, organization and functioning. METEO RWANDA shall have legal personality, administrative and financial autonomy and shall be managed in accordance with general provisions governing public institutions. Article 2: Definitions of terms In this Law, the following terms shall be defined as follows: 1° meteorological stations: facility observing atmospheric conditions to provide information for weather forecast and to study theweather and climate in accordance with World Meteorological Organisation; Vu la Loi Organique n° 06/2009/OL du 21/12/2009 portant dispositions générales applicables aux établissements publics; ADOPTE: CHAPITRE PREMIER: DISPOSITIONS GENERALES Article premier: Objet de la présente loi La présente loi porte création de l‟Agence Rwandaise de la Météorologie dénommée «METEO RWANDA» en sigle. Elle détermine également ses missions, son organisation et son fonctionnement. METEO RWANDA est doté de la personnalité juridique et de l‟autonomie financière et administrative et est géré conformément aux dispositions générales applicables aux établissements publics. Article 2: Définitions des termes Dans la présente loi, les termes suivants ont les significations suivantes: 1° stations météorologiques: lieu où les données météorologiques liées aux variations du climat sont enregistrées conformément aux exigences de l‟Organisation Météorologique Mondiale; Official Gazette nº 04 of 23/01/201223 23 2° igihe: imiterere y‟ikirere igaragazwa n‟indangagihe zinyuranye; 3° indangagihe: ibintu bigaragaza imiterere y‟ikirere cy‟ahantu mu gihe runaka; 4° iteganyagihe: uburyo bwo kugaragaza imiterere y‟ikirere mu gihe kiri imbere mu karere cyangwa agace k‟ikirere runaka; 5° ihinduka ry’ibihe: ihinduka rifatika ry‟ibipimo mpuzandengo by‟indangagihe byabazwe mu gihe cy‟imyaka icumi cyangwa irenga. METEO RWANDA ishobora kugira amashami ahandi hose mu Gihugu bibaye ngombwa, kugira ngo igere ku nshingano zayo, byemejwe n‟iteka rya Minisitiri w‟Intebe. 2° weather: state of the atmosphere as defined by the various meteorological elements; 3° meteorological element: atmospheric variable or phenomenon which characterize the state of the weather at a specific place at a particular time; 4° weather forecasting: statement of expected meteorological conditions for a specific period and for a specific area or portion of air space; 5° climate change: significant change in the mean values of a meteorological element in ten years or more. Article 3: Head office of METEO RWANDA The head office of METEO RWANDA shall be located in Kigali City, the Capital of the Republic of Rwanda. It may be transferred elsewhere on the Rwandan territory, if deemed necessary. METEO RWANDA may, in order to fulfil its mission, have branches elsewhere in the country if deemed necessary upon approval by the Order of the Prime Minister. 2° temps: état de l‟atmosphère défini par les différents éléments météorologiques; 3° élément météorologique: variable ou phénomène atmosphérique qui caractérise l‟état du temps en un endroit déterminé et à un moment donné; 4° prévision du temps: exposé des conditions météorologiques prévues pour une période définie et pour une zone ou une partie d‟espace aérien déterminé; 5° changement climatique: changement significatif des valeurs moyennes météorologiques au cours d‟une période de dix ans ou plus. Article 3: Siège du METEO RWANDA Le siège de METEO RWANDA est établi dans la Ville de Kigali, Capitale de la République du Rwanda. Il peut, en cas de nécessité, être transféré en tout autre lieu du territoire rwandais. Pour mieux s‟acquitter de ses missions, METEO RWANDA peut, en cas de nécessité et après approbation par un arrêté du Premier Ministre, établir des branches en tout autre lieu du territoire national. METEO RWANDA shall be particularly responsible for the following: 1° to establish meteorological stations across the country to identify each climatic zone, monitor such characteristics of and use them towards national development; 2° to collect, gather and access data of meteorological elements from around the country, and exchange related informations to ensure the security of people and the property in accordance with international agreements to which Rwanda is signatory; 3° to approve weather and climate change data; 4° to establish a special communication network to be used in collecting and disseminating meteorological elements in accordance with CHAPITRE II: MISSIONS DU METEO RWANDA Article 4: Missions du METEO RWANDA METEO RWANDA a pour mission de mettre en œuvre la politique de l‟Etat dans le domaine de la météorologie en se servant des méthodes modernes d‟étude, de recherche, de coordination et de promotion des programmes dans le domaine de la météorologie. Ayo masezerano amara igihe gihwanye na manda y‟abagize urwego rufata ibyemezo rwa METEO RWANDA. 