Order n° 004/11.30 of 15/02/2013 determining the requirements for obtaining business license of Agrochemicals; Reviewing the Ministerial Order n° 005/11.30 of 15/02/2013 determining fees for registration of Agrochemicals. Article 2 : Definitions In this Order, the following terms have the following meanings: 1° Advertise: any representation by any means whatever for the purpose of informing the public and promoting directly or indirectly the sale, use or disposal of agrochemicals; 2° Agrochemicals: any chemical fertiliser, agricultural lime material, pesticide, fungicide, insecticide, nematicide, herbicide, acaricide, bactericide, rodenticide, molluscicide, growth regulator or any other chemical or material used for agricultural purposes; ARRETE : CHAPITRE PREMIER : DISPOSITIONS GENERALES Article premier : Objet de ces instructions Le présent arrêté détermine les règlements régissant les produits agrochimiques, les conditions requises pour l’octroi de licence pour la commercialisation et les frais à payer pour l’enregistrement des produits agrochimiques. Article 2 : Définitions Dans le présent arrêté, les termes repris ci-après ont les significations suivantes : 1° Publicité : toute chose ayant pour but de donner l’information et de promouvoir directement ou indirectement la vente, l'utilisation ou l'élimination des produits agrochimiques ; 2° Produits agrochimiques : tout fertilisation chimique, la chaux agricole, pesticide, fongicide, insecticide, nématicide, herbicides, acaricides, bactéricides, rodenticides, molluscicides, régulateur de croissance ou tout autre produit chimique ou le matériel utilisé à des fins agricoles; 3° Agrochemical dealer: any person dealing with agrochemicals, this includes those who import, export, sell, store, retail, fumigate, spray, distribute and any other commercial applicator of agrochemicals; 4° Antidote: a chemical used to reverse the effects of other poisoning agrochemical; 5° Corrosive agrochemicals: any substance or agrochemical which degrades substances or chemicals that react with containers during their shelf life; 6° Damaged containers: agricultural chemical containers that are rusty or corroded or that have leaks, loose lids or have lost labels or are otherwise lacking legible labels, or any pesticide or chemical container letting off gaseous or liquid fumes of the contained agrochemical; 3° Commerçant de produits agrochimiques : toute personne qui manipule les produits agrochimiques incluant l’importation, exportation, la vente, le stockage, le détail, la fumigation, la pulvérisation, la distribution et tout autre applicateur commercial des produits agrochimiques; 6° Contenants endommagés : contenants de produits agrochimiques qui sont rouillés ou corrodés ou qui ont des fuites, ayant des couvercles qui ont lâché ou qui ont perdu des étiquettes ou manquent des étiquettes lisibles, ou tout pesticide ou contenants de produits chimiques qui laissent échapper des vapeurs gazeux ou liquides du produit agrochimique contenu; 10° Package: any container, wrapping, covering or holder in which any agrochemical is wholly or partly contained, placed, packed or repacked; 11° Persistent agrochemical: any agrochemical which when applied remains active in the soil longer than the period of the intended effectiveness leading to environmental contamination; 21° Shop: a place where agrochemicals are sold; 22° Technical knowledge: knowledge characterizing certified agrochemical dealers; 23° Volatile chemicals: those chemicals or pesticides that form vapours at normal temperature and pressure; Article 3: Importation of unregistered agrochemical The registrar of agrochemicals, after consulting the Advisory Council, may authorize the importation of unregistered agrochemical if: 1° the agrochemical is imported for experimental or research purposes and not for distribution; Article 3: Importation de produits agrochimiques non enregistrée Le registraire de produits agrochimiques, après consultation du Conseil consultatif, peut autoriser l'importation de produit agrochimique non enregistré si: 1° le produit agrochimique est importé à des fins expérimentales ou de recherche et non pour la distribution, Official Gazette nᵒ 30 of 25/07/2016 20 2° umuti n’ifumbire bitumijwe mu bihe bidasanzwe kandi byihutirwa; Ingingo ya 4: Urutonde rw’imiti n’amafumbire byemewe n’ibibujijwe Urutonde rw’imiti n’amafumbire byemewe n’urutonde rw’imiti n’amafumbire bibujijwe gukoreshwa mu Rwanda ziri ku mugereka wa I w’iri teka. Umwanditsi w’imiti n’amafumbire ashobora kuvugurura urutonde rw’imiti n’amafumbire byemewe n’urutonde rw’imiti n’amafumbire bibujijwe gukoreshwa mu Rwanda igihe cyose bibaye ngombwa. Ingingo ya 5: Igabanywa n’ikumira ry’imkoreshwa ry’umuti n’ifumbire Umwanditsi, amaze kugisha inama Inama Ngishwanama, ashobora gukumira cyangwa kubuza 2° the agrochemical is imported in the event of emergency; 3° the agrochemical is in transit through Rwanda and the Advisory Council is satisfied that it is permitted to enter the country of destination; 4° the Minister in charge of agrochemical recommends for the importation of the agrochemical. Article 4: Lists des registered and prohibited agrochemicals The list of registered agrochemicals and the list of prohibited agrochemicals in Rwanda are in annex I of this Order. The registrar may review the list of registered agrochemicals and the list of prohibited agrochemicals when considered necessary. Le registraire peut revoir la liste des produits agrochimiques enregistrés et la liste des produits agrochimiques interdits s’il s’avère nécessaire. Article 5 : Restriction et interdiction d’utilisation d’un produit agrochimique Le Registraire peut, après avis du Conseil Consultatif, restreindre ou interdire l’utilisation Official Gazette nᵒ 30 of 25/07/2016 21 ikoreshwa mu gice runaka no mu bihe bigenwe ry’umiti n’ifumbire byandstwe. Ingingo ya 7: Ikorwa ry’imiti n’amafumbire bitanditswe Umwanditsi w’imiti n’ifumbire, amaze kugirwa inama n’Inama Ngishwanama ashobora kwemera ikorwa ry’umuti n’ifumbire bitanditse byo kohereza mu mahanga iyo: 1° umuti n’ifumbire bikozwe hakurikijwe ibibiranga by’ubitumiza; 2° Iyo ibiranga umuti n’ifumbire byujuje ibya ngombwa bisabwa mu gihugu bizoherezwamo. UMUTWE WA II: IYANDIKWA RY’IMITI N’AMAFUMBIRE Ingingo ya 8: Gusaba iyandikwa ry’umuti cyangwa ifumbire Umuntu wese wifuza kwandikisha umuti n’ifumbire iyo ari yo yose ashyikiriza umwanditsi w’imiti use in a designated area and for a specified periods of a registered agrochemical. Article 6: Alteration of an agrochemical No person shall alter the formulation, composition or use of a registered agrochemical or alter it in any other manner. Article 7: Manufacture of unregistered agrochemicals The registrar, acting on the advice of the Advisory Council, may authorize the manufacture of unregistered agrochemical for export if: 1° the agrochemical is manufactured in accordance with specifications provided by the importer; or if 2° the specifications of the agrochemical satisfy the requirements applicable for the purpose in the country of exportation. CHAPTER II: REGISTRATION OF AGROCHEMICALS Article 8: Application for registration of