MINISTERIAL ORDER N° 006/16.01 OF 24/05/2013 DETERMINING THE ORGANIZATION OF WATER RESOURCES DATA COLLECTION, TREATMENT, MANAGEMENT, EXPLOITATION AND COMMUNICATION The Minister of Natural Resources, Pursuant to the Constitution of the Republic of Rwanda of 04 June 2003 as amended to date especially in Articles 120, 121 and 201; Pursuant to Law nº 62/2008 of 10/09/2008 putting in place the use, conservation, protection and management of water resources regulations, especially in Article 26; After consideration and approval by the Cabinet, in its session of 14/11/2012; HEREBY ORDERS: CHAPTER ONE: GENERAL PROVISIONS Article One: Purpose of this Order This Order determines the organization of water resources data collection, treatment, management, use and its communication. ARRETE MINISTERIEL N° 006/16.01 DU 24/05/2013 PORTANT ORGANISATION DE LA COLLECTE, TRAITEMENT, GESTION, EXPLOITATION ET COMMUNICATION DES DONNEES SUR DES RESSOURCES EN EAU Le Ministre des Ressources Naturelles, Vu la Constitution de la République du Rwanda du 04 juin 2003 telle que révisée à ce jour, spécialement en ses articles 120, 121, et 201 ; Vu la Loi nº 62/2008 du 10/09/2008 fixant les règles d’utilisation, de conservation, de protection et de gestion des ressources en eau, spécialement en son article 26 ; Après examen et adoption par le Conseil des Ministres, en sa séance du 14/11/2012; ORDONNE : CHAPITRE PREMIER : DISPOSITIONS GENERALES Article premier : Objet du présent arrêté Le présent arrêté porte organisation de la collecte, traitement, gestion, exploitation et communication des données des ressources en eau. Official Gazette nº Special of 30/05/2013 64 Ingingo ya 2: Ibisobanuro by’amagambo Muri iri teka rya Minisitiri, amagambo akurikira afite ibisobanuro bikurikra: 1º amakuru y’umutungo w’amazi: amakuru ajyanye n’ubwiza n’ubwinshi bw’amazi yavuye mu bipimo, isesengurwa n’iperereza; 2º ikigo: ikigo gifite gucunga umutungo w’amazi mu nshingano zacyo; UMUTWE WA II: IKUSANYA MAKURU KU MUTUNGO W’AMAZI Ingingo ya 3: Ihuriro ry’ikusanyamakuru Ikusanyamakuru ku mazi, imicungire, n’ikoreshwa ryayo bikorwa n’ihuriro ry’abafatanya bikorwa rigizwe n’abantu babiri (2) baturuka muri buri rwego mu nzego zikurikira: 1º Minisiteri ifite Umutungo Kamere mu nshingano zayo; 2º Ikigo cy’Igihugu Gishinzwe Umutungo Kamere; 3º Ikigo cy’Igihugu gishinzwe kubungabunga ibidukikije; Article 2: Definitions For the purposes of this Ministerial Order, the following terms shall have the following meanings: 1º water resources data: factual information related to water quality and quantity derived from measurements, analysis and observations; 2º agency: institution in charge of water resources management; CHAPTER II: WATER RESOURCES DATA COLLECTION Article 3: Water Data Collection Network Water data collection, management, treatment and its use shall be conducted through a network of stakeholders composed of two (2) members from each of the following entities: 1º Ministry in charge of Natural Resources; 2º Rwanda Natural Resources Authority; 3º Rwanda Environment Management Authority; Article 2 : Définitions Dans le présent arrêté ministériel, les termes suivants ont les significations suivantes: 1º données des ressources en eau: données relatives à la qualité et quantité d’eau obtenues par des mesures, analyses et observations ; 2º agence: l’institution ayant la gestion de ressources naturelles en eau dans ses attributions; CHAPITRE II : COLLECTE DES DONNEES DES RESSOURCES NATURELLES EN EAU Article 3: Réseau de collecte des données de l’eau La collecte des données de l’eau, la gestion, le traitement et l’exploitation se fait par le réseau des partenaires composé de deux (2) membres provenant de chacune des institutions suivantes : 1º le Ministère ayant Ressources Naturelles dans ses attributions; 2º l’Office Rwandais des Ressources Naturelles ; 3º l’Office Rwandais de Protection de l’Environnement ; Official Gazette nº Special of 30/05/2013 65 4º Akarere kari mu kibaya cy’amazi ; 5º Minisiteri ifite Ubutegetsi bw’Igihugu mu nshingano zayo; 6º Minisiteri ifite Ingabo mu nshingano zayo; 7º Polisi y’u Rwanda; 8º Minisiteri ifite Ubucuruzi n’Inganda mu nshingano zayo; 9º Minisiteri ifite Ubuhinzi n’Ubworozi mu nshingano zayo; 10º Minisiteri ifite Ibikorwa Remezo mu nshingano zayo; 11º Urugaga rw’Abikorera; 12º Inzego z’amashuri makuru; 13º Komisiyo y’ibibaya mpuzamahanga. Ingingo ya 4: Ubuhuzabikorwa bw’ikusanyamakuru ku mazi Igiko gishyiraho ihuriro rishinzwe gukurukirana amakuru yerekeranye n’umutungo w’amazi. Ikigo