Ingingo ya 2: Ibirebwa n’iri teka Iri teka rireba ibi ikurikira: 1° ibirebana n’ikoreshwa ry’amazi mu ngo; 2° ibikorwa byerekeranye n’umutungo kamere w’amazi bikorerwa imenyekanisha; 3° ibikorwa byerekeranye n’umutungo kamere w’amazi bitangirwa impushya; 4° ibikorwa byerekeranye n’itangwa ry’imbago mu birebana n’umutungo kamere w’amazi n’ibisabwa abazihawe. Ingingo ya 3 : Ikoreshwa ry’umutungo kamere w’amazi Umutungo Kamere w’amazi ubarirwa mu mutungo rusange wa Leta. Article 3: Utilisation of water resources Water resources are among general public domain of the government. Every person has the right to use water resources in accordance with provisions of this Order and other laws. With exception of domestic use of water and in any other activities which are subject to declaration in accordance with the provisions of this Order, the use of the water resources shall be subject to authorisation issued by competent Government authorities. l’utilisation de l’eau. Article 2: Champ d’application du présent arrêté Le présent arrêté s’applique dans les cas suivants : 1° l’utilisation de l’eau pour les activités domestiques; 2° les activités à déclarer relatives aux ressources en eau ; 3° les activités requérant une autorisation en ce qui concerne les ressources en eau ; 4° les exigences et l’octroi des concessions relatives à l’utilisation de l’eau. Article 3: Utilisation des ressources en eau Les ressources en eau font partie du domaine public de l’Etat. Chaque personne à droit à l’utilisation de ces ressources dans le respect des dispositions du présent arrêté et des autres lois. A part l’utilisation pour des besoins domestiques et les activités sujettes à la déclaration suivant les dispositions du présent arrêté, l’utilisation des ressources en eau doit être autorisée par les instances compétentes du Gouvernement. Official Gazette nº Special of 30/05/2013 21 UMUTWE WA II : IKORESHWA RY’AMAZI MU MIRIMO YO MU NGO Ingingo ya 4: Ikoreshwa ry’amazi mu ngo Gukoresha amazi mu ngo bisobanura gukoresha amazi mu buryo bwo kuyanywa, mu guteka, gukaraba, kumesa, gusukura amazu n’ibiyakikije no gusukura ibindi bikoresho byo mu rugo. Amazi akoreshwa mu ngo ashobora kuba ayo ku mavomero rusange, ava mu mugezi, ikiyaga cyangwa isoko kimwe n’atangwa n’urwego rushinzwe kuyatunganya. Ingingo ya 5: Ibikurikizwa mu kuvoma amazi yo gukoresha mu ngo Amazi akoreshwa mu mirimo yo mu ngo avomwa bidatangiwe amahoro. Nyamara hishyurwa amafaranga yerekeranye n'imirimo yo kubungabunga no kurinda umutungo kamere w’amazi, agenwa n’inzego zibifitiye ububasha. UMUTWE WA III: IMPUSHYA, IMBAGO N’IBIKORWA BIKORERWA IMENYEKANISHA Ingingo ya 6: Gusaba uruhushya cyangwa imbago Inyandiko isaba uruhushya cyangwa imbago igomba kuba ikubiyemo ibi bikurikira: CHAPTER II: DOMESTIC USE OF WATER Article 4: Domestic use of water Domestic use of water means the use of water for drinking, cooking, bathing, and washing, cleaning of houses and surroundings and other domestic equipment. Water used in domestic activities may be from public wells, rivers or streams, lakes or water supplied by the Authority in charge of water treatment. Article 5: Conditions for fetching water for domestic use Water used for domestic activities shall be tax free. However, a fee relating to the activities for maintenance and safeguarding water resources may be paid and the fee shall be determined by competent authorities. CHAPTER III: AUTHORISATION, CONCESSIONS AND ACTIVITIES SUBJECT TO DECLARATION Article 6: Application for authorization or a concession The application for authorisation or a concession shall comprise the following: CHAPITRE II : UTILISATION DE L’EAU DANS LES ACTIVITES DOMESTIQUES Article 4: Utilisation de l’eau pour les activités domestiques L’utilisation de l’eau pour les activités domestiques signifie l’usage de l’eau pour la consommation, la cuisson, lavage et lessivage, le nettoyage des maisons et leurs environs et le nettoyage des autres équipements domestiques. L’eau utilisée dans les activités domestiques peut provenir des puits publics, de rivières ou sources, lacs et l’eau distribuée par l’Office chargé de l’épuration. Article 5: Normes à suivre pour puiser l’eau à usage domestique L’eau utilisée pour les activités domestiques n’est pas taxée. Toutefois des frais sont payés pour les activités de maintenance et de sauvegarde de l’eau, qui sont déterminés par l’autorité compétente. Minisitiri ufite umutungo kamere w’amazi mu nshingano ze asubiza usaba uruhushya cyangwa imbago mu nyandiko mu gihe kitarenze iminsi mirongo itatu (30). 