Regulation of the State Service on Quarantine of Plants in the Republic of Tajikistan

REGULATION OF THE STATE SERVICE ON QUARANTINE OF PLANTS IN THE REPUBLIC OF TAJIKISTAN 1. GENERAL PROVISIONS 1.1. To establish, that by the State Inspection on Quarantine of Plants at Ministry of Agriculture of the Republic of Tajikistan on the territory of the Republic of Tajikistan is carried out the system of state measures on external and internal quarantine of plants directed on: a) Protection of the territory of the Republic of Tajikistan from penetration from foreign countries and from the countries of Commonwealth of the Independent States (CIS) of quarantine and other dangerous wreckers, illnesses of plants and weeds, which can put significant economic damage to national economy of the country; b) Duly revealing, localization and liquidation of quarantine and other dangerous wreckers, illnesses and weeds on the territory of the republic, as well as prevention of their penetration in the areas of the republic, where they are absent; c) Realization of the state control over observance of the established rules and measures on quarantine of plants during manufacture, preparation, transportation, storage, processing, realization and use of agricultural and other production of vegetative ongin. 1.2. Quarantine measures are distributed on: a) Seeds and planting material of agricultural, wood and decorative crops, plant and their part (grafts, bulb, strawberry, fruits and etc) as well as any other production of vegetative origin, which can be a carrier of wreckers, illnesses of plants and weeds; b) Crops of living mushrooms, bacteria, viruses, and nematodes, ticks and insects; c) Collection of insects, activators of illnesses of plants and samples causing by them damages, as well as herbarium and collection seeds; d) Agricultural machines and instrument of processing of land, all kinds of container, particular industrial goods, packing means and products from vegetative materials, which there can be carriers of wreckers, illnesses of plants and weeds, monoliths and samples soils, vehicles arriving from foreign countries and from the territory of CIS, announced to be under quarantine; e) The territory and premise of the enterprises and organizations 307 preparing, storing, processing and realizing production of vegetative origin, agricultural and wood area, chicken-garden, individual and country sites, collective gardens and personal plots, and of non agricultural usage (strip of alienation of roads, lines of electric transmission etc.). 1.3. The common management of measures on quarantine of plants in the Republic of Tajikistan is carried out by the State Inspection on Quarantine of Plants at Ministry of Agriculture of the Republic of Tajikistan, which: a) Supervises over a service on quarantine of plants in the republic, carries out the state control on execution of measures, on quarantine of plants, bears the complete responsibility for duly realization of these measures on the territory of the republic; b) Issues within the limits of its competence the orders, instruction, regulation and rule on quarantine of plants not contradicting to the international agreements and legislation of the Republic of Tajikistan, which are obligatory for execution by all ministries, departments, enterprises, establishments, organizations, as well as citizens and when due hereunder leads up to their item of information; c) Once per 5 years reconsiders and asserts the List of wreckers, illnesses of plants and weeds having quarantine meaning for the republic, as well as together with an Academy of Sciences of the Republic of Tajikistan and wood-economic by industrial association "Tajik-wood" of the Republic of Tajikistan and with consent of the interested ministries and departments of the Republic of Tajikistan. List of biological objects is not subject to export from the Republic of Tajikistan; d) Establishes quarantine rules of import in the Republic of Tajikistan, transportation in the republic, export and conditions of use of seeds, plants, vegetative raw material, other production of vegetative origin and consumer goods; e) When due hereunder carries out cooperation on quarantine and protection of plants within the framework of international organizations; f) Concludes, when due hereunder, bilateral international conventions and agreements on quarantine and protection of plants, as well as participates in performance of the obligations following from other agreements of the Republic of Tajikistan with foreign countries and CIS in a part of execution of quarantine measures; g) Carries out other activity connected to execution of tasks and functions of the State Service on Quarantine of Plants, organizes and coordinates the foreign trade activities, not prohibited by the legislation, 308 of the