agrochemical Any person seeking to register any agrochemical submits to the Registrar a written application for dans une zone déterminée et pour de périodes spécifiées d’un produit agrochimique enregistré. CHAPITRE II: ENREGISTREMENT DES PRODUITS AGROCHIMIQUES Article 8: Demande d’enregistrement d’un produit agrochimique Toute personne cherchant à enregistrer tout produit agrochimique adresse au Registraire une demande Official Gazette nᵒ 30 of 25/07/2016 22 n’amafumbire inyandiko ibisaba. Ku biherekeza inyandiko isaba iyandikwa ry’imiti n’amafumbire biteganyijwe mu ngingo ya 12 y’Itegeko hiyongeraho ibi bikurikira: 1° kopi enye z'ikirango cy'umuti n’ifumbire bikoreshwa mu buhinzi; 2° Ibipimongiro bibiri by'uwo muti cyangwa ifumbire byo gusuzuma no kugenzura, kimwe mu bipimongiro kigashyikirizwa urwego rubifitiye ububasha rufite mu nshingano gupima imiti n’amafumbire; 3° ibigaragaza ubumenyingiro bw'usaba kwandikisha imiti cyangwa amafumbire n’ubuzobere mu byerekeranye n’ubutabire mu buhinzi cyangwa ubuhinzi cyangwa ibindi bihwanye nabyo; 4° Inyandiko yemewe igaragaza uko bapima umuti cyangwa ifumbire byo gukoresha n'uko bikoreshwa; 5° Italiki y’igihe umuti n’ifumbire byakoreweho n’igihe bizarangiriraho ; registration of the agrochemical. An applicant not resident in Rwanda applies for registration of an agrochemical through an agent resident in Rwanda. The format of the application form for registration of an agrochemical is prepared by the Advisory Council. Additionally to elements provided for in Article 12 of the Law, the application for registration of an agrochemical is accompanied by: 1° four (4) copies of the label for the agrochemical; 2° two (2) samples of the agrochemical for official testing and evaluation, one of which delivered to the competent authority responsible for agrochemical testing; 3° proof of related technical knowledge of the applicant with specialty in agro chemistry or agronomy or its equivalent; 4° a certified application dosage and prescribed usage of the agrochemical; 5° the manufacture and expiry dates of the agrochemical; écrite d'enregistrement du produit agrochimique. Le requérant qui ne réside pas au Rwanda peut faire la demande par l’intermédiaire d’un agent qui est basé au Rwanda. Le formulaire de demande d'enregistrement du produit agrochimique est préparé par le Conseil Consultatif. En plus des éléments prévus à l’article 12 de la Loi la demande d'enregistrement d’un produit agrochimique est accompagnée : 1° de quatre (4) copies de l’étiquette du produit agrochimique; 2° de deux (2) échantillons du produit agrochimique pour des tests officiels et l'évaluation, dont un échantillon sera livré à l’autorité compétente en charge des tests des produits agrochimiques ; 3° de la preuve de la connaissance technique requise du demandeur avec la spécialité en agrochimie ou l'agronomie ou son équivalent ; 4° d’un document certifie indiquant le dosage de l'application et l'utilisation prescrite du produit agrochimique ; 5° de la mention de la date de fabrication et d’expiration du produit agrochimique ; Official Gazette nᵒ 30 of 25/07/2016 23 6° Igihe gisabwa kugira ngo ahantu hongere gukorerwa n’igihe umuti umara mu gihingwa mbere yo gusarura ; 7° Ingaruka imiti cyangwa amafumbire bishobora guteza ibyo bibitsemo; 8° Imiti irogora n'ubutabazi bw'ibanze butangwa mu gihe habayeho impanuka yo guhumanywa n’umuti cyangwa ifumbire ; 9° Imyambaro yihariye yo kwirinda ikenewe mu gihe cyo gukoresha umuti cyangwa ifumbire bikoreshwa mu buhinzi. Ingingo ya 9 : Kwemeza iyandikwa ry’umuti n’ifumbire Umwanditsi w’imiti n’amafumbire, amaze kugisha inama Inama Ngishwanama, yemeza iyandikwa ry’umuti n’ifumbire agatanga icyemezo cy’iyandikwa ryabyo iyo asanze: 1° usaba afite ubumenyingiro buhagije ku muti n’ifumbire bisabirwa kwandikwa ; 2° isuzuma n'ikurikirana byagaragaje ko uwo muti n’ifumbire bifite akamaro, bitagira ingaruka mbi ku buzima bw'abantu n’ibidukikije, bimwerera kwandika izina 6° re-entry and pre-harvest intervals; 7° corrosive effects of the agrochemical; 8° antidotes and first-aid treatment recommended in case of accidental poisoning by the agrochemical; 9° special protective wear required in the use of the agrochemical. Article 9: Approval of registration of agrochemical The Registrar, after consulting the Advisory Council, approves the registration of agrochemicals and issues the certificate of the registration if he/she establishes that: 1° the applicant has sufficient technical knowledge on the agrochemical for which the application for registration is made for; 2° the official testing and evaluation have proved that the agrochemical is effective, safe and not a danger to public health and cause him/her to enter the name of the agrochemical in the register; 6° de la mention du temps nécessaire pour la réutilisation du sol et l’intervalle avant la récolte ; 7° de l’indication des effets corrosifs du produit agrochimique ; 8° de l’indication des antidotes et des premiers soins recommandés en cas d'intoxication accidentelle par le produit agrochimique ; 9° des vêtements spéciaux de protection nécessaires lors de l'utilisation du produit agrochimique. Article 9 : Acceptation de l’enregistrement des produits agrochimiques Le Registraire, après consultation du Conseil Consultatif, approuve l'enregistrement d'un produit agrochimique et délivre le certificat d'enregistrement s’il constate que : 1° le demandeur a une connaissance technique suffisante sur le produit agrochimique dont l’enregistrement est demandée ; 2° l'essai et l'évaluation officielle ont prouvé que le produit agrochimique est efficace, sûr et sans danger pour la santé publique et autorise le registraire à saisir le nom du produit agrochimique dans le registre ; Official Gazette nᵒ 30 of 25/07/2016 24 ry'uwo muti n’ifumbire mu gitabo cy’imiti n’amafumbire; 3° usaba yaramaze gutanga amafaranga ibihumbi cumi y’u Rwanda (10.000 Frw) yo kwandikisha umuti n’ifumbire. Ingingo ya 14: Itangwa ry’icyemezo cy’iyandikwa ry'agateganyo Umwanditsi ashobora gutanga icyemezo cy'iyandikwa ry’agateganyo ry’umiti n’ifumbire iyo: Article 11: Non-transferability of the Certificate of registration No person issued with a certificate of registration of an agrochemical shall lend, hire, sell, transfer or otherwise dispose of the certificate. Article 12: Renewal of the certificate of registration The registrar may renew the certificate of registration of agrochemical in accordance with the provisions of the Law. The format of the application form for renewal of the certificate is specified by the Advisory Council. Article 13: Temporary registration of agrochemical Any agrochemical dealer may apply for temporary registration of an agrochemical. The format of application for temporary registration of agrochemical is specified by the Advisory Council. Article 14: Temporary registration of agrochemical The Registrar may issue the certificate of temporary registration of agrochemicals if: Article 11 : Non transfert du certificat d’enregistrement Aucune personne à qui un certificat d'enregistrement d’un produit agrochimique a été délivré ne peut prêter, louer, vendre, transférer ou autrement disposer du