Ingingo ya 2 : Aho iri teka rikoreshwa Iri teka rireba abantu batandukanye bakoresha amazi mu bikorwa byashyizwe ku butaka bwite bwa Leta cyangwa ku butaka Leta yakodesheje. Rireba kandi imirima iriho muri iki gihe ndetse n’izashyirwaho mu gihe kizaza. Ingingo ya 3: Ibisobanuro by’amagambo Muri iri teka, amagambo akurikira afite ibisobanuro bikurikira : 1° Ukoresha amazi: umuntu ku giti cye, itsinda cyangwa se ikigo gikoresha amazi ku mpamvu runaka mu mirima yakozwemo ibikorwa byo kuhira imyaka; 2° Ukoresha amazi mu kuhira imyaka: umuntu wibanze ukoresha amazi mu kuhira imyaka kandi izina rye rigaragara ku ikarita y’imirima cyangwa se ku rutonde rw’abuhira imyaka kandi ufite inshingano zo kwishyura umusanzu w’amazi; CHAPTER ONE: GENERAL PROVISIONS Article One: Purpose of this Order This Order establishes Irrigation Water Users Associations on all irrigation schemes within Rwanda. Article 2: Scope This Order serves water users in an irrigation scheme built on the public and private domains of the Government as well as schemes built on land that the Government has given out on lease. It serves all existing as well as all future schemes. Article 3: Definitions In this Order, the following terms are defined as follows: 1° Water user: any individual, group or institution using water in an irrigation scheme for a defined purpose; 2° Irrigation water user: irrigator who is the principal water user and whose name is mentioned on the irrigation scheme map or irrigator and who has an obligation to pay a water fee; CHAPITRE PREMIER: DISPOSITIONS GENERALES Article premier: Objet du présent arrêté Le présent arrêté met en place les associations d'utilisateurs d'eau d’irrigation, dans tous les programmes d’irrigation. Article 2 : Champ d’application Le présent arrêté concerne les différents utilisateurs des programmes d'irrigation établis aussi bien sur les concessions privées du Gouvernement que sur les terres distribuées par celui-ci selon le système de bail. Il concerne tous les programmes actuels et futurs. Article 3: Définitions Aux fins du présent arrêté, les termes suivants sont définis comme suit: 1° Utilisateur d’eau : tout individu, groupe ou institution se servant de l’eau dans un périmètre irrigué pour un usage défini; 2° Utilisateur d’eau d’irrigation : irrigateur qui est en fait l’utilisateur principal de l’eau et dont le nom figure sur la carte du programme d’irrigation et qui a l’obligation de payer les frais de prestation des services d’eau; Official Gazette nº 50 of 12/12/2011 64 3° Abandi bakoresha amazi: ni abantu ku giti cyabo, amatsinda, cyangwa se ibigo bikoresha amazi ku zindi mpamvu zitari izo kuhira imyaka mu mirima yatunganyijwe kandi nabo bishyura umusanzu w’amazi. Ingano y’amazi akoreshwa mubindi bikorwa bitari ibyo kuhira imyaka igenwa n’ishami rishinzwe amashyirahamwe y’abakoresha amazi muri Minisiteri y’Ubuhinzi n’Ubworozi; 4° Ishyirahamwe ry’Amazi : Ishyirahamwe rigizwe n’abantu bose bakoresha amazi ahashyizwe ibikorwa remezo byo kuhira imyaka. Rigomba kuba rifite ubuzimagatozi kugira ngo ribashe gucunga, gutunganya, gukoresha neza amazi no gufata neza imiyoboro na gahunda y’iyuhira; 5° Koperative : bisobanura itsinda ry’abantu bakora igikorwa kimwe kandi rigengwa n’Itegeko n o 50/2007 rigena imitunganyirize y’amakoperative nk’uko ryahinduwe kandi ryujujwe kugeza ubu; 6° Ikarita y’imirima yuhirwa: bisobanura ikarita ikoze mu buryo bw’ikoranabuhanga igaragaza amazina y’abakoresha amazi kandi ihora ivugururwa; 3° Other water users: secondary water users who may be individuals, group or institutions using water for purposes other than irrigation within a defined irrigation scheme and pay a water fee. The proportion of water to be used for secondary purposes will be determined by the Irrigation Water Users Associations Unit in the Ministry of Agriculture and Animal Resources; 4° Irrigation Water Users Association (IWUA): It is an association formed by