MINISTERIAL ORDER N°004/16.01 OF 15/07/2010 GOVERNING THE IMPORTATION AND EXPORTATION OF WILD ANIMALS The Minister of Environment and Lands; Pursuant to the Constitution of the Republic of Rwanda of 04 June 2003, as reviewed to date, especially in Articles 49, 120 ,121 and 201; Pursuant to Organic Law n° 4/2005of 08/04/2005 of 08/04/2005 determining the modalities of protection, conservation and promotion of environment in Rwanda, especially in Article 20; After consideration and approval by the Cabinet, in its session of 01/04/2010; HEREBY ORDERS: Article One: Purpose of this Order This Order governs the importation and exportation of wild animals. ARRETE MINISTERIEL N°004/16.01 DU 15/07/2010 REGISSANT L’IMPORTATION ET L’EXPORTATION D’ANIMAUX SAUVAGES Le Ministre de l’Environnement et des Terres; Vu la Constitution de la République du Rwanda du 04/06/2003 telle que modifiée jusqu’à ce jour, spécialement en ses articles 49, 120, 121 et 201; Vu la Loi Organique n° 08/04/2005 relative à la protection, conservation et la promotion de l’environnement au Rwanda, spécialement en son article 20; Après examen et adoption par le Conseil des Ministres, en sa séance du 01/04/2010; ARRETE: Article premier: Objet du présent arrêté Le présent arrêté régit l’importation et l’exportation d’animaux sauvages. Official Gazette no 35 bis of 30/08/2010 37 Ingingo ya 2: Isobanura magambo Muri iri teka, amagambo akurikira asobanuwe ku buryo bukurikira: 1° “kwinjiza mu gihugu”: kuzana ku butaka bw’u Rwanda cyangwa kuhanyuza ibintu biva mu gihugu byerekeza mu kindi gihugu; 2° “kohereza mu kindi gihugu”: gutwara ibintu biva mu gihugu byerekeza mu kindi gihugu cyo hanze; 3° “gucisha”: gutwara ibintu ubinyuza mu Rwanda bivuye mu gihugu kimwe byerekeza mu kindi; 4° “ubwoko”: inyamaswa yaba nzima cyangwa ipfuye, ikindi kintu icyo ari cyo cyose gikomoka ku nyamaswa cyangwa igicuruzwa iyo ibyanditse ku gipfunyika bigaragaza ko harimo ibikomoka ku nyamaswa; 5° “inyamaswa”: ibikoko byo mu gasozi; Article 2: Definition of terms For the purpose of this Order, the following terms shall be defined as follows: 1° “importation”: introduction to Rwanda of specimen from foreign countries including specimen in transit and /or to be transported; 2° “exportation”: Expedition of specimen from Rwanda to another country; 3° “transit”: transport of specimen through Rwanda from one country to another country; 4° “specimen”: any animal dead or alive, or any other animal products be they for trade, packed or labelled as animal products; 5° “animaux”: wild animals; Article 2: Définitions des termes Au sens du présent arrêté, les termes suivant sont définis comme suit: 1° «importation»: introduction sur le territoire du Rwanda de spécimens en provenance de Pays-tiers, y compris les spécimens en transit et les spécimens destinés à être transportés; 2° «exportation»: expédition à partir du territoire du Rwanda de spécimens à destination d’un pays-tiers; 3° «transit»: transport via le territoire du Rwanda de spécimens en provenance d’un pays-tiers, destiné à un autre pays-tiers; 4° «spécimen»: tout animal vivant ou mort ou toute partie ou tout produit obtenu d’animaux ou toute marchandise dont l’emballage ou la publicité se réfèrent aux produits dérivés d’animaux; 5° «animaux»: animaux sauvages; Official Gazette no 35 bis of 30/08/2010 38 6° “ibyanduza”, ibinyabuzima, cyaba agakoko cyangwa ikimera, byangiza inyamaswa n’ibizikomokaho. Gishobora kuba nka virusi, mikorobi cyangwa icyo ari cyo cyose cyanduza; 7° “icyorezo”: indwara iterwa n’icyanduza ishobora gufata inyamaswa nyinshi n’ibizikomokaho; 8° “akato k’amatungo”: ingamba zose zifatwa mu rwego rwo gushyira ahantu hitaruye, mu kato mu rwego rwo gukurikirana no kugenzura no kurwanya indwara yatera cyangwa yateye inyamaswa n’ibizikomokaho; 9° “urusobe rw’ibinyabuzima”: inyamaswa n’ibimera biba ahantu runaka. Igingo ya 3: Ibidashobora gutumizwa Birabujijwe kwinjiza, kubika no gutwara ku butaka bw’u Rwanda ibintu byose byanduza cyangwa bishobora kwanduza inyamaswa, uko byaba bimeze kose, nk’amagi y’udukoko, ibishorobwa, 6° “harmful organisms”: organisms, enemies of animals, or animal products belonging to animal or plant species and appearing under the form of virus, mycoplasm or organic agents; 7° “scurge”: disease incurred by harmful pathogenic organism causing epidemic calamity to animals and animal products; 8° “animal quarantine”: all restrictions imposed on animals or animal products in particular isolated areas so as to ensure their treatment and protect them under the official and specific control against any harmful organism; 9° “biodiversity”: animals and plants living in a given environment. Article 3: Burned importations It is forbidden to introduce, hold or transport on the national territory organisms harmful to animal specimen whatever their degree of development including formed parasites, eggs, larvae, nymphs and germs. 