MINISTERIAL ORDER No 006/11.30 OF 11/04/2017 DETERMINING THE PROCEDURES FOR SEED INSPECTION AND GRANTING OF SEED QUALITY CERTIFICATES The Minister of Agriculture and Animal Resources; Pursuant to the Constitution of the Republic of Rwanda of 2003 revised in 2015, especially in Articles 121, 122 and 176; Pursuant to Law n° 005/2016 of 05/04/2016 governing seeds and plant varieties in Rwanda, especially in Article 15; After consideration and approval by the Cabinet, in its session of 03/02/2017; HEREBY ORDERS: Article One: Purpose of this Order This Order determines the procedures for seed inspection and granting of seed quality certificates. ARRETE MINISTERIEL No 006/11.30 DU 11/04/2017 DETERMINANT LES PROCEDURES DE VERIFICATION DE SEMENCES ET D’OCTROI DE CERTIFICATS DE LA QUALITE DES SEMENCES Le Ministre de l’Agriculture et des Ressources Animales; Vu la Constitution de la République du Rwanda de 2003 révisée en 2015, spécialement en ses articles 121, 122 et 176; Vu la Loi n° 005/2016 de 05/04/2016 régissant les semences et les variétés végétales au Rwanda, spécialement en son article 15; Après examen et adoption par le Conseil des Ministres, en sa séance du 03/02/2017; ARRETE: Article premier: Objet du présent arrêté Le présent arrêté détermine les procédures de vérification de semences et d’octroi de certificats de la qualité des semences. Official Gazette nᵒ 16 of 17/04/2017 53 Ingingo ya 2: Uburyo bwo gukora igenzura ku mbuto Igenzura ry’imbuto rikorwa mu buryo bukurikira: 1° umutubuzi w’imbuto cyangwa umuhagarariye, nyuma y’iminsi cumi n’ine (14) igihingwa cy’imbuto gitewe, asaba igenzura ku murima we yuzuza ifishi no 1 iri ku mugereka wa I w’iri teka kandi akishyura amafaranga ateganyijwe; 2° igenzura ry’umurima rikorwa n’urwego rubifitiye ububasha cyangwa abagenzuzi b’imbuto babyemerewe, kandi ryibanda gusa ku mirima yanditswe gutuburirwamo imbuto; 3° nyuma yo gukora igenzura ry’imbuto, umugenzuzi w’imbuto atanga icyemezo ku mbuto, iyo asanze yujuje amabwiriza y’ubuziranenge ateganywa n’itegeko; 4° ibivuye muri buri genzura ry’umurima byandikwa ku ifishi no 2 iri ku mugereka wa II w’iri teka kandi bigashyirwaho umukono n’umutubuzi w’imbuto hamwe n’umugenzuzi; 5° buri mbuto yujuje amabwiriza y’ubuziranenge ishyirwa mu cyiciro cy’imbuto gikwiye; Article 2: Procedures for seed inspection Seed inspection is carried out as follows: 1° the seed producer or his/ her agent applies, fourteen days (14) after a seed crop is planted, for a field inspection by completing field declaration on form no 1 in annex I of this Order and pays the prescribed fees; 2° the field inspection is conducted by the competent organ or authorized seed inspectors and it is only limited to registered seed production fields; 3° after inspection of the seeds, the inspector issues a certificate of the seeds, if he/she is satisfied that it meets the standards specified in the law; 4° results of each field inspection is registered on form no 2 in annex II of this Order and signed by both the seed producer and the inspector; 5° any seed that meets the prescribed standards is accorded in an appropriate class; Article 2: Procédures d’inspection des semences La vérification des semences se fait comme suit: 1° le producteur de semences ou son agent, demande, quatorze jours (14) après que la culture de semence est plantée, une inspection sur terrain en complétant le formulaire no 1 en annexe I du présent arrêté après le paiement des frais prescrits; 2° une vérification sur terrain est menée par l’autorité compétente ou les inspecteurs de semences autorisés et, est seulement limitée aux champs enregistrés pour la production de semences; 