kigenzura ikusanya ry’amakuru ryavuzwe mu ngingo ya 3 y’iri teka binyuze mu ihuriro ryagutse 4º any District that falls under the catchment area; 5º Ministry in charge of Local Governement; 6º Ministry in charge of Defence; 7º Rwanda National Police; 8º Ministry in charge of Trade and Industry; 9º Ministry in charge of Agriculture and Animal Resources; 10º Ministry in charge of Infrastructure; 11º Private Sector; 12º academic institutions ; 13º Trans boundary river basin commissions. Article 4: Coordination of water data collection The Agency shall put in place a water resource data monitoring network. The Agency shall coordinate the collection of the data referred to in Article 3 of this Order through the wide network of 4º tout District situé dans le bassin versant ; 5º le Ministère ayant l’administration Locale dans ses attributions ; 6º le Ministère ayant la défense dans ses attributions ; 7º la Police Nationale du Rwanda; 8º le Ministère ayant le commerce et de l’industrie dans ses attributions ; 9º le Ministère ayant l’agriculture et des ressources animales dans ses attributions ; 10º le Ministère ayant des infrastructures dans ses attributions; 11º le Secteur Privé ; 12º les institutions académiques ; 13º les commissions des bassins transfrontaliers. Article 4: Coordination de la collecte des données sur l’eau L’Agence met en place un réseau de suivi des ressources en eau. L’Agence coordonne la collecte des données en eau à travers un réseau élargi de partenaires mentionné à l’article 3 du présent Official Gazette nº Special of 30/05/2013 66 ry’abafatanyabikorwa. Ingingo ya 5: Gutanga raporo ku makuru yakusanyijwe ku mazi Abakusanya amakuru ku mazi bose bagomba gutanga raporo y’amakuru yakusanyijwe kabiri (2) mu mwaka ku kigo. Ingingo ya 6: Gukurikirana ikusanyamakuru Ikigo gikurikirana ikusanya ry’amakuru rikorwa n’abafatanyabikorwa batandukanye, kugira ngo bamenye neza niba bikorwa hakurikijwe amahame yagenwe. UMUTWE WA III: GUTUNGANYA, GUCUNGA NO GUKORESHA NEZA AMAKURU YEREKEYE UMUTUNGO KAMERE W’AMAZI Ingingo ya 7: Gutunganya amakuru y’amazi Ikigo gifite inshingano zo gutunganya amakuru ku mutungo kamere w’amazi. Amakuru yose yakusanyijwe agomba gutunganywa kugira ngo hasuzumwe ubwiza bwayo mbere y’uko yinjizwa mu bubiko. Ingingo ya 8: Gucunga amakuru yerekeranye n’amazi Ikigo gifite inshingano zo gutunganya, gusesengura, kwegeranya no gushyira amakuru ku mutungo kamere wose w’amazi mu bubiko stakeholders. Article 5: Submission of report on collection of data on water All water data collectors shall submit to the Agency a report on the data collected twice (2) a year. Article 6: Follow up on data collection The Agency shall make a follow up on the water data collection activities carried out by different stakeholders to ensure compliance with established standards. CHAPTER III: TREATMENT, MANAGEMENT AND PROPER USE OF WATER RESOURCES DATA Article 7: Treatment of water data The Agency shall be required to treat water resources related data. All data collected shall be processed in order to ensure its quality before entry in the database. Article 8: Management of water data The Agency shall be required to process, analyse, gather and store all water resources related data in its database for decision making process. arrêté. Article 6 : Suivi de la collecte des données L’Agence fait le suivi des activités de collecte de données par différents partenaires pour s’assurer qu’elle est faite suivant les normes établies. CHAPITRE III : TRAITEMENT, GESTION ET EXPLOITATION DES DONNEES Article 7 : Traitement des données en rapport avec l’eau Les données relatives aux ressources en eau sont traitées par l’Agence. Toutes les informations doivent être examinées pour s’assurer de leur qualité avant leur entrée dans la base de données. Article 8: Gestion des données en rapport avec l’eau L’Agence a la responsabilité de préparer, analyser et rassembler toutes données relatives aux ressources en eau dans leur base de données pour Official Gazette nº Special of 30/05/2013 67 bwacyo mu rwego rwo gufata ibyemezo. Ingingo ya 9: Gukoresha neza amakuru yerekeranye n’amazi Ikigo gifite inshingano zo gukoresha neza amakuru yerekeranye n’amazi no kuyarinda hakoreshejwe ikoranabuhanga rigezweho rituma aramba, akoreshwa mu buryo bworoshye, ahindurwa kandi asangirwa n’abayakoresha. UMUTWE WA IV: KUMENYEKANISHA AMAKURU KU MUTUNGO KAMERE W’AMAZI Ingingo ya 10: Ikwirakwiza ry’amakuru ku mazi Ikigo gitanga amakuru ku mazi biciye mu buryo bugezweho bw’itumanaho, bw’impapuro n’ikoranabuhanga. Ingingo