Resolution No. 18/T defining requirements and conditions for the importation of pesticides

SYRIAN ARAB REPUBLIC Ministry of Agriculture & Agrarian Reform Plant Protection Directorate Resolution No 18/T The Ministry of Agriculture and Agrarian Reform By virtue of decree-law no 165/1952 Acting upon the minute of meeting of the technical committee set up under order 765/wla of25.7.2000 Upon the minute of meeting held by the technical committee on 30-31.1.2002 and 6-7.2.2002 In accordance with common interest duties The following is decided: Article - 1- General: Producer Company: means the company that produces the active ingredient and manufactures the commercial preparation of the pesticide. Registration - registration system: Registration or registration system means the sum total of toxicological, biological, sanitary, environmental and agricultural tests to which the pesticide is subjected before its use can be declared for agricultural purpose. Advanced country (ies): means in the context of pesticides the country (ies) where the registration or registration system based on the said tests is applied. Article-2 There shall be allowed the importation of pesticides from those companies which produce the active ingredient and manufacture the commercial preparation and in those countries which have an integrated system of toxicological, biological, sanitary, environmental and agricultural tests as well as controls on manufacture, circulation and use. Article-3 lf a pesticide is made by an active ingredient producer who manufactures the commercial preparation in a country (ies) where there is not an integrated system for pesticide tests, it shall be conditional for the admission of this pesticide in Syrian that it is subjected to the tests (active ingredient and commercial preparation) in a country which satisfies the conditions outlined in Article -2 above or that the pesticide is registered or used in such country. J.J.lll i!1l:i ~ \..~ ) ~ ufi.:! 01 Article-4 There shall be allowed the admission of pesticides made by producers if there are registered and approved by the ministry of agriculture and their pesticide production is registered and circulated in Syria, where upon they shall be governed by the provisions of Articles -2- or -3- above if the production is the sum of cooperation between them ( exchange of active ingredient and commercial preparation components). Article-5 The subsidiaries owned by Mother company in other countries (i.e other than their home country) and to which the provisions of Articles -2- or -3- above apply shall be afforded the same treatment as the mother company provided that they submit documents certified by official authorities to the effect that the mother company owns the subsidiary and is responsible for the production process and, for the product specification and quality assurance. Article-6 No business can be made with formulating companies which carry out only the formulation process and do not produce any active ingredient, excluded from this provisions are those cases where dealing with producers cannot be carried on. Article-7 Only national companies and the like can be allowed to formulate pesticides, provided that the source of active ingredients is from companies and countries to which Article-2- or-3- apply. Article-8 Business can be made with marketing companies only where the producers do not market their products, provided that the label features the name of the producer to whom Articles -2- or-3- apply. Article -11 All resolutions running counter to this resolution shall be abolished. Article -12 This resolution shall be published and notified to whom it may be necessary for its implementation.