all water users of a defined irrigation scheme. It is endowed with a legal personality in view of the management, enhancement and sustainability of the water resource and irrigation scheme; 5° Cooperative: A group of people who come together for a common purpose and are governed by Law n o 50/2007 on cooperatives as amended and complemented to date; 6° Irrigation map: a digitized plot map whose list of landowners is updated periodically; 3° Autres utilisateurs d’eau : usagers secondaires d’eau qui peuvent être des individus, groupe ou institution utilisant l’eau pour un but autre que celui d’irrigation dans un périmètre donné et qui paye les frais de prestation des services d’eau. La portion d’eau à utiliser pour le but secondaire sera déterminée par l’unité en charge des Association d'utilisateurs de l'eau d’irrigation au Ministère de l’Agriculture et des Ressources Animales; 4° Association d'Utilisateurs de l'Eau d’Irrigation (AUEI): association formée de tous les utilisateurs d’eau dans un périmètre donné. Elle est dotée d'une personnalité juridique en vue d’assurer la gestion, l’amélioration et de la viabilité des ressources en eau et du programme d’irrigation ; 5° Coopérative: un groupe de gens qui s’associent pour une cause commune et régi par la loi N o 50/2007 sur les sociétés coopératives telle que modifiée et complétée à ce jour ; 6° Carte du propriétaire de la parcelle de terrain: document digitalisé périodiquement mis à jour et contenant la liste des irrigateurs ; Official Gazette nº 50 of 12/12/2011 65 7° Urutonde rw’abakoresha amazi mu buhinzi: urutonde rw’abakoresha amazi mu buhinzi ruvugururwa buri gihembwe cy’ihinga ruriho amazina yabo na nomero z’indangamuntu zabo; 8° Urutonde rw’abakoresha amazi: urutonde rw’abantu bose bakoresha amazi muri buri murima wuhiwe ruhora ruvugururwa; 9° Amasezerano y’imihigo: amasezerano akorwa hagati ya Minisiteri y’Ubuhinzi n’Ubworozi n’Ishyirahamwe ry’amazi hagamijwe kugera ku ntego; 10° Amasezerano yo kwegurirwa ibikorwa byo kuhira : amasezerano Minisiteri y’Ubuhinzi n’Ubworozi, mu izina rya Leta, ikora yegurira Ishyirahamwe ry’Amazi inshingano zo gucunga no kubungabunga imirima kandi ateganya ibisabwa impande zombi. Akarere bireba nako gashyira umukono kuri ayo masezerano; 11° Umusanzu w’amazi : ni igiteranyo cy’amafaranga Ishyirahamwe rishyiraho kandi cyemezwa n’inama ntegurabikorwa ku rwego rw’Akarere. Uwo musanzu 7° Irrigation water user list: a periodically updated list of irrigators showing their full names and identity card numbers; 8° Water user list: A periodically updated list of all water users on a defined scheme; 9° Performance contract: is an agreement with stipulated rights and responsibilities signed between the Ministry of Agriculture and Animal Resources and IWUA for achieving seasonally planned targets; 10° Irrigation Management Transfer Agreement (IMTA): the document by which the Ministry of Agriculture and Animal Resources, acting for the Government, transfers the responsibility for the operation and maintenance of irrigation scheme to the Irrigation Water Users Association and lists the obligations of both parties. The respective District also co-signs the Irrigation Management Transfer Agreement; 11° Water service fee: the sum of money set by the IWUA and approved by the IWUA steering committee at the District. It is paid by all water users and it is composed 7° Liste des utilisateurs d’eau d’irrigation: liste d'utilisateurs, mise à jour, montrant leurs noms complets et les numéros de leurs cartes d'identité ; 8° Liste des utilisateurs d’eau : liste périodiquement mise à jour de tous les utilisateurs d’eau dans un périmètre donné ; 9° Contrat de performance: accord signé entre le Ministère de l’Agriculture et des Ressources Animales et les AUEI dans chaque périmètre d’irrigation pour accomplir les objectifs fixés ; 10° Accord de transfert de gestion des activités d'irrigation : le document par