TAŞAR Kültür Bakanı Turizm Bakanı Orman Bakanı Çevre Bakanı Nesli Tehlikede Olan Yabani Hayvan ve Bitki Türlerinin Uluslararası Ticaretine İlişkin Sözleşme 3 Mart 1973'te Washington, DC de İmzalanmıştır Sözleşmeci Devletler, Yabani hayvan ve bitkilerin çok çeşitli ve güzel biçimleriyle yeryüzünün doğal sistemle­ rinin yeri doldurulamaz bir parçası olduğunu ve gerek mevcut gerekse gelecek kuşaklar için ko­ runmasının zorunlu olduğunu kabul ederek; Yürütme ve idare Bölümü Sayfa : 14 20 Haziran 1996 - Say ı : 22672 RESMİ G A Z E T E Sayfa: 17 Yabani hayvan ve bitkilerin estetik, bilim, kültür, eğlence-dinlenme ve ekonomi açısından gittikçe artan değerinin bilincinde olarak; Toplumların ve Devletler'in kendi yabani hayvan ve bitki varlıklarının en iyi koruyucula­ rının yine kendilerinin olduğunu ve olması gerektiğini kabul ederek; Ayrıca, bazı yabani hayvan ve bitki türlerinin, uluslararası ticaretin yol açtığı aşın kulla­ nıma karşı korunması için uluslararası işbirliğinin gerekli olduğunu kabul ederek; Uygun önlemlerin ivedilikle alınması gerektiğine inanarak Aşağıdaki konularda anlaşmaya varmışlardır : M A D D E I Tanımlar İş bu Sözleşme'de, içeriği aksini gerektirmedikçe, aşağıdaki terimler karşılarında yazılı an­ lamlarda kullanılacaktır : (a) "Tür", herhangi bir tür veya alt-tür, veya bunun coğrafi olarak ayrı bir popülasyonu anlamına gelir; (b) "Örnek" : (i) Canlı veya ölü herhangi bir hayvan veya bitki; (ii) Hayvanlarla ilgil i olarak : Ek I ve II kapsamındaki türler için, bunların kolayca tanı­ nabilir herhangi bir parçası veya türevi; Ek III kapsamındaki türler için, söz konusu türlerin Ek III'te belirtilen, kolaylıkla tanınabilir herhangi bir parçası veya bunların türevi; ve (iii) Bitkilerle i lgi l i olarak : Ek I kapsamındaki türler için, bunların kolaylıkla tanınabilir herhangi bir parçası veya türevi; ve Ek II ve III kapsamındaki türler için, bunların kolaylıkla tanı­ nabilir ve türlere ilişkin olarak Ek II ve III'te belirtilen herhangi bir parçası veya türevi anlamına gelir. (c) "Ticaret", ihracat, reeksport ithalat ve denizden giriş anlamına gelir; (d) "Reeksport", ithal edilmiş herhangi bir örneğin ihracı anlamına gelir; (e) "Denizden giriş", herhangi bir Devlet'in yetki alanında olmayan bir deniz çevresinden alınan herhangi bir türün örneklerinin bir Devlet'e sevk edilmesi anlamına gelir; (f) "Bilimsel Merci", Madde IX uyarınca belirlenen ulusal bilim mercii anlamına gelir; (g) "Yönetim Mercii", Madde IX 'a uygun olarak belirlenen ulusal yönetim mercii anla­ mına gelir; (h) "Taraf, işbu Sözleşme'nin yürürlüğe girmiş olduğu bir Devlet anlamına gelir. M A D D E II Temel İlkeler 1. Ek I, ticaretten etkilenen veya etkilenebilen ve nesli tükenme tehlikesiyle karşı karşıya bulunan bütün türleri kapsayacaktır. Nesillerinin devamını daha fazla tehlikeye maruz bırakma Yürütme ve İdare Bölümü Sayfa : 15 Sayfa: 18 RESMİ G A Z E T E 20 Haziran 1996 - Say ı : 22672 mak için bu türlerin örneklerinin ticaretinin özellikle sıkı mevzuatlara tabi tutulması ve bu ticare­ te sadece istisnai durumlarda izin verilmesi zorunludur. 2. Ek I I : (a) Halen nesilleri mutlak olarak tükenme tehlikesiyle karşı karşıya olmamakla birlikte, nesillerinin devamıyla bağdaşmayan kullanımları önlemek amacıyla örneklerinin ticareti sıkı mevzuatlara tabi tutulmadığı takdirde soyu tükenebilecek olan türleri; ve (b) bu fıkranın (a) bendinde bahis edilen belirli türlerin örneklerinin ticaretinin etkili şe­ kilde denetim altına alınabilmesi için mevzuata tabi tutulması gereken diğer türleri kapsar. 3. Ek III, Taraflar'dan herhangi birinin, kullanımını önlemek veya kısıtlamak amacıyla kendi yetki alanı içinde düzenlemeye tabi tutulduğunu ve ticaretinin denetime alınmasında diğer Taraflar'la işbirliğine ihtiyaç duyduğunu belirttiği bütün türleri kapsar. 4. Taraflar, Ek I, II ve III kapsamındaki türlerin örneklerinin ticaretine, işbu Sözleşme'nin hükümlerine uygun olmadıkça izin vermeyeceklerdir. M A D D E III Ek I Kapsamındaki Türlerin Örneklerinin Ticaret Mevzuatı 1. Ek I kapsamındaki türlerin örneklerinin her türlü ticareti işbu Madde'nin hükümlerine uygun şekilde yapılacaktır. 2. Ek I kapsamındaki bir türün herhangi bir örneğinin ihraç edilebilmesi için önceden ih­ racat izni alınacak ve alınan izin belgesi ibraz edilecektir. İhracat izni, ancak aşağıdaki şartlar ye­ rine getirildiği takdirde verilecektir. (a) İhracat işlemini yapan Devlet'in Bilimsel Mercii 'nin, söz konusu ihracatın, ilgili tü­ rün soyunun devamına zarar vermeyeceğini bildirmiş olması; (b) İhracat işlemini yapan Devlet'in Yönetim Mercii 'nin, bu örneğin söz konusu Dev­ let'in hayvan ve bitki varlığının korunmasına ilişkin kanunları ihlal edilmeksizin elde edilmiş ol­ duğuna kanaat getirmesi; (c) İhracat işlemini yapan Devlet'in Yönetim Mercii 'nin, herhangi bir canlı örneğin, ya­ ralanma, sağlık bakımından zarar görme ve zalimce davranışa maruz kalma rizikosunu en aza in­ direcek şekilde hazırlanacağı ve sevk edileceğine kanaat getirmesi; ve (d) İhracat işlemini yapan Devlet'in Yönetim Mercii 'nin, söz konusu örnek için ithalat iz­ ninin alınmış olduğuna kanaat getirmesi. 3. Ek I kapsamındaki bir türün herhangi bir örneğinin ithali için ithalat izninin yanı sıra ihracat izni ya da reeksport belgesinin önceden alınması ve bunların ibraz edilmesi şarttır. İthalat izni ancak, aşağıdaki şartlar yerine getirildiği takdirde verilecektir : (a) İthalat işlemini yapan Devlet'in Bilimsel Mercii'nin, ithalatın, ilgili türün soyunun de­ vamına zarar vermeyecek bir amaç için yapılacağını bildirmiş olması; (b) İthalat işlemini yapan Devlet'in Bilimsel Mercii'nin, canlı örneğin önerilen alıcısının, bu örneğin bakımı ve barındırılması için uygun donanıma sahip olduğuna kanaat getirmesi; ve (c) İthalat işlemini yapan Devlet'in Yönetim Mercii'nin, örneğin esas olarak ticari amaç­ larla kullanılmayacağına kanaat getirmesi. 4. Ek I kapsamındaki bir türün herhangi bir örneğinin reeksport edilebilmesi için önceden reeksport belgesi alınması ve bu belgenin ibraz edilmesi şarttır. Reeksport belgesi ancak aşağıda­ k i şartlar yerine getirildiği takdirde verilecektir : Yürütme ve idare Bolümü Sayfa : 16 20 Haziran 1 9 9 6 - S a y ı : 22672 RESMİ G A Z E T E Sayfa: 19 (a) Reeksport işlemini yapan Devlet'in Yönetim Mercii 'nin, örneklerin işbu Sözleş me'nin şartlarına uygun olarak söz konusu Devlet'e ithal edilmiş olduğuna kanaat getirmesi; (b) Reeksport işlemini yapan Devlet'in Yönetim Mercii'nin, canlı örneğin yaralanma, sağlık bakımından zarar görme ve zalimce davranışa maruz kalma rizikosunu en aza indirecek şe­ kilde hazırlanacağı ve sevk edileceğine kanaat getirmesi; ve (c) Reeksport işlemini yapan Devlet'in Yönetim Mercii 'nin canlı örnek için ithalat izni verilmiş olduğuna kanaat getirmesi. 5. Ek I kapsamındaki bir türün herhangi bir örneğinin denizden girişi için, söz konusu ör­ nek hangi Devlet'in topraklarına getirildiyse o Devlet'in Yönetim Mercii'nden önceden belge alınmış olması şarttır. Bu belge, ancak aşağıdaki şartlar yerine getirildiği takdirde verilecektir. (a) Giriş yapılan Devlet'in Bilimsel Mercii 'nin, bu girişin ilgil i türün soyunun devamına zarar vermeyeceğini bildirmesi; (b) Giriş yapılan Devlet'in Yönetim Mercii 'nin, canlı örneğin önerilen alıcısının bu örne­ ğin barındırılması ve bakımı için uygun donanıma sahip olduğuna kanaat getirmesi; ve (c) Giriş yapılan Devlet'in Yönetim Mercii 'nin örneklerin esas olarak ticari amaçlarla kullanılmayacağına kanaat getirmesi. M A D D E IV Ek II Kapsamındaki Türlerin Örneklerinin Ticaret Mevzuatı 1. Ek II kapsamındaki türlerin örneklerini konu alan her türlü ticaret, işbu Madde'nin şart­ larına uygun olarak yapılacaktır. 2. Ek II kapsamındaki bir türün herhangi bir örneğinin ihraç edilebilmesi için önceden ih­ racat izni alınması ve bu iznin ibraz edilmesi şarttır. İhracat izni ancak, aşağıdaki şartlar yerine ge­ tirildiği takdirde verilecektir. (a) İhracat işlemini yapan Devlet'in Bilimsel Mercii'ne bu ihracatın, söz konusu türün so­ yunun devamına zarar vermeyeceğini bildirmesi; (b) İhracat işlemini yapan Devlet'in Yönetim Mercii 'nin, söz konusu örneğin, i lgil i Dev­ let'in hayvan ve bitki varlığının korunmasına ilişkin yasaları ihlal edilmeksizin elde edilmiş oldu­ ğuna kanaat getirmesi; (c) Canlı bir örnek söz konusuysa, İhracat işlemini yapan Devlet'in Yönetim Mercii 'nin söz konusu örneğin yaralanma, sağlık bakımından zarar görme ve zalimce davranışa maruz kalma rizikosunu en aza indirecek şekilde hazırlanacağına ve sevk edileceğine kanaat getirmesi. 3. Tarafların her birindeki Bilimsel Merci, hem Ek II kapsamındaki türün örnekleri için o Devlet tarafından verilen ihracat belgelerini ve hem de bu örneklerin fii l i ihracatlarını izleyecek­ tir. Bilimsel Merci, söz konusu türün varlığını bütün çeşitleriyle birlikte, içinde bulunduğu ekosis temdeki rolüne tamamen uygun olarak ve Ek I kapsamına alınmasını gerektirebilecek düzeyin önemli ölçüde ötesinde bir düzeyde sürdürebilmesi için, bu durumdaki türün örneklerinin ihraca­ tının kısıtlanması gerektiğini tespit ettiği takdirde, söz konusu türe ait örneklerle ilgil i ihracat izin­ lerinin sınırlandırılmasına yönelik uygun tedbirleri i lgil i Yönetim Mercii'ne bildirecektir. 4. Ek II kapsamındaki bir türün herhangi bir örneğinin ithali için önceden ihracat izni ve­ ya reeksport belgesinin alınmış olması ve bu belgenin ibrazı şarttır. 