subordinated legal persons; h) Carries out selection and supervises the activity of experts on quarantine of plants, dispatching by the lines of Ministry of Agriculture of the Republic of Tajikistan, Ministry of Foreign Economic Relations of the Republic of Tajikistan, Tadjikmatlubot and wood-economic industrial association "Tajik-wood" in foreign countries, for realization of quarantine examination of large parties of cargoes, being under quarantine, sent to the Republic of Tajikistan, as well as for study phyto sanitary condition of crops and plantings of agricultural crops and wood breeds in these countries; i) Creates, when due hereunder, specialized groups for rendering assistance to collective farms, state farms and other enterprises and organizations, as well as at the request of foreign countries in realization of struggle with quarantine wreckers, with illnesses of plants and weeds and allocates for these purposes necessary agricultural engineering, equipment and chemical means of protection of plants. 2. BODlES OF A STATE SERVICE ON QUARANTINE OF PLANTS, THEIR RESPONSIBILITIES AND RIGHTS 2.1. The State Inspection on Quarantine of Plants at Ministry of Agriculture of the Republic of Tajikistan organizes realization of state measures on quarantine of plants through the bodies carrying out State Service on Quarantine of Plants and having the rights of the legal person; having a stamp seal with its naming. Its activity guided by Constitution and Laws of Republic of Tajikistan, decrees of the Government of the Republic of Tajikistan, Majlisi Oli of the Republic of Tajikistan, orders of Ministry of Agriculture of the Republic of Tajikistan, other normative acts and present Charter. Into the structure of State Inspection on Quarantine of Plants at Ministry of Agriculture of the Republic of Tajikistan enter: a) State Inspection on Quarantine of Plants - Tajikgosquarantine at Ministry of Agriculture of the Republic of Tajikistan; b) Republican quarantine laboratory at State Inspection on Quarantine of Plants at Ministry of Agriculture of the Republic of Tajikistan; c) Fumigation detachment of State Inspection on Quarantine of Plants; d) State inspections on quarantine of plants in autonomous region and regions; 309 e) District and inter-district points on quarantine of plants; f) Boundary points on quarantine of plants in river ports (on piers), at railway stations, at the airports, on post offices and highways. 2.2. The chief of State Inspection on Quarantine of Plants at Ministry of Agriculture of the Republic of Tajikistan is simultaneously a MAIN State Inspector on Quarantine of Plants of the Republic of Tajikistan. The deputy chief is deputy of the Main State Inspector on Quarantine of Plants of the Republic of Tajikistan. 2.3. The chief of State Inspection on Quarantine of Plants of independent area or in areas is simultaneously a MAIN State Inspector on Quarantine of Plants according to autonomous region or regions. 2.4. The manager of boundary point on quarantine of plants in a river port (on quay), at railway station, at the airport, on post office or highway conducting (senior) agriculturist, agriculturist of inter-district and district point, regional State Inspection on 'Quarantine of Plants of the Republic of Tajikistan, on a post is simultaneously State Inspector on Quarantine of Plants according to served zones or point. 2.5. To State Service on Quarantine of Plants is assigned the following: a) Elaboration of quarantine conditions of import of seeds, plants and production of vegetative origin from foreign countries and CIS, transportation of this production within the republic, mode and conditions of its use; b) Realization of quarantine check and laboratory examination of plants, production of vegetative origin and other materials delivered in the Republic of Tajikistan from foreign countries and CIS, which can be carriers of quarantine wreckers, illnesses of plants and weeds, including vegetative investments acting in luggage, items of mail and in hand luggage of the passengers; c) Organization of improvement and disinfecting of specified production, as well as vehicles arriving to the Republic of Tajikistan from foreign countries and CIS; d) Elaboration of methods of quarantine checks, laboratory examination and diagnostics of latent infection of seeds, plants and production of vegetative origin, as well as development of technology of disinfecting of cargoes; c) Study structure of species, biology and ecology of quarantine and other dangerous wreckers, illnesses of plants and weeds absent and limited of the Republic of Tajikistan, distributed in the territory and on the basis of it elaborate the project of the List of wreckers, illnesses of plants and weeds having quarantine meaning for the Republic of 310 Tajikistan; e) Realization of quarantine