12° to make a partnership with other regional or international agencies that have the same mission in relation to the meteorology in accordance with International Agreements on Meteorology; 13° to advise the Government on Meteorological policy; 14° to monitor and develop science, training and advocacy on Meteorology. CHAPTER III: SUPERVISING AUTHORITY OF METEO RWANDA AND ITS CATEGORY Article 5: Supervising authority of METEO RWANDA and its category A Prime Minister‟s Order shall determine the supervising authority of METEO RWANDA and its category. There shall be concluded between the supervising authority of METEO RWANDA and its decision making organ a performance contract indicating competence, rights and obligations of each party in order for METEO RWANDA to fulfill its missions. Such a contract shall be valid for a period equal to the term of office of members of the decision making organ of METEO RWANDA. 12. collaborer avec les agences tant régionales qu‟internationales ayant les mêmes missions dans le domaine de la météorologie tel que stipulé par la Convention Internationale sur la Météorologie; 13. conseiller le Gouvernement en matière de la politique sur la météorologie; 14. faire le suivi et développer la science, la formation et le plaidoyer sur la météorologie. CHAPITRE III: ORGANE DE TUTELLE DU METEO RWANDA ET SA CATEGORIE Article 5: Organe de tutelle du METEO RWANDA et sa catégorie Un arrêté du Premier Ministre détermine l‟organe de tutelle du METEO RWANDA et sa catégorie. Il est conclu, entre l‟organe de tutelle du METEO RWANDA et l‟organe de décision, un contrat de performance déterminant les compétences, les droits et les obligations de chaque partie en vue de la réalisation des missions du METEO RWANDA. Ce contrat est valide pour une durée égale au mandat des membres de l‟organe de décision du METEO RWANDA. CHAPTER IV: ORGANISATION AND FUNCTIONING OF METEO RWANDA Article 6: Management organs of METEO RWANDA METEO RWANDA shall be comprised of the following two (2) management organs: 1° the Board of Directors; 2° the General Directorate. A Prime Minister‟s Order may determine other relevant organs in order for METEO RWANDA to fulfil its missions. Section One: Board of Directors Article 7: Board of Directors of METEO RWANDA The Board of Directors of METEO RWANDA shall be the governing and decision-making organ. The competence, responsibilities and functioning of the Board of Directors as well as the duties and the term office of its members shall be determined by a Prime Minister‟s Order. A Presidential Order shall appoint members of the Board of Directors including the Chairperson and the Deputy Chairperson. Members of the Board of Directors shall be selected on the basis of their competence and expertise. CHAPITRE IV: ORGANISATION ET FONCTIONNEMENT DU METEO RWANDA Article 6: Organe de direction du METEO RWANDA METEO RWANDA est doté de deux (2) organes de direction suivants: 1° le Conseil d‟Administration; 2° la Direction Générale. Un arrêté du Premier Ministre peut déterminer d‟autres organes nécessaires en vue de la réalisation des missions du METEO RWANDA. Section première: Conseil d’Administration Article 7: Conseil d’Administration de METEO RWANDA Le Conseil d‟Administration du METEO RWANDA est l‟organe de direction et de prise de décision. Ses compétences, ses attributions et son fonctionnement ainsi que les fonctions et la durée du mandat de ses membres sont déterminés par arrêté du Premier Ministre. Un arrêté présidentiel nomme les membres du Conseil d‟Administration dont le Président et le Vice-Président. Les membres du Conseil d‟Administration sont choisis sur base de leur compétence et de leur expertise. At least thirty percent (30%) of the members of the Board of Directors shall be females. Article 8: Sitting allowance for members of the Board of Directors Members of the Board of Directors present in its meetings shall be entitled to sitting allowances determined by a Presidential Order. Article 9: Incompatibilities with membership on the Board of Directors The members of the Board of Directors shall not be allowed to perform any remunerated activity within METEO RWANDA. They are also not allowed whether individually or companies in which they hold shares, to bid for tenders of METEO RWANDA. Section 2: General Directorate Article 10: Members of the General Directorate of METEO RWANDA Members of the General Directorate of METEO RWANDA shall be appointed by a Presidential Order. The competence, responsibilities and modalities of functioning of members of the General Directorate shall be determined by a Prime Minister‟s Order. Article 9: Incompatibilités avec la fonction de membre du Conseil d’Administration Il est interdit aux membres du Conseil d‟Administration d‟exercer des fonctions rémunérées au sein du METEO RWANDA. Ils ne sont non plus autorisés, soit individuellement ou les sociétés dont ils sont actionnaires, de soumissionner aux marchés du METEO RWANDA. Section 2: Direction Générale Article 10: Membres de la Direction Générale du METEO RWANDA Les membres de la Direction Générale du METEO RWANDA sont nommés par un arrêté