lequel le Ministère de l’Agriculture et des Ressources Animales, agissant pour le compte du gouvernement, transfère la responsabilité de l'opération et de l'entretien du périmètre aux associations des utilisateurs d'eau et énumère les deux parties. Le District respectif est également cosignataire de cet accord de transfert de gestion des activités d'irrigation ; 11° Frais de prestation du service d'eau: montant fixé par l’AUEI et approuvé par le comité de pilotage au niveau de District. Il est payé par tous les usagers Official Gazette nº 50 of 12/12/2011 66 wishyurwa n’abakoresha amazi, ufasha mu mirimo yaryo ya buri munsi, gufata neza ibikorwa remezo, umusanzu mu kigega cy’ubwiteganyirize cyifashihwa mu gusana ibikorwa binini, n’umusanzu ujya gufasha izindi gahunda za Leta zo kuhira imyaka; 12° Gahunda y’ibikorwa by’iyuhira : ni ibikorwa by’amazi byateguwe kandi bigatunganywa mu rwego rwo kuyobora amazi mu mirima, bigizwe n’aho amazi afatirwa, urugomero rwo kohereza amazi mu miyoboro cyangwa mu bitembo biyajyana mu miferege mito yuhira ibihingwa; 13° Aho ibikorwa biherereye: ahantu hagizwe n’imirima yose ishobora gukoresha amazi iri mu mbibi zigaragazwa n’ikarita y’imirima yuhirwa; 14° Uruhushya rwo gukoresha amazi : bisobanura icyemezo cyangwa uruhushya gishobora gutangwa na Minisiteri y’Umutungo Kamere n’Ibidukikije hakurikijwe ububasha ihabwa n’itegeko n o 62/2008 rigena amategeko yerekeye gukoresha, kubungabunga, kurinda no gucunga amazi; 15° Inama ntegurabikorwa ya gahunda y’iyuhira: ni inama igizwe n’abafatanya bikorwa banyuranye ku rwego rw’Akarere of, operation and maintenance of an irrigation scheme, reserve fund for major water infrastructure repairs and an irrigation trust fund for contributions to other Government irrigation programs; 12° Irrigation scheme: It is a hydraulic network, whose principal use is irrigation and it consists of the head-works, conveyance and distribution systems that distribute water for field irrigation and terminates at the outlet of the command area in a drainage system; 13° Service area: the area constituted by the assembly of plots whose boundaries are defined by the irrigation map; 14° Water permit: the concession, authorization or declaration receipt that the Ministry of Natural Resources and Environment may issue using its powers granted by Law nº 62/2008 defining the rules for the use, conservation, protection and management of water resources; 15° Scheme steering committee: committee made up of different stakeholders at the District whose responsibility is the overall d’eau et est constitué des frais opérationnel et d’entretien des infrastructures d’irrigation, de contributions au fonds de réserve pour des grosses réparations, et au fond fiduciaire pour d’autres programmes d’irrigation gouvernementaux ; 12° Programme d’irrigation: réseau hydraulique conçu et développé pour l'irrigation et le drainage, et composé d’installations principales et de systèmes de transport et de distribution de l’eau pour irriguer des champs et qui se termine au poste de commande dans un système de drainage ; 13° Zone de prestation de service: secteur constitué par l'ensemble des parcelles de terrain et dont les limites sont mentionnées sur la carte d’irrigation ; 14° Permit d’utilisation de l'eau: c’est une concession, autorisation ou déclaration que le Ministère des Ressources Naturelles et de l'Environnement peut délivrer en vertu des pouvoirs lui conférés par la Loi n o 62/2008 définissant les règles d'utilisation, de conservation, de protection et de gestion des ressources en eau ; 15° Comité de pilotage du programme : comité constitué de différents intervenants au niveau du District dont Official Gazette nº 50 of 12/12/2011 67 bafite inshingano zo kugenzura ibikorwa byo muri icyo cyanya; 16° Ishami rishinzwe amashyirahamwe y’amazi: ishami rya Minisiteri y’Ubuhinzi n’Ubworozi rishinzwe kugenzura ibikorwa n’amashyirahamwe y’abakoresha