check and laboratory examination of seeds, plants and production of vegetative origin sent on export; f) Establishment of quarantine division into districts and micro districts of the territory of the Republic of Tajikistan; g) Elaboration of effective measures on struggle with quarantine wreckers and illnesses of plants together with research by agricultural and wood-economic establishments; h) Realization of the state control over execution of quarantine measures by ministries, departments, enterprises, by establishments, organizations, as well as citizens; i) Control of activity of introduction-quarantine nurseries, state form plots, greenhouses which are carrying out quarantine check seeds and plants, delivered in the Republic of Tajikistan from foreign countries, as well as from areas, announced to be under quarantine from territory of CIS; j) Control on execution of measures on quarantine of plants in nurseries, scientific research establishments, seeds-growing and flower decorative economies with the purpose of maintenance of issue of seeds and planting materials, free from quarantine wreckers, illnesses of plants and weeds; k) Elaboration, agreed with the appropriate ministries and departments, orders, regulation, rules and instructions of State Inspection on Quarantine of Plants at Ministry of Agriculture of the Republic of Tajikistan, regulating realization of measures in the field of external and internal quarantine of plants on the territory of the republic; 1) Organization of propagation and wide introduction in manufacture of achievement of a science and advanced experience, new methods, means and ways of struggle with quarantine wreckers, illnesses of plants and weeds, distribution of knowledge among the population about quarantine objects and measures of struggle against them; m) Issue of the quarantine licenses on import, phyto-sanitary quarantine certificates on seeds, plants and production of vegetative origin: n) Organization and control on realization of measures on quarantine and protection of plants, following from the international agreements of the Republic of Tajikistan; 0) Organization of systematic and implementation of control examinations of agricultural and wood area, places of storage and processing of production of vegetative origin, points of receipt of under quarantine production and territory adjoining to them, with the purpose 311 of duly revealing of quarantine wreckers, illnesses of plants and weeds. THE FOLLOWING OBJECTS ARE SUBJECT TO INSPECllON AND CHECK: Crops and plantings of agricultural, wood and other cultures in districts, adjoining to overland state border of the Republic of Tajikistan, on the territories, adjoining to river ports (piers), airports, railway and automobile stations, through which import of seeds, plants and production of vegetative origin from foreign countries is carried out, as well as in strips of alienation of highway and iron roads; Crops and plantings of the enterprises and establishments engaged in cultivation, duplication and realization of family and planting materials, for use in the Republic of Tajikistan and on export; All crops and plantings produced from seeds and planting material, delivered from foreign countries and CIS; Seeds, planting material and other production of vegetative origin intended for export; Agricultural, wood and other areas in districts of distribution of quarantine wreckers, illnesses of plants and weeds in areas, adjacent with them; Elevators, warehouse premises and other places of a storage and processing of import production of vegetative origin, as well as production delivered from CIS, on which the quarantine is laid on and vehicles, transporting specified production, agricultural machines and instruments of processing of land; p) Taking urgent measures to localization and liquidation of the revealed centers of infection, as well as revealing and overlapping (blocking) of channels of drift of quarantine objects; q) Drawing up of the protocols (acts) about infringement of the Charter or rules on quarantine of plants with the subsequent sending them to administrative commissions at local Hukumats, office of public prosecutor and other bodies for attraction of the guilty persons to the responsibility; r) Sending representations about imposing (removal) of quarantine on the appropriate territory to local Hukumats, the Government of the Republic of Tajikistan. 