Fisheries Regulations 1992

1. These Regulations may be cited as the Fisheries Regulation, 1992. : INTERPRETATION

2. (l) In these regulations - (a) "lhe Act" means the Fisheries Act 1989, and "Or,11.!r" means an Order in Council made under the Act: ·,. ' (b) The terms and phrases defined in the Fisheries Act, , 989, shall be given the same meaning in J.hcse Regulations, unless the conteiu requires otherwise; (c) "operator" means any person who is in charge of. direc:lS or controls any vessel, including the owner, charierer ; nd master. (2) A re(cn:nce in these regulations to - (a) a Form is a reference IO a form or lh.111 number in Ui .-. Schedule I; and (b) a Schedule is II reference to a Schedule to these 1 ,:gulations. :\. FORMS AND FEES • '

3. (I) The forms set out in Schedule I with such modi(icau.1ns as lhe circwnstances require. are hereby prescribed for lhc purposes of i.,,e Act and these Regulations. (2) The rees set out in Schedule 2 arc hi:rcby prescribed ror 1h1: purposes of the Ac1 and these Regulations. PART l - LOCAL FISHING REGISTRATION

4. (I) An application to register a loeal fishing vessel under St"Clion 4 or the Act shall be in Form 1 and shall be accompanied by the fc.~ specified in Part 1 of Schedule 2. (4) A notification of any change in ownership of a registered local fishing vessel shall be in Fonn 3 and b. accomp~nied by the certificate of regisb'ation 11nd the fee specified in Par• 1 of Schedule '2. (5) The Registrar may at any time r,:quirc a ~c~sel registered under this Regulation to be inspected. and if he er nsiders thi:t the vessel is not fit for fishing or does not satisfy the laws co1'.,·cming st1fo1y and hygiene he shall cancel lhe certificate of registration. (6) A nolificalion of any addition '.1r modiffration to a registered local fishing vessel shwl be in Fonn 4 and iu~ accomp.1nied by lhe. certificate of registration and the fee specified in Pi tl I of S(:hcdule 2. {7) Upon any notification under J:~gulation 4(6) lhe Registrar shall - (a) cause the vessel to be i1 ,peeled; ~nd (b) if satisfir.d that the vc.o;!'., I a.~ modified is fit for fishing and satisfies such n:quircmem,, as may he laid down from Lime w time under Tongan law r"t;arding s:i~cty and hygiene, endorse and retwn lhc oortifieaH.- (1f registration; or (c) if not so satisfied, witbd• ,LW lhe r~rii:tration of the vessel and cancel the ccrtificalC of 1egis1ra1ion. 6. A local fishing vessel licence sh,i!I be in Fonn 6 and, unless sooner emcelled or suspended, shall be valid for a peri,.1d of 12 monlhs from lhe date of issue, FEES

7. (1) Subject to sub-regulation (2). the fee llnyable for the issuance or renewal of a local fishing vessel licen.:e is such amount as is specified in Part 2 of Schedule 2. (2) Notwithstanding any provisioP of the At.:t, no fees shall be payable in respect of any licence issued to a t"ishing •ves.~el owned and operated by I.he Government of lhe Kingdom of '!·onga. 49 _·;,··GROUNDS FOR LICENCE REFUSAL

8. (I) In addition lo the grounds for lioonce refusal set out in Section 5(4) of the Act. no licence in respect of a local fishing vessel shall be t.i;.sued or renewed unless: (a) all information 1equcstcd by the Registrar in respc ·t of the proposed fisning operation or relaled activities l.ttS been provided in the mlll1ller rniuin:d or requested; and (b) where approprialr: a valid safety certificate has been issued in respect of the vessel by the Ministry of Marine in a- cordancc with relevant laws. GENERAL CONDITIONS