5. Ek II kapsamındaki bir türün herhangi bir örneğinin reeksport edilebilmesi için önce­ den reeksport belgesi alınması ve bu belgenin ibraz edilmesi şarttır. Reeksport belgesi ancak aşa­ ğıdaki şartlar yerine getirildiği takdirde verilecektir. (a) Reeksport işleminin yapılacağı Devlet'in Yönetim Mercii'nin, örneğin işbu Sözleş me'nin hükümlerine uygun olarak söz konusu Devlet'e ithal edilmiş olduğuna kanaat getirmesi; ve Yürütme ve idare Bölümü Sayfa : 17 Sayfa : 20 RESMİ G A Z E T E 20 Haziran 1996 - Say ı : 22672 (b) Reeksport işleminin yapılacağı Devlet'in Yönetim Mercii 'nin, canlı örneğin yaralan­ ma, sağlık bakımından zarar görme ve zalimce davranışa maruz kalma rizikosunu en aza indire­ cek şekilde hazırlanacağı ve sevk edileceğine kanaat getirmesi. 6. Ek II kapsamındaki bir türün herhangi bir örneğinin denizden girişi için, söz konusu ör­ nek hangi Devlet'in topraklarına getirildiyse o Devlet'in Yönetim Mercii'nden önceden belge alınmış olması şarttır. Bu belge, ancak aşağıdaki şartlar yerine getirildiği takdirde verilecektir. (a) Giriş yapılan Devlet'in Bilimsel Mercii 'nin, bu girişin ilgil i türün soyunun devamına zarar vermeyeceğini bildirmesi; ve (b) Giriş yapılan Devlet'in Yönetim Mercii 'nin, herhangi bir canlı örnek söz konusuysa bu örneğin yaralanma, sağlık bakımından zarar görme ve zalimce davranışa maruz kalma riziko­ sunu en aza indirecek şekilde muamele göreceğine kanaat getirmesi. 7. İşbu Maddenin 6 ncı paragrafında sözü geçen belgeler, diğer ulusal bilim mercileri ve­ ya gereğinde uluslararası bilim mercileri ile istişarede bulunulmak suretiyle, Bilimsel Merci ' in tavsiyesi üzerine bir yılı aşmayan süreler için ve söz konusu süre içinde girişi yapılacak toplam örnek sayısına ilişkin olarak verilebilir. M A D D E V Ek III Kapsamındaki Türlerin Örneklerinin Ticaret Mevzuatı 1. Ek III kapsamındaki türlerin örneklerini konu alan her türlü ticaret, işbu Madde'nin şartlarına uygun olarak yapılacaktır. 2. Herhangi bir türü ek III kapsamına dahil etmiş olan bir Devlet'ten söz konusu türün herhangi bir örneğinin ihraç edilebilmesi için önceden ihracat izni alınması ve bu iznin ibraz edil­ mesi şarttır. Bu ihracat izni ancak, aşağıdaki şartlar yerine getirildiği takdirde verilecektir. (a) İhracat işlemini yapan Devlet'in Yönetim Mercii'nin, söz konusu örneğin ilgili Dev­ let'in hayvan ve bitki varlığının korunmasına ilişkin yasaları ihlal edilmeksizin elde edilmiş oldu­ ğuna kanaat getirmesi; (b) Canlı bir örnek söz konusuysa, İhracat işlemini yapan Devlet'in Yönetim Mercii 'nin söz konusu örneğin yaralanma, sağlık bakımından zarar görme ve zalimce davranışa maruz kalma rizikosunu en aza indirecek şekilde hazırlanacağına ve sevk edileceğine kanaat getirmesi. 3. Ek III kapsamındaki bir türün herhangi bir örneğinin ithal edilebilmesi için, işbu mad­ denin 4 üncü paragrafının uygulandığı durumlar hariç, menşe şahadetnamesi ile söz konusu örnek ilgili türü Ek III kapsamına dahil etmiş olan bir devlet'ten ithal edilecekse ihracat izninin önceden ibraz edilmesi şarttır. 4. Reeksport durumunda, o örneğin reeksportu yapan Devlet'te işlem gördüğüne veya o Devlet'ten reeksport edildiğine ilişkin olarak reeksport yapan Devlet'in Yönetim Mercii tarafın­ dan verilen bir belge, ithalatı yapan Devlet tarafından söz konusu örnek bakımından işbu Sözleş­ me'nin hükümlerine uyulmuş olduğunun kanıtı olarak kabul edilecektir. M A D D E VI İzinler ve Belgeler 1. Madde III, IV ve V ' i n hükümleri çerçevesinde verilen izin ve belgelerin işbu Madde­ nin hükümlerine uygun olması gerekir. 2. İhracat izni, Ek IV'teki modelde belirtilmiş bilgiyi kapsayacak ve verildiği tarihten iti­ baren yalnız 6 aylık bir süre içinde kullanılabilecektir. 3. Her izin veya belgede işbu Sözleşme'nin adının, tanzim eden Yönetim Mercii 'nin adı ile mührünün ve Yönetim Mercii tarafından tespit edilmiş bir kontrol numarasının bulunması şart­ tır. Yönetim Mercii tarafından verilen izin veya belgenin suretleri üzerinde sadece suret ol­ duğunun açıkça belirtilmesi şart olup onaylanmamış hiçbir suret aslının yerine kullanılamaz. 5. Her örneğin şevki için ayrı bir izin veya belge gereklidir. 6. Herhangi bir örneğin ithal edildiği Devlet'in Yönetim Mercii ihracat izni veya reeks­ port belgesini ve o örneğin ithaliyle ilgil i olarak ibraz edilen ithalat iznini iptal ve muhafaza ede­ cektir. 7. Mümkün ve uygun olan durumlarda Yönetim Mercii, örneğin tespitine yardımcı olmak için örneği işaretleyebilir. Bu maksatla "işaret" kelimesi yetkili olmayan şahıslar tarafından taklit edilmesi mümkün olduğu kadar güç olacak şekilde tasarlanmış sabit bir damga, kurşun mühür ve­ ya örneğin tespitine yarayan diğer uygun araçlar anlamına gelir. M A D D E VII Ticaretle İlgili Muafiyetler ve Diğer Özel Hükümler 1. Örneklerin Taraflar'dan birinin sınırları içinden transit geçişi veya aktarılması sırasın­ da örnekler gümrük kontrolundayken III., IV. ve V. Maddelerin hükümleri uygulanmaz. 2. İhracatın veya reeksportun yapıldığı Devlet'in Yönetim Mercii 'nin, bir örneğin işbu Sözleşme'nin o örnekle i lgi l i hükümlerinin uygulanmaya başlamasından önce alındığına kanaat getirmesi ve bu hususta bir belge vermesi durumunda III, IV ve V. maddelerin hükümleri söz ko­ nusu örneğe uygulanmaz. 3. I l l , IV ve V. maddelerin hükümleri zati eşya veya ev eşyası sayılan örneklere uygulan­ maz. Bu muafiyet aşağıdaki durumlarda uygulanmaz. a) Ek I kapsamındaki bir türün örnekleri söz konusu olduğunda, örneklerin sahibi bu ör­ nekleri olağan olarak ikamet ettiği ülkenin dışında almış olup, olağan olarak ikamet ettiği Devle­ te ithal ediyorsa; veya b) Ek II kapsamında bir türün örnekleri söz konusu olduğunda : i) Örneklerin sahibi bu örnekleri olağan olarak ikamet ettiği ülkenin dışındaki bir Dev let'te yabani ortamdan ayırmışsa; ii) Örnekler, örnek sahibinin olağan olarak ikamet ettiği ülkeye ithal ediliyorsa; ve iii) Örnekler hangi Devlet'in sınırları içinde yabani ortamdan alınmışsa o Devlet'ten bu örneklerin ihracından önce ihracat izni alınması gerekir. Ancak k i , Yönetim Mercii örneklerinin işbu sözleşmenin hükümlerinin, bu örneklere uy­ gulanmasından önce alındığına kanaat getirirse. 4. Ek I kapsamındaki bir hayvan türünün ticari amaçla tutsak olarak yetiştirilmiş örnek­ leri ile Ek I kapsamındaki bir bitki türünün ticari amaçla suni yolla üretilmiş örnekleri, Ek II kap­ samındaki türlerin örnekleri sayılacaktır. 5. İhracatçı Devlet'in Yönetim Mercii bir hayvan türünün herhangi bir örneğinin tutsak olarak yetiştirildiği veya bir bitki türünün herhangi bir örneğinin suni yolla üretildiği, veya örne­ ğin bu şekilde yetiştirilmiş bir hayvan veya bitkinin bir parçası olduğuna veya bu şekilde yetişti­ rilmiş veya çoğaltılmış bir bitki veya hayvandan türetilmiş olduğuna kanaat getirmişse, Yönetim Mercii 'nin bu hususta vereceği bir belge III, IV ve V. Maddelerinin hükümleri uyarınca istenen bir izin veya belge yerine geçecektir. 6. III, IV ve V. Maddelerin hükümleri, kurutulmuş bitki koleksiyonu (herbarium) örnek­ lerinin, muhafaza edilmiş kurutulmuş veya mahfaza içine konulmuş diğer müze örneklerinin ve Yönetim Mercii tarafından verilmiş veya onaylanmış bir etiket taşıyan canlı bitki materyalinin, ül­ kelerinin Yönetim Mercii tarafından tescil edilmiş enstitüler ve bilim adamları arasında ticari ol­ mayan amaçlarla ödünç verilmesine ve hibe veya mübadele edilmesine uygulanmaz. 7. Herhangi bir Devlet'in Yönetim Mercii, aşağıdaki şartlar sağlandığı takdirde III. M A D D E VIII Taraflarca Alınacak Tedbirler 1. Taraflar işbu Sözleşme'nin hükümlerinin uygulanmasını ve türlerin işbu Sözleşme'ye aykırı şekilde ticarete konu olmasını yasaklamak üzere uygun tedbirleri alacaklardır. Bu tedbirler : a) Bu örneklerin ticaretini veya bulundurulmasını veya hem ticaretini hem de bulundurul­ masını cezalandırmaya ve b) Bu örneklerin ihraç eden Devlet'e müsaderesini veya geri gönderilmesini sağlamaya yönelik olacaktır. 2. İşbu Madde'nin 1. fıkrası uyarınca alınan tedbirlere ek olarak Taraflar'dan biri, gerek gördüğünde, işbu Sözleşme'nin uygulanmasında alınan tedbirlerin ihlali suretiyle ticareti yapılan bir örneğin müsaderesi nedeniyle yapılan masraflarla ilgili olarak herhangi bir iç tazmin usulü ön­ görebilir. 3. Taraflar, örneklerin ticareti halinde gerekli işlemlerden mümkün olduğunca en az gecik­ meyle geçmelerini temin edeceklerdir. Bu geçişi kolaylaştırmak için Taraflar örneklerin gümrük iş­ lemlerinin yapılacağı giriş ve çıkış limanlarını belirleyebilirler. Ayrıca Taraflar, yaralanma ve sağ­ lık bakımından zarar görme rizikolarını en aza indirmek için tüm canlı örneklerin transit, bekletil­ me ve sevkiyat esnasında uygun muamele görmelerini temin edeceklerdir. 4. Canlı bir örneğin bu maddenin 1. fıkrasında belirtilen tedbirlerin bir sonucu olarak mü­ sadere edilmesi halinde : a) Örnek, müsaderenin yapıldığı Devlet'in Yönetim Mercii'ne emanet edilecektir; b) Yönetim Mercii, ihracat işlemini yapan Devlet'le görüşmeler yaptıktan sonra masraf­ ları ihracat işlemini yapan Devlet'e ait olmak üzere örneği ihracat işlemini yapan Devlet'e iade ede­ cek veya bu koruma merkezine ya da Yönetim Mercinin uygun gördüğü ve işbu Sözleşme'nin amaçlarına uygun olan diğer bir yere gönderecektir; ve c) Yönetim Mercii, koruma merkezi veya başka bir yerin seçimi dahil bu fıkranın (b) ben­ dinde sözü edilen kararı kolaylaştırmak için Bilimsel Merci'den tavsiye alabilecek veya uygun gör­ düğünde Sekreterya'ya başvurabilecektir. 5. Bu maddenin 4. fıkrasında sözü geçen koruma merkezi, canlı örneklerin özellikle, mü­ sadere edilmiş olanların sağlığı ile ilgilenmek üzere Yönetim Mercii tarafından tayin edilen bir ku­ rum anlamına gelir. 6. Taraflar'dan her biri, Ek 1, II ve III kapsamındaki türlerin örneklerinin ticareti ile ilgili kayıtları tutacaktır. Bu kayıtlar : a) İhracatçı ve ithalatçının adı ve adresi, b) Verilen izin ve belgelerin tipi ve sayısı; Ticaretin yapıldığı Devlet; örneklerin sayıları veya miktarları ve tipleri, Ek I, II ve IlI'de belirtilen türlerin isimleri; uygun olduğunda söz konu­ su örneklerin büyüklüğü ve cinsiyetini kapsayacaktır. 