11/23/2018 友善列印 https://www.fa.gov.tw/cht/print.aspx 1/3 ⿁蝠魟漁獲管制措施 ⾏政院農業委員會公告 發文⽇期：中華⺠國107年7⽉17⽇ 發文字號：農漁字第1071327747A號 主旨：修正「⿁蝠魟漁獲管制措施」，名稱並修正為「⿁蝠魟屬漁獲管制措施」（如附件），並⾃中華⺠ 國⼀百零七年八⽉⼗五⽇⽣效。 依據：「漁業法」第四⼗四條第⼀項第⼀款及第九款。 ⾏政院農業委員會公告 發文⽇期：中華⺠國105年5⽉24⽇ 發文字號：農漁字第1051326553A號 主 旨：訂定「⿁蝠魟漁獲管制措施」（如附件），並⾃中華⺠國⼀百零五年七⽉⼀⽇⽣效。 依 據：漁業法第四⼗四條第⼀項第九款。 ⿁蝠魟屬漁獲管制措施（107.08.15⽣效） ⼀、⾏政院農業委員會（以下簡稱本會）為保育我國沿近海域⿁蝠魟屬⽣物資源永續，特依漁業法第四⼗ 四條第⼀項第⼀款及第九款規定，訂定本管制措施。 ⼆、禁⽌捕撈⿁蝠魟屬物種。意外捕獲⿁蝠魟屬物種者，不論其尚存活或已死亡，應立即放回海中。 三、漁業⼈或漁業從業⼈意外捕獲⿁蝠魟屬物種時，應於返港後⼀⽇內，填具「意外捕獲⿁蝠魟屬物種通 報表」（如附件），以傳真⽅式向下列機關（單位）通報： (⼀)當地直轄市、縣（市）政府漁業主管單位。 (⼆)本會漁業署（傳真電話：（○⼆）⼆三三⼆七五三六）。 (三)國立臺灣海洋⼤學環境⽣物與漁業科學系⽔產資源研究室（傳真電話：（○⼆）⼆四六⼆三九八 六或⼆四六⼆○⼆九⼀）。 四、為供國內教學或科學研究⽤，經本會漁業署核准捕撈⿁蝠魟屬物種者，不受第⼆點規定之限制。 五、違反第⼆點規定者，移送司法機關依漁業法第六⼗條第⼆項規定，處三年以下有期徒刑、拘役或科或 併科新臺幣⼗五萬元以下罰⾦。 違反第三點所定通報義務者，依漁業法第六⼗五條第六款規定，核處新臺幣三萬元以上⼗五萬元以下 罰鍰。 漁業⽬ 11/23/2018 友善列印 https://www.fa.gov.tw/cht/print.aspx 2/3 11/23/2018 友善列印 https://www.fa.gov.tw/cht/print.aspx 3/3 Top