certificat. Article 12 : Renouvellement du certificat d’enregistrement Le registraire peut renouveler le certificat d'enregistrement d’un produit agrochimique dans les conditions prévues par la Loi. Le formulaire de la demande de renouvellement du certificat est établi par le Conseil Consultatif. Article 13 : Enregistrement provisoire des produits agrochimiques Tout commerçant de produits agrochimiques peut demander l’enregistrement provisoire d’un produit agrochimique. Le formulaire de demande d'enregistrement provisoire d'un produit agrochimique est préparé par le Conseil Consultatif. Ingingo ya 15: Kutandikwa kw’umuti n’ifumbire Umwanditsi ashobora kutandika umuti n’ifumbire iyo : 1° inyandiko isaba kwandikwa cyangwa ikirango cy'umuti n’ifumbire kitujuje ibisabwa n'Itegeko cyangwa iri teka ; 1° the applicant agrees to provide additional technical information on the agrochemical regarding the use for which the agrochemical is intended to be sold; 2° the agrochemical is urgently required for the control of pest infestations detrimental to public health, animals, plants or the environment; or 3° the agrochemical is undergoing laboratory tests, experiments or field trials to determine its efficacy in Rwanda. The Registrar, after consulting the Advisory Council may issue a certificate of provisional registration of an agrochemical, in a period of fifteen (15) days from the date the applicant submitted the application form and after the applicant pays provisional registration fee of ten thousand Rwandan francs (10.000 Rwf). Article 15: Refusal to register an agrochemical The registrar may reject any application for registration of an agrochemical if: 1° the application for registration or the label of the chemical does not comply with the Law or this Order; 1° le demandeur accepte de fournir des informations techniques supplémentaires concernant l'utilisation à laquelle le produit agrochimique à vendre est destinée ; 2° le produit agrochimique est requis d'urgence pour la lutte contre les infestations de ravageurs nuisibles à la santé publique, les animaux, les plantes ou l’environnement ; ou 3° si le produit agrochimique subit actuellement des tests de laboratoire, des expériences ou des essais sur terrain afin de déterminer son efficacité au Rwanda. Le Registraire, après consultation du Conseil Consultatif peut délivrer un certificat d’enregistrement provisoire pour les produits agrochimiques dans un délai de quinze (15) jours à partir de la date de dépôt du formulaire de demande et après paiement par le demandeur d'un droit d'enregistrement provisoire de dix mille francs rwandais (10.000 Frw). CHAPTER III: REGISTRATION OF PREMISES Article 16: Structural arrangement of premises Premises used for manufacture, distribution, formulating, packaging, re-packaging, loading or storage of agrochemical products have: 1° a suitable design, layout and construction to ensure the health of workers and to avoid contamination of the environment ; 2° adequate space for storage of agrochemicals and placement of necessary materials and equipment for the health of workers and operators; 2° les renseignements que le demandeur fournit au Conseil Consultatif ne sont pas suffisants pour permettre au produit agrochimique d’être évalué et traité ; 3° l'utilisation du produit agrochimique pourrait constituer un risque inacceptable ou une menace pour des choses pour lesquelles le produit agrochimique peut être utilisé, pour la santé publique, les plantes, les animaux ou pour l'environnement. CHAPITRE III: ENREGISTREMENT DES BATIMENTS Article 16 : Structure des bâtiments Les bâtiments servant à la fabrication, à la distribution, à la formulation, à l’emballage, au ré emballage, au chargement ou au stockage des produits agrochimiques ont : 1° une bonne conception et une construction bien appropriée pour assurer une vie saine des travailleurs et éviter la pollution de l’environnement ; 2° un espace suffisant pour le stockage de produits agrochimiques et un endroit pour le matériel et les équipements nécessaires Official Gazette nᵒ 30 of 25/07/2016 28 bw’abakozi n’abacuruza imiti n’amafumbire; 3° ifite ahantu hatandukanye haba mu bice, mu byerekezo cyangwa ku bundi buryo buboneye byatuma abahakora badahura n’imiti n’amafumbire mu yindi mirimo yabo. Ingingo ya 17: Aho inyubako ziba ziherereye Inyubako yose ikorerwamo imirimo y’ubucuruzi bw’imiti n’amafumbire igomba kuba iri: 1° kure y’ingo, ibigo by’amashuri, amavuriro, ahantu hagenewe ubucuruzi ndetse n’inganda z’ibiribwa ; 2° kure y’imigezi, imigende y’amazi y’imvura ndetse n’ibizenga by’amazi; 3° kure y’ahakunze kugaragara imyuzure. Inama Ngishwanama igena ibindi bisabwa kubahirizwa ku bijyane n’ahantu n’ibipimo inyubako z’ububiko z’abanyenganda, abatumiza, abohereza mu mahanga n’izo abakora ubucuruzi buciriritse bw’imiti n’amafumbire zigomba kuba zujuje ikabigaragaza ku nyandiko isaba kwemererwa kwandikisha inyubako. 3° separate areas either by partition, location or other effective means for those operations which do not require workers to be exposed to the agrochemicals. Article 17: Location of premises Any premise in which agrochemical business is carried out is located: 1° away from residential areas, schools, hospitals, shopping areas and food manufacturers; 2° away from water courses, open storm water channels or water catchments; 3° away from areas which are subject to flooding. The Advisory Council determines other requirements for location and size of premises of manufacturers, importers and exporters, storage facilities and retailers’ premises and indicates them on the application form for registration of premises. à la protection de la santé des travailleurs et des opérateurs ; 3° des endroits séparés par partie, par zone ou autrement pour ces opérations pour que les travailleurs ne soient pas exposés aux produits agrochimiques ; Article 17 : Emplacement des bâtiments Tout bâtiment dans lequel des activités agrochimiques sont menées est situé : 1° loin des quartiers résidentiels, des écoles, hôpitaux, des centres commerciaux et des industries alimentaires; 2° loin des cours d’eaux, des canaux des eaux de pluie et des endroits de captage d’eaux ; 3° loin des zones caractérisées par des inondations ; Le Conseil Consultatif détermine d’autres conditions à remplir concernant l’emplacement et les dimensions des bâtiments des fabricants, des importateurs et des exportateurs, des locaux de stockage et des bâtiments des détaillants et les indique sur le formulaire de demande d’enregistrement des bâtiments. Official Gazette nᵒ 30 of 25/07/2016 29 Ingingo ya 18: Kurinda abakorera ku nyubako Umuntu wese utunganyiriza, uvangira, upakirira, upfunyika, ukoresha cyangwa ubika imiti n’amafumbire mu nyubako agomba kuzirikana mu gihe cy’ibikorwa ko: 1° abakozi bari mu kazi mu nyubako bambaye imyenda yo kwirinda; 2° inyubako irimo ibikoresho by’ubutabazi bw’ibanze byagenwe n’Inama Ngishwanama; 3° ubuzima rusange bw’abakorera muri iyo nyubako bumeze neza kandi abifitiye icyemezo cya muganga ubifitiye ububasha; 4° ibindi bikoresho biteganywa mu kurinda abakozi no kubungabunga ibidukikije biri mu nyubako kandi bihagije. Ingingo ya 19: Ubumenyi tekinike