2.6. At execution of the official duties State Inspector on Quarantine of Plants has the right: a) To enter freely the territory of river ports (piers), railway stations and road service stations (auto stations), airports, post offices, 312 warehouses, elevators, on court of river fleet, into passenger and commodity cars, civil planes, on the territory of exhibitions, botanical gardens, scientific research institutes, experienced stations, collective farms, state farms, other enterprises, establishments and organizations, on chicken garden sites .if the citizens, as well ;s on the enterprises engaged in preparation, processing and realization seeds, plants and production of vegetative origin; b) Phyto-sanitary control of materials being under quarantine and vehicles in points of the passing through state border of the Republic of Tajikistan, which is carried out simultaneously with customs examination before realization of unloading operations, as well as during cargo handling works and on end of unloading. The state inspectors of boundary points on quarantine of plants are included into structure of commissions on acceptance of ships, trains, planes, vehicle, containers, luggage and items of mail arriving from other countries. Phyto-sanitary control establishes presence or absence of quarantine and dangerous wreckers, and illnesses of plants and weeds in cargoes and transport; c) To select samples seeds, plants and production of vegetative origin and other materials for the subsequent laboratory examinations at detection of quarantine and other dangerous wreckers, illnesses of plants and weeds to establish restrictions on export and use of production and necessary tasks on execution of system of quarantine measures; d) To detain, to remove and, if it is necessary, to return seeds, plants and production of vegetative origin taken out without the quarantine certificates from the territories, on which the quarantine is imposed; e) To require from administration of customs houses, river ports (piers), railway stations, road service stations (auto stations), airports, post offices and other organizations, the information about arriving and sent. cargoes, on which the quarantine measures and conformity with item 1.2 of the paragraphs a, b, c, d, of the present Charter) are extended; f) To require from administration of river ports (piers), railway stations, road service stations (auto stations), airports, main post offices of representation in case of necessity, vehicles, ancillary workers, office accommodations and auxiliary materials for realization of works on examination and disinfecting of seeds, plants and production of vegeta tive origin on their territory. 2.7. The workers of State Inspection on Quarantine of Plants have the rights and the workers of boundary state inspections and boundary points are obliged to wear a uniform on duty. The uniform is affirmed by Ministry of Agriculture of the Republic of Tajikistan on 313 concordance with Ministry of Finance of the Republic of Tajikistan. 2.8. The instructions of a State Service on Quarantine of Plants at Ministry of Agriculture of the Republic of Tajikistan within the limits of the functions, assigned to it, and rights, given to it, are obligatory for execution by all enterprises, organizations, establishments, ministries and departments engaged in manufacture, preparation, storage, processing, . transporting under-quarantine agricultural and other production of . vegetative origin and consumer goods, as well as citizens. 2.9. Local Hukumat, the Government of the Republic of Tajikistan takes a decision of imposing or removal of quarantine on granting bodies of State Service on Quarantine of Plants at Ministry of Agriculture of the Republic of Tajikistan. 2.10. Quarantine is imposed on: a) Economies (collective farm, state farm), enterprise, settlement, economies of citizens; b) Territory or part of territory of the enterprise, establishment or organization; c) Group of settlement or district; d) Autonomous region or region. 2.11. After taking the decision about imposing quarantine, the bodies of a State Service on Quarantine of Plants are obliged: a) To inform the chiefs of the enterprises, establishments, organizations, economies, as well as citizens about introduction of quarantine restrictions and realization of the authorized measures on localization and liquidation of quarantine wreckers, illnesses of plants and weeds; b) To establish the constant control of steady observance quarantine restrictions and measures by the enterprises, establishments, organizations, economies, as well as citizens; 2.12. The export of seeds, plants and production of vegetative origin from territory, on which the quarantine is imposed, is carried out only at observance of conditions and rules established by Ministry of Agriculture of the Republic of Tajikistan. 2.13. The export from economies announced to be under quarantine, seeds and planting material without the quarantine certificates for use them on the sowing and landing purposes in other economies, free from quarantine wreckers, illnesses of plants and weeds is prohibited. 