présidentiel. La compétence, la mission et le fonctionnement des membres de la Direction Générale sont déterminés par un arrêté du Premier Ministre. UMUTWE WA V: UMUTUNGO N’IMARI Ingingo ya 13: Umutungo wa METEO RWANDA n’inkomoko yawo Umutungo wa METEO RWANDA ugizwe n‟ibintu byimukanwa n‟ibitimukanwa. Umutungo wa METEO RWANDA ukomoka kuri ibi bikurikira: 1° ingengo y‟imari igenerwa na Leta; Article 11: Statutes governing staff of METEO RWANDA and benefits allocated to members of the General Directorate and the staff of METEO RWANDA The staff of METEO RWANDA shall be governed by the General Statute for Rwanda Public Service. Benefits to members of the Directorate General and staff of METEO RWANDA shall be determined in accordance with legal provisions governing benefits to employees of public institutions. Article 12: Functioning, organization and responsibilities of organs of METEO RWANDA The functioning, organization and responsibilities of organs of METEO RWANDA shall be determined by a Prime Minister‟s Order. CHAPTER V: PROPERTY AND FINANCE Article 13: Property of METEO RWANDA and its source The property of METEO RWANDA shall be comprised of movables and immovables. The property of METEO RWANDA shall come from the following sources: 1° the govenment budget allocation; Article 11: Statut du personnel du METEO RWANDA et appointements des membres de la Direction Générale et du personnel du METEO RWANDA Le personnel du METEO RWANDA est régi par le statut général de la fonction publique rwandaise. Article 12: Fonctionnement, organisation et attributions des organes du METEO RWANDA Le fonctionnement, l‟organisation et les attributions des organes du METEO RWANDA sont déterminés par un arrêté du Premier Ministre. CHAPITRE V: PATRIMOINE ET FINANCES Article 13: Patrimoine du METEO RWANDA et sa source Le patrimoine du METEO RWANDA comprend les biens meubles et immeubles. Ingingo ya 15: Iyemeza n’imicungire by’ingengo y’imari ya METEO RWANDA Ingengo y‟Imari ya METEO RWANDA yemezwa kandi igacungwa hakurikijwe amategeko abigenga. 2° government or donor grants; 3° proceeds of its services; 4° incomes from its property; 5° loans extended to METEO RWANDA approved by the Minister in charge of Finance; 6° donation and bequest. Article 14: Use, management and audit of the property The use, management and audit of the property of METEO RWANDA shall be carried out in accordance with relevant legal provisions. The internal audit department of METEO RWANDA shall submit a report to the Board of Directors and with a copy to the Head of the General Directorate of METEO RWANDA. Audit shall also be performed by the Office of Auditor General of State Finances every year and any other time when necessary. Le service d‟audit interne du METEO RWANDA transmet son rapport au Conseil d‟Administration et réserve copie au dirigeant de la Direction Générale du METEO RWANDA. L‟audit est également effectué chaque année ou chaque fois que de besoin par l‟Office de l‟Auditeur Général des Finances de l‟Etat. Article 15: Adoption et gestion du budget du METEO RWANDA Le budget du METEO RWANDA est adopté et géré conformément aux dispositions légales en la matière. Ingingo ya 19: Ivanwaho ry’ingingo z’amategeko zinyuranyije n’iri tegeko Ingingo zose z‟amategeko abanziriza iri kandi Article 16: Annual financial report Within three (3) months following the end of the financial year, the Head of the General Directorate of METEO RWANDA shall submit to the supervising authority of METEO RWANDA an annual financial report after its approval by the Board of Directors, in accordance with legal provisions governing the management of State finance and property. CHAPTER VI: TRANSITIONAL AND FINAL PROVISIONS Article 17: Transitional period METEO RWANDA shall have one (1) year, from the date of the publication of this Law in the Official Gazette of the Republic of Rwanda to merge all activities that was performed by other institutions. Article 18: Drafting, consideration and adoption of this Law This Law was drafted in English, examined and adopted in Kinyarwanda. Article 19: Repealing provision All prior legal provisions contrary to this Law are Article 16: Rapport annuel de l’exercice comptable Dans les trois (3) mois qui suivent la fin de l‟exercice comptable, le dirigeant de la Direction Générale du METEO RWANDA transmet à l‟organe de tutelle du METEO RWANDA le rapport annuel de l‟exercice comptable après son approbation par le Conseil d‟Administration, conformément aux dispositions légales régissant les finances et le patrimoine de l‟Etat. CHAPITRE VI: DISPOSITIONS TRANSITOIRES ET FINALES Article 17: Période transitoire METEO RWANDA a une (1) année à partir du jour de la publication de la présente loi au Journal Officiel de la République du Rwanda pour avoir fusionné les activités qu‟exerçaient d‟autres institutions. Article 18: Initiation, examen et adoption de la présente loi La présente loi a été initiée en anglais, examinée et adoptée en Kinyarwanda.
