Pursuant to the Constitution of the Republic of Rwanda of 04 June 2003 as amended to date, especially in Articles 118, 119, 120, 121 and 201; Pursuant to Law nº 62/2008 of 10/09/2008 putting in place the use, conservation, protection and management of water resources regulations, especially in Article 16; On proposal by the Minister of Natural Resources; After consideration and approval by the Cabinet, in its session of 14/11/2012; HEREBY ORDERS: CHAPTER ONE: GENERAL PROVISIONS Article One: Purpose of this Order This Order determines the organisation, ARRETE DU PREMIER MINISTRE N°143/03 DU 24/05/2013 DETERMINANT L’ORGANISATION, LE FONCTIONNEMENT ET LA COMPOSITION DE LA COMMISSION NATIONALE CONSULTATIVE DE L’EAU Le Premier Ministre; Vu la Constitution de la République du Rwanda du 04 juin 2003 telle que révisée à ce jour, spécialement en ses articles 118, 119, 121 et 201; Vu la Loi nº 62/2008 du 10/09/2008 fixant les règles d’utilisation, de conservation, de protection et de gestion des ressources en eau, spécialement en son article 16; Sur proposition du Ministre des Ressources Naturelles ; Après examen et adoption par le Conseil des Ministres, en sa séance du 14/11/2012; ARRETE: CHAPITRE PREMIER: DISPOSITIONS GENERALES Article premier: Objet du présent arrêté Le présent arrêté détermine l’organisation, le Official Gazette nº Special of 30/05/2013 11 Ngishwanama ku rwego rw’Igihugu ishinzwe amazi n’abayigize. UMUTWE WA II: IMITERERE Y’INAMA NGISHWANAMA Ingingo ya 2: Inama Ngishwanama Inama Ngishwanama ishinzwe amazi ku rwego rw’Igihugu ni urwego ngishwanama rudafite ubuzima gatozi n’ubwigenge mu mitegekere n’imicungire y’umutungo. Inama Ngishwanama ku rwego rw’Igihugu ishobora gutanga imyanzuro ku bibazo yagishijweho inama kandi ikubahirizwa. Minisiteri ifite umutungo kamere w’amazi mu nshingano zayo ikurikirana iyubahirizwa ry’imyanzuro yatanzwe n’Inama Ngishwanama. Ingingo ya 3: Abagize Inama Ngishwanama Inama Ngishwanama ku rwego rw’Igihugu ishinzwe Amazi igizwe na: 1° Minisitiri ufite umutungo kamere w’amazi mu nshingano ze; 2° Minisitiri ufite gukwirakwiza amazi meza n’ingufu mu nshingano ze; 3° Minisitiri ufite ubuhinzi n’ubworozi mu nshingano ze; functioning and composition of the National Water Consultative Commission. CHAPTER II: ORGANISATION OF THE CONSULTATIVE COMMISSION Article 2: Consultative Commission The National Water Consultative Commission shall be a consultative organ without legal personality and financial and administrative autonomy. The national Consultative Commission may provide its recommendations on issues submitted to it and the recommendations may be implemented. The Ministry in charge of water resources shall make a follow up on the implementation of the recommendations given by the Consultative Commission. Article 3: Composition of the National Consultative Commission The National Water Consultative Commission shall be composed of: 1° the Minister in charge of water resources; 2° the Minister in charge of water supply and Energy; 3° the Minister in charge of agriculture and animal resources; fonctionnement, et la composition de la Commission Nationale Consultative de l’Eau. CHAPITRE II : ORGANISATION DE LA COMMISSION CONSULTATIVE Article 2: Commission Consultative La Commission Nationale Consultative de l’Eau est un organe consultatif sans personnalité juridique, et sans autonomie financière et administrative. La Commission Nationale Consultative peut donner des conseils sur les points qui lui ont été soumis, et qui peuvent être mis en exécution. Le Ministère ayant les ressources en eau dans ses attributions fait le suivi de l’exécution des recommandations données par la Commission Consultative. Article 3 : Composition de la Commission Nationale Consultative La Commission Nationale Consultative de l’Eau est composée de personnes suivantes : 1° le Ministre ayant les ressources en eau dans ses attributions ; 2° le Ministre ayant la