environment protection, conservation and development in Rwanda; Pursuant to Organic Law n° 08/2005 of 14/07/2005 establishing the use and management of land in Rwanda; Pursuant to Law n° 58/2008 of Ingingo ya 3: Ubwoko bw’impushya Uruhushya rw’uburobyi rushobora kuba urw’uburobyi bw’umukino, bw’umwuga cyangwa bw’ubushakashatsi. Uburobyi bugamije umukino ni uburobyi bukoresha indobane zitarenze ebyiri. Umurobyi ugamije ubushakashatsi ni umuntu ku CHAPTER ONE: GENERAL PROVISIONS Article One: Purpose of this Order This Order determines the terms and conditions for granting fishing licenses. Article 2: Obligation to hold a license Fishing in free waters of Rwanda shall be subjected to the holding of a license in conformity with the standard form in annex to this Order. Article 3: Types of licenses A fishing license may be for sport, professional or for research. Fishing intended for sport is one which do not use more than two hooks. A professional fisherman is one who uses more than two fishing hooks as well as any other fisherman who uses any other authorized fishing device. A research fisherman is an individual or an CHAPITRE PREMIER: DISPOSITIONS GENERALES Article premier : Objet du présent arrêté Le présent arrêté détermine les modalités d’octroi des licences de pêche. Article 2: Obligation de possession d’une licence La pratique de la pêche dans les eaux libres du Rwanda est soumise à la possession d’une licence conforme au modèle annexé au présent arrêté. Article 3: Types de licences La licence de pêche peut être sportive, professionnelle ou de recherche. Est réputé pêcheur sportif le pêcheur à la ligne n’utilisant pas plus de deux cannes et deux hameçons. Est réputé pêcheur professionnel le pêcheur à la ligne utilisant plus de deux cannes ou plus deux hameçons ainsi que tout pêcheur utilisant tout autre engin de pêche ou matériel de pêche autorisé. Ingingo ya 4: Nyiri uruhushya Uruhushya rw’umurobyi ni urwa nyirarwo gusa. Ku burobyi bw’umwuga bukoresha ibindi bikoresho by’uburobyi, uruhushya ruhabwa itsinda ry’uburobyi. Icyo gihe abantu benshi bashobora kwandikwa kuri urwo ruhushya nka ba nyirarwo ; bapfa kuba bafite amasezerano y’ubufatanye. Ku burobyi bw’ubushakashatsi, uruhushya ruhabwa umuntu wese wujuje ibisabwa kugira ngo hatangwe uruhushya rw’uburobyi bw’ubushakashatsi. Ingingo ya 5: Ubwishyu Ihabwa ry’uruhushya rw’uburobyi n’ihindurwa ryarwo birishyurwa ; umubare w’amafaranga yishyurwa ushyirwaho n’amabwiriza atangwa n’urwego rushinzwe ubuyobozi bw’uburobyi n’ubworozi bwo mu mazi. Ingingo ya 6: Gusaba uruhushya Umuntu usaba uruhushya rw’uburobyi cyangwa kongerewa igihe agomba kugaragaza amazi azakoreramo n’ubwoko bw’uburobyi azakora. Umuyobozi utanga uruhushya afite institution involved in any activity aimed at conducting research on aquatic life of water organisms, provided that he/she has authorization from the Minister in charge of aquaculture and fisheries. Article 4: Licensee The license of a fisherman is personal. For professional fishing involving any other fishing equipment, the license shall be issued to a group of fishermen. In such a case, several persons may be registered on the fishing license as license owners provided that they have a collaboration contract. For research fishing, the license shall be issued to any person who fulfills the requirements for issuance of research fishing license. Article 5: License fee Issuance and renewal of a fishing license shall be subjected to payment; the amount of fee to be paid shall be fixed by the directives from the organ in charge of aquaculture and fisheries administration. Article 6: Application for a license Any person who applies for fishing license or its renewal shall specify the water body and type of fishing for which the application is made. Pour les pêches professionnelles impliquant d’autres engins de pêche, la licence est rattachée à l’unité de pêche. Dans ce dernier cas plusieurs personnes pourront figurer sur la licence de pêche en tant que titulaires moyennant un contrat de collaboration. Pour les pêches de recherches, la licence est attribuée à toute personne répondant aux exigences d’octroi de la licence de pêche de recherche. Article 5: Redevance L’obtention et le renouvellement de la licence de pêche sont soumis au paiement d’une redevance dont le montant est fixé par les directives issues de l’Institution en charge de l’administration de l’aquaculture et de la pêche. Article 6: Demande de la licence Lors du dépôt de la demande d’octroi ou de renouvellement de la licence de pêche, le demandeur doit préciser les eaux et le type de pêche pour lesquels la demande est déposée. Rwongererwa igihe kitarenze igiteganywa n’itegeko, ariko ntirushobora guhabwa undi muntu, keretse hari icyemezo