1° application letter addressed to the Minister in charge of water resources through the Mayor of the District in which the activities will be carried out; 2° identification of the applicant and any other necessary documents to enable easy understanding of the category and activities of the applicant; 3° a detailed and complete description of the project; 4° an environment impact assessment showing the quantity of water which will be used compared to its overall quantity; 5° the receipt for payment of a non refundable fee provided for in this Order. Without prejudice to the provisions of this Article, issuance of the authorisation or concession shall be subject to agreement signed by the applicant and the Minister in charge of water resources. The Minister in charge of water resources shall respond in writing to the applicant within a period not exceeding thirty (30) days. 1° une lettre de demande d’autorisation ou de concession adressée au Ministre ayant les ressources en eau dans ses attributions avec sous couvert du Maire du District où les activités seront menées; 2° les documents d’identification du demandeur et autres documents nécessaires permettant de bien comprendre la catégorie et les activités du demandeur ; 3° les explications complètes et détaillées du projet ; 4° l’étude d’impact environnemental qui indique la quantité d’eau qui sera utilisée par rapport au niveau général de l’eau ; 5° le bordereau de versement des frais non remboursables suivant les dispositions du présent arrêté. Sans porter préjudice aux dispositions du présent article, l’octroi de l’autorisation ou de la concession est fait sous forme d’un contrat signé par le bénéficiaire et le Ministre ayant la gestion des ressources en eau dans ses attributions. Le Ministre ayant les ressources en eau dans ses attributions donne une réponse écrite au demandeur de l’autorisation endéans trente (30) jours. Icyakora, iyo usaba uruhushya cyangwa imbago atanze amakuru atari yo, amasezerano ashobora guseswa nta mpaka. UMUTWE WA IV: ISHYIRWA MU BIKORWA RY’IBIKORERWA IMENYEKANISHA, IBITANGIRWA IMPUSHYA N’IMBAGO Ingingo ya 8: Imenyekanisha Imenyekanisha mbere y’uko igikorwa gitangira rikorwa mu buryo bw’ibaruwa yandikiwe Minisitiri ufite umutungo kamere w’amazi mu nshingano ze, igaragaza ibikorwa biteganyijwe, igihe bizamara, uburyo buzakoreshwa n’ibikoresho bizakoreshwa. Nyir’ibikorwa yoherereza Minisitiri ufite umutungo kamere w’amazi mu nshingano ze raporo agaragaza aho ibikorwa bigeze mu minsi mirongo itatu (30) nyuma y’uko igihe cyagenewe ibyo bikorwa birangiye, n’ikindi gihe cyose bibaye ngombwa. Ingingo ya 9: Impushya n’imbago Umuntu wese uyobya, ugomera, ubika, ukumira cyangwa ukoresha amazi yo ku butaka cyangwa y’ikuzimu cyangwa agashyira inyubako ku mazi Article 7: Correction of information If after the issuance of the authorisation, there exists any false information, it shall be corrected. However, if the applicant for the authorisation or concession provides false information, the contract may be automatically cancelled. CHAPTER IV: IMPLEMENTATION OF ACTIVITIES SUBJECT TO DECLARATION, AUTHORISATION AND CONCESSION Article 8: Declaration The declaration before the beginning of the activities shall be carried out in form of a letter addressed to the Minister in charge of water resources indicating planned activities, their duration, techniques and materials that will be used. The owner of the activities shall submit activity progressive report to the Minister in charge of water resources in a period of thirty (30) days after the duration of the activities, and at any time that may be considered necessary. Article 9: Authorisation and concessions Any person who diverts, dams, stores, obstructs or uses water from surface or underground source or who constructs or maintains any works on water Article 7: Correction de l’information Si après l’octroi de l’autorisation il y a de fausses informations, elles sont corrigées. Néanmoins, si les fausses informations proviennent du demandeur de l’autorisation ou de la concession, le contrat peut être résilié d’office. CHAPITRE IV: MISE EN APPLICATION DES ACTIVITES REQUERANT UNE DECLARATION, AUTORISATION OU CONCESSION Article 8: Déclaration La déclaration avant le démarrage des activités se fait par lettre adressée au Ministre ayant des ressources en eau dans ses attributions indiquant le plan d’action, leur durée, les techniques et les matériaux qui seront utilisés. Le propriétaire des activités fait un rapport au Ministre ayant des ressources en eau dans ses attributions sur l’état d’avancement des activités trente (30) jours dès la fin de la durée de ces activités, et chaque fois qu’il s’avère nécessaire. Article 9: Autorisations et concessions Toute personne qui dévie, barre, stocke, retient ou utilise l’eau de surface ou souterraine ou qui construit toute infrastructure sur l’eau doit Official Gazette nº Special of 30/05/2013 24 agomba gusaba uruhushya rwo gukoresha amazi. Ingingo ya 10: Kugaragaza imbibi z’ahakorerwa umushinga