2.14. Seeds, the plants and production of vegeta tive origin, taken out from the territories, on which the quarantine is imposed, without the quarantine certificates, are subject to withdrawal and transfer to 314 procuring organizations for technical (industrial) processing or use at the enterprises of a public feed and in necessary cases - disinfecting, return or destruction. 2.15. The state inspectors make detention and withdrawal of specified production on quarantine of plants. 2.16. The losses which have arisen as a result of infringement of quarantine rules, are collected from guilty (organizations, economies, persons) in the established order. 2.17. The export of agricultural production with chicken garden which are taking place on the territory (settlements, districts, region, republic), on which the quarantine is imposed, is admitted only through procuring organizations, with the exception of infected production (purpose and the conditions of which use are defined by State Inspector on Quarantine of Plants according to the quarantine rules). 2.18. The quarantine is removed by the decision of Hukumat of district (region) after implementation of the established quarantine measures and complete liquidation of the centers of quarantine wreckers, illnesses of plants and weeds on presentation of the main State Inspector on Quarantine of Plants. 3. ORDER OF IMPORT AND EXPORT OF SEEDS, PLANTS AND PRODUCTION OF VEGETATIVE ORIGIN 3.1 The import in the Republic of Tajikistan from foreign countries and CIS seeds, plants and production of vegetative origin is admitted at presence: a) Quarantine license for import, which is given out by State Inspection on Quarantine of Plants at Ministry of Agriculture of the Republic of Tajikistan; b) Phyto-sanitary certificate or certificate which is given out by state bodies on quarantine and protection of plants of the country exporter. 3.2. The import in the Republic of Tajikistan seeds, plants and production of vegetative origin from foreign countries which have not state bodies on quarantine and protection of plants, is admitted only in the presence of quarantine license for import which is given out in each separate case by State Inspection on Quarantine of Plants at Ministry of Agriculture of the Republic of Tajikistan. 3.3. Ministries and departments on import of vegetative production arc obliged: a) To include in the trade contracts on delivery in the Republic 315 of Tajikistan from foreign countries and CIS, or transportation through territory of republic seeds, plants and production of vegetative origin, requirement State Inspection on Quarantine of Plants at Ministry of Agriculture of the Republic of Tajikistan, ensuring prevention of penetration on the territory of the Republic of Tajikistan quarantine and other dangerous wreckers, illnesses of plants and weeds and to provide in them the property responsibility of the contractors for their infringements; b) To provide at purchase in foreign countries of large parties of seeds, plants and production of vegetative origin, direction, in case of necessity, experts on quarantine of plants for study phyto-sanitary condition of crops and plantings of agricultural cultures in these countries. 3.4. Seeds, the plants and production of vegetative origin imported in the Republic of Tajikistan from foreign countries and CIS, are subject to obligatory check in points of receipt them on the territory of the republic by the inspectors of a State Service on Quarantine of Plants of the Republic of Tajikistan. 3.5. The boundary points, through which the import of seeds, plants and production of vegetative origin is carried out, are determined on concordance with. the State Inspection on Quarantine of Plants at Ministry of Agriculture of the Republic of Tajikistan. 3.6. In case of occurrence on territory of the Republic of Tajikistan of threat of distribution from contiguous of the state quarantine, as well as other dangerous wreckers and illnesses of plants, according to the decision of competent bodies the border on threatening sites can be temporarily closed. 3.7. The export of import production of vegetative origin from river ports (piers), airports, railway stations and post offices in the Republic of Tajikistan is admitted after quarantine check in the presence of the quarantine certificates which are given out on each party of a cargo or a stamp of an established sample, filling on the shipping documents by the state inspectors on quarantine of plants. . The parcels, wrappers with production of vegetative origin are accepted to sending from establishments and organizations in the presence of the quarantine certificates, which are given out on each party of the items of mail (the list a.f.103) or a stamp of an established sample, filling on the accompanying documents (forms to parcels to the lists a.f.103). 