Ingingo ya 2: Amakuru y’ibanga atandikwa mu gitabo cy’imiti n’ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi Amakuru y’ibanga yerekeranye atandikwa mu gitabo n’imiti cyangwa ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi, ni aya akurikira: 1° Imiterere y’utugirangingo tw’ibivanzwe bishabutse tw’imiti cyangwa ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi; 2° uburyo bwo guhuza no gukora umuti cyangwa ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi; 3° uko umuti cyangwa ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi bikora; 4° uburyo bwo gusesengura umuti cyangwa ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi; Article One: Purpose of this Order This Order determines confidential data that are not recorded and non-confidential data to be recorded in the register of agrochemicals. Article 2: Confidential data that are recorded in the register of agrochemicals The following are the confidential data that are not recorded in the register of agrochemicals : 1° the molecular structure of the active ingredients of agrochemicals; 2° method of synthesis and manufacture of agrochemicals; 3° mode of action of agrochemicals; 4° method of analysis of agrochemicals; Article premier: Objet du présent arrêté Le présent arrêté vise à indiquer les données confidentielles à ne pas enregistrer et les données non confidentielles à enregistrer dans le registre des produits agrochimiques. Article 2: Données confidentielles à ne pas enregistrer dans le registre des produits agrochimiques Les données confidentielles à ne pas enregistrer dans le registre des produits agrochimiques sont les suivantes: 1 º la structure moléculaire des composantes actives des produits agrochimiques; 2 º la méthode de synthèse et de fabrication des produits agrochimiques; 3 º le mode d’action des produits agrochimiques; 4 º la méthode d'analyse des produits agrochimiques; Official Gazette nº 9 of 04 March 2013 41 5° uburyo burambuye bwo kuvanga imiti cyangwa ifumbire mvaruganada bikoreshwa mu buhinzi n’ubworozi; 6° gahunda zihariye zo kugenzura ubwiza mu gihe hakorwa umuti cyangwa ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi. Ingingo ya 3: Amakuru atari ibanga yandikwa mu gitabo cy’imiti n’ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi Amakuru atari ibanga yandikwa mu gitabo cy’imiti n’ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi ni aya akurikira: 1° amazina n’ibigize ikivanze gishabutse cyangwa ibindi bivanze bishabutse, n’izina ry’umuti cyangwa ifumbire bikoreshwa mu buhinzi n’ubworozi; 2° izina ry’ibindi bivanze bigomba kwitonderwa nk’uko amategeko y’u Rwanda cyangwa amasezerano mpuzamahanga yemejwe burundu n’u Rwanda abiteganya; 3° amakuru yerekeranye n’ubugenge n’ubutabire ajyanye n’ikivanze gishabutse n’umuti cyangwa ifumbire bikoreshwa mu buhinzi n’ubworozi; 5° formulation details of agrochemicals; 6° special quality control programmes during manufacture of agrochemicals. Article 3: Non-confidential data to be recorded in the register of agrochemicals The following are non-confidential data to be recorded in the register of agrochemicals: 1° the names and content of the active substance or other substances and the names of agrochemicals; 2° the name of other substances which are regarded as dangerous under Rwandan laws or international conventions ratified by Rwanda; 3° the physico-chemical data concerning the active substance and the agrochemical; 5 º les détails de la formule des produits agrochimiques; 6 º les programmes spéciaux de contrôle de qualité au cours de la fabrication des produits agrochimiques. Article 3: Données non confidentielles à enregistrer dans le registre des produits agrochimiques Les données non confidentielles à enregistrer dans le registre des produits agrochimiques sont les suivantes: 1° le nom et le contenu d’une ou des substances actives et le nom du produit agrochimique; 2° le nom d’autres substances considérées comme dangereuses selon les lois en vigueur au Rwanda ou selon les conventions internationales ratifiées par le Rwanda; 3° les données physico-chimiques concernant la substance active et le produit agrochimique; Official Gazette nº 9 of 04 March 2013 42 4° uburyo ubwo ari bwo bwose bwatuma ikivanze gishabutse, umuti cyangwa ifumbire bikoreshwa mu buhinzi n’ubworozi bitangiza; 5° incamake y’ibyagezweho mu igeragezwa mu rwego rwo kumenya ubunoge bw’ikivanze , ubw’umuti cyangwa ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi no kutagira ingaruka mbi ku bantu, ku nyamaswa, ku bimera no ku bidukikije; 6° uburyo n’ingamba zafashwe zo kugabanya ibikorwa byo gufatisha intoki, kubika, gutwara, ibikorwa biterwa n’umuriro n’ibindi byatera impanuka; 7° uburyo bwo gusesengura imiti cyangwa ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi hashingiwe ku biteganywa n’ingingo ya 28 n’iya 30 y’Itegeko n o 30/2012 ryo ku wa 01/08/ 2012 rigena imikoreshereze y’ifumbire mvaruganda n’imiti bikoreshwa mu buhinzi n’ubworozi; 8° Uburyo bukurikizwa bwo gusukura ahabereye impanuka itewe no kumeneka cyangwa kuva kw’umuti cyangwa ifumbire 4° any ways of rendering harmless the active substance or any agrochemical; 5° a summary of the results of the tests to establish the substance's or product's efficacy and harmlessness to humans, animals, plants and the environment; 6° recommended methods and precautions to reduce handling, storage, transport, fire or other hazards; 7° methods of analysis of agrochemicals as provided for by Articles 28 and 30 of the Law n o 30/2012 of 01/08/2012 governing the use of agrochemicals ; 8° decontamination procedures to be followed in case of accident caused by spillage or leakage of agrochemical; 4° les moyens de rendre inoffensif la substance active ou le produit agrochimique; 5° un résumé des résultats des tests établissant l'efficacité de la substance ou du produit et ses effets inoffensifs pour l'homme, les animaux, les végétaux et l'environnement; 6° méthodes et des précautions recommandées pour réduire les dangers résultant de la manutention, l'entreposage, le transport, l’incendie ou d'autres dangers; 7° les méthodes d'analyse des produits agrochimiques telles prévues par les articles 28 et 30 de la Loi n o 30/2012 du 01/08/2012 portant utilisation des produits agrochimiques; 8° les procédures de décontamination à suivre en cas de déversement accidentel ou de fuite d’un produit agrochimique ; Official Gazette nº 9 of 04 March 2013 43 mvaruganda bikoreshwa mu buhinzi n’ubworozi; 9° Ubufasha bw’ibanze n’ubuvuzi bihabwa abantu bakomeretse bitewe n’imiti cyangwa ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi. Ingingo ya 5: Igihe iteka ritangirira gukurikizwa Iri teka ritangira gukurikizwa ku munsi ritangarijweho mu Igazeti ya Leta ya Repubulika y’u Rwanda Kigali, kuwa 15/02/2013 9° first aid and medical treatment to be given to persons injured due to agrochemicals. Article 4 : Repealing provision All prior provisions contrary to this Order are hereby repealed. Article 5 : Commencement This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda. Kigali, on 15/02/2013 9° les premiers soins et traitements médicaux accordés aux personnes en cas de blessures causées par de produits agrochimiques. Article 4 : Disposition abrogatoire Toutes les dispositions antérieures contraires au présent arrêté sont abrogées. Article 5: Entrée en vigueur Le présent arrêté entre en vigueur le jour de sa publication au Journal Officiel de la République du Rwanda.