6° «organismes nuisibles: organismes, ennemis des animaux ou de produits animaux appartenant au règne animal ou végétal ou se présentant sous forme de virus, mycoplasme ou autres agents pathogènes; 7° «fléau»: Maladie causée par un organisme nuisible capable de provoquer une grande calamité publique au niveau de la production animale; 8° «quarantaine»: restrictions imposées aux animaux et produits animaux dans un endroit isolé en vue de les surveiller de manière à assurer l’interception de tout organisme nuisible; 9° «biodiversité»: animaux et végétaux vivant dans un milieu donné. Article 3: Importations prohibées Il est interdit d'introduire, de détenir ou de transporter sur le territoire national des organismes nuisibles aux spécimens animaux quel que soit leur niveau de développement tels que les parasites formés, les œufs, les Official Gazette no 35 bis of 30/08/2010 39 iminyorogoto n’ibindi. Ingingo ya 5: Amategeko agenga kohereza no gutumiza inyamaswa mu mahanga Ikigo cy’Igihugu gishinzwe kurengera ibidukikije gikora igenzura ryo kohereza no gutumiza mu mahanga ry’ubwoko bwose bw’inyamaswa mu minsi itarenze cumi n’ine (14) ikurikira iyinjizwa ry’inyamaswa cyangwa ibanziriza iyoherezwa ryazo mu mahanga. However, for research or experimental purposes, some importations exemptions of harmful organisms may be granted to specialized institutions by the Minister having environment in his/her attributions. Article 4: Right to access Any person, owner, holder and transporter of animal specimen shall open his lands, gardens, warehouses, shops and means of transportation to authorized agents so as to allow the research and possible identification of harmful organisms for quarantine. Article 5: Rules for exportation and importation of animals Rwanda Environment Management Authority ensures the control of animal specimen at the importation and exportation not latter than fourteen (14) days following the importation or prior to the exportation. larves, les nymphes et les germes. Article 4: Droit d’accès Toute personne, propriétaire, détenteur ou transporteur de spécimens animaux est tenue d'ouvrir ses terrains, jardins, dépôts, magasins et moyens de transport aux agents compétents afin de permettre la recherche et l'identification éventuelle des organismes nuisibles et de les mettre en quarantaine. Article 5: Règles d’exportation et importation d’animaux L’Office Rwandais de Protection de l‘Environnement assure le contrôle des spécimens animaux à l'importation ou à l'exportation dans un délai ne dépassant pas quatorze (14) jours suivant l'importation ou précédant l'exportation. Ingingo ya 6: Kwemererwa kohereza inyamaswa mu mahanga Kohereza inyamaswa mu mahanga bikorwa iyo hari icyemezo cy’uko zitarwaye n’uruhushya rwo kuzohereza mu mahanga bitangwa n’inzego zibifitiye ububasha. Ingingo ya 7: Icyemezo gifatirwa inyamaswa zatumijwe cyangwa zigomba koherezwa mu mahanga zanduye Iyo inyamaswa zatumijwe cyangwa zigomba koherezwa mu mahanga zanduye, Ikigo cy’Igihugu gishinzwe kurengera ibidukikije kireba niba ari ngombwa gufata icyemezo cyo kuzishyira mu kato, kuzivura, gusubizwa aho ziturutse cyangwa Any importation of animal species shall be subject to an importation license issued by Rwanda Environment Management Authority. Imported animal species should be accompanied with a health certificate issued by their Country of origin. Otherwise, they shall be considered as contaminated and provisions of Article 6 shall be applicable. Article 6: Animals exportation authorisation The exportation of animals is subject to a health certificate and an exportation license issued by relevant authorities. Article 7: Measures taken to contaminated species to be imported or exported If the animal species to be imported or exported are contaminated, Rwanda Environment Management Authority decides depending on the case of their putting in the quarantine, their treatment, their returning back or their partial or total destruction. Article 7: Mesures prises des spécimens animaux importés ou à exporter qui sont contaminés Si les spécimens animaux importés ou à exporter sont contaminés, l’Office Rwandais de Protection de l'Environnement décide, selon les cas, de leur mise en quarantaine, de leur traitement, de leur refoulement ou de leur destruction partielle ou totale. Ingingo ya 9: Ivanwaho ry’ingingo zinyuranye n’iziri teka Ingingo zose z’amateka abanziriza iri kandi zinyuranyije na ryo zivanyweho. necessary cost for implementation of those measures shall be incurred by the importing or exporting party. Article 8: Instructions on issuance of animal import and export licenses Rwanda Environment Management Authority shall issue instructions governing the issuance of animal import and export licenses, health certificate and any other relevant document thereof. Article 9: Disposition abrogatoire Toutes les dispositions antérieures contraires au présent arrêté sont abrogées.