busabwa Umuntu wese ukorera cyangwa ushinzwe inyubako ikorerwamo ibikorwa byo gutunganya, gukora, kuvanga, gupfunyika, guhunika cyangwa kugurisha imiti n’amafumbire, agomba, kugira ubumenyi bw’ubutabire, uko imiti n’amafumbire bishobora guhumanya, ubwiza bwabyo, umutekano n’imikoreshereze yabyo. Article 18: Protection of workers and operators in premises Any person who manufactures, formulates, packages, uses or stores any agrochemical in any premise must, during business, ensure that: 1° the employees working in the premises wear protective clothing; 2° the premises are well equipped with appropriate first aid facilities determined by the Advisory Council; 3° the general health of the employees working on the premises is adequately catered for and he/she has medical certificate issued by a recognized doctor thereof; and 4° all other equipment to protect workers and environment are available in premises and sufficient ; Article 19: Required technical knowledge Every business owner or responsible for premises in which agrochemicals are manufactured, processed, formulated, packaged, stored or sold is required to have knowledge of chemistry, toxicology, efficacy, safety and general use of the agrochemicals. Article 18 : Protection des travailleurs dans les bâtiments Toute personne qui fabrique, formule, charge, emballe, utilise ou stocke les produits agrochimiques doit, pendant les opérations, s’assurer que : 1° les personnes travaillant dans les bâtiments portent des vêtements de protection ; 2° des bâtiments sont équipés du matériel de premiers secours approprié déterminé par le Conseil Consultatif ; 3° des personnes travaillant dans les bâtiments sont généralement en bonne santé et qu’il dispose, à cet effet, d’un certificat médical délivré par un médecin agrée ; 4° les équipements préventifs pour la protection des travailleurs et de l’environnement sont disponibles et suffisants ; Article 19 : Connaissances techniques requises Toute personne travaillant dans ou responsable des bâtiments de fabrication, de transformation, de formulation, d’emballage, de stockage ou de vente de produits agrochimiques est tenu d’avoir des connaissances de chimie, de toxicologie, d’efficacité, de sécurité et d’utilisation générale des produits agrochimiques. Ingingo ya 21: Igenzurwa ry’inyubako Iyo Umwanditsi agejejweho inyandiko isaba iyandikwa ry’inyubako, ategura igenzura ryayo rigakorwa n’umugenzuzi. Umugenzuzi akorera raporo y’igenzura umwanditsi mu nyandiko mu gihe cy’iminsi cumi n’ine (14) y’akazi kuva umunsi igenzura ry’inyubako ryasabiweho. ngingo ya 22: Itangwa ry’icyemezo cy’iyandikwa ry’inyubako Iyo Umwanditsi amaze gusuzuma raporo y’igenzura ry’inyubako, atanga icyemezo cy’iyandikwa ry’inyubako mu gihe kitarenze iminsi mirongo itatu (30) y’akazi. Article 20: Application for registration of premises The application form for registration of premises is submitted to the Registrar. It must be accompanied by such information as the Advisory Council may require. The application form for registration of premises and the format of the report of inspection of the premises to be submitted to the Registrar, are prepared by the Advisory Council. Article 21: Inspection of premises Where the Registrar is submitted the application for registration of premises he/she arranges for an inspection of the premises to be carried out by an inspector. The inspector prepare, in writing, an inspection report and submit it to the Registrar within a period of fourteen (14) working days from the date of the request for inspection of premises. Article 22: Issuing a certificate of registration of premises The Registrar, after considering the report of inspection of the premises, issues the applicant with a certificate of registration of the premises within a period not exceeding thirty (30) working days. Article 20 : Demande d’enregistrement des bâtiments Le formulaire de demande d'enregistrement de bâtiments est soumis au Registraire. Il doit être accompagné par des informations que le Conseil Consultatif peut exiger. Le formulaire de demande d'enregistrement de bâtiments ainsi que le formulaire du rapport d’inspection des bâtiments soumis au Registraire sont préparés par le Conseil Consultatif. Article 21 : Inspection des bâtiments Lorsque le Registraire reçoit la demande d'enregistrement de bâtiments, il prend les dispositions nécessaires pour une inspection des lieux à mener par un inspecteur. L'inspecteur prépare, par écrit, un rapport d'inspection qu’il soumet au Registraire dans un délai de quatorze (14) jours ouvrables depuis la demande d’inspection des bâtiments. Article 22: Remise d’un certificat d’enregistrement des bâtiments Le Registraire, après examen du rapport d’inspection des bâtiments, délivre au demandeur un certificat d'enregistrement des bâtiments dans un délai ne dépassant pas trente (30) jours ouvrables. Nta yandikwa ry’inyubako rishobora gukorwa Inama Ngishwanama itarabona ko: 1° ibiteganywa n’aya mabwiriza byubahirijwe ; 2° ubucuruzi bw’imiti n’ifumbire bukorerwa muri iyo nyubako bugomba gukorwa n’umuhungizi wemewe cyangwa umucuruzi w’imiti n’ifumbire wemewe cyangwa n’ushobora gukora ibijyanye n’uwo mwugakubera umutekano wayo n’ibirimo; cyangwa 3° nibura umwe mu bafatanyabikorwa cyangwa abayobozi, ari umuhungizi wemewe cyangwa ukoresha imiti n’ifumbire wemewe kandi atuye mu Rwanda mu gihe usaba ari ikigo cyangwa uruganda. Imiterere y’icyemezo cy’iyandikwa ry’inyubako zikorerwamo imirimo If, in the opinion of the Registrar, the premises need to be altered to comply with the requirements of this Order, the Registrar informs, in writing, the owner or occupier of the premises the alterations to be made. The Registrar shall not issue the owner or occupier of the premises with the certificate of registration of the premises unless the alterations are completed. No registration of premises is granted unless the Advisory Council is satisfied that: 1° the provisions of this Order are complied with; 2° the business of agrochemicals would, in relation to the premises, be carried on under the immediate supervision of a registered dealer, fumigator or commercial agrochemical applicator for the purpose of their use and safety; or 3° at least one of the partners or directors is a registered fumigator or a chemical applicator is resident in Rwanda in case of the applicant is a firm or company. The format of the certificate of registration of the premises is prepared Si, l'avis du Registraire est tel que les bâtiments doivent être modifiés pour se conformer aux exigences du présent arrêté, le Registraire informe, par écrit, le propriétaire ou l'occupant des bâtiments des modifications qui s’imposent. Le Registraire ne peut pas délivrer pas au propriétaire ou l'occupant des bâtiments le certificat d’enregistrement des bâtiments sans que les modifications aient été achevées. Aucun enregistrement des bâtiments ne peut être accordé que si le Conseil Consultatif est convaincu que : 1° les dispositions du présent arrêté sont respectées ; 2° l'entreprise de produits agrochimiques serait, en ce qui concerne les bâtiments, être exercée sous la surveillance immédiate d'un commerçant enregistré, fumigateur