7. Taraflar'dan her biri işbu Sözleşme'nin uygulanması ile ilgili dönemsel raporlar düzen­ leyecek ve sekreteryaya : Yürütme ve idare Bölümü Sayfa : 20 20 Haziran 1996 - Say ı : 22672 RESMİ G A Z E T E Sayfa: 23 a) Bu maddenin 6. paragrafının (b) alt paragrafında belirtilen bilgilerin özetini içeren bir yıllık rapor; ve b) İşbu Sözleşme hükümlerinin uygulanması için alınan kanuni, düzenleyici tedbirleri ko­ nusunda iki yılda bir rapor verecektir. 8. Bu maddenin 7. fıkrasında sözü geçen bilgiler ilgili Tarafın kanunlarına ters düşmedi­ ği durumlarda halkın kullanımına açık olacaktır. M A D D E IX Bilimsel ve Yönetim Mercileri 1. Taraflar'ın her biri, işbu Sözleşme'nin amaçları için : a) İlgili Taraf adına izin veya belgeleri vermeye yetkili bir veya birkaç Yönetim Mercii; ve b) Bir veya birkaç Bilimsel Merci tayin edecektir. 2. Tasdik, kabul, onay veya katılım belgeleri tevdi eden bir Devlet diğer Taraflar veya Sek reterya ile haberleşmeye yetkili Yönetim Mercii'nin adını ve adresini Depoziter Hükümete bildire­ cektir. 3. Bu madde çerçevesindeki atama ve yetkilerdeki herhangi bir değişiklik tüm diğer Taraf lar'a iletilmek üzere ilgili tarafça Sekreterya'ya bildirilecektir. 4. Bu maddenin 2. fıkrasında sözü geçen herhangi bir merci, şayet Sekreterya veya diğer bir Tarafın Yönetim Mercii talep ederse ona, izin ve belgelerin doğruluğunu ispat etmek için kul­ lanılan damga, mühür veya diğer işaretlerin örneğini gönderecektir. M A D D E X Sözleşme'ye Taraf Olmayan Devletlerle Ticaret İhracat veya reeksportun işbu Sözleşme'ye Taraf olmayan bir Devlete yapıldığı veya itha­ latın böyle bir Devlet'ten yapıldığı durumlarda, işbu Sözleşme'nin hükümlerine esas itibariyle uy­ gun olan ve o Devlet'teki yetkili merciler tarafından verilmiş benzer dokümantasyon Taraflar'dan herhangi birince izin veya belge yerine kabul edilebilir. M A D D E X I Taraflar'ın Konferansı 1. İşbu Sözleşme'nin yürürlüğe girmesinden itibaren en geç iki yıl içinde Sekreterya, Ta raflar'ı Konferansa çağıracaktır. 2. Daha sonra Sekreterya, konferans aksine karar almadıkça, en az iki yılda bir olağan toplantı ve Tarafların en az üçte birinin yazılı talebi üzerine herhangi bir zamanda olağanüstü top­ lantı çağrısında bulunacaktır. 3. Olağan veya olağanüstü her ik i çeşit toplantıda Taraflar işbu Sözleşme'nin uygulama­ sını gözden geçirecekler ve ayrıca : (a) Sekreterya'nın görevlerini yürütebilmesi için gerekli işlemleri yapabilecek ve mali hu­ suslara ilişkin hükümleri kabul edebilecekler; (b) 15. madde uyarınca Ek I ve II deki değişiklikleri inceleyip kabul edebilecekler; (c) Ek I, II ve III deki türlerin ihyası ve muhafazasına yönelik gelişmeleri, gözden geçi­ rebilecekler; (d) Sekreterya veya Taraflar'dan herhangi birince sunulan raporları ele alıp inceleyebile­ cek; ve Yürütme ve İdare Bölümü Sayfa : 21 Sayfa: 24 RESMÎ G A Z E T E 20 Haziran 1996 - Say ı : 22672 (e) Uygun olduğunda, işbu Sözleşme'nin etkinliğini artırmak için tavsiyelerde bulunabi­ lecektir. 4. Her olağan toplantıda Taraflar bu Madde'nin 2. fıkrasındaki hükümlere uygun olarak bir sonraki olağan toplantının zamanını ve yerini tespit edebilirler. 5. Herhangi bir toplantıda Taraflar, toplantı usulünü tespit ve kabul edebilirler. 6. İşbu Sözleşme'ye taraf olmayan herhangi bir Devlet'in yanı sıra Birleşmiş Milletler, Birleşmiş Milletler 'in Uzmanlık Kuruluşları ve Uluslararası Atom Enerjisi Ajansı, Konferans top­ lantılarında gözlemcileri vasıtasıyla temsil edilebilecek fakat bu gözlemcilerin oy hakkı bulunma­ yacaktır. 7. Yabani hayvan ve bitkilerin korunması, muhafazası ve yönetiminde teknik yönden yet­ kili olan ve Sekreterya'ya Konferans toplantılarında gözlemciler tarafından temsil edilmeyi arzu ettiklerini bildiren aşağıdaki kategorilerdeki kurum veya kuruluşlar, toplantıda hazır bulunan Ta­ raflar'dan en az üçte biri itiraz etmedikçe toplantıya kabul edilecektirler: (a) Resmi veya gayri resmi uluslararası kurum veya kuruluşlar ve resmi ulusal kurum ve­ ya kuruluşlar; ve (b) Bulundukları Devlet tarafından bu amaç için onaylanmış olan gayri resmi ulusal ku­ rum ve kuruluşlar. Kabul edilen bu gözlemcilerin toplantıya katılma hakkı olacak fakat oy haklan bulunma­ yacaktır. M A D D E XII Sekreterya 1. İşbu Sözleşme'nin yürürlüğe girmesinden sonra Birleşmiş Milletler Çevre Programı İc­ ra Direktörü tarafından bir Sekreterya sağlanacaktır. Uygun hükümetler arası veya gayriresmi, uluslararası veya ulusal kuruluşlar ve yabani hayvan ve bitki varlığının korunması, muhafazası ve yönetiminde teknik bakımdan ehil olan kuruluşlar İcra Direktörü'ne, İcra Direktörü'nün uygun gördüğü ölçüde ve şekilde yardımcı olabilirler. 2. Sekreterya'nın görevleri şunlar olacaktır: (a) Taraflar'ın toplantılarını düzenlemek ve toplantılara hizmet vermek; (b) İşbu Sözleşme'nin X V . ve X V I . maddelerindeki hükümler çerçevesinde kendisine ve­ rilen görevleri yerine getirmek; (c) Canlı örneklerin uygun olarak hazırlanması ve nakliyesine ilişkin standartlar ve örnek­ lerin tespit şekilleri ile i lgil i çalışmalar dahil olmak üzere işbu Sözleşme'nin uygulanmasına kat­ kıda bulunacak bilimsel ve teknik çalışmaları Taraflar'ın konferansı'nca onaylanan programlara uygun olarak yürütmek; (d) Taraflar'ca hazırlanan raporları incelemek ve işbu Sözleşme'nin uygulanmasını temin için gerekli görülen ilave bilgileri Taraflar'dan istemek; (e) İşbu Sözleşme'nin amaçlan ile i lgil i hususlara Taraflar'ın dikkatini çekmek; (f) Ek I, II ve III'ün güncel baskılarını bu Ekler ' in kapsamındaki türlere ait örneklerin be­ lirlenmesini kolaylaştıracak bilgilerle birlikte dönemsel olarak yayımlayarak Taraflar'a dağıtmak; (g) Gerek işbu Sözleşme'nin uygulanması gerekse kendi çalışmaları ile ilgili yıllık rapor­ lar ile Taraflar'ın aralarında yapacakları toplantılarda istenebilecek diğer raporları hazırlayarak Taraflar'a sunmak; (h) Bilimsel ve teknik konularda bilgi alışverişi de dahil olmak üzere işbu Sözleşme'nin amaç ve hükümlerinin uygulanması için tavsiyelerde bulunmak; (i) Taraflar'ca kendisine verilebilecek diğer görevleri yerine getirmek. Sekreterya, aldığı bilgilerin ışığında, Ek I veya II kapsamındaki herhangi bir türün, bu türün örneklerinin ticaretinden olumsuz biçimde etkilendiği veya işbu Sozleşme'nin hükümlerinin etkili biçimde uygulanmadığına kanaat getirdiğinde, bu bilgilen ilgili Tarafın veya Taraflar'ın yet­ kili Yönetim Mercii'ne iletecektir. 2. Bu maddenin 1. fıkrasında sözü edilen nitelikte bilgiler Taraflar'dan birine iletildiğinde söz konusu Taraf ilgili hususları mumkun olan en kısa zamanda ve kanunlarının izin verdiği ölçü­ de Sekreterya'ya bildirecek ve uygun olan durumlarda telafi edici işlemler tavsiye edecektir. Sbz konusu taraf bir soruşturmanın yapılmasının uygun olduğu kanısındaysa bu soruşturma soz konu­ su Tarafın açıkça yetkili kıldığı kişi veya kişiler tarafından yürütülecektir. 3. Gerek ilgili Tarafça sağlanan gerekse bu maddenin 2. fıkrasında belirtilen herhangi bir soruşturma sonucu elde edilen bilgiler müteakip Taraflar Konferansı'nda ele alınacak ve Konferans uygun gördüğü tavsiyelerde bulunabilecektir. MADDE XIV Ülke Mevzuatı ve Uluslararası Sözleşmeler Üzerindeki Etki 1. işbu Sozleşme'nin hükümleri, Taraflar'ın: (a) Ek I, II ve III kapsamındaki turlerın örneklerinin ticareti, zilyetliği ve nakliyesi ile ilgi­ li şartlar konusunda daha sıkı ulusal tedbirler alma veya bunları tamamen yasaklama; ve (b) Ek I, II ve III kapsamında olmayan türlerin ticaretini, zilyetliğini veya nakliyesini sı­ nırlandıran veya yasaklayan ulusal tedbirler alma konusundaki haklarını hiçbir şekilde etkilemeyecektir. 2. İşbu Sozleşme'nin hukumlen gumruk, halk sağlığı, hayvan sağlığı ve bitki karantinası konusundaki tedbirler de dahil olmak üzere örneklenil ticareti, alınması, zilyetliği veya nakliyesi­ nin diğer yonlenyle ilgili olarak gerek halen yürürlükte olan gerekse ilende yürürlüğe girebilecek ulusal tedbirlenn hukumlen ile Taraflar'ın herhangi bir antlaşma, sözleşme veya uluslararası anlaş­ madan kaynaklanan yükümlülüklerini hiçbir şekilde etkilemeyecektir. 3. Ortak bir dış gumruk kontrolü oluşturmak ve sürdürmek ve kendi aralarındaki gumruk kontrollarını kaldırmak suretiyle bir birlik kuran veya bölgesel bir ticaret anlaşmasına girmiş veya yalan tarihte böyle bir anlaşmaya girme işlemleri tamamlanacak olan Devletler'in bu hususta ara lannda yaptıkları bir antlaşma, sözleşme veya uluslararası anlaşmanın hükümleri ve bunlardan do­ ğan yükümlülükler, söz konusu Devlet'lerın kendi aralarında yaptıklan ticaretle sınırlı olmak kay­ dıyla işbu Sozleşme'nin hükümlerinden hiçbir şekilde etkilenmeyecektir. 4. işbu Sözleşme'ye Taraf olan bir Devlet, işbu Sozleşme'nin yürürlüğe girdiği sırada yü­ rürlükte olan ve Ek II kapsamındaki deniz türlerinin korunmasıyla ilgili hükümler içeren başka bir antlaşma, sözleşme veya uluslararası anlaşmaya da taraf olduğu takdirde, söz konusu Devlet, ken­ di nezdınde kayıtlı gemiler tarafından alınmış olan Ek II kapsamındaki türlerin örneklerinin ticare­ ti bakımından işbu Sözleşme çerçevesinde üstlendiği yükümlülüklere tabi olmayacaktır. 5. Madde III, IV ve V'ın hükümlerine bakılmaksızın, işbu maddenin 4. fıkrasına uy­ gun olarak alınmış bir örneğin ihraç edilebilmesi için, giriş yapılan Devlet'in Yönetim Mer cii'nin, söz konusu örneğin konuyla ilgili başka bir antlaşma, sözleşme veya uluslararası bir anlaşmanın hükümlerine uygun olarak alınmış olduğuna ilişkin olarak düzenlediği bir belge yeterli olacaktır. 