3° après la vérification de semences, l’inspecteur de semences certifie les semences s’il est convaincu qu’elle respecte les normes spécifiées dans la loi; 4° les résultats de chaque vérification sur terrain est enregistré dans le formulaire no 2 en annexe II du présent arrêté et signé par le producteur de semences et l’inspecteur; 5° toute semence qui répond aux normes prescrites est mise dans une catégorie appropriée; Official Gazette nᵒ 16 of 17/04/2017 54 6° raporo ndakuka y’ubugenzuzi itegurwa hakurikijwe ifishi no 3 iri ku mugereka wa III w’iri teka. Iyo ukora imbuto cyangwa umuhagarariye atanyuzwe n’ibyavuye mu igenzura ashobora kujurira ku rwego rubifitiye ububasha mu gihe cy’amasaha mirongo ine n’umunani (48) kugira ngo hakorwe irindi genzura. Irindi genzura ry’imbuto rikorwa n’itsinda ryagenwe n’urwego rubifitiye ububasha. Ingingo ya 3: Gufata ingero fatizo zo gusuzuma Gusaba gufatirwa ingero fatizo, gufunga no kugenzura imbuto, bikorwa hifashishijwe imbonerahamwe iri ku mugereka wa IV w’iri teka. Ingingo ya 4: Icyemezo kigaragaza ko imbuto yasuzumwe muri laboratwari Icyemezo kigaragaza ko imbuto yasuzumwe muri laboratwari gitangwa hifashishijwe imbonerahamwe ziri ku mugereka wa V n’uwa VI z’iri teka. Ingingo ya 5: Uburyo bwo gutanga ibyemezo by’imbuto nziza Kugira ngo imbuto ihabwe icyemezo igomba kuba yujuje ibi ibikurikira: 6° final field inspection report is prepared in accordance with the form no 3 in annex III of this Order. In case a seed producer or his/ her agent is dissatisfied with the results of any inspection, he/she may appeal within forty eight (48) hours to the competent authority, for re-inspection. Re-inspection of seeds is carried out by a team designated by the competent authority. Article 3: Collection of samples for testing Request for sampling, sealing, testing of a seed, is done using the table on annex IV of this Order. Article 4: Certificate for seed laboratory test A certificate for seed laboratory test is issued using table on annexes V and VI of this Order. Article 5: Procedures for granting seed quality certificates To be certified, seed must fulfill the following conditions: 6° le rapport final de vérification sur terrain est préparé selon le formulaire no 3 en annexe III du présent arrêté. Si un producteur ou son agent n’est pas satisfait des résultats de la vérification, il peut interjeter appel dans les quarante-huit (48) heures à l’autorité compétente pour une nouvelle inspection. La ré-vérification est effectuée par une équipe désignée par l’autorité compétente. Article 3: Collecte des échantillons pour essai La demande d'échantillonnage, d'étanchéité et d'essai d'une semence se fait au moyen du tableau figurant en annexe IV du présent arrêté Article 4: Certificat des essais de laboratoire des semences Le certificat des essais de laboratoire des semences est octroyé au moyen des tableaux figurant en annexe V et VI du présent arrêté Article 5: Procédures d’octroi de certificats des semences de qualité Pour être certifiée, la semence doit remplir les conditions suivantes: Official Gazette nᵒ 16 of 17/04/2017 55 1° kuba ikomoka ku bwoko bw’igihingwa buri ku rutonde rw’amoko y’ibihingwa yemewe mu Rwanda; 2° kuba ibarizwa muri kimwe mu byiciro bine (4) by’imbuto byemewe; 3° kuba itagaragaramo ibyatsi bibi cyangwa uburwayi bukomoka ku mbuto kandi bigoye kurandura; 4° kuba yaratubuwe, yaragenzuwe, yarafatiwe ibipimo, yarasuzumwe kandi ikaba yujuje ibisabwa mu mabwiriza y’ubuziranenge hamwe n’amategeko abigenga; 5° kuba ibungwabungwa n’umushakashatsi ukora amoko y’ibihingwa cyangwa umuhagarariye. Ingingo ya 6: Igihe icyemezo cy’imbuto kimara Icyemezo cy’imbuto