Ask the research

Ask in your own words. The answer is the research itself: its records, word for word, with every source and how sure each one is.

USMCA (in force 1 Jul 2020; not renewed at the July 2026 review but still in force) makes Canadian-originating gold under the two dutiable HTS 7108 lines free; doré refined into bars in Canada qualifies (Annex 4-B separation rule). The 10% Section 301 forced-labor tariff on products of Canada (from 24 Jul 2026) does not apply to any HTS 7108 line (Annex II Part A, all economies), though gold scrap and jewellery are not excluded unless USMCA duty-free; the July 2026 Section 338 tariffs cover vehicles, alcohol and dairy only. Canada requires no export declaration for gold going to the US (Reporting of Exported Goods Regulations s.7), and under a 1987 MOU each country uses the other's import data as its export statistics. Even so, the 2024 Comtrade figures for the pair differ by about US$1.9bn.

Where practice departs from the law

What credible sources show happening that the law does not provide for.

  • Although Canada's export statistics to the US are supposed to be US import data, Canada's Comtrade figure for 2024 exceeds the US figure by about 44% by value. Possible explanations (not verified): Canada's Comtrade submission includes re-exports or balance-of-payments adjustments for gold, or classification differences between 7108.12 and 7108.13.