9. Every local fishing vessel licence shall be subject 10 the following general conditions: (a) Any change in the information set oul in lhe applica,ion fonn shall be notified to the Registrar as soon as practical:le and in ;J., any case no later than seven days from the date of the change; {b) The vessel shall comply with safety standards applicnble from time to time under lhc laws of Tonga concerning fhipping; (c) lbe vessel shall display identification markings in au;ordance with Schedule 3 to these Regul~tions and a.s the Rcgi ,!rar may from time to time require. (d) No fishing shall be undenaken ell:ceJX 115 authoristd by the licence. (c) No fish may be transhipped from or onto the vessel e, ccpt with du: permission of the Registrar in writing md in ft, cordance with such condilions as the Registrar may specify. 11. 12. (1) A locally based foreign fishing eml in 1. ·nded to be used for commercial sport fishing may be register,,; by the Registrar in the same manner as a local fishing vessel. -;j :~: ,, . (2) For !he purposes of regulation 2(1) secti.1n 4 of the Act and regulation 4 shall be applied and read as if the refcr~:1ce.~ therein to a local fishing vessel were references to a locally based foreign fishing vessel. 16. 17. Every commercial sport fishing vessel lic.::nce shall, in additi,m to (a) any particular conditions endorsed on the licence; and (b) any genera] conditions prescribed by Order. be subject to the following general conditions: (a) any change in lhe infonnation set out in the applical:on form shall be notified to the Registrar as soon as ?"acticabl : and m any case no laier than sevm days from lhe date of the change; (b) the vessel shall comply with safety standards applica',Je from time lo time under the laws of Tonga concerning sLiPPing; (c) No fishing shall be undenaken except as authoriser by the licence. PART 3 - FOREIGN l<lSHJl'l-'G FOREIGN FlSIDNG VESSEL LICENCE APPLJCATIONS

18. Every application for a foreign fishing vessel licence made under Section 11(2) of the Act shall be in writing in Form 10. and shall cont.,1n such additional information as may be required by the Minister or the J:egistrar or under an applicable access agreement or multilatera] agreement, rud shall be accompanied by lhe foe specified in Pan 1 of Schedule 2. FOREIGN F1SHING VF.SSEL LICENCE FORM

19. (1) Every foreign fishing vessel liccnci:' shaU be issued in w· ni.ng in Fonn 11, and shall contain such additional information as may be ·cquired by the Minister or Registrar or under an spplicable access agree nent or mul1ilateral agreement. (2) Subject lo subsection (3~ such licence form shall be trans1 1ilted to the vessel promptly after issuance and carried on board a1 all times ; 11d shall be produced for in.~pection upon the request of an authorised offr •ir. (3) Where an endorsement has been made on a foreign fishin,1, vessel lice.nee by an authorised officer. and action in accordance with the pr--,visions of the Act or these Regulations is required by such cndo~emcnt, the >l)Cfalor shall promptly take such ection. (4) Where a licence has been issued but not yet received by th • vessel, a confinnation of the licence and information contained therein by tele,. telefax or cable and carried on board will constitute sufficient aulfiority. 52

20. The fees, royalties and other forms of romi ~,~ation J>nyable in respect of a foreign fishing vessel licence shall be those -·.stablisheii by an applicable access agree.men! or multilateral agreement and ·UJy other foes, royalties or other forms of eompensation consislent with the Act and an applicable access agreement or multilateral agreement which may be specified in the licence. 24. Every foreign fishing vessel licence .shall be subject to lhe foll 1wing conditions in addition to relevant provisions of the Act, including Sr:'j.ions 11, 13, 15, 23 and 38; (a) the vessel shall onJy be used for such fishing md 1 ~J111cd activities. during such periods and in such places as are specified in the lk:cnce: (b) except as may otherwise be provided in any applicable ;;ccess y agreement, the licence shall not be 1n111sferable to any olJier yessel or owner wilhout the written pennission of the Mi1,ister; (c) rhe licence shall be produced at the request of an authurised officer, in accordance with Regulation 19(2): ,; __ (d) lh.c vessel shall at all times in the fishery waters: {i) fly the flag of the State in which it is registered; (ii) displS.y identification markings in accordance wil:1 lhe specificaJ.ion set out in Schedule 3 to lhese Regula.Jons: ""' (iii) display lights and shapes for the vessel and acliv·1y in which it is engaged in complianc.e wilh the requirements of the International Rcgulatiorui for Preventing Coll ~ions al Sea; (e) the vessel shall nol be used for fishing within one nautical mile of a fish aggreg11.ting device ·except in accordance wilh lh.i., Acl or with !he written permission of lite person who was responsible for placing the device.