Ahakorerwa umushinga watangiwe uruhushya cyangwa imbago hagomba kugaragazwa hakoreshejwe ikarita iriho ibisobanuro kandi igaragaza neza aho umushinga uzakorerwa. Ikarita igaragaza aho umushinga uzakorerwa igomba gushyirwa ku mugereka w’amasezerano kandi ikazajya igaragazwa n’uwayihawe igihe cyose abisabwe. Ingingo ya 11: Igitabo cyandikwamo impushya n’imbago Mu kigo cy’igihugu gifite umutungo Kamere w’Amazi mu nshingano zacyo, hashyizweho igitabo cyandikwamo impushya n’imbago zatanzwe. The recipient of the authorisation or concession shall use it for the activities agreed on and in respect of the provisions of the Law and agreement he/she signed with the Minister in charge of water resources. The recipient of the authorisation or concession must present them whenever requested to do so by authorised authorities. Article 10: Demarcation of boundaries of the site of the project The site for the approved project or the concession shall be demarcated by a map bearing the description which clearly shows location from where the project will be implemented. The map which shows the place where the project will be implemented shall be attached to the contract and the holder shall present it whenever required to do so. Article 11: Authorisation and concessions Register The Authority having the water resources under its responsibilities shall maintain a register in which all issued authorisations and concession are recorded. The register contains all the information on the project under execution. demander une autorisation. Article 10: Démarcation des limites de l’endroit où le projet est exécuté L’endroit autorisé pour l’exécution du projet doit être indiquée sur une carte avec les explications et montrant clairement là où le projet sera exécuté. La carte qui montre là où le projet sera exécuté doit être annexée au contrat et doit être présentée par le propriétaire chaque fois qu’on le lui demande. Article 11: Registre des autorisations et de concessions L’agence ayant les ressources en eau dans ses attributions tient un registre dans lequel toutes les autorisations et concessions octroyées sont consignées. Ce registre contient les informations sur le projet en cours d’exécution. Ingingo ya 12: Igihe uruhushya cyangwa imbago bimara Uruhushya cyangwa imbago bimara igihe cyumvikanyweho n’impande zigiranye amasezerano nk’uko biteganywa muri iri teka. Icyakora, icyo gihe ntigishobora kurenga imyaka cumi n’itanu (15). Ingingo ya 13: Gusaba kongererwa igihe cy’uruhushya cyangwa imbago Uwahawe uruhushya cyangwa imbago mu gihe giteganijwe mu masezerano yagiranye na Minisitiri ufite umutungo kamere w’amazi mu nshingano ze, ashobora gusaba kongererwa igihe The register for authorisation and concessions shall contain the following main items: 1° the number of the authorisation or concession; 2° the recepient of the authorisation or the concession; 3° the authorized activity; 4° the duration of the authorisation or concession; 5° any other element that may help to understand the reason for the authorisation or concession. Article 12: Validity of authorisation or concession The authorisation or the concession shall be valid for the period agreed upon by contracting parties as provided for by this Order. However, the period shall not exceed fifteen (15) years. Article 13: Application for extension of the validity of the authorisation or concession The beneficiary of the authorisation or concession may apply for the extension of its validity within the period provided for in the agreement made with the Minister in charge of water resources. Article 12 : Validité de l’autorisation ou de la concession La validité de l’autorisation ou de la concession dépend de la durée conventionnelle entre les deux parties signataires du contrat prévu dans le présent arrêté. Néanmoins, cette durée ne peut pas dépasser quinze (15) ans. Article 13: Demande d’extension de la durée de validité de l’autorisation ou de la concession Le bénéficiaire de l’autorisation ou concession peut demander l’extension de sa durée suivant les clauses du contrat avec le Ministre ayant les ressources en eau dans ses attributions. Article 14: Mode of application for extension of validity Any person who applies for extension of the authorisation or concession shall do so in writing to the Minister in charge of water resources indicating the proposed duration of the extension. The applicant shall be prohibited from altering the content of the original contract. If the application for extension of authorisation or concession is approved, the Minister in charge of water resources and the recipient of the authorisation or concession Shall sign an extension addendum. Article 15: Transfer of contract The contract related to authorisation and concession may be transferred between living