cyihariye cyatanzwe na Minisitiri ufite uburobyi mu nshingano ze. Ingingo ya 8: Ibisabwa n’ibikurikizwa mu itangwa ry’uruhushya Uruhushya rw’uburobyi rutangwa urusaba amaze kwerekana umwirondoro we n’icyo akora. Raporo y’akarere igomba kuba irimo ibyemezo by’uko usaba uruhushya yemerewe ibyo asaba mu nzego z’ibanze kuva ku kagari cyangwa urundi rwego rw’ibanze, arizo zizahabwa inshingano z’akagari. Application for issuance of a license or its renewal shall be submitted to the issuing authority at least two months before effective date of the use of the license. Article 7: Validity, renewal and transfer of a license The period of validity of the fishing license shall be two years. It shall be renewable in a period that does not exceed the one provided by law, but the license cannot be transferable, unless there is an exceptional authorization issued by the Minister in charge of fishing. Article 8: Conditions and criteria for issuance of a license The fishing license shall be issued on presentation by the applicant of documents showing his/her identification and profession. The report of the District shall include documents certifying that the applicant is allowed to be given what he/she is applying for from local authorities starting from the cell or any other local authority, to which the responsibilities of the cell shall be entrusted. While issuing or renewing a fishing license, the issuing authority shall take into account the L’autorité délivrante a le droit de demander toute information complémentaire et tout éclaircissement qu’elle estime nécessaire. Elle est renouvelable dans les limites prévues par la loi, mais elle n’est pas transférable sauf autorisation spéciale du Ministre ayant la pêche dans ses attributions. Article 8: Conditions et critères d’attribution La licence de pêche est délivrée après présentation des pièces attestant l’identité et la profession du demandeur. Le rapport du District doit aussi comprendre les documents attestant que le demandeur a validé l’objet de sa demande auprès des instances de base à partir du niveau de la cellule ou autre instance de base à qui seront confiées les attributions de la cellule. Ingingo ya 9: Igitabo cy’impushya Umuyobozi utanga impushya agomba kugira igitabo kirimo : 1° ibiranga uhawe cyangwa abahawe uruhushya n’icyo bakora; 2° nomero y’iyandikisha ry’ubwato ; 3° ubwoko bw’ibikoresho akoresha mu mazi yaherewe uruhushya ; 4° urwego n’ubwoko by’uruhushya rwatanzwe. Ingingo ya 10: Igihe ikoresha ry’impushya ritangirira Uruhushya rw’uburobyi ruzaba ari itegeko nyuma y’amezi atandatu uhereye igihe iri teka rishyiriweho umukono. Ingingo ya 11: Kwerekana uruhushya Mu mirimo ye, nyiri uruhushya cyangwa ba nyiri uruhushya rw’uburobyi, bagomba kurwerekana igihe babisabwe n’abayobozi babifitiye ububasha. requirements specified by competent experts or the fisheries management and development plan. Article 9: License Register The issuing authority shall keep a license register comprising: 1° the identity and profession of the licensee or licensees; 2° the registration number of the boat; 3° the types of devices used in water body for which the license was issued ; 4° the category and type of license issued. Article 10: Commencement of the license Holding a fishing license shall be obligatory after six months from when this Order was signed. Article 11: Presentation of a license In practice of his/her activities, the licensee or owners of fishing license shall present the license on simple request by relevant authorities. orientations définies par les techniciens habilités ou par le plan de gestion et d’aménagement des ressources halieutiques. Article 10: Début du système des licences La détention d’une licence de pêche devient obligatoire six mois après la signature du présent arrêté. Article 11: Présentation de la licence Dans l’exercice de son activité, le titulaire ou l’un des titulaires de la licence de pêche doit être en mesure de présenter celle-ci sur simple réquisition des autorités compétentes. Ingingo ya 13: Ibisabwa kubahirizwa byihariye Umuyobozi ushinzwe gutanga impushya z’uburobyi ashobora kwandika muri izo mpushya igisabwa cyose cyihariye asanze kigomba kubahirizwa kugira ngo umutungo Article 12: Respect for license regulations Fishing licenses shall be established in accordance with the format prescribed by a Ministerial Order and holders shall respect: 1° the general conditions defined by this Order or regulations relating to its application; 2° the conditions included in the license, in particular, as regards : a. the type and characteristics of boats and fishing devices to be used ; b. the zones in which fishing is authorized and, possibly, the species and quantities of fish to be caught; c. legal fishing