distribution de l’eau et de l’énergie dans ses attributions ; 3° le Ministre ayant l’agriculture et l’élevage dans ses attributions ; Official Gazette nº Special of 30/05/2013 12 4° Minisitiri ufite ubutegetsi bw’igihugu mu nshingano ze; 5° Minisitiri ufite gukumira ibiza mu nshingano ze; 6° Minisitiri w’Iingabo z’Igihugu; 7° Umuyobozi Mukuru w’Ikigo gifite imicungire y’amazi mu nshingano zacyo; 8° Umuyobozi Mukuru w’Ikigo cy’igihugu gitsura ubuziranenge; 9° Umuyobozi Mukuru w’Ikigo gifite ikwirakwiza ry’amazi meza n’amashanyarazi mu nshingano zacyo; 10° Umuyobozi Mukuru w’Ikigo gishinzwe ibidukikije ; 11° Umuyobozi Mukuru w’Ikigo cy’Igihugu gishinzwe iterambere; 12° Umuyobozi Mukuru w’Ikigo cy’ubuhinzi n’ubworozi; 13° Uhagarariye abikorera; 14° Uhagarariye za kaminuza zitanga ubumenyi bwihariye mu bijyanye n’amazi; 15° Uhagarariye imiryango itegamiye kuri Leta ikora mu bijyanye n’amazi. 4° the Minister in charge of administration and local government; 5° the Minister in charge of natural disasters management; 6° the Minister of Defense; 7° the Director General of the Authority in charge of water resources management; 8° the Director General of the Rwanda Bureau of Standards; 9° the Director General of the Agency in charge of water supply and energy; 10° the Director General of the Authority in charge of environment; 11° the Chief Executive Officer of Rwanda Development Board; 12° the Director General of Rwanda Agricultural Board; 13° the Representative of the Private Sector; 14° the representative of Universities offering courses related to water; 15° representative of non-governmental organisations working in water sector. 4° le Ministre ayant l’administration locale dans ses attributions ; 5° le Ministre ayant la gestion des catastrophes naturelles dans ses attributions ; 6° le Ministre de la Défense ; 7° le Directeur général de l’agence chargée de la gestion des ressources en eau ; 8° le Directeur Général de l’Office Rwandais de Normalisation; 9° le Directeur Général de l’Autorité ayant la distribution de l’eau et de l’énergie dans ses attributions; 10° le Directeur Général de l’office ayant l’environnement dans ses attributions; 11° le Directeur Général de l’Office Rwandais de Développement ; 12° le Directeur Général de l’Autorité chargé de l’agriculture et l’élevage; 13° le représentant du secteur privé ; 14° le représentant des universités offrant des cours relatifs à l’eau ; 15° le représentant des organisations non gouvernementales œuvrant dans le domaine de l’eau. Official Gazette nº Special of 30/05/2013 13 Ingingo ya 4: Ubuyobozi bw’Inama Ngishwanama Inama Ngishwanama iyoborwa na Minisitiri ufite umutungo kamere w’amazi mu nshingano ze. Mu gihe adahari, yunganirwa na Minisitiri ufite gukwirakwiza amazi meza mu nshingano ze. Umuyobozi w’Ikigo gifite imicungire y’umutungo kamere w’amazi mu nshingano zacyo ni umwanditsi w’Inama Ngishwanama. Ingingo ya 5 : Urwego rureberera Inama Ibiro bya Minisitiri w’Intebe ni byo bireberera Inama Ngishwanama ku rwego rw’igihugu. UMUTWE WA III: IMIKORERE Y’INAMA NGISHWANAMA Ingingo ya 6: Igihe Inama Ngishwanama iterana Inama Ngishwanama iterana rimwe mu mezi atandatu (6) n’ikindi gihe bibaye ngombwa. Inama y’Inama Ngishwanama itumizwa kandi ikayoborwa n’Umuyobozi wayo cyangwa umwungirije mu gihe umuyobozi wayo adahari. Ubutumire bukorwa mu nyandiko bukagezwa ku bagize Inama byibuze iminsi cumi n’itanu (15) mbere y’uko iba. Article 4: Management of the Consultative Commission The Consultative Commission shall be headed by the Minister in charge of water resources. In case of his/her absence, he/she shall be deputised by the Minister in charge of water supply. The Director General of the agency in charge of water resources management shall act as the Secretary of the Consultative Commission. Article 5: Supervising Authority The Office of the Prime Minister shall be the supervising Authority of the National Consultative Commission