6. İşbu Sözleşme'deki hiçbir husus, Birleşmiş Milletler Genel Kurulu'nun 2750 C (XXV) sayılı karan uyarınca toplanan Birleşmiş Milletler Deniz Hukuku Konferansı tarafın­ dan Deniz Hukuku'nun kodifikasyonu ve geliştirilmesi çalışmalarına ve herhangi bir Dev Yurütme ve idare Bolümü Sayfa 23 Sayfa: 26 RESMİ GAZETE 20 Haziran 1996 - Sayı: 22672 let'in, Deniz Hukuku*na ve kıyı Devleti ile bandıra Devleti'nin yetki alanının mahiyeti ve kapsamına ilişkin mevcut veya müstakbel hak taleplerine ve hukuki kanaatine halel getirme­ yecektir. M A D D E X V Ek I ve irde Yapılan Değişiklikler 1. Tarafların Konferans toplantılarında Ek I ve Il'nin tadiline ilişkin olarak, aşağıda­ ki hükümler uygulanacaktır. (a) Taraflar'dan herhangi biri, müteakip toplantıda görüşülmek üzere Ek I ve Ek İT de değişiklik yapılmasını önerebilir. Değişiklik önerisinin metni toplantıdan en az 150 gün ön­ ce Sekretarya'ya iletilecektir. Sekreterya, bu maddenin 2. fıkrasının (b) ve (c) bendlerinin hü­ kümlerine uygun olarak değişiklik konusunda diğer Taraflarca ve ilgili kuruluşlara danışarak elde edilen sonuçlan toplantıdan en az 30 gün önce bütün Taraflar'a iletecektir. (b) Değişikliklerin kabul edilebilmesi için toplantıda hazır bulunan ve oy veren Ta­ raflar'ın üçte iki çoğunluğunun lehte oy vermesi gerekir. 'Toplantıda hazır bulunan ve oy ve­ ren Taraflar" terimi toplantıya katılan ve lehte veya aleyhte oy veren Taraflar anlamına ge­ lir. Oylamada çekimser kalan Taraflar değişikliğin kabulü için gerekli üçte iki çoğunluğun hesaplanmasında dikkate alınmayacaktır: (c) Bir toplantıda kabul edilen değişiklikler, bu maddenin 3. fıkrasına göre çekimser olan Taraflar hariç bütün Taraflar bakımından toplantıdan 90 gün sonra yürürlüğe girecektir. 2. Ek I ve Il'nin Tarafların Konferans toplantıları arasında değiştirilmesiyle ilgili ola­ rak aşağıdaki hükümler uygulanacaktır: (a) Taraflar'dan herhangi biri, bu fıkrada bahsedilen posta usullerine uygun olarak, Toplantılar arasında tetkik edilmek üzere, Ek I veya II'de bir değişiklik yapılmasını önerebilir. (b) Deniz türleriyle ilgili olarak, Sekreterya, önerilen değişiklik metni kendi eline ge­ çer geçmez bunu derhal taraflara iletecektir. Ayrıca, bu türlerle ilgili olarak bu türlerle ilgili işlevleri olan hükümetler arası kuruluşlara, özellikle bu kuruluşların sağlayabileceği bilim­ sel verileri elde etmek ve bu kuruluşların uyguladığı koruma tedbirleri varsa bunların Koor­ dinasyonunu temin etmek amacıyla danışacaktır. Sekreterya, bu kuruluşlar tarafından sağla­ nan veri ve ifade edilen görüşleri ve kendi bulgularını ve tavsiyelerini Taraflar'a mümkün olan en kısa sürede iletecektir. (c) Sekreterya, deniz türleri dışındaki türlerle ilgili değişiklik önerileri kendi eline ge­ çer geçmez bunları Taraflar'a iletecek ve daha sonra mümkün olan en kısa sürede kendi tav­ siyelerini iletecektir. (d) Bu fıkranın (b) veya (c) bendleri uyarınca Sekreterya'nın kendi tavsiyelerini ilet­ miş olduğu tarihten itibaren 60 gün içinde Taraflar'dan herhangi biri Sekreterya'ya, ilgili herhangi bir bilimsel veri veya bilgiyle birlikte, önerilen değişiklik hususunda herhangi bir mütalaasını bildirebilir. (e) Sekreterya, alınan cevaplarla birlikte kendi tavsiyelerini mümkün olan en kısa sü­ rede Taraflar'a iletecektir. (0 Bu fıkranın (e) bendinin hükümleri Çerçevesinde, cevap ve tavsiyelerin iletilmiş olduğu tarihten itibaren 30 gün içinde değişiklik önerisine ilişkin olarak Sekretarya'ya hiçbir itiraz ulaşmadığı takdirde değişiklik işbu Maddenin 3 uncü fıkrasına uygun olarak çekimser olan Taraflar hariç bütün Taraflar bakımından 90 gün sonra yürürlüğe girmiş olacaktır. (g) Taraflar'dan herhangi biri Sekreterya'ya itirazını ilettiği takdirde önerilen deği­ şiklik, bu fıkranın (h), (i) ve (j) bendlerinin hükümleri uyarınca postayla oylamaya sunula­ caktır. (i) Sekreterya'nın bu fıkranın (h) bendi uyarınca gönderdiği bildirimin tarihinden iti­ baren 60 gün içinde Taraflar'ın en az yarısı Sekreterya'ya lehte, aleyhte veya çekimser oy göndermediği takdirde önerilen değişiklik, daha ayrıntılı olarak görüşülmek üzere Konfe­ ransın müteakip toplantısına havale edilecektir. (j) Taraflar'ın yarısının oylarını göndermiş olması kaydıyla değişiklik, oy veren Ta­ raflar'ın üçte iki çoğunluğuyla kabul edilecektir. (k) Sekreterya oylamanın sonucunu bütün Taraflar'a bildirecektir. (1) Önerilen değişikliğin kabulü halinde bu değişiklik işbu maddenin 3 uncu fıkrası­ na uygun olarak çekince koyan Taraflar hariç butun Taraflar bakımından değişikliğin kabu­ lünün Sekreterya tarafından bildirildiği tarihten 90 gün sonra yürürlüğe girecektir. 3. İşbu Maddenin 2. fıkrasının (i) bendi veya 1. fıkranın (c) bendinde öngörülen 90 günlük süre sırasında Taraflar'dan herhangi biri, Depoziter Hükümete yazılı bildirimde bulun­ mak suretiyle değişiklikle ilgili olarak çekimser olabilir. Söz konusu Taraf bu çekimserliği kal­ dırana kadar ilgili türlerin ticareti hususunda işbu Sözleşme'ye Taraf olmayan bir Devlet sayı­ lacaktır. M A D D E X V I Ek İÜ ve Buna Ait Değişiklikler I 1. Taraflardan herhangi bin Madde H'nin 3. fıkrasında belirtilen amaçlar için kendi yetki alanı içinde düzenlemeye tabi olacağını tespit ettiği türlerin bir listesini herhangi bir za­ manda Sekreterya'ya sunabilir. Ek III ilgili türleri söz konusu Ek'e dahil edilmek üzere su­ nan Tarafın adını, bu türlerin bilimsel adlarını ve Madde Fin (b) bendinin amaçları açısın­ dan bu türlerle ilişkili olduğu belirtilen bitki veya hayvan parçaları veya türevleri varsa bun­ ları kapsayacaktır. 2. Sekreterya, işbu Madde'nın 1. bendinin hükümlerine göre sunulan her listenin kendi eline geçmesinden sonra mumkun olan en kısa zamanda bu listeyi Taraflar'a iletecek­ tir. Liste Taraflar'a iletildiği tarihten itibaren 90 gün sonra Ek IH'un bir bölümü olarak yürür­ lüğe girecektir. Liste'nin iletilmesinden sonra herhangi bir zamanda Taraflar'dan. herhangi bi­ ri Depoziter Hukümet'e yazılı bildirimde bulunarak herhangi bir tur veya bunun parçaları ve­ ya türevleri ile ilgili olarak çekimser olabilir ve bu çekimserlik kaldırılana kadar ilgili Dev­ let söz konusu tur veya bunun parçaları veya türevlerinin ticareti ile ilgili olarak işbu Sözleş­ me'ye Taraf olmayan bir Devlet sayılacaktır. 3. Bir türü Ek III kapsamına dahil ettiren herhangi bir Taraf, Sekreterya'ya herhangi bir zamanda yazılı bildirimde bulunarak bu türün ek III kapsamından çıkarılmasını isteyebi­ lir ve Sekreterya kapsamdan çıkarma yazısını butun Taraflar'a iletecektir. Kapsamdan çıkar­ ma bu yazının iletilmesinden 30 gun sonra yürürlüğe girecektir. 4. işbu Madde'nin 1. bendi uyarınca bir liste sunan bir Taraf söz konusu turun korun­ masına ilişkin ülke kanunları ve mevzuatlarının bir nüshasını kendisinin uygun gördüğü ve Sekreterya'nın isteyebileceği yorumlarla birlikte Sekreterya'ya sunacaktır. Soz konusu tür Ek III kapsamında kaldığı surece ilgili Taraf konuyla ilgili olarak kabul edilmiş olabilecek yem Kanun ve mevzuatları ve bunlarla ilgili yorumları Sekreterya'ya iletecektir. Tarafların en az üçte birinin yazılı talebi üzerine Taraflar'ın Konferansı işbu Söz leşme'de yapılacak değişiklikleri görüşmek ve kabul etmek üzere Sekreterya tarafından ola­ ğanüstü toplantıya çağrılır. Bu gibi değişikliklerin kabul edilebilmesi için toplantıda hazır bulunan ve oy veren Taraflar'ın uçte iki çoğunluğunun lehte oy vermesi gerekir. "Toplantıda hazır bulunan ve oy veren Taraflar" terimi toplantıya katılan ve lehte veya aleyhte oy veren taraflar anlamına gelir. Oylamada çekimser kalan Taraflar değişikliğin kabulü için gerekli üç­ te iki çoğunluğun hesaplanmasında dikkate alınmaz. 2. Önerilen herhangi bir değişiklik metni Sekreterya tarafından bütün Taraflar'a top­ lantı tarihinden en az 90 gun önce iletilecektir. 3. Herhangi bir değişiklik, bu değişikliği kabul eden Taraflar bakımından soz konu­ su değişikliğe ilişkin kabul belgesinin Taraflar'ın en az üçte ikisince Depoziter Hükümet'e tevdi edilmesinden 60 gun sonra yürürlüğe girer. Daha sonra bu değişiklik başka Taraflarca da kabul edildiği takdirde değişiklik söz konusu Taraf bakımından soz konusu Tarafın deği­ şiklikle ilgili kendi kabul belgesini tevdi etmesinden 60 gün sonra yürürlüğe girecektir. M A D D E XVIII ihtilafların Halli 1. işbu Sozleşme'nin yorumlanması veya uygulanması ile ilgili olarak iki veya daha fazla Taraf arasında çıkabilecek ihtilaflar aralarında ihtilaf olan Taraflar arasında müzakere yoluyla halledilecektir. 