3.8. The import in the Republic of Tajikistan from foreign countries and CIS seeds, plants and production of vegetative origin is 316 prohibited, in which quarantine and other dangerous wreckers, illnesses of plants and weeds, all kinds of cultures of alive mushrooms, bacteria, viruses - activators of illnesses of plants, as well as insects, ticks and nematodes are found out; damaging plants, with the exception of samples imported for the scientific purpose. At detection of the specified wreckers or illnesses in a cargo after the arrival in a port, railway station, the State Inspection on Quarantine of Plants is obliged to give out the recommendation to the owner of a cargo on further use, and the cargo owner in daily term is obliged to dispose of a cargo. 3.9. The transfer in the items of mail from foreign countries to the citizens of the Republic of Tajikistan, (as well as transportation in luggage), seeds and planting material, fresh fruit and vegetables is prohibited. The passing of separate fruits, fresh fruit and vegetables, free from infection by quarantine wreckers and illnesses in hand luggage of the passengers is admitted by State Inspector on Quarantine of Plants. In the event that seeds, the plants or planting material representing the special value, follow to the scientific research establishments, they should be directed according to the conclusion of the State Inspector on Quarantine of Plants, for check to introduction quarantine nursery. 3.10. The import in luggage and transfer by mail of production of vegetative origin coming from foreign countries for diplomatic, consular and trade representations, accredited in the Republic of Tajikistan, is carried out after carrying out of the quarantine control. 3.11. Seeds, the plants and production of vegetative origin imported into the Republic of Tajikistan from foreign countries and CIS, at detection quarantine and other dangerous wreckers, illnesses of plants and weeds in them, are subject obligatory disinfecting of chemical or other ways, clearing of weeds, sifting or landing in introduction quarantine nurseries and greenhouses with the purpose of revealing latent infection and improvement of the specified vegetative material, technical processing or use in areas, where there is no danger of distribution of the found out wreckers, illnesses of plants and weeds. The revealing latent infection can be on occasion, carried out by the laboratory analysis. 3.12. The quarantine check of seeds and planting material will be carried out according to a Regulation on the Order of Quarantine Check of Imported Seeds and Planting Materials on the territory of the Republic of Tajikistan. . 3.13. Chemical disinfecting of seeds, plants and production of vegetative origin from quarantine and other dangerous wreckers, illnesses 317 of plants on boundary points on quarantine of plants, through which this cargo is delivered, is carried out by fumigation detachments of a State Service on Quarantine of Plants of the Republic of Tajikistan. 3.14. All charges connected with disinfecting of seeds, plants and production of vegetative origin, including, use of a labor, transport, premises and auxiliary materials stipulated by items 2.6 the paragraph d, delivered in the Republic of Tajikistan from foreign countries and CIS are made at the expense of appropriate external-trade associations. 3.15. Disinfecting of seeds, plants and production of vegetative origin, container, vehicles' from quarantine and other dangerous wreckers, illnesses of plants is carried out according the instructions and under the control of the State Inspectors on Quarantine of Plants in accordance with the working instructions: a) Fumigation detachment of a State Service on Quarantine of Plants at State Inspection on Quarantine of Plants of the Republic of Tajikistan, when realization of chemical disinfecting is caused by quarantine condition of production, directly on boundary points on quarantine of plants; b) Consignees in places of receipt, realization or use of production, when the realization of disinfecting on specifications is impossible directly on boundary points on quarantine of plants or in places of shipment; c) The transport organizations or consignees, when an unloading of transported production of vegetative origin made by them should disinfect- vehicles infected quarantine and other harmful organisms in all cases irrespective of a quarantine.condition of transported production of vegetative origin. 3.16. In case of detection of quarantine and other dangerous dodges, illnesses of plants and weeds in seeds, plants, production of vegetative origin and in other cargoes delivered to the Republic of Tajikistan and from foreign countries and CIS, concerning which the effectual measures but disinfecting and clearing cannot be accepted, this production and the cargoes under the instruction of State Inspection on Quarantine of Plants at Ministry of Agriculture of the Republic of Tajikistan coordinated with the representatives of ministries, departments . importers, come back to the exporter or are destroyed. 