Having reviewed Law nº 47/1988 of 05/12/1988 establishing forest regime, especially in articles 8, 9, 10, 11,12 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24 and 70; Having reviewed Law n° 62/2008 of 10/09/2008 putting in place the use, conservation, protection and management of water resources regulations, especially in Article 72; ADOPTS: CHAPTER ONE: GENERAL PROVISIONS Article One: Purpose of this Law This Law determines organization, functioning and mission of the National Fund for environment in Rwanda which is abbreviated as « FONERWA» in the French language. portant exploitation des mines et des carrières; ADOPTE: CHAPITRE PREMIER: DISPOSITIONS GENERALES Article premier: Objet de la présente loi La présente loi détermine l‟organisation, le fonctionnement et la mission du Fonds National de l‟Environnement au Rwanda, dénommé « FONERWA» en sigle français. Official Gazette n°26 of 25/06/2012 60 UMUTWE WA II: INSHINGANO YA FONERWA Ingingo ya 2: Inshingano za FONERWA Inshingano z‟ingenzi za FONERWA ni izi zikurikira: 1° gushaka no gucunga umutungo ukoreshwa mu gutera inkunga ibikorwa byose bigamije kurengera ibidukikije n‟umutungo kamere; 2° gushaka no gucunga inkunga yo guhangana n‟imihindagurikire y‟ibihe n‟ingaruka zayo; 3° gutera inkunga inzego za Leta, amashyirahamwe n‟abantu ku giti cyabo bagamije ibikorwa byo kurengera ibidukikije, kubikoraho ubushakashatsi no guhangana n‟imihindagurikire y‟ibihe. Ingingo ya 3: Urwego rureberera FONERWA FONERWA irebererwa na Minisiteri ifite ibidukikije n‟imihindagurikire y‟ibihe mu nshingano zayo. CHAPTER II: MISSION OF FONERWA Article 2: Responsibilities of FONERWA The main responsibilities of FONERWA shall be the following: 1° mobilizing and managing resources used in activities aiming at protecting environment and natural resources; 2° mobilizing and managing funds to be used in the fight against the climate changes and its impacts; 3° to support public organs, associations and individuals aimed at protecting environment, research as well as managing climate change. Article 3: FONERWA supervising authority FONERWA shall be supervised by the Ministry in charge of environment and climate change. CHAPITRE II: MISSION DU FONERWA Article 2: Attributions du FONERWA Les principales attributions du FONERWA sont les suivantes: 1° mobiliser et gérer des fonds pour le financement des activités visant la protection de l‟environnement et des ressources naturelles; 2° mobiliser des fonds à utiliser dans la lutte contre les changements climatiques et leurs effets; 3° appuyer les institutions publiques, associations et les particuliers visant la protection de l‟environnement, la recherche ainsi que la lutte contre les changements climatiques. Article 3: Autorité de tutelle du FONERWA FONERWA est sous la tutelle du Ministère ayant l‟environnement et les changements climatiques dans ses attributions. Ingingo ya 5: Ibigenerwa abitabiriye inama y’abagize Komite y’imicungire ya FONERWA Ibigenerwa abagize Komite y‟imicungire ya FONERWA bitabiriye inama bishyirwaho n‟iteka rya Perezida. Ingingo ya 6 : Ubuhuzabikorwa Imirimo ya buri munsi ya FONERWA ikorwa n‟Umuhuzabikorwa n‟abandi bakozi ba ngombwa bashyirwaho hakurikijwe Sitati Rusange igenga Abakozi CHAPTER III: MANAGING COMMITTEE OF FONERWA Article 4: Managing Committee of FONERWA There is hereby established a Managing Committee of FONERWA. A Prime Minister‟s Order shall determine its members, powers, responsibilities and functioning. At least thirty per cent (30%) of the members shall be female. Article 5: Sitting allowances for members of Managing Committee of FONERWA Sitting allowances to which members of Managing Committee of FONERWA present in the meeting are entitled shall be determined by a Presidential Order. Article 6: Coordination The daily activities of FONERWA shall be coordinated by a coordinator and other relevant staff appointed in accordance with the General statute for Rwandan CHAPITRE III: COMITE DE GESTION DU FONERWA Article 4: Comité de Gestion du FONERWA Il est créé un Comité de Gestion du FONERWA. Un arrêté du Premier Ministre détermine ses membres, ses compétences, ses attributions et son fonctionnement. Au moins trente pour cent (30%) des membres sont de sexe féminin. Article 5: Jetons de présence des membres du Comité de Gestion du FONERWA Un arrêté présidentiel détermine le montant de jetons de présence alloués aux membres du Comité de Gestion du FONERWA présents aux réunions. Article 6: Coordination Les activités quotidiennes du FONERWA sont coordonnées par un coordinateur et autre personnel nécessaire recrutés conformément au Statut Général de la Official Gazette n°26 of 25/06/2012 