2. ihtilaf işbu Madde'nin 1. bendine göre hail edilemediği takdirde Taraflar araların­ da mutabakata vararak ihtilafı, özellikle Lahey Daimi Tahkim Mahkemesi olmak üzere, ha­ keme havale edebilirler ve Taraflar ihtilafı hakeme havale etmekle tahkim kararının Bağlayı­ cılığını kabul etmiş sayılırlar. Recognizing that wild fauna and flora in their many beautiful and varied forms are an irreplaceable part of the natural systems of the earth which must be protected for this and the generations to come; Conscious of the ever-growing value of wild fauna and flora from aesthetic, scientif­ ic, cultural, recreational and economic points of view; Recognizing that peoples and States are and should be the best protectors of their-own wild fauna and flora: Recognizing, in addition, that international cooperation is essential for the protection of certain species of wild fauna and flora against over-exploitation through international trade; Convinced of the urgency of taking appropriate measures to this end; Have agreed as follows: Article I Definitions For the purpose of the present Convention, unless the context otherwise requires: (a) "Species" means any species, subspecies, or geographically separate population thereof; (b) Specimen" means: (i) any animal or plant, whether alive or dead; (ii) in the case of an animal: for species included in Appendices I and II, any read­ ily recognizable part or derivative thereof; and for species included in Appendix III, any read­ ily recognizable part or derivative thereof specified in Appendix III in relation to the species; and (iii) in the case of a plant: for species included in Appendix I, any readily recogniz­ able part or derivative thereof; and for species included in Appendices II and III, any readily recognizable part or derivative thereof specified in Appendices II and III in relation to the species; (c) "Trade" means export, re-export, import and introduction from the sea; (d) "Re-export" means export of any specimen that has previously been imported; (e) "Introduction from the sea" means transportation into a State of specimens of any species which were taken in the marine environment not under the jurisdiction of any State; Yürütme ve İdare Bölümü Sayfa : 66 20 Haziran 1996 - Say ı : 22672 RESMİ G A Z E T E Sayfa: 69 (f) "Scientific Authority" means a national scientific authority designated in accor­ dance with Article I X ; (g) "Management Authority" means a national management authority designated in accordance with Article I X ; (h) "Party" means a State for which the present Convention has entered into force. Article II Fundamental Principles 1. Appendix I shall include all species threatened with extinction which are or may be affected by trade. Trade in specimens of these species must be subject to particularly strict regulation in order not to endanger further their survival and must only be authorized in exceptional circumstances. 2. Appendix II shall include: (a) al l species which although not necessarily now threatened with extinction may become so unless trade in specimens of such species is subject to strict regulation in order to avoid utilization incompatible with their survival; and (b) other species which must be subject to regulation in order that trade in speci­ mens of certain species referred to in sub-paragraph (a) of this paragraph may be brought under effective control. 3. Appendix III shall include all species which any Party identified as being sub­ ject to regulation within its jurisdiction'for the purpose of preventing or restricting exploita­ tion, and as needing the cooperation of other parties in the control of trade. 4. The Parties shall not allow trade in specimens of species included in Appendices I, II and III except in accordance with the provisions of the present Convention. Article III Regulation of Trade in Specimens of Species included in Appendix I 1. A l l trade in specimens of species included in Appendix I shall be in accordance with the provisions of this Article. 2. The export of any specimen of a species included in Appendix I shall require the prior grant and presentation of an export permit. A n export permit shall only be granted when the following conditions have been met: (a) a Scientific Authority of the State of export has advised that such export wi l l not be detrimental to the survival of that species; (b) a Management Authority of the State of export is satisfied that the specimen was not obtained in contravention of the laws of that State for the protection of fauna and flora: (c) a Management Authority of the State of export is satisfied that any living spec­ imen w i l l be so prepared and shipped as to minimize the risk of injury, damage to health or cruel treatment; and (d) a Management Authority of the State of export is satisfied that an import permit has been granted for the specimen. 3. A n import permit shall only be granted when the following conditions have been met: (a) a Scientific Authority of the State of import has advised that the import wi l l be for purposes which are not detrimental to the survival of the species involved; (b) a Scientific Authority of the State of import is satisfied that the proposed recip­ ient of a l iving specimen is suitably equipped to house and care for it; and (c) a Management Authority of the State of import is satisfied that the specimen is not to be used for primarily commercial purposes. 4. The re-export of any specimen of a species included in Appendix I shall require the prior grant and presentation of a re-export certificate. A re-export certificate shall only be granted when the following conditions have been met; (a) a Management Authority of the State of re-export is satisfied that the specimen was imported into that State in accordance with the provisions of the present Convention; (b) a Management Authority of the State of re-export is satisfied that any living specimen wi l l be so prepared and shipped as to minimize the risk of injury, damage to health or cruel treatment; and (c) a Management Authority of the State of re-export is satisfied that an import per­ mit has been granted for any living specimen. 5. The introduction from the sea of any specimen of a species included in Appendix I shall require the prior grant of a certificate from a Management Authority of the State of introduction. A certificate shall only be granted when the following conditions have been met: (a) a Scientific Authority of the State of introduction advises that the introduction wi l l not be detrimental to the survival of the species involved; (b) a Management Authority of the State of introduction is satisfied that the pro­ posed recipient of a l iving specimen is suitably equipped to house and care for it; and (c) a Management Authority of the State of introduction is satisfied that the speci­ men is not to be used for primarily commercial purposes. Article IV Regulation of Trade in Specimens of Species included in Appendix II 1. A l l trade in specimens of species included in Appendix II shall be in accordance with the provisions of this Article. 2. The export of any specimen of a species included in Appendix II shall require the prior grant and presentation of an export permit. A Scientific Authority in each Party shall monitor both the export permits grant­ ed by that State for specimens of species included in Appendix II ^ d the actual exports of such specimens. Whenever a Scientific Authority determines that the export of specimens of any such species should be limited in order to maintain that species throughout its range at a level consistent with its role in the ecosystems in which it occurs and well above the level at which that species might become eligible for inclusion in Appendix I, the Scientific Authority shall advise the appropriate Management Authority of suitable measures to be taken to limit the grant of export permits for specimens of that species. 4. The import of any specimen of a species included in Appendix II shall require the prior presentation of either an export permit or a re-export certificate. 5. The re-export of any specimen of a species included in Appendix II shall require the prior grant and presentation of a re-export certificate. A re-export certificate shall only be granted when the following conditions have been met: (a) a Management Authority of the State of re-export is satisfied that the specimen was imported into that State in accordance with the provision of the present Convention; and (b) a Management Authority of the State of re-export is satisfied that any living specimen w i l l be so prepared and shipped as to minimize the risk of injury, damage to health or cruel treatment. 6. The introduction from the sea of any specimen of a species included in Appendix II shall require the prior grant of a certificate from a Management Authority of the State of introduction. A certificate shall only be granted when the following conditions have been met: (a) a Scientific Authority of the State of introduction advises that the introduction wi l l not be detrimental to the survival of the species involved; and (b) a Management Authority of the State of introduction is satisfied that any living specimen wi l l be so handled as to minimize the risk of injury, damage to health or cruel treat­ ment. 7. Certificates referred to in paragraph 6 of this Article may be granted on the advice of a Scientific Authority, in consultation with other national scientific authorities or, when appropriate, international scientific authorities, in respect of periods not exceeding one year for total numbers of specimens to be introduced in such periods. Article V Regulation of Trade in Specimens of Species included in Appendix III 1. A l l trade in specimens of species included in Appendix III shall be in accordance with the provisions of this Article. 2. The export of any specimen of a species included in Appendix III from any State which has included that species in Appendix III shall require the prior grant and presentation of an export permit. The import of any specimen of a species included in Appendix III shall require, except in circumstances to which paragraph 4 of this Article applies, the prior presentation of a certificate of origin and, where the import is from a State which has included that species in Appendix III, an export permit. 4. In the case of re-export, a certificate granted by the Management Authority of the State of re-export that the specimen was processed in that State or is being re-exported shall be accepted by the State of import as evidence that the provisions of the present Convention have been complied with in respect of the specimen concerned. Article V I Permits and Certificates 1. Permits and certificates granted under the provisions of Articles III, IV, and V shall be in accordance with the provisions of this Article. 2. A n export permit shall contain the information specified in the model set forth in Appendix IV, and may only be used for export within a period of six months from the date on which it was granted. 