Article 1. To ban the import and expo1t of, and trade in, specimens of the following wild fauna species in the appendices to the Convention on International Trade in Decision N o. 11/2013/QD-TT g Endangered Species of Wild Fauna and Flora of January 24, 2013, banning the (CITES), except the cases specified in Article import and export of, and trade in, 2 of this Decision: specimens of a number of wild fauna 1. W hite (square-lipped) rhinoceros species in the appendices to the (Ceratotherium simum) and their products. Convention on International Trade in Endangered Species of Wild 2. Black (hook-lipped) rhinocerous (Diceros Fauna and Flora bicornis) and their products. Pursuant to the December 25, 2001 Law on 3. African elephants (Loxodonta Africana) Organi=ation of the Gorernment; and their products. Pursuant to the December 3, 2004 Law on Article 2. The specimens specified in Forest Protection and Development; Article 1 of this Decision may be imported only when: Pursuant to the Convention on International Trade in Endangered Species of WUd Fauna 1. They are used for foreign affairs, and Flora; scientific research, biodiversity conservation Issue nos 04-05/Februarv 2013 21 (Cong Bao nos 87-90/February 8, 2013) facilities, display at zoos; exhibitions and circus performances not for commercial purposes; law enforcement; and exchange among CITES management authorities of member count:Iies. 2. They are not used for commercial purposes and are eligible for import under the cooperation agreements between the CITES management autholity of Vietnam and CITES management authorities of countries of expo1t. 3. They had been granted CITES import permits before the effective date of this Decision.
Article 3. Handling of violations Organizations and individuals that violate this Decision shall, depending on the nature and seiiousness of their violations, be criminally or administ:I·atively handled under cmTent laws on management, protection, trade in, transpo1t, import and export of wild fauna and flora species.
Article 4. Implementation provisions 1. This Decision takes effect on March 15, 2013. 2. Ministers, heads of ministelial agencies, heads of government-attached agencies, and chairpersons of provincial-level People's Committees shall implement this Decision.- Prime Minister NGUYEN TAN DUNG