ou un applicateur agrochimique commerciale aux fins de leur utilisation et de sécurité ; ou 3° au moins un des associés ou des administrateurs est un fumigateur enregistré ou un applicateur de produits chimiques qui réside au Rwanda au cas où le demandeur est une entreprise ou société. Le formulaire du certificat d'enregistrement des bâtiments est préparé par le Conseil Consultatif. Icyemezo cy’iyandikwa ry’inyubako gishobora kongererwa igihe nyirayo amaze koherereza umwanditsi inyandiko ibisaba no kwishyura amafaranga ateganyijwe ku mugereka wa II w’iri teka ashyirwa mu Isanduku ya Leta. Inyandiko isaba kongerera igihe icyemezo cy’iyandikwa ry’inyubako iherekezwa na kopi y’icyemezo cy’iyandikwa ry’inyubako usaba yari asanganywe. Ingingo ya 24: Guhagarika cyangwa kwambura agaciro icyemezo cy’iyandikwa ry’inyubako Umwanditsi ashobora guhagarika cyangwa kwambura agaciro icyemezo cy’iyandikwa ry’inyubako iyo uwahawe icyemezo: 1° yanyuranyije n’ibiteganywa n’iri teka; 2° atacyujuje ibisabwa n’umwanditsi byerekeranye n’iyandikwa ry’inyubako; by the Advisory Council. Article 23: Duration and renewal of the certificate of registration of premises A certificate of registration of premises is valid for a period of five (5) years from the date of its issuance. The certificate of registration of premises may be renewed upon a written application submitted to the registrar by the owner and after payment of fees provided for in Annex II of this Order to the Public Treasury Account. The written application of renewal of the certificate of registration of premises is accompanied by a copy of the certificate of registration held by the applicant. Article 24: Suspension or cancellation of the certificate of registration of premises The Registrar may suspend or cancel a certificate of registration of the premises if the holder of the certificate: 1° contravenes provisions of this Order; 2° fails to fulfil requirements set by the registrar in relation to registration of the premise; Article 23: Durée et renouvellement du certificat d’enregistrement des bâtiments Le certificat d’enregistrement des bâtiments est valable pour une période de cinq (5) ans à compter de la date de délivrance. Le certificat d’enregistrement des bâtiments peut être renouvelé sur demande écrite et paiement du droit de renouvellement de la somme prévue à l’annexe II du présent arrêté au compte du Trésor Public. La demande écrite de renouvellement du certificat d’enregistrement des bâtiments est accompagnée d’une copie du certificat d’enregistrement actuel du demandeur. Article 24 : Suspension ou annulation du certificat d’enregistrement des bâtiments Le Registraire peut suspendre ou annuler un certificat d’enregistrement des bâtiments si le titulaire du certificat : 1° ne respecte pas les dispositions du présent arrêté ; 2° ne remplit pas les conditions spécifiées par le registraire en rapport avec l’enregistrement des bâtiments ; Official Gazette nᵒ 30 of 25/07/2016 33 3° atagifite ubushobozi bwo gukomeza gukora ubucuruzi bw’imiti n’amafumbire. CHAPTER IV: LICENSING OF AGROCHEMICAL DEALERS Article 25: Requirement for agrochemical dealer’s license A person who applies for an agrochemical dealer’s license as importer, exporter or distributor is required to have personnel who possess at least a bachelor’s degree in chemistry, bio-chemistry or agricultural sciences; A person who applies for an agrochemical dealer’s license as retailer is required to have personnel who possess at least a high school diploma (A2) in chemistry, bio-chemistry or agricultural sciences. Any agrochemical dealer’s license is subject to conditions specified in the license and to any other conditions as Advisory Council may prescribe. Article 26: Application for an agrochemical dealer’s license A person who applies for an agrochemical dealer’s license submits in writing the application to the Registrar. 3° est incapable de mener le commerce des produits agrochimiques. CHAPITRE IV: LICENCE DE COMMERCIALISATION DE PRODUITS AGROCHIMIQUES Article 25 : Conditions pour une licence de commercialisation de produits agrochimiques Le demandeur d’une licence de commercialisation des produits agrochimiques en tant qu’importateur, exportateur ou distributeur doit avoir du personnel détenteur d’au moins un diplôme de licence en chimie, biochimie ou sciences agricoles ; Le demandeur d’une licence de commercialisation des produits agrochimiques en tant que détaillant doit avoir du personnel détenteur d’au moins un diplôme d’études secondaires (A2) en chimie, biochimie ou en sciences agricoles. Toute licence de commercialisation des produits agrochimiques est soumise à des conditions spécifiées dans la licence et à d'autres conditions que le Conseil Consultatif peut imposer. Article 26 : Demande d’une licence de commercialisation de produits agrochimiques Le demandeur d’une licence de commercialisation des produits agrochimiques adresse sa demande écrite au Registraire. The application form for agrochemical dealer’s license is accompanied by: 1° the applicant’s proof of payment to the Public Treasury account of a fee specified in Annex II of this Order; 2° four (4) duly certified copies of relevant documents regarding the technical knowledge of the applicant; 3° a copy of the agrochemical certificate of registration. The format of the application form for agrochemical dealer’s license is prepared by the Advisory Council. Article 27: Selection of subsidized agrochemical importers Selection of subsidized agrochemical importers goes through a public procurement process. Agrochemical retailers is registered with the entity in charge of managing Government subsidy. Le formulaire de demande de licence de commercialisation des produits agrochimiques doit être accompagné de : 1° justificatif du demandeur du paiement au compte du Trésor public des frais dont le montant est spécifié dans l’annexe II du présent arrêté ; 2° quatre (4) copies certifiées conformes aux documents originaux concernant la connaissance technique du demandeur; 3° une copie du certificat d'enregistrement des produits agrochimiques. Le formulaire de demande de licence de commercialisation de produits agrochimiques est préparé par le Conseil Consultatif. Article 27: Sélection d’importateurs de produits agrochimiques subventionnés La sélection d’importateurs des produits agrochimiques subventionnés se fera à travers le processus de passation de marché public. Les détaillants de produits agrochimiques sont enregistrés par l’entité en charge de gérer la subvention gouvernementale. Article 28: Issuance of an agrochemical dealer’s license If the applicant complies with the requirements mentioned in the Law and this Order, the Registrar issues to him/her an agrochemical dealer’s license within a period of fifteen (15) days from the date of application. The agrochemical dealer’s license is prepared by the Advisory Council. Article 29: Duration and renewal of agrochemical dealer’s license An agrochemical dealer’s license is valid for five (5) years from the date of issuance. The agrochemical dealer’s license may be renewed for a further period of five (5) years after the applicant pays to the Public