3. Each permit or certificate shall contain the title of the present Convention, the name and any identifying stamp of the Management Authority granting it and a control num­ ber assigned by the Management Authority. 4. Any copies of a permit or certificate issued by a Management Authority shall be clearly marked as copies only and no such copy may be used in place of the original, except to the extent endorsed thereon. 5. A separate permit or certificate shall be required for each consignment of spec­ imens. 6. A Management Authority of the State of import of any specimen shall cancel and retain the export permit or re-export certificate and any corresponding import permit pre­ sented in respect of the import of that specimen. 7. Where appropriate and feasible a Management Authority may affix a mark upon any specimen to assist in identifying the specimen. For these purposes "mark" means any indelible imprint, lead seal or other suitable means of identifying a specimen, designed in such a way as to render its imitation by unauthorized persons as difficult as possible. Article VII Exemptions and Other Special Provisions Relating to Trade 1. The provisions Articles III, IV and V shall not apply to the transit or trans-ship­ ment of specimens through or in the territory of a Party while the specimens remain in Customs control. Where a Management Authority of the State of export or re-export is satisfied that a specimen was acquired before the provisions of the present Convention applied to that specimen, the provisions of Articles III, I V and V shall not apply to that specimen where the Management Authority issues a certificate to that effect. 3. The provisions of Articles III, IV and V shall not apply to specimens that are per­ sonal or household effects. This exemption shall not apply where: (a) in the case of specimens of a species included in Appendix I, they were acquired by the owner outside his State of usual residence and are being imported into that State; or (b) in the case of specimens of species included in Appendix II: (i) they were acquired by the owner outside his State of usual residence and in a State where removal from the wild occurred; (ii) they are being imported into the owner's State of usual residence; and (iii) the State where removal from the wild occurred requires the prior grant of export permits before any export of such specimens; unless a Management Authority is satisfied that the "specimens were acquired before the pro­ visions of the present Convention applied to such specimens. 4. Specimens of an animal species included in Appendix I bred in captivity for commercial purpose, or of a plant species induced in Appendix I artificially propagated for commercial purposes, shall be deemed to be specimens of species included in Appendix II. 5. Where a Management Authority of the State of export is satisfied that any spec­ imen of an animal species was bred in captivity or any specimen of a plant species was arti ficaially propagated, or is a part of such an animal or plant or was derived therefrom, a cer­ tificate by that Management Authority to that effect shall be accepted in lieu of any of the permits or certificates required under the provisions of Articles III, I V or V. 6. The provisions of Articles III, IV and V shall not apply to the non-commercial loan, donation or exchange between scientists or scientific institutions registered by a Management Authority of their State, of herbarium specimens, other preserved, dried or embedded museum specimens, and live plant material which carry a label issued or approved by a Management Authority. 7. A Management Authority of any State may waive the requirements of Articles III, I V and V and allow the movement without permits or certificates of specimens which from part of a travelling zoo, circus, menagerie, plant exhibition or other travelling exhibi­ tion provided that: (a) the exporter or importer registers full details of such specimens with that Management Authority; (b) the specimens are in either of the categories specified in paragraphs 2 or 5 of this Article; and (c) the Management Authority is satisfied that any living specimen w i l l be so trans­ ported and cared for as to minimize the risk of injury, damage to health or cruel treatment. The Parties shall take appropriate measures to enforce the provisions of the pre­ sent convention and to prohibit trade in specimens in violation thereof. These shall include measures: (a) to penalize trade in, or possession of, such specimens, or both; and (b) to provide for the confiscation or return to the State of export of such specimens. 2. In addition to the measures taken under paragraph 1 of this Article a Party may, when it deems it necessary, provide for any method of internal reimbursement for expenses incurred as a result of the confiscation of a specimen traded in violation of the measures taken in the application of the provisions of the present Convention. 3. A s far as possible, the Parties shall ensure that specimens shall pass through any formalities required for trade with a minimum of delay. To facilitate such passage, a Party may designate ports of exit and ports of entry at which specimens must be presented for clear­ ance. The Parties shall ensure further that all living specimens, during any period of transit, holding or shipment, are properly cared for so as to minimize the risk of injury, damage to health or cruel treatment. 4. Where a l iving specimen is confiscated as a result of measures referred to in paragraph 1 of this Article: (a) the specimen shall be entrusted to a Management Authority of the State of con­ fiscation; (b) the Management Authority shall, after consultation with the State of export, return the specimen to that State at the expense of that State, or to a rescue centre or such other place as the Management Authority deems appropriate and consistent with the purpos­ es of the present Convention; and (c) the Management Authority may obtain the advice of a Scientific Authority, or may, whenever it considers it desirable, consult the Secretariat in order to facilitate the deci­ sion under subparagraph (b) of this paragraph, including the choice of a rescue centre or otheT place. 5. A rescue centre as referred to in paragraph 4 of this Article means an institution designated by a Management Authority to look after the welfare of l iving specimens, partic­ ularly those that have been confiscated. 6. Each Party shall maintain records of trade in specimens of species included in Appendices I, II and III which shall cover: (a) the names and addresses of exporters and importers; and (b) the number and type of permits and certificates granted; the States with which such trade occurred; the numbers or quantities and types of specimens, names of species as included in Appendices I, II and III and, where applicable, the size and sex of the specimens in question. 7. Each Party shall prepare periodic reports on its implementation of the present Convention and shall transmit to the Secretariat: Yürütme ve İdare Bölümü Sayfa : 72 20 Haziran 1996 - Sayı : 22672 RESMİ G A Z E T E Sayfa : 75 (a) an annual report containing a summary of the information specified in sub-para­ graph (b) of paragraph 6 of this Article; and (b) a biennial report on legislative, regulatory and administrative measures taken to enforce the provisions of the present Convention. 8. The information referred to in pragraph 7 of this Article shall be available to the public where this is not inconsistent with the law of the Party concerned. Article I X Management and Scientific Authorities 1. Each Party shall designate for the purpose of the present Convention: (a) one or more Management Authorities competent to grant permits or certificates on behalf of that Party; and (b) one or more Scientific Authorities. 2. A State depositing an instrument of ratification, acceptance, approval or acces­ sion shall at that time inform the Depositary Government of the name and address of the Management Authority authorized to communicate with other Parties and with the Secretariat. 3. Any changes in the designations or authorizations under the provisions of this Article shall be communicated by the Party concerned to the Secretariat for transmission to all other Parties. 4. Any Management Authority referred to in paragraph 2 of this Article shall i f so requested by the Secretariat or the Management Authority of another Party, communicate to it impression of stamps, seas or other devices used to authenticate permits or certificates. Article X Trade with States not Party to the Convention Where export or re-export is to, or import is from a State not a party to the present Convention, comparable documentation issued by the competent authorities in that State which substantially conforms with the requirements of the present Convention for permits and certificates may be accepted in lieu thereof by any Party. Article X I Conference of the Parties 1. The Secretariat shall call a meeting of the Conference of the Parties not later than two years after the entry into force of the present Convention. 2. Thereafter the Secretariat shall convene regular meetings at least once every two years, unless the Conference decides otherwise, and extraordinary meetings at any time on the written request of at least one-third of the Parties. 