3.17. Transported through territory of the Republic of Tajikistan, transit cargoes containing seeds, plants, production of vegetative origin, are adjusted by check according to international rules of transportation. In case of detection in the specified cargoes of quarantine and 318 , other dangerous wreckers, illnesses of plants or weeds, these cargoes should be detained, disinfected (with the consent of the sender) or are returned to the country - exporter. 3.18. Seeds, planting material, plant cultures (race) of activators of illnesses, other biological objects and production of vegetative origin taken out from the Republic of Tajikistan and the foreign countries and CIS, should answer conditions stipulated by the international agreements of the Republic of Tajikistan on quarantine and protection of plants, as well as trade contracts and does not enter into the List of biological objects, which are not subject to export from the Republic of Tajikistan. 3.i9. Each party of export seeds, plants and production of vegetative origin should be accompanied by the phyto-sanitary certificate of the established sample. 3.20. The organizations engaged in export of seeds, plants and production of vegetative origin, are obliged not later than 30 days before prospective shipment of specified production for limits of republic to inform bodies of a State Service on Quarantine of Plants of the Republic of Tajikistan on the planned shipment, together with them determine places, whence it is expedient to make shipment of production, and 15 days prior to shipment to present exported production for check. 4. DUTIES AND RIGHTS OF MINISTRIES, DEPARTMENTS, CHIEFS OF THE ENTERPRISES;ESTABLISHMENTS, ORGANIZATIONS AND CITIZENS 4.1. Ministries, department, enterprise, establishment and the organizations engaged in manufacture, preparation, storage, transportation, processing and realization of under quarantine production, carry out under the control of bodies of a State Service on Quarantine of Plants measures on inspection and struggle against quarantine wreckers, illnesses of plants and weeds and under the prevention of their distribution in case of detection. 4.2. The customs bodies of the Republic of Tajikistan should not accept to registration, and Dushanbe Branch of the Central Asian Railway, State Airline "Tojikiston", Ministry of Transport of the Republic of Tajikistan, other ministries and the departments should not accept to transportation seeds, plants and production of vegetative origin from territories on which the quarantine is imposed, without the quarantine certificates which are given out by State Inspection on Quarantine of Plants of the Republic of Tajikistan. 4.3. The chiefs of the enterprises, establishments and 319 organizations are obliged: a) To provide systematic inspections of crops, plantings and territories around of warehouses and enterprises, in which is stored or processed under quarantine production, as well as check of stocks of agricultural production with the purposes of revealing quarantine wreckers, illnesses of plants and weeds; b) In all cases of detection of quarantine wreckers, illnesses of plants and weeds immediately to inform about it bodies of a State Service on Quarantine of Plants and local Hukumats; c) To provide realization preventive and destroying measures directed on prevention of distribution and liquidation of quarantine wreckers, illnesses of plants and weeds during manufacture, preparation, storage, transportation and realization of agricultural and other production of vegetative origin according to the instruction State Inspector on Quarantine of Plants; d) Strictly observe working quarantine rules at delivery of seeds, plants and production of vegetative origin from foreign countries and CIS; e) To coordinate with bodies of a State Service on Quarantine of Plants allocation of the areas under a bookmark of nurseries and seeds growing economies; f) To carry out by forces and means of the enterprises, establishments, organizations or fumigation by dispatch of State Service on Quarantine of Plants of Ministry of Agriculture of the Republic of Tajikistan (under the applications of consignor or consignee), disinfecting of seeds, plants and production of vegetative origin, vehicles, warehouse and other premises, container, to contain in proper condition technical means (fumigation and disinfecting cabins, thermal installations, equipment etc.) for realization of measures on disinfecting. 