kimara: 1° amezi cumi n’abiri (12) abarwa uhereye itariki cyatangiweho ku binyampeke, ibinyamisogwe, n’ibihingwa bikorwamo indodo; 2° amezi atandatu (6) uhereye igihe igipimongero cyafatiwe ku bihingwa by’ibinyamavuta; 1° be from a variety listed on the national variety list; 2° belonging to any of the four (4) recognized seed classes; 3° not containing noxious weeds or seed borne diseases that are difficult to eradicate; 4° to have been produced, inspected, sampled, tested, and complies with the standards and in accordance with relevant laws; 5° being maintained by the breeder or a designated person. Article 6: Validity of seed certificate A seed certificate is valid for: 1° twelve (12) months counted from the date of its issuance for cereals, pulses and fibers crops; 2° six (6) months from the date of sampling for oil crops; 1° provenir d’une variété inscrite sur le catalogue nationale des variétés végétales; 2° appartenir à une de quatre (4) catégories de semences reconnues; 3° ne pas contenir de mauvaises herbes nuisibles ou de maladies transmises par les semences difficiles à éradiquer; 4° avoir été produite, vérifiée, échantillonnée, analysée, et être conforme aux normes et aux lois en la matière; 5° être maintenue par un obtenteur ou une personne désignée. Article 6: Validité du certificat des semences Le certificat des semences est valide pour: 1° douze (12) mois à compter de la date de sa délivrance pour les cultures céréales, légumineuses et des fibres; 2° six (6) mois à compter de la date de l’échantillonnage pour les cultures d’huile; Official Gazette nᵒ 16 of 17/04/2017 56 3° amezi atandatu (6) kuva igihe ibipimo ngero byafatiwe ku bihingwa by’imiti n’ibirungo, ibyatsi, ibinyamisogwe, ibinyabijumba, imboga n’ibihingwa bitera imbaraga; 4° amezi atandatu (6) kuva igihe ibipimo ngero byafatiwe mu gihe cy’itangazwa ry’ubwiza bw’ubwoko bw’imbuto. Umucuruzi w’imbuto, nyirazo cyangwa umuhagarariye ashobora gusaba abagenzuzi kongera gufata ibipimo, gusuzume no gufunga icyiciro cy’imbuto gifite icyemezo cyarangiye. Ingingo ya 7: Ivanwaho ry’ingingo zinyuranyije n’iri teka Ingingo zose z’amateka abanziriza iri kandi zinyuranyije na ryo zivanyweho. Ingingo ya 8: Igihe iteka ritangira gukurikizwa Iri teka ritangira gukurikizwa ku munsi ritangarijweho mu Igazeti ya Leta ya Repubulika y’u Rwanda. 3° six (6) months from the date of sampling for herbs, grass, legumes, root crops, vegetables and stimulant crops; 4° six (6) months from the date of sampling in case of declaration of the quality of seed species. The seed dealer, owner or his/her agent may request the inspectors for re-sampling, re-testing and re-sealing of seed lot whose validity of certificate has expired. Article 7: Repealing provision All prior provisions contrary to this Order are repealed. Article 8: Commencement This Order comes into force on the date of its publication in the Official Gazette of the Republic of Rwanda. 3° six (6) mois à compter de la date de l’échantillonnage pour les herbages, herbe, légumineuses, plantes racines, les légumes et les cultures stimulants; 4° six (6) mois à compter de la date d’échantillonnage en cas de déclaration de la qualité des espèces de semences. Le commerçant de semences, le propriétaire ou son agent peut demander les inspecteurs pour ré échantillonnage, ré-analyse et ré-scellage du lot de semences dont la validité du certificat a expiré. Article 7: Disposition abrogatoire Toutes les dispositions antérieures contraires au présent arrêté sont abrogées. Article 8: Entrée en vigueur Le présent arrêté entre en vigueur le jour de sa publication au Journal Officiel de la République du Rwanda.