3. At meetings, whether regular or extraordinary, the Parties shall review the implementation of the present Convention and may: (a) make such previsons as may be necessary to enable the Secretariat to carry out its duties, and adopt financial provisions; Yünltme ve Idare Bolürnu Sayfa : 73 Sayfa : 76 RESMİ G A Z E T E 20 Haziran 1996 - Sayı : 22672 (b) consider and adopt amendements to Appendices I and II in accordance with Article X V ; (c) review the progress made towards the restoration and conservation of the species included in Appendice I, II and III; (d) receive and consider any reports presented by the Secretariat or by any Party; and (e) where appropriate, make recommendations for improving the effectiveness of the present Convention. 4. A t each regular meeting, the Parties may determine the time and venue of the next regular meeting to be held in accordance with the provisions of paragraph 2 of this Article. 5. At any meeting, the Parties may determine and adopt rules of procedure for the meeting. 6. The United Nations, its Specialized Agencies and the International Atomic Energy Agency, as well as any State not a Party to the present Convention, may be repre­ sented at meetings of the conference by observers, who shall have the right to participate but not to vote. 7. Any body or agency technically qualified in protection, conservation or man­ agement of wild fauna and flora, in the following catagories, which has informed the Secretariat of its desire to be represented at meetings of the Conference by observers, shall be admitted unless at least one-third of the Parties present object: (a) international agencies or bodies, either governmental or non-governmental, and national governmental agencies and bodies; and (b) national non-governmental agencies or bodies which have been approved for this purpose by the State in which they are located. Once admitted, these observers shall have the right to participate but not to vote. Article XII The Secretariat 1. Upon entry into force of the present Convention, a Secretariat shall be provided by the Executive Director of the United Nations Environment Programme. To the extent and in the Manner he considers appropriate, he may be assisted by suitable inter-governmenfal or non-governmental, international or national agencies and bodies technically qualified in pro­ tection, conservation and management of wild fauna and flora. 2. The functions of the Secretariat shall be: (a) to arrange for and service meetings of the Parties; (b) to perform the functions entrusted to it under the provisions of Articles X V and X V I of the present Convention; (c) to undertake scientific and technical studies in accordance with programmes authorized by the Conference of the Parties as w i l l contribute to the implementation of the present Convention, including studies concerning standards for appropriate preparation and shipment of l iv ing specimens and the means of identifying specimens; Yürütme ve İdare Bölümü Sayfa : 74 20 Haziran 1996 - Sayı : 22672 RESMİ G A Z E T E Sayfa : 77 (d) to study the reports of Parties and to request from Parties such further informa­ tion with respect thereto as it deems necessary to ensure implementation of the present Convention; (e) to invite the attention of the Parties to any matter pertaining to the aims of the present Convention; (f) to publish periodically and distribute to the Parties current editions of Appendices I, II and III together with any information which wi l l facilitate identification of specimens of species included in those Appendices. (g) to prepare annual reports to the Parties on its work and on the implementation of the present Convention and such other reports as meetings of the Parties may request; (h) to make recommendations for the implementation of the aims and provisions of the present Convention, including the exchange of information of a scientific or technical nature: (i) to perform any other function as may be entrusted to it by the Parties. Article XIII Internationa] Measures 1. When the Secretariat in the light of information received is satisfied that any species included in Appendices I or II is being affected adversely by trade in specimens of that species or that the provisions of the present Convention are not being effectively imple­ mented, it shall communicate such information to the authorized Management Authority of the Party or Parties concerned. 2. When any Party receives a communication as indicated in paragraph 1 of this Article, it shall, as soon as possible, inform the Secretariat of any relevant facts insofar as its laws permit and, where appropriate, propose remedial action. Where the Party considers that an inquiry is desirable such inquiry may be carried out by one or more persons expressly authorized by the Party. 3. The information provided by the Party or resulting from any inquiry as specified in paragraph 2 of this Article shall be reviewed by the next Conference of the Parties which may make whatever recommendations it deems appropriate. Article X I V Effect on Domestic Legislation and International Conventions 1. The provisions of the present Convention shall in no way affect the right of Parties to adopt: (a) stricter domestic measures regarding the conditions for trade, taking, possession or transport of specimens of species included in Appendices I, II and III, or the complete pro­ hibition thereof; or (b) domestic measures restricting or prohibiting trade, taking, possession, or trans­ port of species not included in Appendices I, II or III. 2. The provisions of the present Convention shall in no way affect the provisions of any domestic measures or the obligations of Parties deriving from any treaty, convention, or international agreement relating to other aspects of trade, taking, possession, or transport Yürütme ve İdare Bölümü Sayfa : 75 Sayfa : 78 RESMİ G A Z E T E 20 Haziran 1996 - Sayı : 22672 of specimens which is in force or subsequently may enter into force for any Party including any measure pertaining to the Customs, public health, veterinary or plant quarantine fields. 3. The provisions of the present Convention shall in no way affect the provisions of, or the obligations deriving from, any treaty, convention or international agreement con­ cluded or which may be concluded between States creating a union or regional trade agree­ ment establishing or maintaining a common external customs control and removing customs control between the parties thereto insofar as they relate to trade among the States members of that union agreement. 4. A State Party to the present Convention, which is also a party to any other treaty, convention or international agreement which is in force at the time of the coming into force of the present Convention and under the provisions of which protection is afforded to marine species included in Appendix II, shall be relieved of the obligation imposed on it under the provisions of the present Convention with respect to trade in specimens of species included in Appendix II that are taken by ships registered in that State and in accordance with the pro­ visions of such other treaty, convention or international agreement. 5. Notwithstanding the provisions of Articles III, IV and V, any export of a speci­ men taken in accordance with paragraph 4 of this Article shall only require a certificate from a Management Authority of the State of introduction to the effect that the specimen was taken in accordance with the provisions of the other treaty, convention or international agreement in question. 6. Nothing in the present Convention shall prejudica the codification and develop­ ment of the law of the sea by the United Nations Conference on the Law of the Sea convened pursuant to Resolution 2750 C ( X X V ) of the General Assembly of the United Nations nor the present or future claims and legal views of any State concerning the law of the sea and the nature and extent of coastal and flag State jurisdiction. Article X V Amendments to Appendices I and II 1. The following provisions shall apply in relation to amendments to Appendices I and II at meetings of the conference of the Parties: (a) Any Party may propose an amendment to Appendix I or II for consideration at the next meeting. The text of the proposed amendment shall be communicated to the Secretariat at least 150 days before the meeting. The Secretariat shall consult the other Parties and interested bodies on the amendment in accordance with the provisions of sub-paragraph (b) and (c) of paragraph 2 of this Article and shall communicate the response to all Parties not later than 30 days before the meeting. (b) Amendments shall be adopted by a two-thirds majority of Parties present and voting. For these purposes "Parties present and voting" means Parties present and casting an affirmative or negative vote. Parties abstaining from voting shall not be counted among the two-thirds required for adopting an amendment. (c) Amendments adopted at a meeting shall enter into force 90 days after that meet­ ing for all Parties except those which make a reservation in accordance with paragraph 3 of this Article. 2. The following provisions shall apply in relation to amendments to Appendices I and II between meetings of the Conference of the Parties: Yürütme ve İdare Bolümü Sayfa . 