Treasury account a fee which the amount is specified in annex II of this Order. The applicant for renewal of the agrochemical dealer’s license submits, in writing, the application to the Registrar and provides information the Advisory Council may require for. Article 287 : Délivrance de licence de commercialisation de produits agrochimiques Si le demandeur se conforme aux exigences de la Loi et du présent arrêté, le Registraire lui délivre une licence de commercialisation de produits agrochimiques dans une période de quinze (15) jours à compter de la date de la demande. Le format de la licence de commercialisation de produits agrochimiques est préparé par le Conseil Consultatif. Article 29 : Durée et renouvellement d’une licence de commercialisation de produits agrochimiques Une licence de commercialisation de produits agrochimiques est valable pour cinq (5) ans à compter de sa date d'émission. La licence de commercialisation des produits agrochimiques peut être renouvelée pour une période de cinq (5) ans sur paiement au compte du Trésor Public par le titulaire d'un montant spécifié à l’annexe II du présent arrêté. La demande de renouvellement de la licence de commercialisation de produits agrochimiques est soumise au Registraire par écrit et le demandeur doit fournir toute autre information que le Conseil Consultatif peut exiger. Ingingo ya 32: Ubujurire bw’icyemezo cyo guhagarika cyangwa gutesha agaciro uruhushya Umuntu utishimiye icyemezo cyo guhagarika cyangwa gutesha agaciro uruhushya rwo gucuruza imiti n’amafumbire ashobora kujurira mu rwego rwa mbere kuri Minisitiri ufite imiti n’amafumbire mu nshingano ze, na we agafata icyemezo kuri icyo Article 30: Suspension or cancellation of agrochemical dealer’s license The Registrar may suspend or cancel an agrochemical dealer’s license if he/she: 1° has reasonable grounds to believe that the licensee has failed or refused to comply with provisions of the law and this Order; 2° considers that suspension or cancellation of the license is necessary to prevent or remove a potential hazard to people, crops, animals or the environment. Article 31: Instructions of stopping sale of an agrochemical The Advisory Council may issue and enforce an instruction stopping or suspending sale of any deficient agrochemical. Article 32: Appeal against suspension or cancellation of the license A person aggrieved by the decision to suspend or cancel the agrochemical dealer’s license may appeal in the first instance to the Minister in charge of agrochemicals, which settles the matter in a period of thirty (30) days from the dates Article 30 : Suspension et annulation d’une licence de commercialisation de produits agrochimiques Le Registraire peut suspendre ou annuler une licence de commercialisation des produits agrochimiques s’il : 1° a des motifs sérieux de croire que le titulaire a omis ou refusé de se conformer aux dispositions de la Loi et à présent arrêté ; 2° estime que la suspension ou l'annulation de la licence est nécessaire pour prévenir ou éliminer un danger potentiel pour les personnes, les cultures, les animaux ou l'environnement. Article 31 : Instructions d’arrêt de la vente d’un produit agrochimique Le Conseil Consultatif peut adopter et faire appliquer une instruction d’arrêt ou de suspension de la vente d’un produit agrochimique déficient. Article 32: Appel contre la suspension ou l’annulation de la licence La personne lésée par la décision de suspendre ou d'annuler la licence de commercialisation de produits agrochimiques peut faire appel au premier degré au Ministre ayant les produits agrochimiques dans ses attributions, qui tranche sur l’affaire dans Official Gazette nᵒ 30 of 25/07/2016 37 kibazo mu minsi mirongo itatu (30) kuva umunsi agerejweho inyandiko y’ubujurire. Article 33: Records to be kept Every agrochemical dealer prepares and keeps a record of quantities of agrochemicals manufactured, processed, formulated, re-packed, imported or exported, stored or he/she sells as the case may be, and such a record is made available to the Advisory Council and inspector as they may require. CHAPTER V: PACKAGES, LABELS AND TRANSPORTATION OF AGROCHEMICALS Section One: Packages of agrochemicals Article 34: Packaging facilities for agrochemicals Packaging and repackaging of agrochemicals are carried out only in premises registered in accordance with the provisions of this Order. un délai de trente (30) jours à compter du jour de réception de notification écrite du recours. The applicant for approval of the package submits a sample of the package, details of its nature and authorization of packaging/re packaging from the manufacturer of the agrochemical. Article 36: Packaging of agrochemicals A manufacturer or person repacking agrochemicals ensures that the package of an agrochemical is durable, designed and made so as to contain the agrochemical safely under practical conditions of storage, display, transportation and distribution. Article 37: Production of packages of agrochemicals A producer of packages of agrochemicals makes them in such a manner as to minimize the degradation or change of their contents resulting bâtiments enregistrés conformément aux dispositions du présent arrêté. Article 36 : Emballage de produits agrochimiques Le fabricant ou celui qui réemballe les produits agrochimiques veiller à ce que l’emballage d’un produit agrochimique soit durable, conçu et fabriqué de manière à contenir le produit agrochimique en toute sécurité dans des conditions pratiques de stockage, d'exposition, de transport et de distribution. Section 2 : Etiquettes de produits agrochimiques Article 38: Approbation des étiquettes de produits agrochimiques Les étiquettes de produits agrochimiques mélangés, emballés ou réemballés au Rwanda, sont approuvées par le Conseil Consultatif. Article 40: Information displayed on agrochemical label On an agrochemical labelis displayed the following main information: 1° Name of the agrochemical; 2° Name and address of the manufacturer ; 3° Manufacturing and expiry date; 4° Percentages of main nutrient elements and grade; 5° Registered source in case of agricultural lime product; 6° Net weight of the product; 7° Trace elements content in percentage by weight in whole numbers or to one decimal place for agrochemicals Article 39 : Avertissements et directives sur l’étiquette d’un produit agrochimique L’étiquette d’un produit agrochimique doit contenir des avertissements et des directives prohibitives sur le mode d’emploi nécessaires pour la protection des vies humaines, des animaux, des plantes, de la vie aquatique, des sols, de l'air, de l'eau et de l'environnement en général. Article 43: Transportation of corrosive and explosive agrochemicals Corrosive agrochemicals are transported in plastic containers. Explosive agrochemicals are transported under cool conditions. CHAPTER VI: ADVERTISING, STORAGE, USE OF AGROCHEMICALS Section One: Advertising agrochemicals Article 44: Advertising statements of an agrochemical Any statement used in advertising an agrochemical is technically substantiated by the person carrying out the advertisement. Article 45: Contents of advertising statements An advertiser of