ya 11: Gutangaza amakuru y’ibihe bikomeye mu mutungo w’amazi Ikigo gifite inshingano zo gutanga amakuru yerekeranye n’ibihe bikomeye ku mutungo kamere w’amazi. Ingingo ya 12: Amafaranga yerekeranye n’amakuru ku mazi Umuntu uwo ari we wese wigenga, yaba umunyarwanda cyangwa umunyamahanga wifuza kubona amakuru yerekeranye n’amazi agomba Article 9: Proper use of water data The Agency shall have the responsibility to properly use water resources related data and safeguard it by use of modern technology in order to facilitate durability, ease of use, transformation and sharing by the users. CHAPTER IV: WATER RESOURCES DATA COMMUNICATION Article 10: Water resources data dissemination The Agency shall be required to disseminate data on water resources through modern print or electronic communication media. Article 11: Communication of emergency situations on water resources The Agency shall have the responsibility to communicate any emergency situation related to water resources. Article 12: Water resources data access fees Any private operator, whether national or international, who requires to have access to water resources data shall be required to apply in writing la prise de décisions. Article 9: Utilisation de l’information sur l’eau L’Agence a la responsabilité de s’assurer de la sauvegarde de toutes les données en utilisant les technologies modernes qui permettent la durabilité, l’accessibilité, la manipulation et le partage entre les usagers. CHAPITRE IV : COMMUNICATION DES DONNEES SUR LES RESSOURCES EN EAU Article 10 : Diffusion des données sur l’eau L’Agence diffuse les données sur les ressources en eau à travers les médias modernes, imprimés et électroniques. Article 11 : Communication des situations d’urgence relatives aux ressources en eau L’Agence a la responsabilité de communiquer toute situation urgence relative aux ressources en eau. Article 12 : Frais d’accès aux données sur l’eau Tout opérateur privé, rwandais ou étranger, désirant avoir accès aux données des ressources en eau fait une demande écrite adressée à l’Agence et Official Gazette nº Special of 30/05/2013 68 kuyasaba ikigo mu nyandiko kandi akishyura amafaranga ibihumbi myakumyabiri (20000FRW) y’amanyarwanda. Umuntu wese wifuza amakuru ku mutungo w’amazi yishyura amafaranga avugwa mu gika cya mbere cy’iyi ngingo kuri konte yagenewe amafaranga akomoka ku mutungo kamere w’amazi. Umuntu wese wifuza amakuru ku mutungo kamere w’amazi akayahabwa ayakoresha gusa icyo yayasabiye kandi akamenyesha ikigo imikoreshereze yayo mu nyandiko. Umuntu wifuza amakuru yerekeranye n’amazi agomba komeka inyemezabwishyu ku urupapuro rusaba kubona amakuru. Icyakora, ibigo bya Leta n’abanyeshuri bakora ubushakashatsi bifuza kubona amakuru yerekeranye n’amazi bemerewe kuyabona nta kiguzi iyo babisabye kandi bagaragaje ibibaranga. UMUTWE WA V: INGINGO ZISOZA Ingingo ya 13: Ivanwaho ry’ingingo zinyuranyije n’iri teka Ingingo zose z’amateka abanziriza iri kandi zinyuranyije na ryo zivanyweho. and pay a fee of twenty thousand Rwandan francs (Rwf20000) . Any applicant for water resources data shall be required to deposit the fee mentioned in Paragraph One of this Article on the Bank Account relating to water resources. Any applicant for water resources data who gets access to it shall use it only for the purposes related thereto and notify the Agency of the results of the usage of the water resources data. The applicant shall be required to attach the payment receipt to the request form. However, Government institutions and students undertaking research shall be permitted to have access to water resources data without any fee upon presentation of their individual requests and their identification. CHAPTER V: FINAL PROVISIONS Article 13: Repealing provision All prior provisions contrary to this Order are hereby repealed. payer des frais équivalant à vingt mille francs rwandais (20.000 Frw). Tout demandeur de données sur l’eau qui y a eu accès doit utiliser ces dernières dans le seul but pour lequel l’accès a été demandé et informer l’Agence par écrit de l’utilisation de ces données. Le demandeur présente un reçu de paiement à l’annexe de sa demande. Toutefois, l’accès aux données sur les ressources en eau est gratuit pour les institutions publiques et les étudiants qui font leur recherche sur présentation d’une demande appropriée et du document d’identification. CHAPITRE V : DISPOSITIONS FINALES Article 13: Disposition abrogatoire Toutes les dispositions antérieures contraires au présent arrêté sont abrogées.