periods; d. the landing areas; e. specific obligations; f. holders of a fishing license. Article 13: Specific requirements Authorities in charge of issuance of fishing licenses may state in the licenses any specific requirement to be respected in order to respect effective management of fish resources. Article 12: Respect des prescriptions de la licence Les licences de pêche seront établies dans les formes prescrites par arrêté du Ministre ayant la pêche dans ses attributions et leur titulaire sera soumis au respect : 1° des conditions générales définies par le présent arrêté ou par les textes réglementaires pris pour son application ; 2° des conditions inscrites dans la licence, notamment quant : a. au type et aux caractéristiques des embarcations et engins de pêche pouvant être utilisées ; b. aux zones à l’intérieur desquelles la pêche est autorisée et éventuellement quant aux espèces et aux quantités de poissons dont la capture est permise ; c. aux périodes pendant lesquelles la pêche est licite ; d. aux lieux de débarquement ; e. aux obligations spécifiques ; f. aux titulaires de la licence de pêche. Article 13: Prescriptions spécifiques Les autorités compétentes pour l’octroi des licences de pêche pourront inscrire dans ces mêmes licences toute prescription spécifique dont elle juge le respect opportun en vue d’une Official Gazette n° 50 of 13/12/2010 26 ukomoka ku burobyi ucungwe neza. CHAPTER II: USE OF SPORT FISHING LICENSE Article 14: Types and characteristics of sport fishing licenses Sport fishing licenses shall be in the category A of licenses. Article 18: Authority issuing professional fishing licenses The professional fishing license shall be issued by the authority in charge of aquaculture and fisheries upon presentation of a District report. If the water body is shared by several districts, the application letter shall be submitted to the District in which the applicant intends to carry out the fishing activities. Before issuance of B4 type of license, the authority responsible for aquaculture and fisheries shall obtain a written approval of the Minister in charge of aquaculture and fisheries. Article 19: Specific characteristics of professional licenses An individual or a legal entity cannot hold more than one professional license, except where relevant authorities discovers that the licenses granted for the water body concerned are not sufficient for their exploitation in their use or in case of controlled concessions. CHAPTER IV: RESEARCH LICENSE Article 21: Scientific fishing Scientific fishing is aimed at the study and knowledge of fish and aquatic resources. The persons engaged in scientific fishing operations shall be exempted from the obligation to hold a fishing license and may not abide by the provisions of this Order. Such exemptions can be granted only by the Minister in charge of aquaculture and fisheries, and shall be explicitly included in the authorization mentioned in Paragraph 3 of this Article. Scientific fishing activities are subjected to written authorization from the Minister in charge of aquaculture and fisheries. Les personnes se livrant à des opérations de pêche scientifique sont libérées de l’obligation de détenir une licence de pêche et peuvent déroger aux dispositions du présent arrêté. De telles dérogations ne peuvent être accordées que par le Ministre ayant l’aquaculture et la pêche dans ses attributions et doivent figurer explicitement sur le document d’autorisation visé à l’alinéa 3 du présent article. Les opérations de pêche à but scientifique sont soumises à l’autorisation écrite du Ministre ayant la pêche dans ses attributions. CHAPTER V: REFUSAL, SUSPENSION AND REVOCATION OF A LICENSE Article 22: Refusal to issue or renew a license Refusal to issue or renew a fishing license shall occur when: 1° the boat for which the license was applied does not conform to the regulations of navigation policy; 2° the applicant does not meet legal conditions. Also, the fishing license may be refused, suspended or revoked by the relevant authority: 1° for efficient management of fish resources, limitations que l’on estime nécessaires. CHAPITRE V: REFUS, SUSPENSION ET REVOCATION D’UNE LICENCE Article 22 : Refus de l’octroi ou du renouvellement d’une licence L’octroi ou le renouvellement d’une licence de pêche est refusé dans les cas suivants : 1° les embarcations pour lesquelles la licence est demandée ne sont pas conformes aux règlements de police de navigation ; 2° le demandeur ne remplit pas les conditions légales. Article 23: Reasons for refusal Refusal to issue a license shall always be justified. Without prejudice to the appeal procedures provided by other laws, refusal to issue or renew a license may always be appealed against.