an agrochemical uses statement or visual presentation without omission, ambiguity or exaggerated claim that could mislead the buyer in particular with regard to the safety of the agrochemical, its nature or composition, suitability for use or official recognition or approval. Article 43 : Transport des produits agrochimiques corrosifs et explosifs Les produits agrochimiques corrosifs sont transportés dans des récipients en plastique. Les produits agrochimiques explosifs sont transportés dans des conditions froides. CHAPITRE VI: PUBLICITE, STOCKAGE, UTILISATION DES PRODUITS AGROCHIMIQUES Section première : Publicité de produits agrochimiques Article 44 : Annonce publicitaire d’un produit agrochimique Toute annonce utilisée dans la publicité d’un produit agrochimique est appuyée de justifications techniques de la véracité de son contenu de la part de la personne chargée de la publicité ; Article 45 : Contenu des messages de publicité Une personne qui fait de la publicité d’un produit agrochimique utilise des termes ou fait une présentation visuelle sans omission, ambiguïté ni exagération pouvant induire en erreur l’acheteur, en particulier en ce qui concerne la sécurité du produit agrochimique, sa nature ou sa composition, la pertinence de son utilisation ou de reconnaissance ou d’approbation officielle. Article 46: Advertisement of restricted-use agrochemicals An agrochemical whose use is restricted shall not be advertised except when permitted by the Advisory Council. Section 2: Storage of agrochemicals Article 47: Conditions for storage of agrochemicals Any agrochemical dealer shall store and display his/her agrochemicals in accordance with conditions indicated on the respective label. Article 48: Premises for storage of agrochemicals Premises on which agrochemicals are stored conform to the following requirements: 1° to be separate, strictly for the purpose of storage of the agrochemicals and securely lockable; Toute déclaration publicitaire d’un produit agrochimique doit être en conformité avec les informations fournies lors de l'enregistrement du produit agrochimique. Section 2 : Stockage des produits agrochimiques Article 47 : Conditions de stockage des produits agrochimiques Tout commerçant de produits agrochimiques doit stocker et étaler ses produits agrochimiques conformément aux conditions indiquées sur l'étiquette respective. Article 51: Safe handling and use of agrochemicals Any agrochemical dealer must ensure that: 1° hazards are avoided while handling agrochemicals at all times during use; 2° users are not allowed any drifting away from the agrochemicals; 3° approved personal protective equipment is worn during handling and use of agrochemicals; 4° only recommended equipment and materials are used to handle and apply agrochemicals Section 3 : Utilisation des produits agrochimiques Article 50 : Protection des cultures et de l’environnement Afin de protéger les cultures et l'environnement, les produits agrochimiques sont utilisés uniquement pour l’usage prescrit et dans le strict respect des conditions et des indications figurant sur l'étiquette. Article 52: Precautions on the use of agrochemicals The user of agrochemicals must take the following precautions : 1° no person or animal is allowed into freshly sprayed areas; 2° no food product is consumed immediately after application of agrochemicals in accordance with instructions of use on the label ; 5° les aliments ne sont pas consommés au lieu de stockage ou au magasin ou lors de l'application de produits agrochimiques ; 6° personne ne fume, ne mange, n’allaite, ne boit ni ne manipule des aliments et ustensiles de cuisine dans des bâtiments abritant des produits agrochimiques ou durant leur application; 7° tous les vêtements et les appareils utilisés par toute personne au stock, au magasin ou durant l’application des produits agrochimiques sont lavés immédiatement après l’application ; 8° toute personne se lave le corps avec de l'eau propre et du savon immédiatement après la manipulation ou l'application d’un produit agrochimique. CHAPTER VII: TESTING OF AGROCHEMICALS Article 53: Modalities for laboratory tests and experiments of agrochemicals Any Laboratory test and experiment of agrochemicals is carried out in accordance with good laboratory practice, and copies of original reports of the tests, together with samples of the agrochemicals, are submitted to the Advisory Council for assessment. Article 57: Period for experimenting n agrochemical The agrochemical is experimented for a minimum of two crop growing seasons in different field locations in Rwanda. Article 58: Costs for agrochemical testing The applicant of agrochemical testing bears the responsibility of payment to the Public Treasury account of all the costs for agrochemical testing, before he/she is granted a certificate of temporary registration issued by the competent Authority. Article 59: Report on testing of agrochemicals The researcher or the team of researchers in respective competent institutions gather, analyze and compile test data into a technical report to be submitted to the Advisory Council. The Advisory Council analyzes the technical report and communicates its final decision to the Registrar. The Registrar, within a period of fourteen (14) days from the date he/she received the technical report, communicates to the applicant the decision of the Advisory Council on the agrochemical testing in order to take appropriate action. Article 57 : Période d’expérimentation d’un produit agrochimique Le produit agrochimique est expérimenté pour un minimum de deux saisons de croissance des cultures dans différents endroits sur le terrain du Rwanda. Article 58 : Frais pour les essais des produits agrochimiques Le demandeur d’essai des produits agrochimiques est tenu du paiement au compte du Trésor Public de tous les frais pour essais des produits agrochimiques, avant d’obtenir le certificat d'enregistrement provisoire délivré par l’autorité compétente. Article 59 : Rapport de test de produits agrochimiques Le chercheur ou l'équipe de chercheurs dans les institutions compétentes respectives recueillent, analysent et compilent des données de test dans un rapport technique à soumettre au Conseil Consultatif. Le Conseil Consultatif analyse le rapport technique et communique sa décision finale au Registraire. Dans un délai de quatorze (14) jours à compter du jour ou le rapport technique lui a été soumis, le Registraire communique au demandeur la décision du Conseil Consultatif sur les essais de produits agrochimiques afin de prendre les mesures appropriées. Inyandiko isaba uruhushya rwo kuvanaho imiti n’amafumbire iba iherekejwe n’ibi bikurikira: CHAPTER VIII: DISPOSAL OF AGROCHEMICALS Article 60: Dumping agrochemicals away from water courses or lakes No person shall dispose any agrochemical on the land within ten meters (10m) of a water course or within fifty meters (50m) of a lake. Article 61: Collection and disposal of empty agrochemical containers After use, empty agrochemical containers are collected in a designated place before being taken for safe disposal. Article 62: Application for authorization for disposal of agrochemicals Any