at the national level. CHAPTER III: FUNCTIONING OF THE NATIONAL CONSULTATIVE COMMISSION Article 6: Meetings of the Consultative Commission The Consultative Commission shall meet once in six (6) months and whenever it is considered necessary. The meeting of the Consultative Commission shall be convened and chaired by its Chairperson or the Vice chairperson in case of absence of the Chairperson. The invitation must reach the members at least fifteen (15) days before the meeting is held. Article 4: Administration de la Commission La Commission consultative est dirigée par le Ministre ayant les ressources en eau dans ses attributions. Il est secondé par le Ministre ayant la distribution de l’eau dans ses attributions. Le Directeur Général de l’agence ayant la gestion des ressources en eau dans ses attributions est le secrétaire de la Commission. Article 5: Autorité de tutelle La Commission Nationale Consultative de l’Eau opère sous la supervision de l’Office du Premier Ministre. CHAPITRE III: FONCTIONNEMENT DE LA COMMISSION NATIONALE CONSULTATIVE Article 6: Réunions de la Commission Consultative La Commission Consultative se réunit une fois tous les six (6) mois et chaque fois qu’il est jugé nécessaire. La réunion de la Commission Consultative est convoquée et dirigée par son président ou son vice-président en cas d’absence du président. L’invitation doit parvenir par écrit aux membres au moins quinze (15) jours avant la tenue de la réunion. Ingingo ya 8: Raporo z’Inama Umuyobozi wa Komisiyo Ngishwanama n’umwanditsi wayo bashyira umukono kuri raporo ikubiyemo imyanzuro y’Inama Ngishwanama mu gihe kitarenze iminsi itanu (5) uhereye ku munsi inama yabereyeho. Umuyobozi wa Komisiyo Ngishwanama ashyikiriza raporo Minisitiri w’Intebe akagenera kopi inzego zirebwa n’imyanzuro yafashwe kugira ngo ziyubahirize. Ingingo ya 9: Ibikenerwa n’Inama Ngishwanama Minisiteri ifite umutungo kamere w’amazi mu nshingano zayo itanga ibikenerwa byose kugira ngo Inama Ngishwanama ishinzwe amazi ku rwego rw’Igihugu irangize inshingano zayo neza. Article 7: Meeting sessions and decision taking The meeting shall be held if at least two thirds (2/3) of the members of the Consultative Commission are present and it shall take decisions on the absolute majority vote of the members present. Article 8: Reports of the meetings The Chairperson and the Secretary of the Consultative Commission shall sign the report containing the recommendations of the Consultative Commission in a period not exceeding five (5) days from the date the meeting is held. The Chairperson shall submit the report of the Consultative Commission to the Prime Minister with copies to the organs in charge of the implementation of the recommendations. Article 9: Logistical requirements of the Consultative Commission The Ministry in charge of water resources shall provide the National Water Consultative Commission with the necessary logistical requirements to enable it to effectively fulfil its responsibilities. Article 7: Séances de réunion et prise de décision La Commission Consultative siège valablement si deux tiers (2/3) de ses membres au moins sont présents et prend les décisions sur vote de la majorité absolue des membres présents. Article 8: Rapports des réunions Les rapports de la Commission Consultative contenant les recommandations doivent être signées par le président et le secrétaire au moins cinq (5) jours après la tenue de la réunion. Le rapport est adressé par le président de la Commission Consultative au Premier Ministre avec copie aux instances concernées par la mise en application des recommandations. Article 9: Besoins de la Commission Consultative Le Ministère ayant les ressources en eau dans ses attributions donne à la Commission Nationale Consultative de l’Eau tout l’appui nécessaire pour lui permettre de remplir ses responsabilités. Article 12: Commencement This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