amazi. UMUTWE WA II : IMIKORERE Y’AMASHYIRAHAMWE Y’AMAZI MU KUHIRA IMIRIMA Ingingo ya 4 : Gusabwa gushyiraho amashyirahamwe y’abakoresha amazi mu mirima yuhirwa Ishyirahamwe ry’abakoresha amazi mu kuhira rigizwe n’abakoresha amazi bose bo muri buri gace ka gahunda y’iyuhira. Ingingo ya 5 : Ububasha bw’Ishyirahamwe ry’Amazi Ishyirahamwe ni rwo rwego rwonyine rwemerewe gushyira umukono ku masezerano yo kwegurirwa ububasha bwo gucunga ibikorwa byo kuyobora amazi mu mirima. Ayo masezerano ahuza ishyirahamwe, Minisiteri y’Ubuhinzi n’Ubworozi n’Akarere. Ni narwo rwego rwonyine rushinzwe ibikorwa n’imirimo byo kubungabunga imirima yuhirwa ruhagarariye Minisiteri kandi rufite uburenganzira bwo gutunga uruhushya rwo gukoresha amazi. management of the scheme; 16° Water Users Association Unit: A unit in the Ministry of agriculture whose role is to oversee the activities of IWUA. CHAPTER II: FUNCTIONING OF IRRIGATION WATER USERS ASSOCIATIONS Article 4: Obligation to establish Irrigation Water Users Associations The IWUA is represented by all water users of every segment of the scheme. Article 5: Powers of the Irrigation Water Users Association The association is the sole user organization entitled to sign and implement the Irrigation Management Transfer Agreement with the Ministry of Agriculture and Animal Resources and the District. The association is also in charge of the operation and maintenance of the scheme on behalf of the Ministry. It is the entity entitled to hold the water permit for the scheme. la responsabilité consiste à la gestion globale du programme ; 16° Unité en charge des Associations des utilisateurs d’eau : Unité au sein du Ministère de l’Agriculture dont le rôle est de superviser les activités des AUEI. CHAPITRE II: FONCTIONNEMENT DES ASSOCIATIONS DES UTILISATEURS DE L’EAU D’IRRIGATION Article 4 : Obligation de mettre en place des associations des utilisateurs d’eau d’irrigation L’AUEI est constituée de tous les utilisateurs d’eau dans chacun des segments du programme d’irrigation. Article 5 : Pouvoirs d’une association des utilisateurs d'eau L'association est l'unique organisation d’utilisateurs habilitée à signer l'accord de transfert de gestion d'irrigation avec le Ministère de l’Agriculture et des Ressources Animales. Elle est aussi l'organisation unique responsable de l’opération et de l'entretien du programme pour le compte du Ministère et autorisée à détenir le permit d’utilisation de l’eau pour le programme d’irrigation. Ingingo ya 6: Inshingano z’amashyirahamwe y’amazi Ishyirahamwe rifite inshingano zikurikira : 1° gukora ku buryo buri munyamuryango agira uruhare rusesuye mu bikorwa byaryo ; 2° gucunga konti zayo zose ku buryo bugaragarira buri munyamuryango, abanyamuryango bakagira uburenganzira bwo kugera ku madosiye yose ; 3° gukora ku buryo icyemezo gifashwe kiba giciye mu kuri kandi mu bwisanzure; IWUA must open two bank accounts where all water fees are deposited. One for operation and maintenance and the other for a reserve fund. Withdrawals for operation and maintenance and reserve fund shall be done by the IWUA upon approval by the steering committee at District level. Irrigation trust fund will be transferred to the specified Government account by IWUA after every season. The IWUA applies scheme bylaws and Irrigation Management Transfer Agreement with due diligence and according to the law enshrined in this Order. Article 6: Responsibilities of IWUA The IWUA shall have the following responsibilities: 1° ensure full participation of all members in all its activities; 2° ensure full transparency of all its accounts to all water users by giving full access to all documents; 3° ensure decision making is fair and democratic; L’AUEI doit ouvrir deux comptes à la banque où tous les frais d’utilisation d’eau seront versés. Un compte est utilise pour les frais opérationnel et d’entretien alors que l’autre est réservé au fonds de réserve. Les retraits