76 20 Haziran 1996 - Say ı : 22672 RESMİ G A Z E T E Sayfa: 79 (a) A n y Party may propose an amendment to Appendix I or II for consideration between meetings by the postal procedures set forth in this paragraph. (b) For marine species, the Secretariat shall, upon receiving the text of the proposed amendment, immediately communicate it to the Parties. It shall also consult inter-govern­ mental bodies having a function in relation to those species especially with a view to obtain­ ing scientific data these bodies may be able to provide and to ensuring coordination with any conservation measures enforced by such bodies. The Secretariat shall communicate the views expressed and data provided by these bodies and its own findings and recommendations to the Parties as soon as possible. (c) For species other than marine species, the Secretariat shall upon receiving the text of the proposed amendment, immediately communicate it to the Parties, and, as soon as possible thereafter, its own recommendations. (d) A n y Party may, within 60 day of the date on which the Secretariat communicat­ ed its recommendations to the Parties under sub-paragraphs (b) or (c) of this paragraph, trans­ mit to the Secretariat any comments on the proposed amendment together with any relevant scientific data and information. (e) The Secretariat shall communicate the replies received together with its own rec­ ommendations to the Parties as soon as possible. (f) If no objection to the proposed amendment is received by the Secretariat within 30 days of the date the replies and recommendations were communicated under the provi­ sions of sub-paragraph (e) of this paragraph, the amendment shall enter into force 90 days later for al l Parties except those which make a reservation in accordance with paragraph 3 of this Article. (g) If an objection by any Party is received by the Secretariat, the proposed amend­ ment shall be submitted to a postal vote in accordance with the provisions of sub-paragraphs (h), (i) and (j) of this paragraph. (h) The Secretariat shall notify the Parties that notification of objection has been received. (i) Unless the Secretariat receives the votes for, against or in abstention from at least one-half on the Parties within 60 days of the date of notification under sub-paragraph (h) of this paragraph, the proposed amendment shall be referred to the next meeting of the Conference for further consideration. (j) Provided that votes are received from one-half of the Parties, the amendment shall be adopted by a two-thirds majority of Parties casting an affirmative or negative vote. (k) The Secretariat shall notify all Parties of the result of the vote. (1) If the proposed amendment is adopted it shall enter into force 90 days after the date of the notification by the Secretariat of its acceptance for all Parties except those which make a reservation in accordance with paragraph 3 of this Article. 3. During the period of 96 days provided for by sub-paragraph (c) of paragraph 1 or sub-paragrap (I) of paragraph 2 of this Article any Party may be notification in writing to the Depositary Government make a reservation with respect to the amendment. Unt i l such reservation is withdrawn the Party shall be treated as a State not a Party to the present Convention with respect to trade in the species concerned. Any party may at any time submit to the Secretariat a list of species which it identifies as being subject to regulation within its jurisdiction for the purpose mentioned in paragraph 3 of Article II. Appendix III shall include the names of the Parties submitting the species for inclusion therein, the scientific names of the species so submitted, and any parts or derivatives of the animals or plants concerned that are specified in relation to the species for the purposes of sub-paragraph (b) of Article I. 2. Each list submitted under the provisions of paragraph 1 of this Article shall be communicated to the Parties by the Secretariat as soon as possible after receiving it. The list shall take effect as part of Appendix III 90 days after the date of such communication. At any time after the communication of such list, any Party may by notification in writing to the Depositary Government enter a reservation with respect to any species or any parts or deriva­ tives, and until such reservation is withdrawn, the State shall be treated as a State not a Party to the present Convention with respect to trade in the species or part or derivative concerned. 3. A Party which has submitted a species for inclusion in Appendix III may with­ draw it at any time by notification to the Secretariat which shall communicate the withdraw­ al to all Parties. The withdrawal shall take effect 30 days after the date of such communica­ tion. 4. Any Party submitting a list under the provisions of paragraph 1 of this Article shall submit to the Secretariat a copy of all domestic laws and regulations applicable to the protection of such species, together with any interpretations which the Party may deem appropriate or the Secretariat may request. The Party shall, for as long as the species in ques­ tions is included in Appendix III, submit any amendment of such laws and regulations or any new interpretations as they are adopted. Article X V I I Amendment of the Convention 1. A n extraordinary meeting of the Conference of the Parties shall be convened by the Secretariat on the written request of at least one-third of the Parties to consider and adopt amendments to the present Convention. Such amendments shall be adopted by a two-thirds majority of Parties present and voting. For these purposes "Parties present and voting" means Parties present and casting an affirmative or negative vote. Parties abstaining from voting shall not be counted among the two-thirds required for adopting an amendment. 2. The text of any proposed amendment shall be communicated by the Secretariat to all Parties at least 90 days before the meeting. 3. A n amendment shall enter into force for the Parties which have accepted it 60 days after two-thirds of the Parties have deposited an instrument of acceptance of the amend­ ment with the Depositary Government. Thereafter, the amendmen shall enter into force for any other Party 60 days after that Party deposits its instrument of acceptance of the amend­ ment. A n y dispute which may arise between two or more Parties with respect to the interpretation or application of the provisions of the present Convention shall be subject to negotiation between the Parties involved in the dispute. 2. If the dispute cannot be resolved in accordance with paragraph 1 of this Article, the Parties may, by mutual consent, submit the dispute to arbitration, in particular that of the Permanent Court of Arbitration at The Hague and the Parties submitting the dispute shall be bound by the arbitral decision. Article X I X Signature The present Convention shall be open for signature at Washington until 30th A p r i l 1973 and thereafter at Berne until 31st December 1974. Article X X Ratification, Acceptanca, Approval The present Convention shall be subject to ratification, acceptance or approval. Instruments of ratification, acceptance or approval shall be deposited with the Government of the Swiss Confederation which shall be the Depositary Government. Article X X I Accession The present Convention shall be Open indefinitely for accession. Instruments of accession shall be deposited with the Depositary Government. Article X X I I Entry into Force 1. The present Convention shall enter into force 90 days after the date of deposit of the tenth instrument of ratification, acceptance, approval or accession, with the Depositary Government. 2. For each State which ratifies, accepts or approves the present Convention or accedes thereto after the deposit of the tenth instrument of ratification acceptance, approval or accession the present Convention shall enter into force 90 days after the deposit by such State of its instrument of ratification acceptance approval or accession. Article X X I I I Reservations 1. The provisions of the present Convention shall not be subject to general reser­ vations. Specific reservations may be entered in accordance with the provisions of this Article and Articles X V and X V I . 2. Any State may, on depositing its instrument of ratification, acceptance, approval or accession, enter a specific reservation with regard to: Yürütme ve tdare Bölümü Sayfa : 79 Sayfa : 82 RESMİ G A Z E T E 20 Haziran 1996 - Sayı : 22672 (a) any species included in Appendix I, II or III; or (b) any parts or derivatives specified in relation to a species concluded in Appendix III. 3. Unti l a Party withdraws its reservation entered under the provisions of this Article, it shall be treated as a State not a party to the present Convention with respect to trade in the particular species or parts or derivatives specified in such reservation. Article X X I V Denunciation Any Party may denounce the present Convention by written notification to the Depositary Government at any time. The denunciation shall take effect twelve months after the Depositary Government has received the notification. Article X X V Depositary 1. The original of the present Convention, in the Chinese, English, French, Russian and Spanish languages, each version being equally authentic, shall be deposited with the Depositary Government, which shall transmit certified copies thereof to all States that have signed it or deposited instruments of accession to it. 2. The Depositary Government shall inform all signatory and acceding States and Secretariat of signatures, deposit of instruments of ratification, acceptance, approval or acces­ sion, entry into force of the present Convention, amendments thereto entry and withdrawal of reservations and notifications of denunciation. 3. As soon as the present Convention enters into force, a certified copy thereof shall be transmitted by the Depositary Government to the Secretariat of the United Nations for registration and publication in accordance with Article 102 of the Charter of the United Nations.