people or for the reason of death. Le demandeur n’est pas autorisé à modifier les termes du contrat initial. Lorsque la demande d’extension est agréée, un avenant d’extension est signé entre le Ministre ayant les ressources en eau dans ses attributions et le bénéficiaire de l’autorisation ou de la concession. Article 15: Transfert du contrat Le contrat relatif à l’autorisation et concession peut être transféré entre vifs ou pour des raisons de décès. Article 16: Termination of the contract If the signatory of the contract with the Minister in charge of water resources does not respect provisions of the law and the contract itself, the contract shall be terminated. In the event of termination of the contract, the signatory to the contract with the Minister shall be required to repair the damages caused by his/her activities in relation to the authorisation or concession that was granted. CHAPTER V: AUTHORISATION AND CONCESSION FEES Article 17: Application fees Any applicant for authorisation or concession shall pay a non-refundable application fee of thirty five thousand (Rwf 35,000) Rwandan francs. Fees mentioned in Paragraph One of this Article shall be paid on the Bank Account relating to water resource. Le demandeur du transfert est notifié par écrit de l’acceptation ou du rejet de sa demande endéans trente (30) jours à compter de la réception de la demande. Article 16: Résiliation du contrat Lorsque le signataire du contrat avec le Ministre ayant les ressources en eau dans ses attributions ne respecte pas les dispositions des lois et les clauses du contrat, le contrat est résilié. Le signataire du contrat avec le Ministre dont le contrat est résilié doit réparer les dégâts causés par ses activités relatives à l’autorisation ou à la concession qu’il avait reçue. CHAPITRE V: FRAIS RELATIFS AUX AUTORISATIONS ET CONCESSIONS Article 17 : Frais payés par le demandeur Le demandeur de l’autorisation ou de la concession doit payer des frais non remboursables équivalant à trente-cinq mille francs (35.000 Frw). Les frais prévus à l’alinéa premier du présent article sont versés au compte bancaire réservé aux ressources en eau. UMUTWE WA VI: INGINGO Z’INZIBACYUHO N’IZISOZA Ingingo ya 20: Ibikorwa byari bisanzwe bikorwa Umuntu wese ukora ibikorwa biteganyijwe muri iri teka bikorerwa imenyekanishwa, bisabirwa uruhushya cyangwa imbago, asabwa kuba yakoze imenyekanisha ry’ibikorwa bye mu gihe cy’amezi cumi n’abiri (12) uhereye igihe iri teka ritangirira gukurikizwa. Article 18: Fees paid on the basis of the quantity of water used The recipient of the authorisation or concession shall also be required to pay forty Rwandan francs (Rwf 40) per each cubic metre of water intended for industrial and mining use, and thirty Rwandan francs (Rwf 30) per cubic metre intended for use in agriculture. The recipient of the authorisation or concession shall be required to pay Twenty Rwandan francs (Rwf 20) per cubic metre of water intended for use in any other activities not mentioned in this Article. Article 19: Fees paid for issuing of documents Fees paid for documents as may be requested by the recipient of the authorisation or concession shall be determined by relevant authorities. CHAPTER VI: TRANSITIONAL AND FINAL PROVISIONS Article 20: Activities under implementation Any person who carries out activities stipulated in this Order and which are subject to declaration, authorisation or concession shall be required to have declared his/her activities in a period of twelve (12) months from the date of commencement of this Order. Article 18: Frais payés sur la base de la quantité de l’eau utilisée Celui qui a reçu l’autorisation ou la concession doit aussi payer respectivement quarante francs (40 Frw) par mètre cube d’eau destinée à l’usage industriel ou dans les mines, et trente francs (30 Frw) par mètre cube d’eau destinée à l’usage dans l’agriculture et l’élevage. Le bénéficiaire de l’autorisation ou de la concession doit payer vingt francs (20 Frw) par mètre cube d’eau destinée à l’usage dans d’autres activités non mentionnées dans le présent article. Article 19: Frais payés pour délivrance de documents Les frais payés par le bénéficiaire de l’autorisation ou de la concession pour les documents requis sont fixés par les organes compétents. CHAPITRE VI: DISPOSITIONS TRANSITOIRES ET FINALES Article 20: Activités en cours d’exécution Toute personne qui exécute des activités qui requièrent une déclaration, autorisation ou concession, doit procéder à la déclaration de ces activités dans les douze (12) mois à compter de la date d’entrée en vigueur du présent arrêté. Article 21: Repealing provision All prior provisions contrary to this Order are hereby repealed. Article 22: Commencement This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
