Unofficial Translation Directive of the Department of Fisheries on Determination of Formats and Methods for Requesting Catch Certificates or Processing Statements for Aquatic Animal Products or Aquatic Animal Processing B.E. 2562 By virtue of section 93 of the Royal Ordinance on Fisheries B.E. 2558 �A.D. 2015� , the Director-General of the Department of Fisheries has hereby issued the Rule as follows: Clause 1 This Directive is called the ³Directive of the Department of Fisheries on Determination of Formats and Methods for Requesting Catch Certificates or Processing Statements for Aquatic Animal Products or Aquatic Animal Processing, B.E. 2562´ Clause 2 The following shall be repealed: � � � �Directive of the Department of Fisheries on Determination of Formats and Methods for Requesting Catch Certificates or Processing Statements for Aquatic Animal Products or Aquatic Animal Processing B.E. 2558 dated 29 December, B.E. 2558 �A.D.������ � � � �Directive of the Department of Fisheries on Determination of Formats and Methods for Requesting Catch Certificates or Processing Statements for Aquatic Animal Products or Aquatic Animal Processing �No. 2��B.E. 2559 �A.D. 2016��dated 4 May 4, B.E. 2559��A.D.������ Clause 3 In this Rule: ³Catch certificates´ �means a document certifying that an aquatic animal and an aquatic animal product are obtained from an aquatic animal caught by Thai fishing vessels and a legitimate form of fishery; ³ Processing statement´ means a document certifying that an aquatic animal processed in Thailand, contains an imported aquatic animal material caught by a non Thai fishing vessel, which is obtained from a legitimate form of fishery. Clause 4 An Exporter of aquatic animals or aquatic products who wishing to request a catch certificate or a processing statement that aquatic animals or aquatic products must come from a fisheries establishment included on the list approved by the Department of Fisheries, If exporting to the European Union must come from a fisheries establishment included on the list approved by the European Union. Unofficial Translation The lodging of a request as per paragraph one shall be submitted a request with documents and evidence as specified in the request form prior to exportation thereof by no less than 3 working days unless there is a necessity that prevents the operation within the said period must notify in writing showing reasons and necessity to the officer for consideration on a case-by-case basis. Clause 5 The lodging of a request as per clause 4 shall be submitted through the electronic system of the Department of Fisheries as follows: � � � �Requesting a catch certificate shall be submitted through the Thai Flagged Catch Certification System ����Requesting a processing statement shall be submitted through the PSM linked and Processing Statement System In the case where the application cannot be submitted through the system under paragraph one the request shall be submitted to the official at the following places: � � � �Bangkok, shall submit at the Fish Inspection and Quality Control Division �FIQD��of the Department of Fisheries � � � �Other provinces, shall submit at the Songkhla Fish Inspection and research Center in Songkhla Province or the Samut Sakhon Fish Inspection and research Center in Samut Sakhon Province Clause 6� After receiving the application receipt a certificate the applicant's officer shall issue an application receipt to the applicant and proceeding to verify the correctness and completeness of the request and documents or evidence� In the case of the request for a certificate documents or evidence are not completely correct, the officer shall notify the certificate applicant to amend the certificate request or submit documents or evidence to be correct and complete within the period designated In the case of the applicant does not modify the certificate or not submitting documents or evidence correctly and completely within the period under paragraph two shall be deemed to have obtained a certificate shall be canceled from the expiration date of the said period and the officer shall notify in writing or by any other means to the applicant for the certificate know Clause 7 Consideration for issuing a certificate the officers shall verify information about the documents and the following evidence to ensure that the aquatic animals or aquatic products do not come from illegal fishing � � � � Consideration for issuing a catch certificate, check the� Marine Catch Purchasing Document �MCPD), Catching and Moving an aquatic animals Document � artisanal fishing� , documents showing the use of an aquatic animal raw materials domestic product ,labels of aquatic products and documents or any other evidence. � � � � Consideration of issuing a processing statement, check� catch certificate issued by the flag state (In the case of EU exports)� ,Import Aquatic Animal Movement Document (IMD), documents showing the use of imported aquatic animals and any other documents or evidence. Unofficial Translation Clause 8 In the case of a request�for receiving a catch certificate or a processing statement and the documents and evidence supporting the application are complete and correct the Director-General or Persons assigned by the Director-General shall issue the following certificates: � � � � In the case of exporting to the European Union or countries requiring the same format as the certificate� used to export to the European Union, shall issue a CATCH CERTIFICATE OF�THAILAND or a SIMPLIFIED CATCH CERTIFICATE� OF THAILAND or a processing statement (ANNEX IV), as the case may be. ����In the case of exporting to other countries that do not require the same format as the certificate used for export�European Union, shall issue a CATCH CERTIFICATE For fish and fishery products originated from Thailand or� a SIMPLIFIED CATCH CERTIFICATE For fish and fishery products originated from�Thailand or a Processing� Statement For fishery products processed in Thailand, as the case may be. In the case that there is an order not to issue a catch certificate or a processing statement under paragraph one the reason and right of appeal shall also be stated in the notice of consideration. Clause 9 An application for� receiving a catch certificate or a processing statement shall be in accordance with the form attached to this Rule. Clause 10� An Application for receiving a catch certificate or a processing statement that has been submitted on the day prior to the date of entry into force of this regulation and is still under consideration� shall be deemed to be a request under these regulations and consider in accordance with the rules as prescribed in this regulation In the case of an application submitted under paragraph one and the documents or evidence submitted with such request differ from those prescribed in this regulation, the officer shall have the power to order the amendment, request or deliver additional documents or evidence as necessary in order to comply with this regulation. Clause 11 A catch certificate or an application for requesting a processing statement issued prior to the date of this regulation� enforceable to remain valid until expiration or revoked. Clause 12 This Directive shall come into force after the expiration of thirty days from the date of its publication in the Government Gazette.