62 ba Leta n‟Inzego z‟Imirimo ya Leta. CHAPTER IV: PROPERTY USED BY FONERWA AND ITS MANAGEMENT Article 7: Source of property used by FONERWA The property used by FONERWA shall come from the following sources: 1° State allocated budget; 2° grants and subsidies; 3° special grants and subsidies aiming at management of climate change and its impacts; 4° donations and bequests; 5° fines emanating from penalties determined by different laws aiming at environmental, water and forestry protection and laws on mining and quarry exploitation; 6° zero point one per cent (0,1%) of a project total cost of which environmental impact assessment has been carried out minus the working capital; 7° fees coming from proceeds from Fonction Publique Rwandaise. CHAPITRE IV: PATRIMOINE UTILISE PAR FONERWA ET SA GESTION Article 7: Sources du patrimoine utilisé par FONERWA Le patrimoine utilisé par FONERWA provient des sources suivantes: 1° les dotations budgétaires de l‟Etat; 2° les subventions et aides; 3° les subventions et aides spéciales pour la gestion des changements climatiques et de leurs effets; 4° les dons et legs; 5° les amendes provenant de peines prévues par les lois diverses sur la protection de l‟environnement, de l‟eau et des forêts et celles de l‟exploitation des mines et carrières; 6° le zéro point un pour cent (0,1%) du coût total de l‟évaluation d‟impact sur l‟environnement d‟un projet moins le fond de roulement; 7° les frais provenant du produit de Official Gazette n°26 of 25/06/2012 63 ry‟amashyamba ya Leta, ay‟Uturere n‟ay‟abaturage n‟ibiyakomokaho agenwa n‟Iteka rya Minisitiri ufite FONERWA mu nshingano ze kandi rikagena n‟uburyo ayo mafaranga atangwa; 8° umutungo wahoze ari uw‟Ikigega cy‟Igihugu cy‟Imari y‟Amashyamba; 9° andi mafaranga agenwa n‟itegeko. Ingingo ya 8: Kwegurirwa umutungo Imitungo yimukanwa, itimukanwa, imyenda n‟izina by‟Ikigega cy‟Igihugu cy‟Imari y‟Amashyamba bishyizwe mu mutungo ukoreshwa na FONERWA. Ingingo ya 9: Itegurwa n’iyemezwa by’ingengo y’imari ikoreshwa na FONERWA Ingengo y‟imari ikoreshwa na FONERWA itegurwa na Komite y‟Imicungire, ikemezwa hakurikijwe amategeko abigenga. cutting wood belonging to the State, the Districts and private persons and from forestry exploitation; such fees shall be fixed by an Order of the Minister supervising FONERWA, which also shall determine modalities of their payment; 8° property formerly owned by the National Forestry Fund; 9° other fees determined by law. Article 8: Transfer of property Movable and immovable property, liabilities and denomination of National Forestry Fund are hereby transferred into the property used by FONERWA. Article 8: Transfert du patrimoine Les biens meubles et immeubles, le passif et la dénomination du Fonds Forestier National sont transférés dans le patrimoine utilisé par FONERWA. Article 9: Préparation et adoption du budget utilisé par FONERWA Le budget utilisé par FONERWA est préparé par le Comité de Gestion et approuvé conformément aux dispositions légales en la matière. Ingingo ya 12: Itegurwa, isuzumwa n’itorwa ry’iri tegeko Iri tegeko ryateguwe mu rurimi rw‟Icyongereza, risuzumwa kandi ritorwa mu rurimi rw‟Ikinyarwanda. Ingingo ya 13: Ivanwaho ry’ingingo z’amategeko zinyuranyije n’iri tegeko Ingingo zose z‟amategeko abanziriza iri Article 10: Use, management and audit of the property used by FONERWA Use, management and audit of the property used by FONERWA shall be carried out in accordance with relevant legal provisions. CHAPTER V: TRANSITIONAL AND FINAL PROVISIONS Article 11: Transitional period FONERWA is given a period not exceeding twelve (12) months from the date of publication of this Law in the Official Gazette of the Republic of Rwanda to merge activities formerly performed by the National Forestry Fund. Article 12: Drafting, consideration and adoption of this Law This Law was drafted in English, considered and adopted in Kinyarwanda. Article 13: Repealing provision All prior legal provisions contrary to this Article 10: Utilisation, gestion et audit du patrimoine utilisé par FONERWA L‟utilisation, la gestion et l‟audit du patrimoine utilisé par FONERWA sont effectués conformément aux dispositions légales en la matière. CHAPITRE V: DISPOSITIONS TRANSITOIRES ET FINALES Article 11: Période transitoire FONERWA dispose d‟un délai ne dépassant pas douze (12) mois à compter du jour de la publication de la présente loi au Journal Officiel de la République du Rwanda pour fusionner les activités qui étaient assurées par le Fonds Forestier National. Article 12: Initiation, examen et adoption de la présente loi La présente loi a été initiée en Anglais, elle a été examinée et adoptée en Kinyarwanda.