des frais de fonctionnement et d’entretien ainsi que les fonds de réserve sont faits par AUEI avec l’approbation du comité de pilotage au niveau du District. Le fond de roulement est transféré par l’AUEI sur un compte spécifié de l’Etat à la fin de chaque saison culturale. L’AUEI applique strictement les règlements d’ordre intérieur et l’accord de transfert de gestion tel que stipulé dans le présent arrêté. Article 6: Attributions de l’AUEI L'AUEI a les attributions suivantes : 1° s’assurer de la pleine participation de tous les membres dans toutes ses activités; 2° s’assurer de la transparence totale de tous ses comptes vis-à-vis de ses membres en leur permettant d’accéder pleinement à tous les documents; 3° s’assurer d’une prise de décision juste et démocratique; Official Gazette nº 50 of 12/12/2011 69 4° gukora ku buryo abakoresha amazi bagomba kuyahabwa ntawe uryamiwe ; 5° kwirinda gusesagura amazi; 6° guteza imbere ikoranabuhanga mukuzamura umusaruro hakoreshejwe amazi make; 7° kurinda isuri, imyunyu mu mazi, kuhira birenze urugero n’imyuzure ; 8° gukora ku buryo abanyamuryango babungabunga uburumbuke bw’ubutaka kandi bakarengera n’ibidukikije; 9° kubahiriza uburenganzira ba nyir’ubutaka n’ababukoresha bahabwa n’amategeko. Ingingo ya 7: Imikoranire na Minisiteri y’Ubuhinzi n’Ubworozi Minisiteri y’Ubuhinzi n’Ubworozi, ari nayo ishyira umukono ku masezerano yo kwegurira amashyirahamwe inshingano zo gucunga ibikorwa by’iyuhira, ishinzwe gukurikirana no kugenzura imikorere y’amashyirahamwe mu bikorwa byose birebana n’iyuhira ry’imyaka. Ishyirahamwe rigomba guha Minisiteri y’Ubuhinzi n’Ubworozi amakuru yose irisabye. 4° ensure that all water users receive their fair share of water in time; 5° minimise waste of water; 6° promote the use of new techniques and technologies for raising yield per unit of water; 7° avoid erosion, salinization, overwatering and control flooding; 8° ensure members maintain the fertility of the soil and protect the environment; 9° respect the rights and legal interests of all owners and all users of the scheme. Article 7: Relationship with the Ministry of Agriculture and Animal Resources The Ministry of Agriculture and Animal Resources, as signatory to the Irrigation Management Transfer Agreement on behalf of the Government, is responsible for regulation, monitoring and evaluating the performance of all Irrigation Water Users Associations. The association must provide all information requested by the Ministry of Agriculture and Animal Resources. 4° s'assurer que tous les usagers reçoivent leur part en eau à temps; 5° réduire au minimum le gaspillage de l'eau; 6° promouvoir l’utilisation des techniques et technologies nouvelles pour l’accroissement du rendement par unité d’eau; 7° éviter l'érosion, la salinisation et l’arrosage excessif et assurer le control des inondations; 8° s’assurer que les membres maintiennent la fertilité du sol et protègent l'environnement; 9° respecter les droits et les intérêts légaux de tous les propriétaires et de tous les utilisateurs du programme. Article 7: Relations avec le Ministère de l’Agriculture et des Ressources Animales Le Ministère de l’Agriculture et des Ressources Animales, en tant que signataire de l'accord de transfert de gestion d'irrigation au nom du gouvernement, est responsable de la régulation, du suivi et de l'évaluation des performances de toutes les associations d'utilisateurs d’eau d'irrigation. L'association doit fournir toutes les informations demandées par le Ministère de l’Agriculture et des Ressources Animales. Article 8: Relationship with the Cooperatives In irrigation schemes IWUA and cooperative are two independent bodies. Article 10: Relationships with the District The District Authority, as co-signatory entity to the Irrigation Management Transfer Agreement, is responsible for monitoring and evaluation of the performance of all IWUA operating within the District. l’une de l’autre.
