No. , 2018 SECTIONAL TITLES ACT, 1986: AMENDMENT OF REGULATIONS I, Maite Nkoana- Mashabane, Minister of Rural Development and Land Reform, acting in terms of section 55 of the Sectional Titles Act, 1986 (Act No. 95 of 1986), after consultation with the sectional titles regulation board, hereby amend the Regulations promulgated by Government Notice No. R. 664 of 8 April 1988, as set out in the Schedule hereto. The Regulations will come into operation one month from the date of publication hereof in the Gazette. R. 774 27 JULY 2018 R. 774 Sectional Titles Act (95/1986): Amendment of Regulations 41798 2 SCHEDULE Definitions 1. In this Schedule "the Regulations" mean the Regulations promulgated by Government Notice No. R. 664 of 8 April 1988 (as corrected by Government Notice No. R. 991 of 27 May 1988), as amended. Amendment of regulation 6 2. Regulation 6 of the Regulations is hereby amended by the deletion of paragraph (g). Insertion of regulation 15 A 3. The Regulations are hereby amended by the insertion after regulation 15 of the following regulation: "15A Amendment or withdrawal of unregistered sectional plan (1) A sectional plan may be amended, prior to the registration thereof, only by the Surveyor -General who shall initial such amendment and notify the architect or land surveyor thereof in appropriate circumstances. (2) A draft sectional plan may be amended and initialled only by the land surveyor or architect who prepared such a plan: Provided that the Surveyor -General may in special circumstances initial such amendments and notify the land surveyor or architect thereof in appropriate circumstances. (3) A sectional plan may be withdrawn prior to the registration thereof by the Surveyor -General at the written request of the architect or land surveyor concerned or the owner of the land. ". Amendment of Annexure 1 4. ". Short title 5. These regulations shall be known as the Sectional Titles Amendment Regulations, 2018. Die Regulasies tree in werking een maand vanaf die datum van publikasie hiervan in die Staatskoerant. In hierdie Bylae beteken "die Regulasies" die Regulasies afgekondig by Goewermentskennisgewing No. R. 664 van 8 April 1988 (soos verbeter deur Goewermentskennisgewing No. R. 991 van 27 Mei 1988), soos gewysig. Wysiging van regulasie 6 2. Regulasie 6 van die Regulasies word hierby gewysig deur die skrapping van paragraaf (g). Invoeging van regulasie 15A 3.. Die Regulasies word hierby gewysig deur die invoeging nรก regulasie 15 van die volgende regulasie: "15A Wysiging of onttrekking van ongeregistreerde deelplan (1) `n Deelplan mag voor registrasie daarvan slegs gewysig word deur `n Landmeter -generaal wat sodanige wysiging moet parafeer en die argitek of landmeter in gepaste omstandighede daarvan in kennis moet stel. (2) Wysigings aan `n konsep deelplan mag slegs aangebring en geparafeer word deur die landmeter of argitek wat sodanige plan voorberei het: Met dien verstande dat die Landmenter -generaal sodanige wysigings in spesiale omstandighede mag parafeer en die argitek of landmeter in gepaste omstandighede daarvan in kennis stel. (3) 'n Deelplan mag deur die Landmeter -generaal onttrek word, voor registrasie daarvan, op skriftelike versoek van die betrokke argitek of landmenter of die eienaar van die grond. ".
