Ingingo ya 2: Abakozi bahawe ububasha bw’ubugenzacyaha Abakozi b‟Ikigo cy‟Igihugu cyo Kubungabunga Ibidukikije bakurikira bahawe ububasha bw‟Ubugenzacyaha: 1° Umuyobozi Mukuru w‟Ikigo; 2° Umuyobozi w‟Ishami rishinzwe kwigisha no kwinjiza ibidukikije muri gahunda zose; 3° Umuyobozi w‟Ishami rishinzwe iyubahirizwa ry‟amategeko no kugenzura iyangirika ry‟ Ibidukikije; 4° Umujyanama mu by‟amategeko; 5° Umukozi Ushinzwe inyigisho z‟ibidukikije; 6° Umukozi ushinzwe iyinjizwa ry‟ibidukikije muri gahunda zose; investigate; After consideration and approval by the Cabinet in its session of 01/04/2010; ORDERS: Article One: Purpose of this Order This Ministerial Order grants employees of Rwanda Environment Management Authority power to investigate crimes provided for under the Organic Law n° 04/2005 of 08/04/2005 determining the modalities of protection, conservation and promotion of the environment in Rwanda and other related laws. Article 2: Employees granted the power to investigate The following employees of Rwanda Environment Management Authority are granted the power to investigate : 1° The Director General; 2° The Head of the Unit in charge of environmental education and mainstreaming; 3° The Head of the Unit in charge of regulation and pollution control; 4° The Legal Advisor; 5° The Environmental Education Officer; 6° The Environmental Mainstreaming Officer; Protection de l‟Environnement ; Après examen et adoption par le Conseil des Ministres en sa séance du 01/04/2010 ; ARRETE : Article Premier : Objet du présent arrêté Le présent arrêté accorde aux agents de l‟Office Rwandais de protection de l‟environnement au Rwanda la qualité d‟Officiers de Police Judiciaire pour les infractions prévues par la Loi Organique n° 04/2005 du 08/04/2005 portant modalités de protéger, sauvegarder et promouvoir l‟environnement au Rwanda et d‟autres lois en la matière. Article 3 : Agents auxquels la qualité d’Officiers de Police Judiciaire est accordée La qualité d‟Officiers de Police Judiciaire est accordée aux agents de l‟Office Rwandais de Protection de l‟Environnement dont la liste suit. Il s‟agit du: 1° Directeur Général ; 2° Chef de l‟Unité chargée de l‟éducation sur l‟environnement et de son introduction dans toutes les planifications; 3° Chef de l‟Unité chargée de la régulation et contrôle de la pollution; 4° Conseiller juridique; 5° Chargé de l‟éducation environnementale; 6° Chargé de l‟introduction de l‟environnement dans toutes les Official Gazette nº 42 of 17/10/2011 76 7° Umukozi ushinzwe gufasha Uturere n‟abaturage mu micungire y‟ibidukikije ; 8° Umukozi ushinzwe kugenzura no gukurikirana ibidukikije; 9° Umukozi ushinzwe ibipimo ngenderwaho ; 10° Umukozi ushinzwe ibikoresho by‟ubutabire. Ingingo ya 3 : Ivanwaho ry’ingingo zinyuranyije n’iri teka Iteka rya Minisitiri n o 61/11 ryo kuwa 24/9/2007 riha ububasha bw‟Ubugenzacyaha abakozi bo mu Kigo cy‟Igihugu cyo Kubungabunga no Guteza imbere Ibidukikije mu Rwanda n‟izindi ngingo z‟amateka abanziriza iri kandi zinyuranyije naryo bivanyweho. Ingingo ya 4 : Igihe iteka ritangira gukurikizwa Iri teka ritangira gukurikizwa ku munsi ritangarijweho mu Igazeti ya Leta ya Repubulika y‟u Rwanda. Article 3: Repealing provision The Ministerial Order n o 61/11 of 24/9/2007 granting specific employees of Rwanda Environment Management Authority powers to investigate and all other prior provisions contrary to this Order are hereby repealed. Article 4: Commencement This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda. Article 3 : Disposition abrogatoire L‟Arrêté Ministériel n o 61/11 du 24/9/2007 accordant la qualité d‟Officiers de Police Judiciaire aux agents de l‟Office Rwandais de Protection de l‟Environnement et toutes les autres dispositions réglementaires antérieures contraires au présent arrêté sont abrogés. Article 4 : Entrée en vigueur Le présent arrêté entre en vigueur le jour de sa publication au Journal Officiel de la République du Rwanda.