person who intends to dispose of agrochemicals applies in writing for authorization to do so in Rwanda Environment Management Authority and provides a copy to the Minister in charge of agrochemicals. The application for authorization for disposal of agrochemicals is accompanied by the following: CHAPITRE VIII : DESTRUCTION DES PRODUITS AGROCHIMIQUES Article 60 : Déversement des produits agrochimiques loin de cours d'eau ou des lacs Nul ne peut déverser un produit agrochimique sur le terrain se trouvant à dix mètres (10m) d'un cours d'eau ou à cinquante mètres (50m) d'un lac. Article 61 : Collecte et destruction des emballages vides des produits agrochimiques Après usage, les récipients vides des produits agrochimiques doivent être collectés dans un endroit désigné en attendant la destruction sécurisée. Article 62: Demande d’autorisation de destruction des produits agrochimiques Toute personne qui a l'intention de détruire des produits agrochimiques en fait, par écrit, une demande d’autorisation à l’Office Rwandais pour la Protection de l’Environnement et réserve une copie au Ministre ayant les produits agrochimiques dans ses attributions. Ingingo ya 63: Itangwa ry’uruhushya rwo kuvanaho imiti n’amafumbire Ikigo cy’Igihugu cyo Kubungabunga Ibidukikije gisuzuma inyandiko y’usaba kuvanaho imiti n’amafumbire kigatanga uruhushya mu minsi makumyabiri (20) uhereye ku munsi inyandiko isaba yatangiwe. underground water sources, rivers, air space and lives; 9° Indication of the role of all stakeholders involved in the disposal of the agrochemicals if any; 10° Indication of any predicted consequences and precautions taken and how to intervene in case of accidents and unexpected reactions; 11° Indication of how to carry out the inspection and monitoring of consequences that may arise and mitigation methods on long and short term basis; 12° Justifications for the selection of mode of disposal of agrochemicals; 13° any other necessary information if any. Article 63: Issuance of authorization for disposal of agrochemicals Rwanda Environment Management Authority considers the application for disposal of the agrochemicals and issue the authorization within a period of twenty (20) days from the date of submission of the application. 9° L'indication du rôle de tous les partenaires intervenant, le cas échéant, dans l'élimination des produits agrochimiques ; 10° L'indication de tout conséquence prévisibles, et précautions prises et de comment intervenir en cas d'accident et des réactions inattendues; 11° L'indication de comment l'inspection et le suivi des conséquences pouvant survenir vont être menés et des méthodes d'atténuantes à long et à court terme; 12° Les justifications du choix de la façon de destruction des produits agrochimiques; 13° tout autre information nécessaire, s’il y en a. Article 63 : Délivrance de l'autorisation de destruction de produits agrochimiques L’Office Rwandais pour la Protection de l’Environnement examine la demande de destruction de produits agrochimiques et délivre l'autorisation dans un délai de vingt (20) jours à compter de la date de dépôt de la demande. Ingingo ya 64: Kudatanga uruhushya rw’ivanwaho ry’imiti n’amafumbire Ikigo cy’Igihugu cyo Kubungabunga Ibidukikije gishobora kudatanga uruhushya rw’ivanwaho ry’imiti n’amafumbire iyo uwasabye atujuje ibisabwa bivugwa mu ngingo gika cya 2 cy’ingingo ya 61 y’iri teka. Ikigo cy’Igihugu cyo Kubungabunga Ibidukikije gishobora kandi gutegeka ubundi buryo bwo kuvanaho bwo kuvanaho imiti n’amafumbire. Ingingo ya 65: Ikiguzi cy’ivanwaho ry’imiti n’amafumbire bikoreshwa mu buhinzi Ikiguzi cy’ivanwaho ry’imiti n’amafumbire n’icy’inyigo zose zakenerwa zifitanye isano na ryo kishingirwa n’usaba. However, Rwanda Environment Management Authority may extend the period for issuance of the authorization for disposal of agrochemicals, but it informs in writing the applicant of the extension of the period before the initial period for issuance of the authorization elapses. Article 64: Refusal of authorization for disposal of agrochemicals Rwanda Environment Management Authority may refuse to issue the authorization for disposal of agrochemicals if the applicant does not fulfil the requirements provided for in Paragraph 2 of Article 61 of this Order. Rwanda Environment Management Authority may also instruct another alternative mode to dispose of the agrochemicals. Article 65: Cost of disposal of agrochemicals The cost of disposal of agrochemicals as well as any other required related studies are borne by the applicant. Toutefois, l’Office Rwandais pour la Protection de l’Environnement peut prolonger la période de délivrance de l'autorisation de destruction des produits agrochimiques, mais il en informe le demandeur, par écrit, avant l’expiration du délai initial. Article 64: Refus d’autorisation de destruction de produits agrochimiques L’Office Rwandais pour la Protection de l’Environnement peut refuser de délivrer l'autorisation de destruction de produits agrochimiques si le demandeur ne remplit pas les exigences prévues à l’alinéa 2 de l’article 61 du présent arrêté. L’Office Rwandais pour la Protection de l’Environnement peut aussi ordonner d’autre façon de destruction de produits agrochimiques. Article 65 : Frais de destruction des produits agrochimiques Les frais de destruction des produits agrochimiques, ainsi que d'études connexes nécessaires sont supportés par le demandeur. CHAPTER IX: TRANSITIONAL AND FINAL PROVISIONS Article 66 : Compliance period with this Order All agrochemical dealers who do not fulfil the requirements of this Order are required to comply with its provisions within a period not exceeding six (6) months from the date of its publication in the Official Gazette of the Republic of Rwanda. Article 67: Repealing provision The Ministerial Order no 004/11.30 of 15/02/2013 determining the requirements for obtaining business license of Agrochemicals and the Ministerial Order n° 005/11.30 of 15/02/2013 determining fees for registration of Agrochemicals, as well as all other prior provisions contrary to this Order are hereby repealed. Article 68: Commencement This Order comes into force on the date of its publication in the Official Gazette of the Republic of Rwanda. CHAPITRE IX : DISPOSITIONS TRANSITOIRES ET FINALES Article 66 : Période de conformité au présent arrêté Tous les commerçants de produits agrochimiques qui ne remplissent pas les conditions requises par le présent arrêté doivent se conformer à ses dispositions dans un délai ne dépassant pas six (6) mois à compter de la date de sa publication au Journal Officiel de la République du Rwanda Article 67 : Disposition abrogatoire L’Arrêté Ministériel no 004/11.30 du 15/02/2013 déterminant les conditions requises pour l’octroi de licence pour la commercialisation des produits agrochimiques et l’Arrêté Ministériel n° 005/11.30 du 15/02/2013 fixant les frais à payer pour l’enregistrement des produits agrochimiques, ainsi que toutes les autres dispositions antérieures contraires au présent arrêté sont abrogées. Article 68 : Entrée en vigueur Le présent arrêté entre en vigueur le jour de sa publication au Journal Officiel de la République du Rwanda.