4.4. It is prohibited consignors to show to transportation on iron roads perishable production of vegetative origin with presence of quarantine wreckers and illnesses of plants. The shipment of this production should be carried out only after realization by consignors either fumigation dispatches preventive or destroying measures directed on prevention of distribution of quarantine wreckers and illnesses in transit and in zones, free of them. 4.5. The enterprises, establishments, organizations, producing seeds and planting material for realization, are obliged to have fumigation chamber and other installations for realization of disinfecting of the grown material. 4.6. The post offices of communication 10 areas announced 320 under quarantine can accept parcels with fresh fruit and vegetables, seeds and planting materials only at presence of the quarantine certificate. 4.7. The citizens engaged in cultivation of agricultural plants and wood breeds, are obliged to carry out systematic supervision over crops and plantings with the purpose of duly revealing of quarantine wreckers, illnesses of plants and weeds, and at their detection immediately to inform about it Republican government State Infection on quarantine of plants, agricultural and wood-economic bodies or local Hukumat about it and take measures on liquidation of the revealed centers; strictly observe working rules on quarantine of plants and instruction of the State Inspector on Quarantine of Plants. 4.8. With the purposes of duly implementations of quarantine measures in the help to a State Service on Quarantine of Plants, collective farms, state farms, wood-economic, procuring transport, trade and other enterprises, establishment and the organizations allocate from experts public representatives on quarantine of plants. 4.9. The administration of a river port (pier), railway stations, road service stations (auto stations), airports, post offices is obliged to give State Inspection on Quarantine of Plants of Ministry of Agriculture of the Republic of Tajikistan office accommodations, necessary for work, in points of import of seeds, plants and production of vegetative origin and, in case of necessity, vehicles, warehouse premises, auxiliary materials, as well as ancillary workers for realization of works on examination and disinfecting of under quarantine production at the expense of the owner of a cargo. 4.10. The officials of the enterprises, establishments and organizations are obliged to assist bodies of a State Service on Quarantine of Plants of Ministry of Agriculture of the Republic of Tajikistan at realization of measures on quarantine of plants, by them to coordinate with them questions of quarantine of plants by manufacture, preparation, processing, storage, realization and use of under quarantine production. 4.11. The officials of the enterprises, establishments and organizations engaged in questions of manufacture, preparations, transportation, storage, processing and realization of seeds, planting material or production of vegetative origin have the right: a) To elaborate in necessary cases together with the representatives of a State Service on Quarantine of Plants additional measures or complex of additional measures providing unconditional performance of working quarantine rules; b) To require of bodies of a State Service on Quarantine of 321 Plants realization of control inspections of agricultural area, territories of warehouse premises, plants and production of vegetative origin etc. on revealing of quarantine objects; c) To put before bodies of a State Service on Quarantine of Plants and local Hukumats a question on removal of quarantine after complete liquidation of the centers of quarantine objects. , 5. RESPO~.SIBILiTY FOR INFRINGEMENT OF THE CHARTER AND RULES ON QUARANTINE OF PLANTS 5.1. Persons guilty of infringement of the Charter and established rules on quarantine of plants are involved in administrative, criminal or other responsibility according to the current legislation. 5.2. Persons, who have allowed export from boundary river ports (piers), railway stations, road service stations (auto stations), airports and other boundary points delivered from foreign countries and CIS, materials, not passed quarantine check and appropriate processing, as well as from zones announced under quarantine, are exposed to the penalty imposed by administrative commissions at local Hukumats in the order, established by the current legislation, if these infringements do not entail the criminal liability according to the current legislation. 5.3. For infringement of rules on struggle against quarantine wreckers, illnesses of plants and weeds guilty persons are exposed to the penalty imposed by administrative commissions at Hukumat of district (city) in the order, established by the current legislation, if these infringements do not entail the criminal liability according to the current legislation. 6. The sum of the penalty is enlisted in the budget of the Republic of Tajikistan. 322
